[0:02:54] Voice 5: So this is for 5706 Canal Road, Sandra and Chris Tredick,
[0:02:59] Voice 5: and the proposed variance is a height variance for an accessory building,
[0:03:03] Voice 5: and that's proceeding ahead of a purchase of a used engineered steel building,
[0:03:10] Voice 5: preliminary plan review, and a building permit application.
[0:03:14] Voice 5: The specific variance to the land use bylaw is for Section 3.43,
[0:03:19] Voice 5: which states that an accessory building may not exceed 4.6 meters in height,
[0:03:24] Voice 5: and that would be varied to a maximum of 6.7 meters to permit the construction of an accessory building,
[0:03:32] Voice 5: and that would have a maximum floor area of 232 meters squared there was a
[0:03:38] Voice 5: rationale provided by the applicants who I believe are in attendance as well and
[0:03:43] Voice 5: that is to allow for a building with sufficient height to provide the inside
[0:03:47] Voice 5: storage on their property for their collection of vehicles and equipment
[0:03:52] Voice 5: some of which are over height and these are currently stored off island at a
[0:03:57] Voice 5: significant cost and inconvenience and also as i stated they intend to purchase a used
[0:04:04] Voice 5: engineered steel building so the current height maximum limits their options in that market
[0:04:10] Voice 5: the property is 8.91 hectares in size and this proposed siting which is shown in the in figure
[0:04:19] Voice 5: two on the staff report and as part of the actual variance is approximately 300 meters from any
[0:04:25] Voice 5: adjacent neighboring dwelling and the closest property boundary is 80 meters further the
[0:04:32] Voice 5: topography and vegetation make that the proposed building site is unlikely to be visible from any
[0:04:38] Voice 5: neighboring dwellings staff undertook the required neighbor notification and had no response the
[0:04:45] Voice 5: applicants provided two letters of support from the directly adjacent neighbors to the east and
[0:04:50] Voice 5: west and those were attached to the staff report um the our recommendation or staff's recommendation
[0:04:58] Voice 5: is to support the variance as the rationale for the variance is reasonable impacts on neighboring
[0:05:04] Voice 5: properties from approval would be minimal the variances don't challenge the intent of the
[0:05:10] Voice 5: regulation and there has been no response to notification and we have two letters of support
[0:05:15] Voice 5: and that's my summary thank
[0:05:18] Trustee Maude: you very much so trustees you have any questions of the plan or

[0:05:23] Trustee Morrison (probable): no questions i do have a comment on this one so um this maybe it is a question
[0:05:29] Trustee Morrison (probable): actually um brad from what you just said but from my understanding of the property
[0:05:32] Trustee Morrison (probable): the landing is up top there and then the road goes down below and it would be just as you start
[0:05:38] Trustee Morrison (probable): to get down below the landing and behind like underneath the landing so you wouldn't see it
[0:05:43] Trustee Morrison (probable): when you're looking from the road you look over top of the landing and the building would be
[0:05:46] Trustee Morrison (probable): below it is that correct so

[0:06:02] Voice 5: closer to the road and more visible this is on a bench below and quite indistant as it's completely

[0:06:12] Voice 5: i i did a site visit i couldn't
[0:06:15] Voice 5: quite see the school the the applicants uh and there's the pictures do sort of indicate that
[0:06:19] Voice 5: it's not but um again maybe the applicants could comment on that so i i i understand your question
[0:06:26] Voice 5: because the school is to the south and west and sorry south and east and um i don't recollect
[0:06:35] Voice 5: seeing the school and the photos don't indicate that so I don't know
[0:06:39] Trustee Morrison (probable): if we can promote the
[0:06:40] Voice 5: applicants and maybe they could answer that question
[0:06:43] Trustee Morrison (probable): Sandra here and my my question is not
[0:06:46] Trustee Morrison (probable): so much a concern if it's visible from the school just that Sandra maybe if you just want to if you
[0:06:51] Trustee Morrison (probable): have or if you can connect with the school so they're aware that you're putting a building
[0:06:55] Trustee Morrison (probable): there just to make sure that there's like kids are monitored in that edge of the school grounds

