[0:12:31] Voice 7: One is with respect to the, so the Wooddale one, I think we've agreed we're tucking that into the housing project and that's good.
[0:12:41] Voice 7: But I'm just keeping it on the follow up action list so that we don't lose sight of it.
[0:12:47] Voice 7: And then the ALC application, I had a conversation with the CRD and a staff member at the Agricultural Land Reserve.
[0:12:59] Voice 7: So, essentially, what they need from the LTC, and that was just last week, so it didn't make this agenda package, but what they need from the LTC is just a, they'll need just support to go forward with the application.
[0:13:14] Voice 7: They think it'll be a very smooth and easy application. We talked to them about what, you know, the nature of the application would be.
[0:13:22] Voice 7: So I just wanted to let you know that, because I know there was some concerns around whether they would be supportive or what have you.
[0:13:30] Voice 7: I can tell you that they saw it to be a very simple thing compared to a lot of the other applications they get.
[0:13:39] Voice 7: And so the next meeting, I'll be just bringing forward a resolution, a staff report, just outlining that.
[0:13:46] Voice 7: And then they'll need a resolution to just move it into their process, basically.
[0:13:53] Voice 7: basically so that and i think the question was there was whether we could get get a response
[0:13:59] Voice 7: from them before going ahead with the application but essentially we we they need from us they need
[0:14:04] Voice 7: from you a resolution to move forward for them to look at the application but they don't see
[0:14:07] Voice 7: any problems with the application so excellent

[0:14:18] Trustee Maude: this is the just to follow up on that so
[0:14:20] Trustee Maude: this is an exclusion application to the alr that's going to be made by the local trust committee on
[0:14:28] Trustee Maude: on behalf of the local trust committee for the CRD, correct?
[0:14:36] Voice 7: So the application, we have to support the application going forward for them to have a look at.
[0:14:45] Voice 7: And so the way that they said, you don't need, as trustees, you don't have to put any sort of,
[0:14:51] Voice 7: you don't have to identify your interests
[0:14:55] Voice 7: but you do need to express that you are willing
[0:14:59] Voice 7: to support the ALC looking at the
[0:15:04] Voice 7: application essentially.
[0:15:06] Trustee Maude: So this is different than what's happened
[0:15:09] Trustee Maude: on other islands. I just say because on Saterna
[0:15:13] Trustee Maude: we were in the process of doing an inclusion
[0:15:17] Trustee Maude: exclusion application on behalf of a landowner. We're a year
[0:15:22] Trustee Maude: you're into it right now it's become a it's become a major project on that island so

[0:16:12] Voice 8: was so no intention to develop on any of the untouched agricultural land but this is not the

[0:17:49] Voice 11: Okay, so we'll move into applications and referrals. At 10.1, we've got the Salt Spring Island Local Trust Committee referral for draft bylaw number 536 for response and that is attached.

[0:18:22] Voice 8: controversy over this bylaw on salt spring but really it doesn't impact our interests that i can
[0:18:28] Voice 8: see so as a referral um i'm not quite sure why i was contacted by a salt spring trustee
[0:18:35] Voice 8: um where there seems to be a conflict with what staff is recommending and what what
[0:18:41] Voice 8: trustees want so i'm not sure if anyone here has any more information on that but

