[0:00:25] Voice 2: want to acknowledge today that we're gathering here on the traditional territories of many Kodosh Salish peoples and specifically the Penelakut Nation.
[0:00:35] Voice 2: part of my personal sort of journey of reconciliation islands trust is working
[0:00:43] Voice 2: with a group called culturally committed to offer trustees and staff some insights into
[0:00:51] Voice 2: concepts such as cultural safety and various in indigenous knowledge
[0:00:58] Voice 2: knowledge we have some great mentors from nearby and across the nation that's been a really really
[0:01:06] Voice 2: positive thing I look forward to to continuing that throughout this year I'm Jim Peterson I'm
[0:01:14] Voice 2: elected on the Skidi Island I am the chair of the Galeano Island Local Trust Committee and with me
[0:01:20] Voice 2: our trustees Ben Maverly,
[0:01:22] Voice 4: Lisa Cabrera and our planner Kim Stockdale is here with us
[0:01:28] Voice 4: and we have some staff our meeting administrators Lisa Millard I believe today
[0:01:34] Voice 4: and I'm not sure if we have other staff
[0:01:37] Voice 2: zooming in but great that we have the option of having
[0:01:43] Voice 2: these essentially hybrid type meetings in this space so that's great um meetings an official
[0:01:53] Voice 2: forum for the local trust committee to make decisions about land use planning matters and
[0:01:58] Voice 2: to discuss relevant business um it's also a place of employment and this will remind everyone our
[0:02:03] Voice 2: staff have a right to a safe and respectful workplace there
[0:02:07] Voice 4: is a town hall um section
[0:02:11] Voice 4: questions coming up, which is an opportunity for the public to speak. And when we get to
[0:02:16] Voice 4: that spot, I'll mention
[0:02:18] Voice 2: a little bit more
[0:02:19] Voice 4: about that. But to start with, we have an
[0:02:22] Voice 4: agenda before us today, and I want to see if there's any amendments to today's agenda
[0:02:29] Voice 4: from either of the trustees. No? Okay, I'll take it by general consent that the agenda
[0:02:34] Voice 4: will be adopted as presented then. And we'll
[0:02:41] Voice 3: go to trustee reports.

[0:03:18] Voice 3: was just the service cd at our office and
[0:03:23] Voice 4: i attended a lot of jobs
[0:03:24] Voice 4: i found our town hall meetings very productive overall definitely considering the extent of
[0:03:34] Voice 4: verified discussions and i found great value in the
[0:03:37] Voice 3: gift of that media and i think it's
[0:04:03] Voice 4: Thank you for supporting the needs and the priorities of our community within the animals
[0:04:15] Voice 4: frustrating we are unique not every island has moving forward i will utilize the space
[0:04:24] Voice 4: as an opportunity to collaborate we plan to go to meeting meetings where the community can come out
[0:04:31] Voice 4: of the chat and learn
[0:04:32] Voice 4: about why we do what we do and why that's the perspective it will be
[0:04:38] Voice 4: informal meeting utilizing existing information already and will help me gain community input
[0:04:47] Voice 4: So I'm looking for suggestions of topics.
[0:04:52] Voice 4: Do you want to read through the Housing Options Toolkit that the Regional Planning Committee put together?

[0:05:05] Voice 4: I believe with a little enthusiasm, that office space can be a vibrant, positive hub of activity for everyone in the community.