[0:07:02] Voice 7: it's it's a really marshy area between like right at the corner where like our property
[0:07:08] Voice 7: joins abuts the school by about a meter or two meters of property line um and it's it's a marsh
[0:07:15] Voice 7: and it's wet most of the year in there so i mean the neighbors to our south have um they they're
[0:07:25] Voice 7: the ones who had the school put up a fence along the property line because the kids were going into
[0:07:31] Voice 7: to the their property but they we've never seen kids in our property at all and where the building
[0:07:36] Voice 7: would be situated it it's it's kind of tucked in it would be tucked in closer to the the tree line
[0:07:46] Voice 7: so it would be like a really sharp angle from that corner of the school property to even like
[0:07:53] Voice 7: I doubt it would be seen unless all the trees were cleared that are in that area okay

[0:08:41] Voice 9: sandra a little bit uh the other day yeah it's like it's pretty pretty much a prime prime spot
[0:08:47] Voice 9: to put something like that and and it to have no effect on anybody else so yeah

[0:09:22] Trustee Maude: so we'll move on uh to mpdp 2018.5 pciss um staff report who's up for that chair maude that's
[0:09:36] Voice 5: me again thank you so um this is a development permit application um for the pender island
[0:09:47] Voice 5: and community services society and it's for a new new to you um facility and um sorry uh
[0:09:58] Voice 5: just so you're aware uh karen hillel of hillel architecture who's the applicant and manfred
[0:10:03] Voice 5: barrett uh of the picss are both in attendance i believe uh to speak to the application uh so
[0:10:12] Voice 5: this has actually been a long road which stretches back eight years with an initial rezoning
[0:10:19] Voice 5: application and then a subsequent subdivision and we're now at the final step with this application
[0:10:24] Voice 5: a dp application which with approval will finish the island's trust involvement
[0:10:30] Voice 5: the property was donated by the driftwood mall and it's located on the newly zoned and subdivided lot
[0:10:37] Voice 5: lot directly south of the mall and the proposal as I said was for a new new to you facility
[0:10:42] Voice 5: and that's to replace the existing facility adjacent to the library. So the DP application
[0:10:48] Voice 5: is for commercial and industrial form and character and that's been made in advance of
[0:10:55] Voice 5: a preliminary plan review and a building any building permit application. In short it entails
[0:11:02] Voice 5: It entails the construction of a 565 square meter in area wood frame building with two wings that includes a retail space and a receiving, sorting, and warehousing area, the vehicle and pedestrian access via the driftwood mall to the north, parking for cars and bicycles, landscape of the development area of the property, the protection of an identified culturally modified tree,
[0:11:32] Voice 5: and signage and lighting. I'll note that there is a variance that's part of the development permit
[0:11:38] Voice 5: and that's to the maximum number of signs permitted on a business.
[0:11:44] Voice 5: PICSS hired Karen Hillel to act as the agent for this application and to undertake site and
[0:11:52] Voice 5: building design for the new facility to manage the application, building permit application
[0:11:57] Voice 5: and construction they've consulted with PIC SS volunteers and staff to derive
[0:12:04] Voice 5: the proposed plans over the past several months they submitted comprehensive a
[0:12:09] Voice 5: comprehensive application that included site building floor elevation plans
[0:12:15] Voice 5: landscape plan and cost estimate and civil engineering plans a detailed
[0:12:22] Voice 5: letter aligning their design approach and the response to the DP guidelines
[0:12:26] Voice 5: which includes or included a DP checklist and all of this has been
[0:12:32] Voice 5: attached to all the schedules have been attached to the draft DP staff's analysis
[0:12:39] Voice 5: of the design guidelines as part of the staff report and a checklist our
[0:12:44] Voice 5: checklist is also attached in summary the proposal conforms to the DP
[0:12:49] Voice 5: guidelines so one note that I would make is that early on in the process the
[0:12:55] Voice 5: rezoning process the malahat first nation conducted a site visit with staff and at that time they
[0:13:00] Voice 5: identified a culturally modified tree which i mentioned previously and at that the board at
[0:13:06] Voice 5: that time agreed to conditions for protection and maintenance or sorry ongoing protection and
[0:13:12] Voice 5: maintenance of the cmt and those were agreed to by the malahat and i'm pleased to say that the cmt
[0:13:17] Voice 5: has been treated with respect throughout the process and the conditions in the dp include
[0:13:23] Voice 5: include including the site and landscape and maintenance plans will ensure that that is
[0:13:27] Voice 5: protected into the future. So our recommendation is that the LTC approve issuance of the DP
[0:13:34] Voice 5: and that is because the proposed development is compliant with DPA guidelines and the proposed
[0:13:41] Voice 5: uses, siting and parking and signage including a variance to the sign regulations will conform
[0:13:46] Voice 5: form with the provisions of the LUB. And further, we're recommending that the variants be supported
[0:13:54] Voice 5: on the basis of the unique nature of the site and proposed facilities location relative to
[0:14:02] Voice 5: the roadway. And that's my summary.
[0:14:05] Trustee Maude: Excellent. Thank you very much. Trustees,