[0:20:21] Voice 7: procedural this is a procedural thing to satisfy the requirements of the the
[0:20:28] Voice 7: liquor and cannabis regulation branch to hold a public meeting via zoom to
[0:20:34] Voice 7: collect uh community input um and so as the staff report indicates the main island brewing company
[0:20:42] Voice 7: is wanting to basically shift their license from a picnic area endorsement license to a what is
[0:20:49] Voice 7: called a lounge license this just provides a little bit more flexibility um for them um and
[0:20:56] Voice 7: is more in line with the kind of services they'd like to provide um and so they're having to go
[0:21:01] Voice 7: back to the the the liquor and cannabis regulation branch to to um to shift their license and so part
[0:21:10] Voice 7: of the the process of the branch is that they require um they require public um that there's
[0:21:17] Voice 7: a public engagement now i will tell you that i i did give them a call to find out because because
[0:21:22] Voice 7: this so as the um the brewery doesn't plan on really in changing anything there's nothing
[0:21:28] Voice 7: that's shifting relating to the zoning that they currently have and so I did I
[0:21:35] Voice 7: did have some conversation to see if we still needed to go through public
[0:21:38] Voice 7: process given that it's already gone through essentially rezoning through the
[0:21:43] Voice 7: the LUB process and previous to that the TEP process but they said yes with this
[0:21:48] Voice 7: is a new application so you do need to go through public process but you can
[0:21:53] Voice 7: determine what that is and so um given that um the brewery there has been um there have been no um
[0:22:03] Voice 7: issues with uh with their their business um i don't i don't the staff is recommending that we
[0:22:09] Voice 7: we sort of move forward with a fairly straightforward process which is also
[0:22:13] Voice 7: something that they've done um on salt spring island they've had a number of these applications
[0:22:17] Voice 7: come forward and um and they've they've basically just opened a zoom meeting to see if anybody is
[0:22:22] Voice 7: interested in commenting um and then just moved on to um to complete the application so um that is
[0:22:30] Voice 7: um that's the rationale for for that particular recommendation it's really about moving
[0:22:36] Voice 7: the application forward as as um as efficiently as as possible

[0:24:20] Voice 10: format so people can have just one glass of something instead of a flight of something so

[0:26:07] Voice 2: the application before you is ma rz 2023.1 located at 6 30 dinner bay road the application proposes
[0:26:15] Voice 2: to amend the main island land use bylaw number 146 by rezoning the existing site specific zone
[0:26:22] Voice 2: country guest house commercial a c5a to support 20 detached tourist accommodation units with a total
[0:26:29] Voice 2: four of 1068 square meters four accessory buildings and a 916 square meter staff accommodation
[0:26:39] Voice 2: building the purpose of this presentation is to summarize the information received from the
[0:26:44] Voice 2: applicant regarding the resolution made by the ltc back in september and to receive direction
[0:26:49] Voice 2: from the ltc regarding next steps what's uh what's going on uh staff have provided recommendations on
[0:26:55] Voice 2: page one of the staff report um so as a recap the ltc made the following resolution at the september
[0:27:02] Voice 2: 25th 2023 meet ltc meeting um so it was moved and seconded that the main island local trust
[0:27:09] Voice 2: committee requests that prior to proceeding further the applicant consult with surrounding
[0:27:13] Voice 2: neighbors host a community information meeting provide their feedback to local trust committee
[0:27:18] Voice 2: for consideration identify additional options for amenity contribution and water management
[0:27:23] Voice 2: and explore archaeological potential okay so beginning with neighborhood consultation
[0:27:29] Voice 2: so the applicant provided an email thread just this afternoon to demonstrate that the neighbors
[0:27:37] Voice 2: had been consulted due to the late submission staff have not had an opportunity to review and
[0:27:42] Voice 2: circulate this to the LTC. But just like a quick review shows that the property owners reached out
[0:27:49] Voice 2: to five email addresses to inquire that they'd received the full page notice in the mainliner
[0:27:53] Voice 2: and provided contact information. And last week staff have received and from what I could see
[0:28:02] Voice 2: was circulated to LTC. Staff have received nine emails in opposition from neighbors either with
[0:28:07] Voice 2: concerns or in opposition to the application as proposed um it appears that there's general
[0:28:12] Voice 2: support for reviving the ocean wood in um but opposition for the following for this uh
[0:28:19] Voice 2: application is proposed for the following reasons um proposed density and development coverage
[0:28:23] Voice 2: um staff note that the existing c5 zone allows for a maximum lot coverage of 10
[0:28:28] Voice 2: um water usage for the proposed use and potential impacts to adjacent wells
[0:28:33] Voice 2: as well as lack of consultation with the surrounding neighbors and insufficient project information in order to proceed further.
[0:28:42] Voice 2: Moving on to hosting a community information meeting. This was completed and has been summarized in the staff report.
[0:28:52] Voice 2: So a community meeting was held on November 24th, 2023 at the Main Island Community Center.
[0:29:00] Voice 2: regarding the amenity contribution and water management the applicant did provide amenity