[0:05:17] Voice 4: Lastly, I'd like to mention the passing of the Honourable Ayanna Capagnolo on April 4th.
[0:05:28] Voice 4: Born in 1932 on Galliano, her family lived at Murchison's College.
[0:05:34] Voice 4: Capagnolo began his political career in 1966 as an Alderman and City Councilor in Prince River.
[0:05:42] Voice 4: Capagnolo's dedication to serving British Columbians never wavered.
[0:05:46] Voice 4: In 1992, she was elected Chancellor of University of British Columbia, and in 2001, she was
[0:05:56] Voice 4: appointed the 27th Lieutenant Governor of British Columbia.
[0:06:00] Voice 4: As the first woman to hold this position, she tirelessly advocated for a very important
[0:06:06] Voice 4: thing, which is climate action, gender equality, and reconciliation.
[0:06:12] Voice 4: The reality of the piece of service that we all have seen and remember its awards on the
[0:06:16] Voice 4: faculties, including an honorary degrees, indigenous honor, and the Order of British
[0:06:23] Voice 4: Columbia.
[0:06:24] Voice 4: Her exceptional career is further recognized when she was named a member and later an officer
[0:06:30] Voice 4: of the Order of Canada.
[0:06:32] Voice 4: These honors reflect a remarkable impact on her lifelong commitment to public service.
[0:06:39] Voice 4: The photo on her we can peek at in each.
[0:06:42] Voice 4: she is seen at her luncheons i think we have a community
[0:06:45] Voice 4: thank you lisa um yeah um two things we wanted to cover today i brought some
[0:06:57] Voice 4: pamphlets today for the uh secondary suite incentive program that's a provincial program
[0:07:03] Voice 4: that uh allows for a forty thousand dollar forgivable loan for anybody
[0:07:07] Voice 4: who's living in their primary residence that wants to put in the secondary suite
[0:07:10] Voice 4: week. It's a good start in a housing program, I guess. There was a bit of a fight to get
[0:07:18] Voice 4: this brought into the rural communities, but it's here, so there's pamphlets available
[0:07:24] Voice 4: here for anybody who's interested. I wish it had been expanded a bit more to include
[0:07:29] Voice 4: not just primary homeowners, but it's a start anyways.
[0:07:37] Voice 4: Secondly, we've had a lot of correspondence about parking down at Montague.
[0:07:43] Voice 4: So I took the opportunity to meet with Francois Laurent, who's the Highways fellow for this
[0:07:50] Voice 4: area, and we went
[0:07:52] Voice 4: down to the site.
[0:07:55] Voice 4: I think Highways realized that maybe just posting no parking signs all over the place
[0:08:00] Voice 4: was a little bit heavy-handed and they've agreed to open up two stretches
[0:08:10] Voice 4: of Montague. So from the Montague Harbour Road, if you go up on the left-hand side
[0:08:16] Voice 4: up to the big alder tree or arbutus tree, they're going to rehabilitate that. Now
[0:08:22] Voice 4: the thing is, once they've closed it, you suddenly, when you want to open something
[0:08:27] Voice 4: something again, you've got to get geotech and you've got to get the engineers involved.
[0:08:30] Voice 4: So it'll be a bit of a process, but that stretch will be opened up for parallel parking. And
[0:08:35] Voice 4: then also on the sort of left-hand side leaving Montague, there's a stretch of the road that
[0:08:43] Voice 4: has a very shallow ditch, goes for quite a ways. And they're going to rehabilitate that
[0:08:49] Voice 4: as well for more parallel parking down there. It's not going to be enough. There's no question
[0:08:55] Voice 4: about that i think the last count down there just in landowners and that was about 135 people
[0:09:01] Voice 4: access their lands through montague and that doesn't include people live on boats and people
[0:09:07] Voice 4: who want to get marina and all those people go to the restaurants and things like that so
[0:09:12] Voice 4: i expect it to be a calm show
[0:09:13] Voice 6: um
[0:09:14] Voice 4: but they're aware at least they're aware that of some of
[0:09:19] Voice 4: the problems we had a good discussion and they're aware that you know just closing home parking
[0:09:27] Voice 4: and probably isn't going to be the greatest or the best path forward.
[0:09:31] Voice 4: And so hopefully we'll see them back off on enforcement for a while
[0:09:36] Voice 4: until alternatives are there.
[0:09:39] Voice 4: I mean, to me, you can't just say no without an alternative, right?
[0:09:44] Voice 4: But there is a genuine concern about the ability of the ambulance
[0:09:48] Voice 4: to get to the dock, and that became a problem last winter
[0:09:52] Voice 4: when they were unable to plow to the dock
[0:09:55] Voice 4: and the ambulance could not get to the dock with the patient.
[0:10:00] Voice 4: So that's just not going to fly.
[0:10:03] Voice 4: Regardless how inconvenient it is maybe to walk a little bit further for parking,
[0:10:08] Voice 4: it's really inconvenient if you can't get to the hospital when you're in an ambulance.
[0:10:13] Voice 4: So hopefully we're working on that.
[0:10:15] Voice 4: And we look forward to making more progress.
[0:10:18] Voice 4: and i know tim has got something later on working with uh with uh highways as well
[0:10:26] Voice 4: and so lastly i i'm going to acknowledge a couple of people this week one probably that not many of
[0:10:34] Voice 4: you know but bill camp bill campbell was in this community since 1952-ish 52 and the reason bill's
[0:10:45] Voice 4: significant because without bill camp you don't have a conservancy property and uh and so bill a
[0:10:53] Voice 4: long time out there a long time back and forth even when he had left the island uh a very active
[0:11:00] Voice 4: member of the rodney um like that you know when they were selling that property there was other
[0:11:09] Voice 4: people interested in that property and they wanted it to remain in a in a state that was
[0:11:16] Voice 4: was more natural. I think, you know, they picked the Conservancy because it sort of
[0:11:21] Voice 4: aligned with what they wanted to see the property to be. So, you know, good for Bill. Bill and
[0:11:28] Voice 4: Ben is great. And the second is Joanne McKay, you know, dear friend. And it was really heartwarming
[0:11:37] Voice 4: to see the turnout for Joanne at the Lions Hall. Joanne struggled for a long, long time
[0:11:47] Voice 4: and we all know people who struggle right but it just showed the um you know that turnout to
[0:11:56] Voice 4: me showed you know regardless of her struggles joanne was a beautiful person right so i just
[0:12:06] Voice 4: wanted to highlight her because you know we know we all know people who struggle all the time and
[0:12:12] Voice 4: uh it was great to see the community support yeah that's it for me
[0:12:20] Voice 4: okay so next up is the chair's report um lisa mentioned we had uh trust council in march
[0:12:27] Voice 2: um our focus on the budget deliberations but also as you mentioned there's immediate training
[0:12:34] Voice 2: section and a bit of strategic um priority uh strategizing i suppose and it was just we got
[0:12:43] Voice 2: got a start on that um that's a precursor to the our change in direction that the stress council
[0:12:53] Voice 2: is attempting which is to align uh budgetary planning and strategic planning in a corporate
[0:12:59] Voice 2: planning process which um once it's fully up and running is is intended to uh provide some
[0:13:07] Voice 2: more surety for long-term funding um for projects that are going to take more than one fiscal we've
[0:13:14] Voice 2: had um over the past nine years i've been on council we've had uh investments made into
[0:13:20] Voice 2: projects that uh uh a couple years in and before they were complete trust that the will of trust
[0:13:27] Voice 2: council decided not to spend any more money on them and uh i think from my perspective it makes
[0:13:34] Voice 2: a lot more sense if you're if you're going to get into a project that's going to take some
[0:13:39] Voice 2: some time to to plan ahead to fund it to completion so um that's definitely a big part of