[0:14:14] Voice 9: I don't. I tried to come up with some,
[0:14:18] Voice 9: but i figured i'd get tart and feathered if i said anything new to you on pender island it'd
[0:14:24] Voice 9: be the end of you i
[0:14:27] Trustee Morrison (probable): have one question just a little bit more generally about the driftwood
[0:14:31] Trustee Morrison (probable): because i know the driftwood itself has um still open development doesn't it like on uh
[0:14:36] Trustee Morrison (probable): yeah and so one of the conditions of that which i think is also a part of this if i'm reading
[0:14:41] Trustee Morrison (probable): correctly is roadside landscaping and all the landscaping for the driftwood hasn't been fully
[0:14:49] Trustee Morrison (probable): finished like related to where the parking or like and I know that's partly because there's
[0:14:53] Trustee Morrison (probable): still development going on is there a timeline for that type of landscaping to be done
[0:14:59] Voice 5: not really
[0:15:01] Voice 5: because they've the driftwood of course have taken a phased approach so they've been incrementally
[0:15:07] Voice 5: building as they go and that the adjacent area the parking area is is has some minor landscaping
[0:15:15] Voice 5: associated with it but not they haven't completed their landscaping and presumably that won't
[0:15:21] Voice 5: be done until the development is fully um completed or potentially in the in the near
[0:15:29] Voice 5: future but there's no mechanism other than by application and a similar application as this
[0:15:36] Voice 5: which I will note I didn't mention in my summary is that they will have to amend their DP based on
[0:15:43] Voice 5: the access that's been proposed here because that actually shifts or removes at least one parking
[0:15:47] Voice 5: spot but and our understanding from from the Driftwood Mall from Hardell management is that
[0:15:55] Voice 5: they will be making an amendment to their or sorry amendment application to their DP in the near
[0:16:01] Voice 5: year future because there are some uh some of the the um as builds of more recent uh development
[0:16:08] Voice 5: don't conform to what the dp says so that would be an
[0:16:12] Voice 5: opportunity there to to um re-look at the
[0:16:17] Voice 5: landscaping and get a more firm schedule on that
[0:16:20] Trustee Morrison (probable): okay and i i have talked sometime this spring i
[0:16:24] Trustee Morrison (probable): don't remember when exactly but i i did talk with dorothy a little bit about like their overarching
[0:16:28] Trustee Morrison (probable): plan there so um yeah that's just always my concern is like i know that there's no real
[0:16:34] Trustee Morrison (probable): timeline like attached to these and it's a bit of an issue i think the new to you is like you
[0:16:39] Trustee Morrison (probable): know sensitive to and maybe karen can speak to this but they're sensitive to the you know
[0:16:44] Trustee Morrison (probable): community's concerns which i've had restated over the last six years to me time and time again
[0:16:48] Trustee Morrison (probable): about the landscape and getting finished at the driftwood so um just to be aware of that
[0:16:54] Voice 5: yeah and there is um as you've probably seen as part of the report and part of uh is there's a
[0:17:03] Voice 5: comprehensive landscaping plan and there's a substantial um cost to that which is protected
[0:17:10] Voice 5: by security which is a requirement before we issued the dp uh so that's just taken as a deposit
[0:17:16] Voice 5: closet um and yeah so that that's the actual mechanism through a dp that we can use to um
[0:17:23] Voice 5: ensure that the deep the landscaping gets completed in a timely
[0:17:28] Voice 5: fashion yeah okay
[0:17:29] Trustee Morrison (probable): and i know that the
[0:17:30] Trustee Morrison (probable): when the driftwood's working on it like i can see that they've done a lot over the years but
[0:17:35] Trustee Morrison (probable): it's
[0:17:35] Voice 5: just yeah it has we we have um we've tried it's been somewhat challenging because there
[0:17:44] Voice 5: there there's been a lot of different architects i think some landscape architects and some
[0:17:51] Voice 5: others that have been involved in the landscaping of the driftwood so and it's been we've sort of
[0:17:58] Voice 5: pushed and pulled a bit and you know haven't necessarily gotten too far with that okay

