[0:00:24] Trustee Luckham: to be able to work with the Islands Trust and live and work in the Coast Salish Territory.
[0:00:30] Trustee Luckham: And today we're meeting across a large swath of the Islands Trust area and the Coast Salish
[0:00:37] Trustee Luckham: Territory all the way up into Howe Sound and myself over here on Thetis Island today and our
[0:00:43] Trustee Luckham: staff in Nanaimo Territory in Nanaimo. So good morning. So I'll just introduce trustees that are

[0:00:58] Trustee Bernardo (probable): I come from Cates Island, also known as Lake Tynes. And that's it. That's what I'm here for,

[0:01:49] Trustee Luckham: So, we have an agenda before us. There was a late item added at section 12 regarding housing reports, briefings. And so just acknowledge that that is also posted electronically online and should have been emailed, maybe was emailed to folks.

[0:02:49] Trustee Luckham: So the first item on our agenda here today is trustee reports and who would like to start today?

[0:03:07] Trustee Stamford: thank you trustee bernardo um uh since our last meeting uh our last regular
[0:03:16] Trustee Stamford: meeting we've we've had a couple of special meetings um since that time uh we've also
[0:03:22] Trustee Stamford: december was a busy month uh away from the islands trust and i was
[0:03:28] Trustee Stamford: away from the country for most of december so my report is quite small um primarily what i've been
[0:03:37] Trustee Stamford: working with since january started is getting up to date on the gambier island rural economic
[0:03:44] Trustee Stamford: development and infrastructure program that has been moving ahead with a volunteer community group
[0:03:53] Trustee Stamford: on the island they have some initial data that they're working with they've been working with
[0:03:59] Trustee Stamford: planning students from UBC to provide project framework and survey results it's quite exciting
[0:04:09] Trustee Stamford: and it's been interesting to see how it meshes with the Gambier official community plan work
[0:04:17] Trustee Stamford: work. So I also have met with planners of panic, and she will be updating us further about where
[0:04:27] Trustee Stamford: she's at with the official community plan work. So that's sort of the main focus that I've had
[0:04:32] Trustee Stamford: with trustee work in January.
[0:04:41] Trustee Luckham: Very good. Thank you, Trustee Stanford. Over to you, Trustee Bernardo.
[0:04:45] Trustee Bernardo (probable): Thank you. A few things to report. In my capacity as chair of the Financial Planning Committee,
[0:04:51] Trustee Bernardo (probable): That committee has been doing work to develop the budget for the next budget period, 24-25.
[0:05:00] Trustee Bernardo (probable): And we have a special meeting coming up to discuss the possibility of developing budget guidelines.
[0:05:07] Trustee Bernardo (probable): It's kind of a technical thing.
[0:05:08] Trustee Bernardo (probable): I won't bore people with that discussion now.
[0:05:11] Trustee Bernardo (probable): And then we're all working towards the goal of developing a budget to bring forward for Trust Council's approval in March.
[0:05:20] Trustee Bernardo (probable): That's happening at the same time that an FPC working group is attempting to develop
[0:05:27] Trustee Bernardo (probable): and working with staff to develop a corporate planning process, which should bring about
[0:05:33] Trustee Bernardo (probable): significantly more disciplined financial planning approach in the future, but that's still a
[0:05:39] Trustee Bernardo (probable): development.
[0:05:40] Trustee Bernardo (probable): Since the last report, the CEO has provided notice that he intends to leave the Islands
[0:05:49] Trustee Bernardo (probable): Trust in June. Per our policies, a hiring committee has been struck, and as the chair
[0:05:54] Trustee Bernardo (probable): of one of the standing committees, I'm sitting on that committee, as is Chair Luckham. And at the
[0:06:01] Trustee Bernardo (probable): moment, what we're doing is developing a process for hiring a new CAO. That's about as much as I
[0:06:09] Trustee Bernardo (probable): can say about that here. Meanwhile, I'm also on the governance committee, and it is continuing
[0:06:14] Trustee Bernardo (probable): its work of attempting to reform governance practices here. With respect to the work of
[0:06:20] Trustee Bernardo (probable): the LTC specifically, certainly from my perspective, the Keats Broadband issue,
[0:06:29] Trustee Bernardo (probable): enabling Connected Coast to bring broadband internet to Keats Island remains a priority.
[0:06:35] Trustee Bernardo (probable): The Keats Foreshore By-law has taken a temporary backseat to that, but it hasn't been forgotten.
[0:06:42] Trustee Bernardo (probable): but my perspective, we need to ensure we do our part to bring broadband to Keats within the
[0:06:49] Trustee Bernardo (probable): timeframe of the project, the Connected Coast project. That's the immediate thing that's
[0:06:56] Trustee Bernardo (probable): certainly on my plate. Thank you.