[0:13:46] Voice 2: of where we're going on that um a couple uh let's see what else the or the islands trust
[0:13:54] Voice 2: chief administrative officer has announced he's going to retire in the summer
[0:13:59] Voice 2: um been involved we've had a lot of meetings uh with the hiring committee um looking to find a
[0:14:07] Voice 2: replacement suitable replacement uh for that position um there's been a lot of meetings
[0:14:12] Voice 2: involved with that and uh um there's an intention to in fact more than intention there's been a
[0:14:21] Voice 2: request for proposals put out for executive search firm to help us find suitable candidates
[0:14:29] Voice 2: um so that work is ongoing and uh uh there was a meeting yesterday and of course i was traveling
[0:14:37] Voice 2: and had difficulty connecting, so I can't give you the verbatim
[0:14:41] Voice 2: on what the Verizon report out of that session was,
[0:14:44] Voice 2: but they're still trying to pin down the successful candidate
[0:14:50] Voice 2: for that executive search firm.
[0:14:52] Voice 2: And so that's pretty big news at Islands Trust.
[0:14:56] Voice 2: The CAO has been in that position for seven years,
[0:15:01] Voice 2: which is a total long for a CAO in this type of organization.
[0:15:06] Voice 2: Although it almost seems like it was just shortly ago that he joined.
[0:15:15] Voice 2: Let's see. The Association of Vancouver Island Coastal Communities meetings are this weekend.
[0:15:23] Voice 2: Most executives going to be attending. I'm not going to make it because I'm actually going to take the weekend off because of this full week of travel.
[0:15:34] Voice 2: and then my next couple of weeks are busy as well.
[0:15:38] Voice 2: I wanna thank Ben for bringing the pamphlets
[0:15:41] Voice 2: on the secondary suite incentive.
[0:15:46] Voice 2: And as he mentioned, it was a bit of a struggle
[0:15:49] Voice 2: to get it out to the islands,
[0:15:52] Voice 2: which the province sort of did securitously
[0:15:54] Voice 2: by including the regional districts
[0:15:57] Voice 4: as being eligible,
[0:16:00] Voice 4: certainly just started out with the municipalities.
[0:16:02] Voice 4: There's a lot of questions on some of our rural communities of why are we being excluded
[0:16:08] Voice 4: from this.
[0:16:10] Voice 4: Certainly there's housing issues all through the islands in the Islands Trust area.
[0:16:20] Voice 2: The CRD is hosting a meeting on April 30th around collaboration on marine issues.
[0:16:32] Voice 2: I'm hoping that that leads to some productive discussions, clearly with the four levels
[0:16:41] Voice 2: of jurisdiction being local government, regional district, the province and the federal government,
[0:16:49] Voice 2: some form of working together, it's essential to address the issues.
[0:16:54] Voice 2: I am not as familiar with the Montague Harbour, but I'm told that the issues are not dissimilar
[0:16:59] Voice 2: which I'm more more familiar with and hopefully we're going to this is hopefully this step towards
[0:17:08] Voice 2: some some more inter-agency collaboration so that we're working in the same direction instead of
[0:17:16] Voice 2: piecemeal and at odds and so I'm hopeful that that leads to to better better work and
[0:17:23] Voice 2: and uh better outcomes for all these harbors that are just increasingly popular and especially given
[0:17:30] Voice 2: the the housing costs and housing availability you know liveaboards are are something that
[0:17:39] Voice 2: may end it's i think likely to increase um in numbers as as we move along here
[0:17:48] Voice 2: finally the montague harbour uh as as mentioned with i've received lots of emails um around that
[0:17:56] Voice 2: and the positive note from that is i ended up in a email discussion with um vancouver island
[0:18:05] Voice 2: district manager at moti uh as well as um uh one of adam olson's uh staffers and i brought up the
[0:18:14] Voice 2: fact that islands trust and motif have a fairly dated uh letter of agreement that stretches back
[0:18:23] Voice 2: to 1992 and there's a mending letter of 1996 which sets out the parameters for establishing
[0:18:31] Voice 2: a task force which has never been done um in september when executive committee met with the
[0:18:38] Voice 2: the minister and that was one of the items I brought up and the minister was receptive he
[0:18:44] Voice 2: said oh it's we have that agreement let's do it unfortunately we didn't get much traction in terms
[0:18:49] Voice 2: of hearing back from the ministry on next steps but fortuitously with this email conversation
[0:18:57] Voice 2: around Montague Harbour the department district manager has agreed to a meeting with Finance Trust
[0:19:09] Voice 2: in April 29th and part of that's going to be around exploring what steps we need to take to
[0:19:18] Voice 2: establish this this long delayed task force which is if you go back to the letter of agreement
[0:19:26] Voice 2: a lot of it is about good better communication and certainly in this Montague parking situation
[0:19:35] Voice 2: situation that just really highlighted how there wasn't any um and you know certainly for i think
[0:19:44] Voice 2: for all of us and and i would imagine at some level at the at the ministry there um the value
[0:19:51] Voice 2: of of discussion before action has hopefully been uh brought to the fore and certainly uh working
[0:19:59] Voice 2: with um for island stress being able to work with with the ministry there's a lot of there's a lot
[0:20:04] Voice 2: infrastructure issues that need to be addressed everything from i've heard in this room
[0:20:10] Voice 2: line painting heard that numerous times here uh this parking issue uh the promises is
[0:20:17] Voice 2: the province is wanting to advance uh active transportation routes well i think if you go
[0:20:23] Voice 2: to any of the ferry terminals in the southern gulf islands that i've been to there needs to
[0:20:28] Voice 2: be some serious improvement to safely move foot passengers and especially cyclists through the
[0:20:34] Voice 2: ferry interface safely in a way that that especially if we're trying to enhance active
[0:20:41] Voice 2: transportation we need to think about this when there's restructuring and infrastructure changes
[0:20:47] Voice 2: at those uh at those ferry terminals so i'm hopeful that we're going to establish the task
[0:20:52] Voice 2: force and and that it um leads to a better better communication to start with and hopefully better
[0:21:00] Voice 2: better outcomes in terms of all of that type of infrastructure in the Islands
[0:21:05] Voice 2: Trust area and I
[0:21:08] Voice 2: will leave it there for now and I don't see our electoral director area here today but I will note
[0:21:20] Voice 2: that I suggested he'd be invited to that meeting with Moti even though it is Islands Trust and
[0:21:27] Voice 4: multi but he's he's a former trustee and he's been on the island a lot i think it's actually
[0:21:33] Voice 4: it's reasonable to expand the collaboration a little bit um and and to be able to if nothing
[0:21:41] Voice 4: else have him there to listen um and and maybe he'll have some good suggestions who knows
[0:21:49] Voice 4: um nexus birth nation report ben i think you said you yeah i was
[0:21:53] Voice 4: just a small update uh
[0:21:55] Voice 4: talked with Josh James and
[0:21:57] Voice 4: Ken Thomas this morning.
[0:21:59] Voice 4: They apologized for not being here today.
[0:22:01] Voice 4: They wanted to come to this meeting to let everybody know
[0:22:08] Voice 4: they're looking forward to meeting with staff and
[0:22:11] Voice 4: with the trustees in regard to the applications that are before them now.
[0:22:15] Voice 4: They're just waiting to hear back from legal and they expect that to be
[0:22:20] Voice 4: by the end of this week.
[0:22:21] Voice 4: and so uh hopefully we'll be we'll be having a sit down with them very shortly so uh yeah
[0:22:30] Voice 4: great and that's it for them yep that's that's good news glad to hear that so next on the agenda