[0:18:05] Voice 9: just as a current they've actually been they've got a couple of extra people hired right now
[0:18:11] Voice 9: specifically doing landscaping and freshening up the dirt road
[0:18:16] Voice 9: right now so yeah

[0:20:03] Trustee Maude: I do struggle with the reasoning for this, but no, this is a very straightforward update
[0:20:10] Trustee Maude: to our land use bylaw.
[0:20:12] Trustee Maude: It's a little bit of editing here, a little add there.
[0:20:16] Trustee Maude: It's nothing of any particular substance if you go through it.
[0:20:22] Trustee Maude: It's just one of those normal housekeeping things.
[0:20:25] Trustee Maude: Maine tends to do this about every year or two.
[0:20:28] Trustee Maude: we just we keep a little added little list of stickies with the planter and when the pile gets
[0:20:34] Trustee Maude: high enough we just do a quick little update to land use biologists to to bring things up to speed
[0:20:39] Trustee Maude: as things come across our tables and that's what this is so does

[0:20:48] Trustee Maude: well well i guess we all face pender but um

[0:20:56] Trustee Maude: not think of anything that in any way would possibly um directly or indirectly um affect
[0:21:05] Trustee Maude: north pender because as i said it's all basically housekeeping stuff okay

[0:21:11] Trustee Morrison (probable): aren't on the like slope facing pender well
[0:21:14] Trustee Maude: well contractor yards we've we've opened that up to
[0:21:17] Trustee Maude: basically we only had one property that was that could be a contractor's yard on on main island
[0:21:23] Trustee Maude: that was a lumber yard and of course
[0:21:25] Trustee Maude: we have lots of contractors who are electricians plumbers
[0:21:29] Trustee Maude: excavators all that so what we've done is we've opened it up um so on properties of i believe it's
[0:21:36] Trustee Maude: an acre or less um we we say that you can you can be there with with your van with your stuff
[0:21:42] Trustee Maude: we limit i believe is to 350 square feet of utilization on the property uh for a contractor
[0:21:48] Trustee Maude: yard so that i can't imagine being of any effect the larger properties i believe five acres and
[0:21:55] Trustee Maude: above um we basically we've opened it up but again uh like a dump truck in amongst 50 acre farm
[0:22:03] Trustee Maude: i don't think it's going to have an effect on anybody from north pender never mind our community
[0:22:09] Trustee Maude: so what basically what we're trying to we're trying to sort of legitimize and legalize
[0:22:14] Trustee Maude: um what it was literally probably over 100 operators who right now are falling outside of
[0:22:20] Trustee Maude: the um the bylaws we're we're trying to make it work for the community and so far it's been very

