[0:03:34] Planner Thomaidis: Yeah, this should be a very brief presentation just to introduce the project.

[0:03:39] Planner Thomaidis: I can't see any of the other attendees in my Zoom list, but I'm assuming we do have

[0:03:44] Planner Thomaidis: some members of the public attending electronically um so yeah good good evening everyone my name is

[0:03:51] Planner Thomaidis: margo i'm one of the land use planners for gabriel island the trust office here and one of the land

[0:03:58] Planner Thomaidis: use planners for uh thetis island as well this evening i'll be reviewing the main elements of

[0:04:03] Planner Thomaidis: proposed bylaw numbers 113 and 114. so the purpose of this meeting is to provide you with one final

[0:04:10] Planner Thomaidis: opportunity to review the information related to this project and ask any

[0:04:15] Planner Thomaidis: questions. This is the last opportunity for questions about the bylaws prior to

[0:04:21] Planner Thomaidis: the public hearing. I'll be providing an overview of the two proposed bylaws that

[0:04:26] Planner Thomaidis: are being considered today by the LTC. So the goal of this meeting is also to help

[0:04:35] Planner Thomaidis: you determine if your interests are affected by the proposed bylaws so that

[0:04:39] Planner Thomaidis: during the public hearing after this presentation you're prepared to make a

[0:04:43] Planner Thomaidis: a submission to the LTC about whether or not you support the proposed bylaw changes and you can

[0:04:51] Planner Thomaidis: make a verbal or written submission. So the project objectives were to review and update the Thetis

[0:04:59] Planner Thomaidis: Associated Islands official community plan policies and land use bylaw regulations to address the

[0:05:04] Planner Thomaidis: portion of the marine area that is outside of the OCP designation area and is also outside of the

[0:05:10] Planner Thomaidis: area of land use bylaw application. The project objectives are also to amend the OCP designation

[0:05:18] Planner Thomaidis: area and the LUB application area for the Thetis Associated Islands OCP and LUB and to designate

[0:05:27] Planner Thomaidis: the identified marine area as marine in the OCP and to zone the identified marine area as marine

[0:05:35] Planner Thomaidis: general, or W1, in the land use bylaw. So generally, a portion of the water between

[0:05:44] Planner Thomaidis: the Thetis Island land use bylaw boundaries and the Thetis associated islands land use bylaw area

[0:05:52] Planner Thomaidis: of application is presently unzoned. And as such, there's no Thetis regulatory bylaws that apply.

[0:05:59] Planner Thomaidis: And therefore, the Thetis Local Trust Committee cannot regulate this area. And staff so recommended

[0:06:06] Planner Thomaidis: recommended that the own unzoned area surrounding Scott Damon and Hudson Island are zoned Marine

[0:06:12] Planner Thomaidis: General or w1 in the land use bylaw and also designated and designated as Marine in the

[0:06:19] Planner Thomaidis: official Community plan staff have determined that the undesignated area would be well suited

[0:06:26] Planner Thomaidis: to the Marine designation in the Thetis Associated Islands OCP the Marine designation applies to all

[0:06:32] Planner Thomaidis: the waters in the plan area. So expanding the plan area to include these waters up to the Thetis

[0:06:38] Planner Thomaidis: Island official community plan allows the LTC greater control in the future uses for this area.

[0:06:51] Planner Thomaidis: So this map shows the current W1 zone or water one zone boundaries in blue

[0:06:56] Planner Thomaidis: and the proposed expansion of the boundaries are shown in orange. So the following timeline

[0:07:07] Planner Thomaidis: line outlines the bylaw amendment process milestones for the marine areas review project

[0:07:11] Planner Thomaidis: to date along with next steps and approximate timing the blue steps identify completed milestones

[0:07:17] Planner Thomaidis: the orange identifies the current stage that we're in at community information meeting and

[0:07:21] Planner Thomaidis: a public hearing and the green identifies anticipated next steps or milestones in the

[0:07:26] Planner Thomaidis: process so the sorry the changes are to replace schedule b plan area area of application in the

[0:07:43] Planner Thomaidis: the official community plan with a new map that adds a larger marine area around Scott, Damon and

[0:07:49] Planner Thomaidis: Hudson Islands and also to change the land use designation in the OCP Schedule C from undesignated

[0:07:56] Planner Thomaidis: to marine. There's the map updates proposed map updates to the official community plan to add

[0:08:03] Planner Thomaidis: the marine area and the proposed summary of changes to the Thetis Associated Islands

[0:08:15] Planner Thomaidis: Island's land use bylaw, bylaw number 114. There's a proposal to amend Schedule B area of

[0:08:24] Planner Thomaidis: application to include part of the marine area surrounding Scott, Damon, and Hudson Islands,

[0:08:29] Planner Thomaidis: as well as changing the marine area zoning from unzoned to water one. So there's the map

[0:08:38] Planner Thomaidis: showing the subject area to be added to the bylaw area of application, that marine area,

[0:08:45] Planner Thomaidis: water surrounding Scott, Damon, and Hudson Islands, not including some particular water

[0:08:51] Planner Thomaidis: five zoned aquaculture areas between Scott Island and Damon Island.