[0:30:53] Voice 12: lot of great conversations so since that meeting we have talked to a couple people about water
[0:30:59] Voice 12: Water catchment, processes that are already happening on the island.
[0:31:03] Voice 12: I had a great meeting with Brian Dearden from Home Hardware.
[0:31:07] Voice 12: And I think water catchment is certainly the easiest way to go.
[0:31:13] Voice 12: Desalinization was an idea that really we just put out there
[0:31:15] Voice 12: because clearly water is going to be something that has to be considered.
[0:31:20] Voice 12: So we wanted to make sure all options were put out there.
[0:31:24] Voice 12: Overwhelmingly, certainly water catchment seems to be the most popular option
[0:31:27] Voice 12: from a community perspective it seems um and there's already a viable case on main island

[0:31:33] Voice 12: with the resort they do rainwater catchment yeah i think
[0:31:37] Voice 12: they're running solely and given the
[0:31:39] Voice 12: amount of runoff that happens around the property there's definitely uh definitely going to be
[0:31:43] Voice 12: enough water to water catchment i think so um i don't know as far as we're concerned on our side
[0:31:48] Voice 12: it seems to be going really smoothly um we've had a lot of great feedback from the community
[0:31:53] Voice 12: in the facebook group as well as at the event over and above water catchment there hasn't really been
[0:31:58] Voice 12: anything else that was a hot topic other than staff accommodation and the size of that building
[0:32:04] Voice 12: at the meeting and in terms of that it's really that'll be a function directly related to i guess
[0:32:11] Voice 12: the size of the property once rezoning is actually confirmed so certainly up for discussion yeah and
[0:32:18] Voice 12: And it was also suggested, too, if we were doing rainwater catchment, that that could be one of the amenities to the community as well.
[0:32:25] Voice 12: Because if we have a surplus of water, we personally live in that same water district.
[0:32:31] Voice 12: So we know they're always, even in the winter, they've been low on water this year.
[0:32:36] Voice 12: So there's a possible for get back and definitely if there's a fire or something, making it accessible.

So we talked, you just mentioned about the staff housing, the 10, well, 9,000 and whatever, 860 square feet, which doesn't, of course, relate to three staff houses at all in today's world when people are trying to shrink their footprint.
[0:33:38] Voice 8: So I have concerns about the size of the project, the amount of area that it would cover, the land that's there right now that has existing structures on it is already disturbed, but from what I can see, and I wasn't at the open house, I did have conversations with people, I've had significant number of emails in the past few days from people, certainly water is a big issue, we know that, that's not my concern right now, I think water we can deal with.
[0:34:07] Voice 8: My concern is I think that what you've proposed in terms of a lot coverage, what would be there when you were done, is significantly larger than what's there now.
[0:34:17] Voice 8: So I would like to see you go back and look at what your plans are and try to fit something in that is more what I would call main island friendly.
[0:34:26] Voice 8: Also, I'd like to see you shift from the luxury resort idea to more of an eco-eco-environmental main island friendly model.
[0:34:35] Voice 8: model. That word luxury concerns me, people's expectations, the number of people that would
[0:34:41] Voice 8: go into 20 cottages versus 12 rooms in terms of the volume of use, but I don't really have
[0:34:47] Voice 8: enough information about the individual units you have planned. The event center, I say I've
[0:34:53] Voice 8: got an 8 by 11 piece of paper and it's not really helpful to me looking at that piece of paper,
[0:34:59] Voice 8: but overall from what I've seen so far it's a very large project. Other island properties do
[0:35:06] Voice 8: have these projects they tend to make them two-story or they have a different layout of
[0:35:11] Voice 8: the property but I at this point really would like to see kind of a rethinking as to what actually
[0:35:18] Voice 8: is going to go on this site is the intensity of use is quite significant in the change and that's
[0:35:24] Voice 8: an area that currently actually gets a lot of use between the um the disc golf the japanese garden
[0:35:33] Voice 8: just parking um the impact on the immediate neighbors and if you read their letters
[0:35:38] Voice 8: i mean there is valid concerns there on the impact so that's at this point i certainly would not
[0:35:43] Voice 8: support the staff proposal at this time i would ask that instead the applicant go back and try
[0:35:50] Voice 8: to tighten it up and make it as they say more island trust environmentally main island friendly
[0:35:56] Voice 8: in terms of size i also want to mention that you know in terms of development in terms of tourism
[0:36:02] Voice 8: for a number of years the spring water lodge has been for sale and it is zoned it is zoned for
[0:36:08] Voice 8: approximately 27 cottages so i think also what we're not hearing or seeing is that in fact we
[0:36:15] Voice 8: We already have density in place that has not been developed.
[0:36:19] Voice 8: Not only is the spring water zoned for 27, the property adjoining it off of Neeler Road across from the library is zoned for 30 units of tourist accommodation.
[0:36:29] Voice 8: So if we look at the bigger picture of what is the potential for Maine, there is a lot of potential for a lot more tourist accommodation.
[0:36:36] Voice 8: So I think that that has to be part of our decision.
[0:36:39] Voice 8: decision we would I would definitely everyone I think would like to see the Oceanwood project
[0:36:44] Voice 8: go ahead no no n's ifs or buts about that but we want to see it in a way that at least
[0:36:51] Voice 8: certain amount of agreement as to what we're going to see thank you I'm just going to go