[0:22:47] Voice 2: issues within the jurisdiction of the islands trust if possible ideally what's on our agenda

[0:23:04] Voice 2: comments brief um if needed i'll use a timer and restrict people to three minutes um and uh with
[0:23:12] Voice 2: that i would look for show hands of people who would like to say something or ask a question

[0:23:28] Voice 4: um i would urge yourself and ben to please make use of your contacts with motive because you're
[0:23:38] Voice 4: We're probably dealing with people on Galpiano, who represent Galpiano, that have been able
[0:23:44] Voice 4: to get any sort of an official response, or a response of any kind, promoting on safety
[0:23:51] Voice 4: issues, especially the issue of repainting of the federal lines.
[0:23:57] Voice 4: Multi-staff, including Francois and his manager, have been ignoring and stonewalling citizens
[0:24:05] Voice 4: citizens who have been writing to them about this issue.
[0:24:09] Voice 4: It's not only Eliano, the Powhatan Valley Regional District recently made public statements
[0:24:18] Voice 4: that were covered by a local newspaper about MOTI's lack and complete lack of cooperation
[0:24:29] Voice 4: Cooperation or even communication with the regional district on road issues on regional road issues
[0:24:37] Voice 4: So if you do have it in and they will listen to or at least pick up the telephone
[0:24:44] Voice 4: Please please
[0:24:47] Voice 4: Y'all keep them on their toes and ask them about this one particular issue the season for
[0:24:56] Voice 4: for repainting roads is rapidly coming
[0:24:59] Voice 4: and will be over before we know it.

[0:25:12] Voice 4: I'd just like to comment on the student's application.
[0:25:16] Voice 4: I wasn't at the February LTC meeting
[0:25:19] Voice 4: and I've just been sort of catching up
[0:25:21] Voice 4: with the information that's available
[0:25:22] Voice 4: in the agenda packages.
[0:25:24] Voice 4: But I would like to speak as a resident who doesn't live anywhere near this property.
[0:25:32] Voice 4: I was really quite shocked, I have to say, to read the staff report and the staff recommendation
[0:25:37] Voice 4: that this involvement permit application or variance permit be approved.
[0:25:44] Voice 4: From what I read, the zoning infractions on this property are long standing and multiple.
[0:25:51] Voice 4: to vote. There clearly has been an opportunity over decades for these contraventions to be
[0:25:58] Voice 4: addressed and bring the property into compliance. And as a resident and taxpayer, I'm really
[0:26:06] Voice 4: not very happy that my tax money, which goes to the Island's Trust, has been in fact used
[0:26:15] Voice 4: is to get a judgment in a court case,
[0:26:18] Voice 4: a judgment
[0:26:20] Voice 4: that gave the owner of the property,
[0:26:23] Voice 4: the longtime owner of the property,
[0:26:25] Voice 4: a year to bring the property into compliance,
[0:26:28] Voice 4: and nothing has been done.
[0:26:31] Voice 4: And then to see this application be recommended
[0:26:34] Voice 4: for approval, I find really concerning.
[0:26:41] Voice 4: Personally, I feel like I have a civic duty
[0:26:43] Voice 4: to abide by the bylaws that we have in our official community plan and by our zoning bylaws
[0:26:51] Voice 4: and I don't believe that it's fair to the adjacent property owners to have to go to
[0:26:59] Voice 4: the amount of trouble and work that I saw in the report that they have submitted
[0:27:05] Voice 4: it um that is in this agenda package a very detailed report to try and have bigger um rights
[0:27:15] Voice 4: respected in the situation i appreciate that the um uh mistake and the people who have now
[0:27:23] Voice 4: adhered to this property are in an unfortunate situation but as is stated in the staff
[0:27:30] Voice 4: opportunity nation report if this development areas permit is
[0:27:35] Voice 3: approved it
[0:27:37] Voice 4: sets a really
[0:27:38] Voice 4: can set a very unfortunate precedent for other applications that come before
[0:27:45] Voice 4: the ltc and i really feel that we have to be very careful of that
[0:27:53] Voice 4: that. I also am very concerned for the environment and the fact that one particular variance
[0:28:02] Voice 4: has to do with the fact that the septic field or system is extremely close to the sea. I
[0:28:12] Voice 4: think the width, if I'm correct, it was within three meters where the requirement is at least

[0:28:37] Voice 4: initial reactions to what i saw in this application that really influenced me thank you

[0:28:48] Voice 4: hello i'm richard boyce sergeant uh i'm here also to speak about the uh variance issues on
[0:29:02] Voice 4: john skin's property my wife and i have been the owner of our seasonal cabin on galliano since 1993
[0:29:10] Voice 4: 1993, over 31 years. When we returned to open the cabin in the spring of 2005, we were shocked
[0:29:18] Voice 4: to discover that Mr. Bernstein was shocked to have had, he's the recent owner, new owner
[0:29:26] Voice 4: of this property, had made use of our driveway and had created an open construction area
[0:29:31] Voice 4: on our land with heavy construction equipment. Boulders and sand were strewn landably next
[0:29:39] Voice 4: thanks to our well-pumped housing, among other things.
[0:29:43] Voice 4: However, far more upsetting here was the realization
[0:29:48] Voice 4: that our thick stand of trees that we valued for privacy
[0:29:52] Voice 4: had been removed without our consent
[0:29:54] Voice 4: to facilitate easier access to a construction site.
[0:30:00] Voice 4: Trees on both sides of our property were removed and the natural divide filled in with fine gravel
[0:30:06] Voice 4: and sand to ensure adequate drainage for the construction of a long driveway down the joint
[0:30:13] Voice 4: property line. Cars, pickups, front and lower ears were able to use this road next to our fence.
[0:30:22] Voice 4: This was followed by a building of a septic field leveling and filling in of the sloped property
[0:30:30] Voice 4: raising and changing the whole topography by way of the erection of massive boulders to encase the added fill.
[0:30:39] Voice 4: I initially thought the boulder wall would pop out at four feet high, but it ended up close to double that,
[0:30:48] Voice 4: changing the entire lay of the land in water runoff next to ours.
[0:30:53] Voice 4: and our leafy view towards the marina from our living room was replaced with an eight-foot
[0:31:00] Voice 4: stockade fence above which the new level of our neighbor's lawn and the occasional parked car
[0:31:07] Voice 4: peered down upon us. So to conclude, it appears that the Islands Trust's guiding principle
[0:31:19] Voice 4: of privacy, visual impact, and role of character
[0:31:24] Voice 4: have suddenly been sidestepped in this case,
[0:31:29] Voice 4: and the impetus to resolve the problems
[0:31:31] Voice 4: have been allowed to stagnate by the governing parties.
[0:31:36] Voice 4: So for all concerned, could we please prioritize this case
[0:31:42] Voice 4: and seek a lawful conclusion?
[0:31:45] Voice 4: Thank you.