[0:07:02] Trustee Luckham: Trustee Bernardo and also Trustee Stamford. So Chair's report, nothing of significance to report
[0:07:10] Trustee Luckham: on a local Gambier-Keats perspective.
[0:07:14] Trustee Luckham: Certainly, as the chair of Trust Council,
[0:07:18] Trustee Luckham: there's lots of activities going on.
[0:07:21] Trustee Luckham: As Trustee Bernardo has mentioned,
[0:07:24] Trustee Luckham: the 2024-2025 budget is well underway
[0:07:30] Trustee Luckham: and expected to be presented in March to Council for adoption.
[0:07:37] Trustee Luckham: Policy statement work continues.
[0:07:39] Trustee Luckham: The policy statement is out for consultation at this time with First Nations, and that will be being hopefully seen by council in not likely before, well, definitely not council, but shortly thereafter, we're hoping in April.
[0:07:57] Trustee Luckham: And then that work will advance out to community for consultation there.
[0:08:03] Trustee Luckham: Indeed, the other committees that I sit on, governance, regional planning, and trust programs committee,
[0:08:09] Trustee Luckham: are meeting and also in preparation or conducting the work of council and also in preparation for trust council in March.
[0:08:20] Trustee Luckham: Nothing otherwise significant to report at this time.
[0:08:24] Trustee Luckham: and so uh thank you for your interest in the islands trust and i'll turn to electoral area
[0:08:29] Trustee Luckham: director's report kate louis stanford hi
[0:08:34] Trustee Stamford: thank you chair um
[0:08:36] Trustee Stamford: so again same kind of schedule we were
[0:08:40] Trustee Stamford: we're not a lot of work in the last couple weeks of december but uh highlights are that the uh
[0:08:48] Trustee Stamford: sunshine coast regional district board we adopted a strategic plan for the coming for the new term
[0:08:55] Trustee Stamford: The focus is quite clear and succinct. It's water strategy, water security, and also solid waste. So those are our two primary focuses for this term.
[0:09:10] Trustee Stamford: We're doing it with a lens of service delivery and excellence, climate resilience and environmental focus, as well as social equity and governance excellence.
[0:09:25] Trustee Stamford: So we're using those four lenses to inform our strategic plan.
[0:09:29] Trustee Stamford: So it's a very basic document. I can send the link to it.
[0:09:33] Trustee Stamford: to it it's um it's certainly helping us provide that direction to staff that is required
[0:09:41] Trustee Stamford: um uh heading into regional district budget round two in february 5th
[0:09:49] Trustee Stamford: um for our area for the islands primarily for area f islands right now after round one
[0:09:57] Trustee Stamford: It's a 14% proposed increase to property tax.
[0:10:03] Trustee Stamford: We'd like to bring that down significantly.
[0:10:08] Trustee Stamford: Another, there's been a lot of activity, various different issues come up quite quickly at the regional district, as you can imagine.
[0:10:19] Trustee Stamford: One of them was in late November, a presentation was provided to the Sunshine Coast Regional District Board.
[0:10:28] Trustee Stamford: about the proposed dock management plan that was developed between the Shishalt Nation
[0:10:34] Trustee Stamford: and the provincial government.
[0:10:36] Trustee Stamford: This is an extension of the Pender Harbor dock management plan
[0:10:41] Trustee Stamford: and provides further direction as to how to best support the focus of the SWIA,
[0:10:52] Trustee Stamford: which is the lands and territory of the Shishalt Nation,
[0:10:56] Trustee Stamford: in terms of protecting their archaeological history as well as the environment
[0:11:05] Trustee Stamford: with an understanding of how to move forward with community and economics.
[0:11:12] Trustee Stamford: This dock management plan is quite important for the Sunshine Coast community.
[0:11:18] Trustee Stamford: It provides significant direction on what is permitted in the foreshore, in the inland waters.
[0:11:30] Trustee Stamford: It does impact Area B islands right now.
[0:11:35] Trustee Stamford: Now, since it comes into place, there are restrictions now that have impact on how the expansion or even the continuation of commercial moorage can occur along the coast.
[0:11:51] Trustee Stamford: So primary bringing this up to indicate that right now, this is just part of the SWIA, but it does have impact on our islanders.
[0:12:03] Trustee Stamford: And I've encouraged people if they do have specific questions to forward it to the provincial government, there's contact information, and they are open for comment until February 16, I think.
[0:12:16] Trustee Stamford: So we'll see how that all plays out. And it's an interesting document to see how they're using potential regulation to support their focus, which is archaeology and the environment in the area.
[0:12:38] Trustee Stamford: And finally, there has been some new information about the new Brighton Dock, as I've sort of introduced this subject to Trustee Bernardo, but also Chair Luckum is more than aware of the 10-year discussions that I've had and requests for help.
[0:13:00] Trustee Stamford: um last year the uh the local community group uh the community association for gambier presented
[0:13:08] Trustee Stamford: to the scrd about the possibility of the regional district adding new brighton to their nine
[0:13:16] Trustee Stamford: community docs that they already manage and um recently a couple of weeks ago the board returned
[0:13:25] Trustee Stamford: turned a letter to the community association
[0:13:28] Trustee Stamford: saying they're declining to consider that at this time
[0:13:33] Trustee Stamford: and they are supporting the concept
[0:13:36] Trustee Stamford: that this is part of a provincial responsibility
[0:13:40] Trustee Stamford: given that New Brighton Dock is part of Route 13,
[0:13:44] Trustee Stamford: which is a BC Ferries regulated route
[0:13:47] Trustee Stamford: and therefore there is certain responsibilities
[0:13:52] Trustee Stamford: with the government to maintain that route
[0:13:55] Trustee Stamford: and safe access to that route so with that in mind i've had some discussions with
[0:14:02] Trustee Stamford: um minister cullen um a minister of water lands and resource sustainability
[0:14:11] Trustee Stamford: not his exact minutes not the the right ministry exactly but because that's one of the complexities
[0:14:18] Trustee Stamford: of this situation is there is no one ministry that takes this um this issue and we are um his
[0:14:27] Trustee Stamford: staff are working on having a joint meeting with various ministries to see if there's a way forward
[0:14:32] Trustee Stamford: to support long-term management and sustainability of this critical piece of infrastructure i'm i'm
[0:14:41] Trustee Stamford: happy to take questions it's it's all up in the air right now um i'm hoping to see this meeting
[0:14:47] Trustee Stamford: happen within the next couple of weeks so i'll be able to update people as uh i have no idea what
[0:14:54] Trustee Stamford: the province is considering at this point um the bottom line is this dock is deteriorating there is
[0:15:00] Trustee Stamford: no funding available to to maintain it and it is the only access point for the southwest peninsula
[0:15:10] Trustee Stamford: insular that is open year round so um yeah if anybody has any questions or comments um i'm happy
[0:15:20] Trustee Stamford: provide detail go
[0:15:22] Trustee Bernardo (probable): ahead yeah i've got a question for you kate um at this upcoming meeting that um
[0:15:27] Trustee Bernardo (probable): you're hoping to have uh do you have any indication whether or not a representative