[0:39:15] Voice 11: Well, have you researched other Gulf Islands and how well they're doing in that sort of accommodation facility market? Because I'll tell you on Gabriola, they're struggling. The infrastructure is immense to keep up. Water issues are chronic.
[0:39:37] Voice 11: and um so basically my question is has have you done your research in terms of the marketability
[0:39:42] Voice 11: of this um are you going to be um scaling it back so that locals can use the facilities are
[0:39:52] Voice 11: they going to be affordable for um local events and why such a large staff accommodation it's
[0:39:59] Voice 11: it's just about the size of all of your cottages so how many people are going to be housed there
[0:40:05] Voice 11: and why is it so large and my final point is you're not going to get the lot once you take
[0:40:12] Voice 11: those trees down you can't get that back so that's why i ask these questions about have you done your
[0:40:17] Voice 11: research because that development there's there's no going back from that um level of lot coverage
[0:40:23] Voice 11: which uh trustee dodds referred to so really thinking through um the numbers and who your
[0:40:30] Voice 11: market is and um the long-term viability of this project um is is where i'm at is is um and so yeah

[0:41:05] Voice 1: given a specific outline as to what to achieve to move the process further, you know, we went
[0:41:11] Voice 1: about achieving those goals. And it seems to me that I think a bit of the process is being
[0:41:19] Voice 1: overlooked. So what I mean by that is that, you know, just for us to go ahead and spend money to,
[0:41:26] Voice 1: you know fine-tune our application we and by what i mean by that is that the island trust has to
[0:41:34] Voice 1: give us the go-ahead to proceed with an ocean wood you know proposal um in greater detail
[0:41:41] Voice 1: we were asked to go away and uh have a voluntary you know island meeting which we had a very good
[0:41:48] Voice 1: showing to in that meeting you know we collected a lot of very very valuable data and a lot of
[0:41:55] Voice 1: very positive and and you know non-positive input to which we were using to develop the ocean wood
[0:42:03] Voice 1: and fine-tune our plan if we were allowed to proceed with an application we have not been
[0:42:11] Voice 1: given the right to proceed with an application at this date you know the size of the unit that
[0:42:19] Voice 1: that will house staffing, you know, was a preliminary number that we used to start the application with.
[0:42:28] Voice 1: You know, since then we've gotten feedback that, you know, maybe five units are necessary
[0:42:34] Voice 1: or that possibly we would use some of the staff accommodation for, you know, other staffing for the island itself.
[0:42:43] Voice 1: So, you know, this point, my understanding from our last letter was that we were to uphold our side of the letter and complete the tasks at hand that we were given by the trustees in order for the trustees to vote on this project moving forward or not.
[0:43:03] Voice 1: And as the trustees might be aware, an on-vote, you know, kills any application for the next year.
[0:43:10] Voice 1: And so our hopes and the positive, you know, information that we've received back is that we have enough information to know that we need to pay attention to how big the staff housing is.
[0:43:22] Voice 1: We need to pay attention to how many trees we are removing.
[0:43:25] Voice 1: We have to pay attention to, you know, how our water is being used and what that benefit is.
[0:43:30] Voice 1: We have to pay attention to what the community benefits are that we are giving back in order to receive 20 units.
[0:43:37] Voice 1: At no point did we ever call these luxury units.