[0:32:13] Voice 4: not been enforced.
[0:32:14] Voice 4: And I think that one of the steps
[0:32:17] Voice 4: that we need to take
[0:32:19] Voice 4: is to find out why.
[0:32:23] Voice 4: How was the ball
[0:32:24] Voice 4: drawn? Why was there no
[0:32:26] Voice 4: enforcement by the
[0:32:28] Voice 4: ILO Trust
[0:32:30] Voice 4: on the particular issue?
[0:32:34] Voice 4: The other issues
[0:32:36] Voice 4: which stem
[0:32:38] Voice 4: from this are
[0:32:39] Voice 4: perhaps legal in nature.
[0:32:42] Voice 4: Does the current
[0:32:43] Voice 4: variation application
[0:32:46] Voice 4: have any impact
[0:32:48] Voice 4: or is it impacted by the
[0:32:50] Voice 4: outstanding B.C. Supreme Court order.
[0:32:53] Voice 4: If so, which one takes precedence?
[0:32:58] Voice 4: The other issue which is troubling is that the staff recommendations did not even mention
[0:33:10] Voice 4: this particular outstanding B.C. Supreme Court order.
[0:33:15] Voice 4: with staff unaware of the order that if they were aware of the order and ignored it
[0:33:27] Voice 4: that is a serious problem that the local trust community has to deal with
[0:33:33] Voice 4: there are a whole series of issues i think that the trust needs to clarify
[0:33:38] Voice 4: before you proceed any further on the current variance application thank you
[0:33:47] Voice 4: yeah thank you for that yes um i'd just like to respond um the neighbor's question the lengthy
[0:33:56] Voice 4: delay in submitting of this application so the honest book brochure states very clearly that
[0:34:04] Voice 4: attention must be given to unusual and personal circumstances that may affect the timing of an
[0:34:09] Voice 4: application two deaths in my family as pointed out it's pointed out in the stock report plus a
[0:34:16] Voice 4: worldwide pandemic are unusual in personal circumstances. With my father's death in 2016,
[0:34:24] Voice 4: my brother became executor. He worked diligently and closely with Islanders Trust staff to clarify
[0:34:31] Voice 4: and fully identify the respective variances. During that time he struggled with a misdiagnosed
[0:34:37] Voice 4: disease and was increasingly in poor health. He died nine days after being diagnosed with cancer
[0:34:45] Voice 4: answer at the age of 68. There was no transition time for me to get up to speed as the alternate
[0:34:52] Voice 4: executor, and I had to take time to be able to advise myself when making issues. Demanding
[0:35:01] Voice 4: issues, sorry, demanding answers about the delay in the present context suggests a lack
[0:35:08] Voice 4: of understanding and a disconnect from our present reality.
[0:35:16] Voice 4: Okay, and you are the applicant, right?
[0:35:19] Voice 3: Okay, I am, yeah.
[0:35:19] Voice 3: yeah
[0:35:19] Voice 4: okay and and so you will also have an opportunity to speak

[0:37:29] Voice 4: These are infractions against By-law 127, legal action that's been taken, a responsible
[0:37:36] Voice 4: pathway for compliance, and to wrap up with some conclusions.

[0:37:42] Voice 4: So the property that we're talking about is right here under the yellow arrow.
[0:37:47] Voice 4: Our property, the Swan property, is on this side.
[0:37:50] Voice 4: The Boyce Sarkins property is right here, and the O'Shaughneau property is right here.
[0:37:56] Voice 4: This constitutes the adjacent property owners that I'm speaking on behalf of.

[0:38:03] Voice 4: This is a site plan of 3307.
[0:38:07] Voice 4: It's a small residential lot.
[0:38:10] Voice 4: It's also quite a small lot.
[0:38:12] Voice 4: It's actually a little bit bigger than ours, but it's 0.159 acres.
[0:38:16] Voice 4: When you take in the six meter setback on the interior lot lines and the 7.5 meter setback
[0:38:23] Voice 4: on the water and the road, it leaves you with 42% that you can legally build on.

[0:38:31] Voice 4: Anything in the red is where development took place in the setback area.
[0:38:37] Voice 4: And you can see it's about, the red is about 25% of this green.