[0:15:36] Trustee Stamford: would be the intent yes bc ferries is part of this conversation

[0:18:25] Trustee Luckham: But three items were advanced, changing the meeting time of November, determining not to hold public hearing on Bylaw 158.
[0:18:37] Trustee Luckham: that's the keats land use bylaw 2022 and there'll be some discussion about that a little later today
[0:18:44] Trustee Luckham: and to schedule a special electronic meeting for january the 9th and so those were the three items
[0:18:50] Trustee Luckham: there and that's there for information for public notice 6.4 advisory planning commission meeting
[0:18:57] Trustee Luckham: minutes nothing today and so indeed this now brings us to item 7.1 the follow-up action list
[0:19:06] Trustee Luckham: And maybe I'll just briefly turn to staff to see if there's anything new not included in this list of January the 19th.

[0:19:30] Trustee Stamford: So from the minutes, there was just a mention I noticed in the minutes that we were considering a pamphlet to send out to Keats Islanders about the ongoing work with the foreshore protection project.
[0:19:44] Trustee Stamford: And I just wondered, I noted we didn't actually make a motion to advance that.
[0:19:49] Trustee Stamford: I just wondered if anything had been done in that regard.
[0:19:54] Planner McCargar: no as far as i was aware that was sort of discussed as an option but wasn't given
[0:20:00] Planner McCargar: specifically direction to staff and
[0:20:03] Trustee Stamford: then i have a question about
[0:20:08] Trustee Stamford: oh well if trustee bernardo i'll look for my next question okay just a comment

[0:20:17] Trustee Bernardo (probable): concerned about i think they're already on the agenda for discussion okay simply the the we're