[0:43:40] Voice 1: I think that's a painting that, you know, has been arbitrarily put upon us.
[0:43:46] Voice 1: There's no word luxury that I believe any of us have ever used.
[0:43:51] Voice 1: But this is simply, you know, the business end of it, you know, TBD.
[0:43:56] Voice 1: But I can tell you as a, you know, as a consultant that's been brought on this project that sees the, you know, economical picture from a development standpoint, you know, not just as, you know, the islands, but also Vancouver, BC, you know, and much more abroad.
[0:44:13] Voice 1: You know, the independent housing or temporary housing for people to vacation with, i.e. individual cabins, has become, you know, the most kind of targeted development need ever since COVID.
[0:44:33] Voice 1: So we're seeing it more and more that, you know, individualizing units rather than having them as a joint building is something that we definitely paid attention to from our research.
[0:44:46] Voice 1: So the economics of it, you know, just to recap, you know, in order for us to move forward, you know, we need the trustees to be able to grant us that ability.
[0:44:56] Voice 1: And after that ability is granted, we plan on, you know, exercising our ability to fine-tune the details in the previously outlined aspects.

[0:45:43] Voice 8: know about the ocean with property what i knew about my whatever too many years on main island
[0:45:48] Voice 8: um my sense is that the project's too big you talk about flexibility so go back to that flexibility
[0:45:54] Voice 8: ability and come up with what is a reasonable amount for staff housing under the current
[0:45:59] Voice 8: circumstances the same with how many cottages you actually need to build in my opinion it is too
[0:46:05] Voice 8: large and is going to cover too much of the current property if you can shrink it down and
[0:46:11] Voice 8: make it fit onto the site where all the structures currently are and come back with a drawing that
[0:46:17] Voice 8: shows that but what i see in the drawings is is expanding and covering a much larger area so we
[0:46:23] Voice 8: We have not, we've only just had that first meeting.
[0:46:26] Voice 8: And yes, you needed to go out to the public and consult.
[0:46:29] Voice 8: Now, my suggestion and request is that you actually go back and rethink the project and
[0:46:35] Voice 8: make it a bit smaller.
[0:46:36] Voice 8: I'm not saying that you have to completely throw everything out, but I think the staff
[0:46:40] Voice 8: housing does need a little bit more thought because it's a lot of square footage and maybe
[0:46:46] Voice 8: the number of cottages because the impact of traffic and people, et cetera, as I said
[0:46:51] Voice 8: in my first words.
[0:46:52] Voice 8: so I don't see anything wrong with that I don't want to send you off to get a whole bunch of
[0:46:56] Voice 8: reports if I at this point am not comfortable with your project so I'm not comfortable with
[0:47:01] Voice 8: the scale of it right as it sits right now I'm quite certain that once we get to the stage where
[0:47:07] Voice 8: we are more comfortable then you can go off and hire and do your water surveys and all of those
[0:47:13] Voice 8: necessary things but I feel at the moment including the people that went to the meeting
[0:47:18] Voice 8: that the scale of it is probably too large for Bain Island.

[0:48:02] Voice 12: But to tell us that we have to put a series of cabins just on the footprint of the existing structure, I don't think is very feasible either, because I don't even know if you could fit 13 cabins in the existing footprints, given that if we were to even just match the same number of rooms, because it's different levels.