[0:38:45] Voice 4: when you build in the setback area you're undoubtedly going to run into a lot coverage
[0:38:50] Voice 4: area problem the land use file 127 has a limit of 25 percent this lot the way it was developed
[0:38:58] Voice 4: is sitting at 36 next slide please this is a picture of the property
[0:39:06] Voice 4: our property is over on this side this is the western lot line you can see that the setback
[0:39:13] Voice 4: has been ignored right up to the property line all the way along here this cottage is only a meter
[0:39:20] Voice 4: and a half from the property line the what coverage you can see is peculiar that's the 36
[0:39:27] Voice 4: percent i'm talking over just the buildings and also the coverage in the uh the patio and parking
[0:39:34] Voice 4: area and then there's the oversized woodshed compost here next slide please on the other side
[0:39:42] Voice 4: of the property which is the boy started side this is the before picture with all the trees
[0:39:48] Voice 4: that richard just spoke about goodbye trees hello fence and there was no consent on that but richard
[0:39:55] Voice 4: covered that so let's go on to the next slide this is the court order this is what was issued
[0:40:02] Voice 4: in september of 2014 and what happened here is the ltc of galliano petitioned john's news
[0:40:09] Voice 4: And they cited multiple by-law infractions of By-law 127, and if you go to the next slide,
[0:40:20] Voice 4: you'll see that the Islands Trust were successful on all of the contraventions, and John was
[0:40:29] Voice 4: given a year to comply.
[0:40:32] Voice 4: The LTC wanted to do it in two months.
[0:40:34] Voice 4: The judge said no, we'll give them a year, and if you go to the next slide, it proved
[0:40:42] Voice 4: to be a mistake because none of these happened, unfortunately.
[0:40:46] Voice 4: Now the current situation is interesting.
[0:40:49] Voice 4: After eight years of the deadline, there's been an application put in for DBT to vary
[0:40:54] Voice 4: nine violations, setback violations.
[0:40:58] Voice 4: The applicant gets to choose which ones they would like to vary, but there are six contraventions
[0:41:06] Voice 4: in the court order that haven't been addressed, and there's five other issues that have been
[0:41:16] Voice 4: passed on to the enforcement.
[0:41:19] Voice 4: And then if the violations aren't varied or they aren't applied for or if they're applied
[0:41:25] Voice 4: and they're approved but if they're not approved then you have to correct them next slide please
[0:41:32] Voice 4: this slide shows the violations that are on the property the green ones are all the ones that are
[0:41:38] Voice 4: in the dvp application we wanted to make sure they were very visible for the ltc because there's a
[0:41:44] Voice 4: lot of issues going on here the red ones are the ones that are in the the core quarter that's
[0:41:49] Voice 4: that have been addressed in the DDP, and the blue ones are the ones that are additional
[0:41:54] Voice 4: that have been submitted to enforcement. Next slide, please. This is a description of the
[0:42:01] Voice 4: violations. The green are the ones that are in the DDP, and we've included the reference.
[0:42:06] Voice 4: Next slide, please. Okay, so what we did, as he takes the property over, is we undertook
[0:42:15] Voice 4: a a bylaw assessment and what we did is we applied the criteria from the island's trust if you go to
[0:42:24] Voice 4: the next slide i can better explain this these are all the violations here again the green ones are
[0:42:31] Voice 4: in the dvp red ones are in the fourth order the new ones uh blue ones are uh reporting to enforcement
[0:42:40] Voice 4: this is the island's criteria across the top this is a criteria they use to measure the impact
[0:42:47] Voice 4: on setbacks and so what we did is we evaluated the criteria against each one 140 decisions
[0:42:58] Voice 4: on what the impact was on these various um infractions one is minor three is
[0:43:08] Voice 4: is medium, 5 is high in terms of the income.
[0:43:14] Voice 4: The totals were put in here.
[0:43:16] Voice 4: If it's red, it almost means you've got to do remediation.
[0:43:20] Voice 4: If it's tan color, this couple down here,
[0:43:24] Voice 4: that would mean that it would be something
[0:43:26] Voice 4: that you could probably bear.
[0:43:28] Voice 4: They've been put into four groups
[0:43:30] Voice 4: to help with the remediation strategies.
[0:43:34] Voice 4: Next slide, please.
[0:43:37] Voice 4: Okay, Jan, let's go and look at the picture.
[0:43:40] Voice 4: Okay, so what this is is the parking lot group.
[0:43:44] Voice 4: It's got these three violations that are in the court order,
[0:43:49] Voice 4: and there's four that are being reported to enforcement.
[0:43:54] Voice 4: The remediation plan here would be to remove these lock-lock walls,
[0:43:59] Voice 4: return this area of the lot back to its natural level.
[0:44:04] Voice 4: these three and fourth concrete walls would remain in push fill into backfill and that would restore
[0:44:10] Voice 4: the contour it would also by taking the tiles up you would restore 7.1 percent of the lot coverage
[0:44:20] Voice 4: okay next slide please now the front wall is group two and let's look at the next slide
[0:44:31] Voice 4: Again, there's two that are in, two walls that are in the court document, there's two
[0:44:37] Voice 4: over there that are, or three in total that are in the DBP.
[0:44:41] Voice 4: The recommendation is these walls be dismantled and in the setback areas it be returned to
[0:44:49] Voice 4: the natural level.
[0:44:51] Voice 4: Next slide please.
[0:44:53] Voice 4: Okay, the cottage, can we go to the next picture?
[0:44:57] Voice 4: sure the cottage there's one court violation has to do with the density and then there's two that
[0:45:05] Voice 4: are in the dvp um what the remediation would be here would be to take the cottage off the property
[0:45:13] Voice 4: and that would um solve the density problem and also between taking the tile out of the parking
[0:45:20] Voice 4: lot and the covered area that you would lose here in compliance with the coverage of provision.
[0:45:29] Voice 4: This wall would be removed, this area would be returned to the natural slope all the way
[0:45:38] Voice 4: along the entire line.
[0:45:40] Voice 4: Next slide.
[0:45:42] Voice 4: Okay, the miscellaneous violations, when we go to the next slide I can explain it in a
[0:45:47] Voice 4: picture easier again four that are in the dvp one that's been reported to enforcement
[0:45:55] Voice 4: and what we recommend here is that this wall or this fence actually be buried it's reasonable to
[0:46:02] Voice 4: bury it the septic field the circumstances with the contamination of wells and so forth
[0:46:10] Voice 4: we're recommending it was a hard decision but we're recommending that it be buried
[0:46:15] Voice 4: this house was built in the 50s it's got a setback of 6.7 37.5 why would you take a corner
[0:46:23] Voice 4: of a house after it's been there for 70 years we recommend that it be buried for the pub house we
[0:46:29] Voice 4: just recommended the roof over the covered area to be removed and we recommend that the flow be
[0:46:36] Voice 4: brought into compliance with the development permit for that flow next next slide please
[0:46:42] Voice 4: okay so in conclusion um in conclusion we believe that what we're proposing is reasonable sensible
[0:47:00] Voice 4: and achievable um this would responsibly bring uh 3307 into compliance with the bylaw the rights of
[0:47:09] Voice 4: the cases for property owners would be respected and so would the galliano community there'd be
[0:47:14] Voice 4: nothing to abolish the cottage would be transported off the property the wall of his
[0:47:19] Voice 4: these are solutions are obvious and affordable and the cost of doing it would be less than the
[0:47:33] Voice 4: the appreciation in the last year.
[0:47:37] Voice 4: And if I were, I'd just like to say
[0:47:39] Voice 4: that the existing property owners
[0:47:42] Voice 4: did correct the violations prior to selling.
[0:47:45] Voice 4: It's a mess.
[0:47:46] Voice 4: Please do the right thing.
[0:47:48] Voice 4: I would stress, please enforce your bylaw.
[0:47:51] Voice 4: It's in the interest of the public, the environment,
[0:47:54] Voice 4: and the property owners.
[0:47:56] Voice 4: Please do what's right.