[0:20:34] Trustee Stamford: The only, in the follow-up action report,
[0:20:38] Trustee Stamford: there is a new Ministry of Transportation
[0:20:42] Trustee Stamford: and Infrastructure representative on Sunshine Coast.
[0:20:46] Trustee Stamford: They just started last week.
[0:20:48] Trustee Stamford: I did make a call out for the name
[0:20:51] Trustee Stamford: and contact information for will because we still need to set up a meeting with modi for island
[0:20:58] Trustee Stamford: issues specifically uh as soon as i get that um message or that information i'll forward it to
[0:21:05] Trustee Stamford: will for hopefully we'll be able to set up a meeting soon so that's all i wanted to say
[0:21:14] Trustee Luckham: Okay, very good then. So I'm going to then move on to applications and referrals. And 8.1 appears to be a referral from the Sunshine Coast Regional District, noting that this doesn't have our normal sort of cover sheet with it.
[0:21:39] Trustee Luckham: So, of course, I'm new to this LTC, relatively speaking, and so perhaps I'll just ask Planner McCargar, is this the intention that we, as we would normally just make a comment to the Sunshine Coast Regional District, whether or not our interests are affected, or is this different?
[0:22:01] Planner McCargar: Correct. That's my understanding. It's just a referral. There's some housekeeping amendments
[0:22:08] Planner McCargar: that are proposed for zoning bylaws and they are to provide measures to strengthen protection of
[0:22:15] Planner McCargar: ecologically sensitive areas including watercourses and shorelines within the SCRD. I did have a quick
[0:22:21] Planner McCargar: look at the proposed changes and it looks as though that the interests would be unaffected
[0:22:29] Planner McCargar: for islands trust all
[0:22:30] Trustee Luckham: right thank you so is that just an oversight that we don't have a cover sheet
[0:22:34] Trustee Luckham: for that that indicates that islands trust formality or
[0:22:39] Planner McCargar: yeah i think so i can look into
[0:22:41] Planner McCargar: that further with the ledge clerk but um i think it's probably just an oversight okay good then
[0:22:47] Trustee Luckham: so then um perhaps it's appropriate that the regional director uh might be able to offer some
[0:22:54] Trustee Luckham: a summary background on this particular report and then um the trustees can determine whether or not
[0:23:01] Trustee Luckham: our interests are affected or not and by motion we would advise the sunshine coast regional district
[0:23:07] Trustee Luckham: of that determination trustee stanford yeah
[0:23:12] Trustee Stamford: this although it's um it it's just housekeeping the
[0:23:18] Trustee Stamford: housekeeping was to align the the two um bylaws together um the work itself was done in the
[0:23:26] Trustee Stamford: previous term and it does actually align with the work that we did on gambier with recurring
[0:23:34] Trustee Stamford: area regulations and um and sensitive ecosystem protection um i'd like to point out that it
[0:23:42] Trustee Stamford: it actually makes it stronger uh on the mainland than what we have currently on gambier um primarily
[0:23:51] Trustee Stamford: around a five meter buffer with outside of the speed yeah um but it it is um it was significant
[0:24:00] Trustee Stamford: at the time but i kind of point out that um what was never an issue which i found very interesting
[0:24:07] Trustee Stamford: when the original riparian areas regulations were put in is the 15 foot or 15 meter setback from the
[0:24:17] Trustee Stamford: ocean was never an issue and I was quite surprised because it does impact a lot of people along the
[0:24:25] Trustee Stamford: coast but it does bring in the line with sort of what's become the standard setback from the ocean
[0:24:35] Trustee Stamford: in in the marine area but really all this is is to align the two bylaws together bylaw 722 is for

[0:29:29] Voice 8: high medium or low priorities to address those concerns that could then be translated to
[0:29:34] Voice 8: recommendations for the local trust committee so the march 26th meeting for the local trust
[0:29:41] Voice 8: committee would be the meeting at which i'm targeting a comprehensive report for you that
[0:29:46] Voice 8: That will include that list of prioritized actions that the nation's staff and their advisory committee would have endorsed.

[0:33:16] Voice 8: the point of the regional planning team, I think, is to alleviate that burden that there's learning happening within one employee's expertise or area of interest, and then that's not transferable.
[0:33:28] Voice 8: So the whole point of the regional planning team is to make sure that this is firmly embedded and entrenched in our processes moving forward.
[0:33:35] Voice 8: So anybody that's providing the Gambier Local Trust Committee with advice moving forward about any of the projects within the territory of, in this case, the Squamish Nation specifically, should be infused with this approach of learning and understanding the baseline.
[0:33:53] Voice 8: line because it's it's not just gambier island we're we're focusing our interest of course in
[0:33:58] Voice 8: this particular case for gambier but this is directly related to keats it's directly related
[0:34:03] Voice 8: to um boyer passage um you know some of the other islands would still be of interest except they
[0:34:10] Voice 8: don't maybe have active land use planning projects on the go so we want to remind the elected
[0:34:15] Voice 8: officials at every state and stage that just because this is the gambier learning opportunity
[0:34:20] Voice 8: it's not separate from the other work and jurisdiction and authority you have for land
[0:34:26] Voice 8: use planning changes on the other islands and marine areas so we are documenting this process
[0:34:32] Voice 8: internally we are creating a bit of a regional planning team template moving forward to this
[0:34:42] Voice 8: is still pilot so we don't have you know necessarily success yet it all depends what
[0:34:48] Voice 8: what the local trust committee decides to do with the recommendations,
[0:34:50] Voice 8: then we can measure success.
[0:34:52] Voice 8: But for now, in terms of discussions with Squamish Nation, yes,
[0:34:56] Voice 8: we definitely have achieved a lot and they are excited and super keen to
[0:35:01] Voice 8: continue to work with us because they see that we're listening and we've
[0:35:06] Voice 8: heard them.
[0:35:06] Voice 8: But the next step is the challenging one is the political appetite to advance
[0:35:10] Voice 8: these into actual changes in policy and regulations.
[0:35:13] Voice 8: So that's when we can measure success.