[0:48:26] Voice 12: be taken into account I don't disagree at all that the staff accommodation is too big and I

[0:51:49] Voice 2: applications should be relatively modest for modest increases in density, local trust communities
[0:51:54] Voice 2: should not consider applications in which more than 10 additional dwelling units are proposed
[0:51:58] Voice 2: in exchange for community amenity, which they're doing, right? Um, we're not exceeding, it would
[0:52:04] Voice 2: would be eight additional units and then the other part so I think the big takeaway would be to
[0:52:13] Voice 2: determine if the amenities as proposed by the applicant are sufficient considered sufficient
[0:52:22] Voice 2: by the LTC and so the staff accommodations doesn't meet the definition of the accessory
[0:52:30] Voice 2: Because that used to be sort of like the caretaker's unit or the operator's unit. So this would be considered and could be considered an amenity contribution if it was some sort of affordable housing provision, right?
[0:52:46] Voice 2: But in terms of the plans or the number of units, I just found out recently about the number of units from the feedback from the meeting sort of thing.
[0:52:56] Voice 2: So that would all need to be determined by LTC if that's considered a sufficient amenity or if additional information is needed sort of thing, which I tried to summarize in the report.

[1:07:14] Voice 1: And that 20 number was something that always has kind of worked out to the expenditure, you know, what those community contributions would be.

[1:10:29] Voice 2: that's on there is actually what is you know is being proposed sort of thing so we have the exact

[2:09:58] Voice 11: But there is, what he notes is there's a general misunderstanding among property owners regarding their rights to build on their property, especially when it comes from the setback to the sea, from the sea.
[2:10:10] Voice 11: Some view the setback regulations as a seizure of land by Islands Trust.
[2:10:15] Voice 11: Many will maintain they have the right to protect their property from erosion.
[2:10:18] Voice 11: And so it is your decision, local trust committee.

[2:24:23] Voice 7: drawings for the retaining wall and so they
[2:24:27] Voice 7: they received some drawings before christmas
[2:24:30] Voice 7: and then they like uh early in december and then the drawings were insufficient uh the
[2:24:37] Voice 7: information was insufficient for uh the review by the by the engineers so they were asked to
[2:24:46] Voice 7: provide some other um drawings and um and modi provided them with some more specifics that they
[2:24:53] Voice 7: had to include and those were received by moti um a couple of weeks ago and so where it's at now
[2:25:01] Voice 7: is those are now being reviewed by their engineers and so once we receive um the okay from them
[2:25:09] Voice 7: then we can move on to the uh uh through the dvp process so that's that's where it's at so
[2:25:18] Voice 7: So the last I heard is it's with the engineers, and my contact in Moti also just sent the letter to the applicant confirming that yesterday.

[2:29:15] Trustee Maude: That rather than people dealing directly with the issue of the ocean, some have elected to go down the path of talking about the personalities of the people involved in the application, which is inappropriate.
[2:29:30] Trustee Maude: We do not look at applications based on the applicant.
[2:29:35] Trustee Maude: We look at the land use and the community as a whole.
[2:29:39] Trustee Maude: um and and saying the things that some people have said about the applicants um i don't care
[2:29:47] Trustee Maude: about the source i don't care about anything it's not relevant to to the discussion at hand
[2:29:52] Trustee Maude: and and on a small island i find those type of conversations to be highly inappropriate
[2:29:57] Trustee Maude: so i just wanted to touch on that because i was
[2:30:00] Trustee Maude: very very disappointed particularly some of the individuals who i know who have said those things

[2:31:52] Voice 8: so obviously that property is pretty much all fenced it's flat it's convenient location i think
[2:31:59] Voice 8: it's a great idea it'll be on the next agenda and at that point um either a trustee or the chair
[2:32:07] Voice 8: can write a letter asking uh bc ferries for permission to to use that property once the
[2:32:13] Voice 8: temporary use permit has gone and the trailers are gone so i just thought i should bring it up

[2:32:24] Voice 8: for this agenda package, but I think it's really the perfect spot if they have no development plans