[0:08:58] Planner Thomaidis: And then there's the water one marine general zoning of the subject area proposed.

[0:09:09] Planner Thomaidis: So after the close of the public hearing today, the LTC has a business meeting scheduled.

[0:09:15] Planner Thomaidis: scheduled, they can consider, they have a special meeting scheduled, so they can consider the

[0:09:22] Planner Thomaidis: reading of the bylaws. If they do, the bylaws are then, I guess they can consider third reading of

[0:09:29] Planner Thomaidis: the bylaws because first and second reading have been complete, have passed. And then if they do

[0:09:35] Planner Thomaidis: consider third reading, the bylaws that are then sent to executive committee for approval and the

[0:09:43] Planner Thomaidis: the OCP bylaw must be approved by the Minister of Housing as well. So it is at that time that

[0:09:50] Planner Thomaidis: the LTC can consider final adoption of the bylaws. No new information or public submissions can be

[0:09:57] Planner Thomaidis: considered during this time. So it is important that your views are heard today during the public

[0:10:02] Planner Thomaidis: hearing. So we will take however much time we need to answer any questions from members of the

[0:10:12] Planner Thomaidis: public right now staff are staff are here um this is not an opportunity for your views or

[0:10:18] Planner Thomaidis: comments necessarily but more technical questions about the bylaws specifically

[0:10:23] Planner Thomaidis: so

[0:12:16] Planner Thomaidis: bylaw and the fetus associated islands land use bylaw because they have very similar names and

[0:12:22] Planner Thomaidis: yeah so i think that you were confusing the zoning regulations in the fetus island land use bylaw

[0:12:29] Planner Thomaidis: with the zoning the regulations and the thetis associated islands land use bylaw i just thought

[0:12:35] Voice 2: they would have the same numbers but okay yeah

[0:12:37] Planner Thomaidis: it's it's they're they're different and the and

[0:12:39] Planner Thomaidis: the regulations are different but the marine general w1 zone classification will apply

[0:12:46] Planner Thomaidis: to the area that's what this this bylaw

[0:16:57] Voice 5: Associated Islands Official Community Plan By-law 2014, Amendment No. 1, 2023, and Proposed By-law

[0:17:06] Voice 5: No. 114, cited as Thetis Associated Islands Land Use By-law 2014, Amendment No. 1, 2023.

[0:17:15] Voice 5: All persons who believe that their interest in property is affected by the proposed by-laws

[0:17:19] Voice 5: will be given a reasonable opportunity to be heard or to be present or to present written

[0:17:24] Voice 5: submissions respecting matters contained in the proposed bylaws. Those wishing to speak should

[0:19:18] Planner Thomaidis: All notification requirements under the Local Government Act have been completed.

[0:19:22] Planner Thomaidis: There is a copy of the complete public hearing binder available during this public hearing

[0:19:27] Planner Thomaidis: and it is located on the Islands Trust website under Thetis Projects.

[0:19:34] Planner Thomaidis: The amendments to the Thetis Associated Islands Official Community Plan and Land Use By-law are part of the Thetis Island OCP LUB Marine Areas Review Project

[0:19:44] Planner Thomaidis: to ensure the marine area surrounding Scott, Damon, and Hudson Island permits uses that are consistent with the object of the Islands Trust

[0:19:53] Planner Thomaidis: trust. The intent of bylaw number 113, if adopted, would be to amend schedule maps B and C in the

[0:20:01] Planner Thomaidis: Thetis Associated Islands Official Community Plan Bylaw 2014 to include undesignated area in the

[0:20:08] Planner Thomaidis: area of application. The proposed subject area is a sensitive ecosystem, and inclusion in the

[0:20:14] Planner Thomaidis: OCP bylaw application area offers greater protection and regulation. The intent of bylaw

[0:20:21] Planner Thomaidis: Bylaw number 114, if adopted, would be to amend Schedule Maps B and C in the Thetis

[0:20:27] Planner Thomaidis: Associated Islands Land Use Bylaw 2014 to include the unzoned area surrounding Scott,

[0:20:34] Planner Thomaidis: Damon, and Hudson Island in the Marine General or W1 zone.