[0:35:17] Trustee Bernardo (probable): And I understand certainly your point that the political side trustees need to be briefed, informed, educated, frankly.

[0:35:36] Trustee Bernardo (probable): And I'm just thinking, you know, informal seminars behind closed doors for planning staff.

[0:35:44] Trustee Bernardo (probable): Somebody else may have learned a bunch of stuff working with a certain project, and I'm specifically talking about in relation to developing relationships with First Nations.
[0:35:55] Trustee Bernardo (probable): Given that reconciliation is a priority, I would hope that that kind of informal information sharing, you know, knowledge sharing, would be happening on a regular basis to better arm staff to sort of keep moving the process forward.

[0:38:02] Planner McCargar: No, that would be a part of this project.
[0:38:04] Trustee Luckham: Okay. So then, just wanted to make sure I was on the right page. And so I believe Stefan has spoken with both of the trustees as well, and I'm presuming with yourself also. Is he likely to join us at all if there's any questions, or are we just going to rely upon you here today?
[0:38:22] Planner McCargar: I don't believe he's planning to attend, but yeah, I can hopefully answer any questions that you have.

[0:38:29] Trustee Luckham: And I think that probably Stefan summarized it reasonably well after the conversation that I had with him that, indeed, we want to try and advance this in as quick and smooth a process as possible. And it looks like we can meet the deadlines accordingly. And that if this LTC can make a decision today to request an analysis.

[0:39:05] Trustee Luckham: I'm just introducing, letting you know what I've heard and setting out some, I'm going to lay out some suggestions that if this can be advanced in a good way, then it's up to you to do that. And so thank you, Trustee Bernardo. And indeed, let's go to planning staff for their advice on this topic.

[0:39:25] Planner McCargar: so I guess just a quick update. Referrals were sent out to First Nations and agencies on January 11th. And to date, we've heard back from Squamish Nation, who indicate they have no comments. Cowichan Tribes noted that they'll defer to communities closer to the referral area.
[0:39:43] Planner McCargar: and Musqueam Nation has responded that they need a minimum of 45 days to do an initial review.
[0:39:51] Planner McCargar: So those are the three out of 10 that we've heard back from. And there have been no referral
[0:39:57] Planner McCargar: responses received from any agencies or organizations at this time. There is a report
[0:40:02] Planner McCargar: going to executive committee for January 31st. And I think as you were alluding to, it's possible
[0:40:10] Planner McCargar: that the executive committee could give conditional approval if the LTC would like
[0:40:17] Planner McCargar: to request that staff do an assessment to ensure the bylaw is not contrary to the OCP or policy
[0:40:23] Planner McCargar: statement. If the LTC is interested in that option, staff have drafted some resolution wording that we
[0:40:32] Planner McCargar: could look at. Another option is that the LTC can just wait and see what EC decides and then
[0:40:39] Planner McCargar: potentially would be scheduling a special meeting to discuss what they hear back from
[0:40:44] Planner McCargar: executive committee. So if there's any specific questions, I can answer those now. I'm assuming
[0:40:51] Planner McCargar: that everyone has read the report that's going to EC.
[0:40:57] Trustee Luckham: And so did you say you had some recommended
[0:41:01] Trustee Luckham: wording for a motion for this?

[0:42:43] Trustee Bernardo (probable): And one of the things I'm struggling with is that at the last meeting, and I believe the meeting before that, staff told us that you didn't believe it was in contradiction to the OCP.

[0:43:06] Trustee Bernardo (probable): able to waive it now uh i may have misunderstood that if so please clarify it but my understanding
[0:43:14] Trustee Bernardo (probable): was that staff had already drawn the conclusion that there's nothing about this bylaw that
[0:43:19] Trustee Bernardo (probable): contradicted the ocp that's one question uh and then as indicated before i'd like you to
[0:43:28] Trustee Bernardo (probable): explain a bit more about this process of assessment you're talking about how long it's
[0:43:35] Trustee Bernardo (probable): going to take and in relation to that whether or not staff has had any communications recently with