[0:49:32] Voice 5: application for a development variance permit for the sighting of a proposed dwelling the sighting
[0:49:39] Voice 5: in height of an existing accessory building and the sighting of proposed structures a septic field
[0:49:46] Voice 5: and a rainwater storage tank for the property on Gossip Island.
[0:49:53] Voice 5: The property owner is proposing to build over roughly a 500-square-foot dwelling
[0:50:00] Voice 5: that would be located on approximately the same foot as where a previous cabin was placed
[0:50:07] Voice 5: for approximately 100 years.
[0:50:10] Voice 5: Due to not trying to remove any trees on the property, they'd like to retain that plot
[0:50:18] Voice 5: for the proposed dwelling.
[0:50:20] Voice 5: In order to do that though, some variances would be required for the dwelling unit.
[0:50:25] Voice 5: That would be to bury the interior lot line for the proposed house.
[0:50:31] Voice 5: A water cistern would also be next to the house and the cistern siding would also need a variance.
[0:50:41] Voice 5: There is a new septic disposal system proposed which has been designed by a licensed installer.
[0:50:49] Voice 5: dollar. And they're also requesting a variance of reducing the 30 meters set back the natural
[0:50:57] Voice 5: boundary of the sea to 22 meters. There is an existing accessory building on the property.
[0:51:05] Voice 5: The property owners would like to retain that building. Currently, I believe they are going
[0:51:11] Voice 5: to be living in that building while they build their new dwelling. When the new dwelling is
[0:51:17] Voice 5: is built they'll convert that building back into an accessory use so they'll take out any
[0:51:22] Voice 5: um like if there's a kitchenette or what uh what have you um because this will be considered a
[0:51:30] Voice 5: accessory building uh the structure is actually over height so there'll be a variance for height
[0:51:35] Voice 5: and as well as siting as well um let's see here so staff have um oh i should mention one thing
[0:51:45] Voice 5: or notification completed and we received one piece of correspondence and that was in support
[0:51:50] Voice 5: of the application so staff are recommending approval for the development variance permit
[0:51:56] Voice 5: based on the fact that the rationale for the variances are reasonable the impacts of the
[0:52:01] Voice 5: neighboring properties are minor and the placement of the dwellings or the accessory buildings where
[0:52:09] Voice 5: they are going to be placed would actually um reduce or really limit injury so
[0:52:15] Voice 5: there all
[0:52:17] Voice 5: are also alternatives the ltc can consider and that's on page 39 of the agenda the ltc may
[0:52:25] Voice 5: request further information from the applicant the ltc may request to amend um the permit and then
[0:52:32] Voice 5: to approve it the ltc also has the um the option to deny the application but staff are making the
[0:52:42] Voice 5: recommendation that the ltc approve issuance of gldp 2024.1 and that's a page down on page 34
[0:52:51] Voice 5: of the agenda and then the applicant is here as well the ltc

[0:53:12] Voice 4: My wife and I have been coming to Gallaudet for at least 40 years, before it was camping
[0:53:19] Voice 4: trips and cycling trips, and then about 10 years ago we had to find a little audio on
[0:53:28] Voice 4: uh since then for about 10 years we've been coming there with their little tips they were really
[0:53:33] Voice 4: little and finally another 10 years bigger um we're pretty familiar with the conditions on
[0:53:39] Voice 4: the lot there year-round weather and animals plants um you know it's not always benign out
[0:53:45] Voice 4: there because i don't remember the big windstorm a few years back well two fairly giant trees came
[0:53:50] down there are a lot out there and actually one of them totally corrupt a little pattern
[0:53:54] and our neighbors in the u.s and some also smashed the historic structure that was there
[0:53:59] so um
[0:54:02] Voice 4: so we we had fun bouncing back from that um we tried to be pretty light on the
[0:54:09] Voice 4: way when we were there so we brought a split power we pretty much currently
[0:54:15] um although in order to get our application from crd we decided that it would just be more
[0:54:21] straightforward it's uh because i don't help this
[0:54:24] Voice 4: used to dealing with the traditional septic systems
[0:54:27] Voice 4: that's why we're putting the sentences um and maybe at another later for the place uh we plan
[0:54:34] Voice 4: to build it mostly on our own um my hands won't be a lot of people and uh it's going to be really
[0:54:41] Voice 4: long stuff like this also reduces the amount of material that we have okay
[0:54:53] Voice 4: get a good seat there okay trustee is collecting this board staff to get out with that yeah one
[0:55:01] Voice 4: uh question here on page 49 from the engineers um semantics for the septic dual um and then on page
[0:55:12] Voice 4: uh on the what is it sorry the site plan figure two it has the dream field in uh two different
[0:55:18] Voice 4: locations yeah that's something oh should i address it

[0:55:32] Voice 4: of the training field has moved around a little bit as we uh adjusted to various things the most

[0:55:44] Voice 4: used to vote on our plans and they didn't like the fact that we were going to run a very accepted
[0:55:50] Voice 4: decline up along uh not either property or anything but it was going to be within the
[0:55:56] Voice 4: six meter setback and they were concerned about that we would damage groups of trees on their
[0:56:01] Voice 4: property which might make them more likely to fall down which were all very sensitive
[0:56:04] Voice 4: um and so in response to that i i routed it completely away and out of the setback region
[0:56:12] Voice 4: so it wasn't an issue but that just meant moving the the drain field to a different spot and that
[0:56:18] Voice 4: was
[0:56:18] Voice 3: kind of something that went down after
[0:56:20] Voice 4: my initial application so i don't think the plans
[0:56:25] Voice 4: have been updated but that's it's um yeah that's why yeah

[0:56:56] Voice 4: i've been over exhausted many many times i know this piece of property and i really appreciate
[0:57:00] Voice 4: that a lot of the planning has gone into minimizing removable trees and and trying to

[0:58:52] Voice 5: to this memo and the applicant states that there's been no changes to the original DTP
[0:59:02] Voice 5: application and is resubmitting this application for the LTC's review and consideration.
[0:59:08] Voice 5: In the letter, the applicant has responded to some of the concerns submitted by the neighbours
[0:59:15] Voice 5: and has also provided a certified septic inspection letter.