[0:20:40] Planner Thomaidis: The following uses and structures are permitted in the W1 zone, subject to the regulations

[0:20:45] Planner Thomaidis: set out in this section, and the general regulations and all other uses are prohibited.

[0:20:50] Planner Thomaidis: Mooring buoys for the mooring of private vessel accessory to the residential use of an upland lot,

[0:20:56] Planner Thomaidis: docks accessory to the residential use of an adjacent upland lot, community docks, floats and swim floats, and marine navigational aids.

[0:21:07] Planner Thomaidis: needs. Proposed bylaw numbers 113 and 114 were referred to one federal agency, three provincial

[0:21:18] Planner Thomaidis: agencies, three regional agencies, two non-agencies, and 13 First Nations. At the time of this public

[0:21:27] Planner Thomaidis: hearing, referral responses have been received from the Cowichan Valley Regional District,

[0:21:32] Planner Thomaidis: Department of Fisheries and Oceans, the Ministry of Transportation and Infrastructure,

[0:21:36] Planner Thomaidis: the Ministry of Agriculture and Food, the Gabriola Island Local Trust Committee,

[0:21:42] Planner Thomaidis: the Salt Spring Island Local Trust Committee, as well as the Tawasin First Nation.

[0:21:47] Planner Thomaidis: All referral responses were either in support with interests unaffected or no objections to

[0:21:54] Planner Thomaidis: the proposed bylaws. One federal agency, DFO, generally recommended that land use planning

[0:22:00] Planner Thomaidis: processes consider establishing clear environmental conservation and protection objectives such as

[0:22:06] Planner Thomaidis: designation of sensitive areas setback requirements storm water retention requirements

[0:22:12] Planner Thomaidis: land use restriction and other bylaws and staff note that these proposed bylaws would increase

[0:22:17] Planner Thomaidis: environmental protection by restricting uses in the marine area and we have received one public

[0:22:25] Planner Thomaidis: submission so far as of i'm not sure exactly what time today i think it was this morning

[0:22:33] Planner Thomaidis: and staff will advise and send any other public submissions that we receive.

Chair Elliott called the meeting to order at 5:31 p.m. She acknowledged that the meeting was 
held on the territory of the Coast Salish First Nations. She welcomed the public and introduced 
herself, Local Trustees, staff and recorder.

3. COMMUNITY INFORMATION MEETING - Proposed Bylaw Nos. 113 and 114 - Marine Areas 
Review Project 
3.1 Planner Presentation 
Planner Thomaidis reported that the purpose of this Community Information Meeting 
(CIM) is to review with the community the elements of the proposed Bylaw Nos. 113 
Thetis Associated Islands Official Community Plan, 2014 (OCP) and 114 Thetis Associated 
Islands Land Use Bylaw, 2014 (LUB) amendments, to provide information needed for 
community members to be able to speak at the Public Hearing which will follow, and 
will include a question and answer session. She explained the timelines and next steps in 
the process. 
She advised that the purpose of the Marine Areas Review Project is to review and 
update the Thetis Associated Islands Official Community Plan (OCP) policies and Land 
Use Bylaw (LUB) regulations to address a portion of the marine area that is outside the 
OCP designation area and is outside the area of LUB application, and will establish an

expanded bylaw area of application for the OCP and LUB in the marine area surrounding 
Scott, Dayman and Hudson Islands.  
 
She summarized the proposed amendments: 
 Bylaw No. 113 would amend both Schedule Maps B and C in the OCP to include 
the undesignated marine area of application surrounding Scott, Dayman and 
Hudson Islands to ensure the marine uses are consistent with the object of the 
Islands Trust and to ensure the Thetis Island Bylaws are applicable in that area. 
 Proposed Bylaw No. 114 would amend the LUB to include the unzoned area 
surrounding Scott, Dayman and Hudson Islands in the Marine General (W1) 
Zone. 
3.2 Question and Answer Period 
 Why is the area of zoning being considered ‘M1’, which is a commercial 
classification?  
 Different Bylaws utilize various marine and water zoning category 
terminology; one may use M for Marine zoning and another uses W for 
a water zone. The Thetis Associated Islands LUB amendment being 
considered at this time is to include the unzoned area in the Marine 
General (W1) Zone of the Thetis Associated Islands LUB.