[0:44:17] Planner McCargar: Yeah, so in regards to the OCP question, there's been no formal analysis done.
[0:44:23] Planner McCargar: So typically, staff would do a formal analysis of the OCP and of the policy statement to ensure that there's nothing contrary or at variance to, and would provide a staff report that would go back to the LTC, and the LTC would look at specifically what had been done, what had been examined.
[0:44:44] Planner McCargar: And that then is sent to the executive committee so that they can make their decision to give approval to a bylaw. None of that was done. So the LTC was instructed staff to not do any analysis and to just proceed forward with making the amendment.
[0:45:04] Planner McCargar: amendment, I did do a very quick analysis of the OCP, nothing written, just to make sure that we
[0:45:14] Planner McCargar: were legally able to not hold a public hearing and that we weren't doing anything illegal in that
[0:45:20] Planner McCargar: sense. But I haven't done a formal analysis at all. So there's just those two major pieces that
[0:45:29] Planner McCargar: are missing from this that the EC typically needs in order to make their decision. And because we're
[0:45:36] Planner McCargar: going off process here, I don't know what will happen at EC if we just, you know, the report's
[0:45:43] Planner McCargar: been written, these pieces haven't been done. I don't know what they will decide.

[0:47:23] Planner McCargar: So then that would mean that they wouldn't have to go back to the EC.

[1:17:46] Trustee Bernardo (probable): But at some point before this deadline comes up, we need to make a decision about whether we want to opt in or not.
[1:17:53] Trustee Bernardo (probable): And to do that, I think we need a briefing about how that would operate in our local trust area, what the pros and cons are, what the utility of opting in would be versus not opting in, that kind of thing.
[1:18:11] Trustee Bernardo (probable): Basically, we need staff's assessment of what are the pros and cons of going down this path for this LTA, because every LTA is a little different. Well, actually, quite different.
[1:18:24] Trustee Bernardo (probable): For example, you know, we may have housing issues in the Gambier local trust area, but they're nothing compared to what those folks in Salisbury are facing.
[1:18:33] Trustee Bernardo (probable): So it's just a whole different context. So one size fits all.

[1:27:22] Trustee Bernardo (probable): I don't think that's, there may be information and learning that's relevant trust wide, trust area wide, but the housing needs and issues do vary from place to place.
[1:27:33] Trustee Bernardo (probable): So I don't think there's a I don't think it makes sense to think that there is a standard practice that all the LTA should adopt.
[1:27:42] Trustee Bernardo (probable): It really is a kind of a suit to suit to the local conditions issue.
[1:27:47] Trustee Bernardo (probable): But I am on the same page with the trustee Stanford on the on the basic point that I don't think we're equipped at this juncture to make a decision one way or another to opt in.

[1:28:02] Trustee Bernardo (probable): The area-wide analysis might be helpful, but we can't really make a responsible decision to opt-in or opt-out without an assessment of what an opt-in, what its effect would be on us, on our area, or what choosing not to opt-in, what the consequences of that would be.
[1:28:25] Trustee Bernardo (probable): the difficulty is we don't get the information and we uh before this deadline and we do nothing
[1:28:32] Trustee Bernardo (probable): that's de facto a decision itself to not opt in uh without really knowing why we're not opting in

[1:28:43] Trustee Bernardo (probable): life that we have to live with and i'm gratified to hear that we have another option in the following

[1:29:12] Trustee Bernardo (probable): the trust has received provincial funding to do housing needs assessments for each of the LTAs,
[1:29:17] Trustee Bernardo (probable): and that's going to be happening. And we're going to be devoting that grant money to that purpose.
[1:29:21] Trustee Bernardo (probable): that's what's being wired into the budget um some local trust areas are going to be easier than
[1:29:28] Trustee Bernardo (probable): others to do the analysis for for example places that have real housing issues and complexities
[1:29:33] Trustee Bernardo (probable): well that's going to be i would anticipate more of the analysis money is going to go in that
[1:29:38] Trustee Bernardo (probable): direction than it would be necessarily for gambier because our local trust area as trustee sanford

And then Boyer and Passage Islands, again, it's short-term vacation rental is permitted as this home occupation. And so the home occupation is the owner or the operator. So it could be a renter of the short-term vacation rental.
[1:32:39] Planner McCargar: So, this provincial regulation is looking at, you know, the opt-in would be this principal residence requirement.
[1:32:48] Planner McCargar: So, it would mean you can only operate a short-term vacation rental in your principal residence.