[1:02:05] Voice 4: In fact, my fiduciary duty to the beneficiaries as executor requires that I sell the property.
[1:02:13] Voice 4: I applied for a permit for the location of the septic field and a permit for the retaining walls that protect it.
[1:02:21] Voice 4: Initially, the adjacent neighbours did not support the variance for the septic field,
[1:02:25] Voice 4: and one neighbour adamantly opposed it, fearing collusion of lodging partners.
[1:02:32] Voice 4: But in the March 25th Impact Assessment Report, all the adjacent neighbours, as well as the one who adamantly opposed it, now approve its location.
[1:02:44] Voice 4: This kind of flip-flop kind of reminds me of that old lawyer joke,
[1:02:48] Voice 4: I have some principles, but if you don't like them, I have others.
[1:02:52] Voice 4: The report, in recommending removal of the septic retaining walls, suggested that care
[1:02:58] Voice 4: be taken not to disrupt the existing sewage.
[1:03:02] Voice 4: How do you remove protected retaining walls and not destroy the septic field in the process?
[1:03:11] Voice 4: The report says that returning the land to a natural state would be a sensible and easy
[1:03:17] Voice 4: process.
[1:03:19] Voice 4: It's a fantasy to believe that dismantling the structures that protect Montague Harbour
[1:03:24] Voice 4: would not destroy the septic field.
[1:03:28] Voice 4: As everyone knows, retaining walls are a common solution to stabilize steep slopes,
[1:03:33] Voice 4: and the existing walls create a bigger absorption field,
[1:03:37] Voice 4: which further protects magic and hardwood.
[1:03:40] Voice 4: The report's recommended solution is to tear out the retaining walls,
[1:03:46] Voice 4: destroy the existing septic field, return the land to steep slope high hazard,
[1:03:52] Voice 4: then build a new septic system in exactly the same location,
[1:03:57] Voice 4: but failed to protect quantity carbon.
[1:04:00] Voice 4: My question is, is this what the adjacent property owners mean by doing what's right?

[1:04:40] Voice 4: 10 years after the fact?
[1:04:42] Voice 4: The legal principle for this is buyer be ready.

[1:10:53] Voice 4: public rail that criteria invites comparison with the basis on the west side property island held's
[1:11:04] Voice 4: record of the 2012 installation of the sewage disposal system the new septic system is a
[1:11:11] Voice 4: location is within the seven and a half meter setback that we have let's think about that
[1:11:19] Voice 4: permit a 12-year-old septic system in the same field as a previous septic system less than seven
[1:11:26] Voice 4: and a half meters from ontario harbor and that septic field reached the end of life when was
[1:11:33] Voice 4: that last when was that cut the field last time i didn't find a variance permit for that setback
[1:11:41] Voice 4: On the east side of the property, Island Health has confirmed that they have a record of the
[1:11:49] Voice 4: set-up on the property.
[1:11:52] Voice 4: What waste management system are they using?
[1:11:55] Voice 4: There's a water course along the east boundary of that property that's set up to clean
[1:12:00] Voice 4: the property.
[1:12:02] Voice 4: The exit area is plainly visible here.

[1:12:06] Voice 4: that isn't causing pollution?
[1:12:12] Voice 4: Mr. Chair, there are three properties side by side that deal with waste management

[1:12:35] Voice 4: septic system with no retaining walls, offering additional protection.
[1:12:39] Voice 4: The Appleton septic system, protected by retaining walls and recently inspected by a certified
[1:12:44] Voice 4: practitioner, reported that the field looks to be in bad condition.
[1:12:50] What have the adjacent property owners done to maintain the base management system and
[1:12:57] Voice 4: serve the public interest, which is referenced in this theory here?
[1:13:06] Voice 4: Members of the LTC, the adjacent property owners recommend you downgrade the system on the applicant's property by destroying the retained wall and building a new septic system in exactly the same location in a steep slope high out of the building.

[1:15:46] Voice 5: that and determine if there's certain aspects that you can agree on or that certain aspects
[1:15:52] Voice 5: that perhaps you're not comfortable with and you need removed from the permit itself

[1:16:42] Voice 4: the optic hypnosis. In the neighbors presentation, they did make some recommendations. One was
[1:16:53] Voice 4: to approve the variance for the dwelling. The second was to, upon removal of the roof
[1:17:00] Voice 4: of the woodshed, to approve a variance for that portion and to approve the variance for
[1:17:07] Voice 4: the septic field. So I appreciate that we did make headway. I mean, I think it was time
[1:17:12] Voice 4: time well spent. I think in correspondence with the applicant, we see that they have
[1:17:23] Voice 4: talked about removing the bump out on the accessory building. I believe that would bring
[1:17:27] Voice 4: the accessory building into compliance because it was built with a permit. I think it's the
[1:17:30] Voice 4: bump out that makes it within the setback. So if the bump out was removed on the accessory
[1:17:36] Voice 4: building, then we could leave that. I think it would follow the variance at that point.

[1:18:41] Voice 4: comes for a new dwelling and a lot of these issues that you that were talked about they're dealt
[1:18:48] Voice 4: they don't have any choice you're buying fulfillment a permit for a new
[1:18:52] Voice 4: dwelling and those things exist on the property you have to deal with them
[1:18:59] Voice 4: I'm prepared to pass a variance for the septic field, the house, and the woodshed.

CALL TO ORDER Chair Peterson called the meeting to order at 1:00 p.m. He acknowledged that the meeting was being held on the territory of the Coast Salish First Nations. 2. APPROVAL OF AGENDA By general consent, the agenda was approved as presented. 3. TRUSTEE REPORT Trustee Gauvreau provided a report that acknowledged the April 9 th anniversary of Vimy Ridge Day as well as the accomplishments of former Lieutenant Governor Iona Campagnolo. Trustee Gauvreau also commented on recently held Trust Council and Governance Committee meetings she attended and noted a desire to make the Trustee office a more vibrant meeting place. Trustee Mabberley acknowledged Bill Campbell and Joanne Mackay, and provided updates on the provincial Secondary Suite Incentive Program and correspondence regarding parking at Montague Harbour. 4. CARRIED 15.2 GL-DVP-2023.5 (Scoones) - Staff Report On behalf of Planner Belcher, Island Planner Stockdill reviewed the staff report related to GL-DVP-2023.5 (Scoones). Discussion was held that raised questions about why these meetings were not being funded by the whole Trust area since the proposed discussions could benefit all Southern Gulf Islands.