[1:32:57] Planner McCargar: aside from you could you know you could be renting out your home and then the the

ADOPTED Gambier Island ADOPTED 2 Local Trust Committee Minutes January 29, 2024 Trustee Bernardo reported on the following activities: As Chair of the Financial Planning Committee, working to develop budget and budget guidelines for the 2024-25 budget period. Goal is to bring forward a budget for Trust Council’s approval in March. Notice was received from the Chief Administrative Officer (CAO) who intends to leave Islands Trust in June. A hiring committee was struck and is developing a process for hiring a new CAO. Governance Committee is working to reform governance practices with respect to the work of the Local Trust Committee. A priority: enabling Connected Coast to bring broadband to Keats Island. 3.2 Chair's Report Chair Luckham, as Chair of Trust Council, reported there were a lot of activities going on. The 2024-25 budget is underway, to be presented to Trust Council for adoption in March. The Policy Statement is out for consultation with First Nations; possibly that work will advance out to the community for consultation by April. Regional Planning and Trust Programs Committees were meeting in preparation for Trust Council in March. 3.3 Electoral Area Director's Report Sunshine Coast Regional District (SCRD) Area F (West Howe Sound) Director Stamford reported on the following activities: SCRD Board adoption of strategic plan for the coming term. Focus: water strategy and water security, and solid waste. Budget round 2 scheduled for February 5 th . Currently there is a 14% proposed tax increase for the islands; director would like to bring this down. Presentation to the Board in November regarding proposed Dock Management Plan, an extension of the Pender Dock Management Plan. Provides direction on how to best support the focus of the swiya, the lands and territory of the Sechelt Nation, in terms of protecting their archaeological history and the environment. Provides direction on what is permitted in the foreshore in the inland waters. Questions should be directed to the provincial government. Regarding the New Brighton dock, last year the Gambier Island Community Association presented to the SCRD about the possibility of the Regional District adding New Brighton to their nine community docks that they manage. Recently, SCRD Board returned a letter to the Community Association indicating the SCRD was declining to consider that at this time, and that the Board was supportive of the concept that this is part of a provincial responsibility, given that the New Brighton dock is part of BC Ferries Route 13, a regulated route, with certain responsibilities to maintain safe access to that route. The dock is the only access point for Gambier’s southwest peninsula that is open year- round. Interaction with Minister of Water, Lands, and Resource Sustainability Cullen about the complexities of the New Brighton dock situation; his staff are working ADOPTED Gambier Island ADOPTED 3 Local Trust Committee Minutes January 29, 2024 on having a joint meeting with various ministries to see if there is a way forward to support long term management of this infrastructure. Trustee had made a call out for the name and contact information and would send the information to the Islands Trust Office Administrative Assistant. Trustee hoped to have a meeting with the Ministry soon regarding island issues. 8. APPLICATIONS AND REFERRALS 8.1 Sunshine Coast Regional District Zoning Bylaw Amendment No. 722.9 & 337.123 Referral Island Planner McCargar and Trustee Stamford provided background on the Sunshine Coast Regional District Zoning Bylaw Amendment No. 722.9 and 337.123 referral. The proposed amendments aim to strengthen protection of ecologically sensitive areas, including watercourses and shorelines, by: Changing how proposed new lot area is calculated when subdividing land; Establishing a buffer from the Stream Protection and Enhancement Area (SPEA); Increasing the setbacks from waterbodies and watercourses in Zoning Bylaw 337 to align with Zoning Bylaw 722 and meet provincial best practices. Staff indicated it appeared that the Local Trust Committee’s interests were unaffected. It was noted this work aligned with work done on Gambier with riparian area regulations and sensitive ecosystem protection. ADOPTED Gambier Island ADOPTED 4 Local Trust Committee Minutes January 29, 2024 GM-2024-009 It was MOVED and SECONDED that the Gambier Island Local Trust Committee request staff to advise the Sunshine Coast Regional District that the Gambier Island Local Trust Committee’s interests are not affected by the amendments of Bylaw Nos. 722.9 and 337.123. CARRIED 9. LOCAL TRUST COMMITTEE PROJECTS 9.1 Major Project: Gambier Island Official Community Plan and Land Use Bylaw Review - verbal update Island Planner Zupanec reported she was still actively engaging with Squamish First Nation staff on the Official Community Plan (OCP) topic areas; this afternoon would be the last scheduled staff meeting. The Island Planner would be compiling a final report for the Nation’s staff regarding what what had been heard to date from them through these meetings, as well as a comprehensive list of potential policy and regulatory options that they were helping to rank in terms of prioritization (whether high, medium, or low priorities) to address those concerns that could then be translated to recommendations for the Local Trust Committee. The March 26 th Local Trust Committee meeting is the target for a comprehensive report that would include a list of prioritized actions that the Nation’s staff and advisory committee would have endorsed. There could be a discussion of policy options and the LTC’s land use planning authority, and advancing some interests and concerns being addressed as part of the OCP project. There could also be discussion of next steps regarding communication in moving forward, and how to prioritize discussions internally as an LTC, as well as taking these back out to the community. Trustee Stamford noted her appreciation for the opportunity and the time that the Island Planner had spent with the trustee and members of the Gambier community, outlining best ways of approaching Squamish Nation staff about this project and the community economic development project, and how to coordinate these initiatives to the betterment of the island community. Trustee Bernardo asked the Island Planner if the learning obtained through this consultation and relationship building with the Squamish Nation would be passed on to Islands Trust staff, in response to which the Island Planner noted that the process was being documented internally and a Regional Planning Team template was being created moving forward. This is a pilot project still in its early stages; the next step is the challenging work of demonstrating the political appetite to advance these recommendations into actual changes in policy and regulations, which is when measures of success could be assessed. Chair Luckham noted it was hoped the position of Senior Indigenous Relations Advisor would be filled soon. Part of that role would be to share knowledge and information and build awareness. ADOPTED Gambier Island ADOPTED 5 Local Trust Committee Minutes January 29, 2024 9.2 Minor Project: Keats Island Marine General Zone Amendment - verbal update Island Planner McCargar reported that referrals for proposed Bylaw No. 158 were sent to First Nations on January 11 th . Three of the ten Nations had responded: Squamish Nation indicated they had no comments; Cowichan deferred to communities closer to the referral area; and Musqueam Nation responded that they need a minimum of 45 days to do an initial review. There were no other responses from agencies and organizations at this time. There would be a report advancing to the Executive Committee on January 31 st . The Island Planner suggested it was possible that the Executive Committee could give a conditional approval of the bylaw if the LTC wished to request that staff do an assessment to ensure the bylaw was not contrary to the OCP or Trust Policy Statement. Staff drafted some resolution wording that could be considered by the LTC. Alternately, the LTC could wait and see what the Executive Committee decides, and then schedule a special meeting to discuss the feedback from the Executive Committee. Discussion ensued and points included: Inquiry about staff’s previous conclusion that nothing about the proposed bylaw contradicted the OCP. o Staff reported no formal analysis had been done and no reporting back to the LTC had occurred. Inquiry regarding the length of time of an assessment process, and regarding whether any communications were recently received with Connected Coast about their actual deadline. o Staff estimated an analysis could be fit into the work plan over the next month. o No further information had been received from Connected Coast. Discussion of possible timeline and actions for completion of analysis and adoption of the bylaw by the end of March. GM-2024-010 It was MOVED and SECONDED that the Gambier Island Local Trust Committee request staff to: a. Provide an evidence-based assessment to the Local Trust Committee, to determine whether Bylaw No. 158, cited as Keats Island Land Use Bylaw, 2002, Amendment No. 1, 2023 is contrary to or at variance with Keats Island Official Community Plan Bylaw No. 77, b. Provide an evidence-based assessment to the Local Trust Committee, by way of submitting an evaluated and completed Policy Statement Checklist, whether Gambier Island Local Trust Committee Bylaw No. 158, cited as Keats Island Land Use Bylaw, 2002, Amendment No. 1, 2023 is contrary to or at variance with the Policy Statement, and c. The Executive Committee recommended that Local Trust Committees consider requesting to opt-in to the province’s principal residence requirement for short-term rental accommodations. This opt-in would need to be done by the end of March, or deferred to a future opt-in cycle. Discussion ensued and points included: Opting in would bring the Local Trust Committee in line with legislation being implemented around the province; For this Local Trust Area, would need to analyze four LUBs(Gambier, Keats, Bowyer-Passage, and Associated Islands); allocating time from the LTC could be a challenge given how many LUBs there are; Would be helpful to have a staff assessment on how the legislation would operate in the Gambier Local Trust Area; Not prepared to say if the Local Trust Committee should opt-in or not; circumstances are different in different Local Trust Areas (LTA’s). Housing is important but not the priority it is in other LTA’s. Not comfortable with the ADOPTED Gambier Island ADOPTED 7 Local Trust Committee Minutes January 29, 2024 timeline of March 2024. Would rather advocate for a Trust-wide analysis on this issue; It is a short timeframe. It could be a consideration to opt-in in the next cycle (March 2025). Changing that policy sounds like an issue that requires more community engagement; Put on the Projects List, to be reviewed at a later date; Table this until we have a housing needs assessment and time to review the legislation. Staff advised that the implications of opting out were not that great for this Local Trust Area (LTA). Short-term vacation rentals are not permitted on Keats. On Gambier and the Associated Islands, the resident, owner or operator has to reside in the home to operate a short-term vacation rental. For Bowyer and Passage Islands, short-term rental is permitted as a home occupation. GM-2024-011 It was MOVED and SECONDED that the Gambier Island Local Trust Committee declines to opt in to S. 15 of the Short- Term Rental Accommodation Act at this time, and requests staff to add to the Projects List an analysis to enable the Local Trust Committee to make an informed decision before the opt-in statutory deadline for 2025, and that staff’s analysis makes use of the findings of the Regional Planning Team relevant to this issue.