[0:24:10] Planner: discussion during your uh this presentation um so they're looking to create uh a individual
[0:24:20] Planner: uh sleeping quarters at each of the fire halls uh each unit uh on page 77 and uh 78 of your 76
[0:24:31] Planner: and 77 in your report you can see the siding location and the sample floor plan of the
[0:24:37] Planner: structures each structure would house two emergency service workers with a bedroom
[0:24:43] Planner: and a shared bathroom facility would be hooked to septic and water at each of the halls
[0:24:50] Planner: staff have no real concerns the sighting as you can see in figure two both located behind the
[0:24:57] Planner: hall fire hall one is of course practically not visible from the roadway anyways and
[0:25:03] Planner: And Fire Hall 2 and Magic Lake, the structure will be sited right in behind the hall, so it will be not visible from the road.
[0:25:10] Planner: Staff have visited both sites, don't see any issues with the siting, any issues with neighbours.
[0:25:17] Planner: We've had no response from the neighbourhood with respect to the notice sent out.
[0:25:23] Planner: and uh with that uh there there is a requirement uh for two parking spots to be consistent with
[0:25:32] Planner: your land use bylaw and uh other conditions in the permit to limit impact but i think this is
[0:25:39] Planner: a really positive thing for your community and starts to move you towards addressing
[0:25:44] Planner: you know some of your housing uh challenges um and uh with that in mind there is an opportunity
[0:25:52] Planner: potentially as a temporary use permit is really meant to be, you know, a tool to assess the
[0:26:01] Planner: reasonableness over use. This will give the LTC and the applicant the opportunity to see how
[0:26:07] Planner: effective and functional these structures are. And you could potentially look at rezoning them
[0:26:12] Planner: as part of your housing project as opposed to requiring the fire department and the society
[0:26:21] Planner: to apply through rezoning.

And I'm not saying that that's a negative to this particular thing, but I know that the questions will come about how we can approve something like this or can they have an approval of their own for a tiny house or some kind of pod type living accommodation.
[0:27:22] Voice 9: So I'm just, yeah, I'm curious to see how this process goes out, because I think that lots of people will want to know information on what is happening there as they see it, as they see it happen.
[0:27:36] Planner: That could certainly be part of your discussion in your project around, you know, accessory dwelling units and what form those take and maybe where, what areas or what requirements, you know, for example, requiring septic and water.
[0:27:53] Planner: in those units so you you know are ensuring that those you know basic services are being met and
[0:28:00] Planner: and are available but certainly as you go forward in your housing project I would think that that
[0:28:08] Planner: would be a big part of the broader conversation and maybe here's an example of an approach that
[0:28:15] Planner: can probably work pretty well in particular because they have septic and water there
[0:28:20] Planner: i do think it's a little bit different in this case that you do have a non-for-profit society
[0:28:25] Planner: and you know the the emergency service
[0:28:28] Planner: uh you know is such a critical i know of course as we
[0:28:33] Planner: all are aware there's such a critical service for your community it's a little bit different
[0:28:36] Planner: than a private property owner but it can certainly
[0:28:39] Planner: help to feed into that conversation and i see mike

[0:29:41] Planner: it gives an immediate you know benefit to your community in having these
[0:29:46] Planner: these housing structures in place definitely go

[0:30:01] Voice 12: with the building department.
[0:30:04] Voice 12: And they're struggling with it as well on the same premise.

[0:30:09] Voice 12: you know, how can they not allow it in a residence?
[0:30:14] Voice 12: And so where they came to was they're requiring me,
[0:30:20] Voice 12: us, I shouldn't say me,
[0:30:21] Voice 12: but they're requiring the society
[0:30:24] Voice 12: to acquire a building permit
[0:30:26] Voice 12: for the positioning of the building and in that permit they're requiring uh the structure to
[0:30:34] Voice 12: meet the csa requirements um which is quite demanding not every manufacturer can actually
[0:30:45] Voice 12: do that you know that has to be certified so it's a pretty major requirement for the structure that
[0:30:53] Voice 12: would sort of separate people you know right away just in terms of safety and um security for the
[0:31:01] Voice 12: building um so i thought it was a reasonable compromise for them to demand that of us you
[0:31:09] Voice 12: know we are you know public safety is our first concern so it really should be you know applied
[0:31:16] Voice 12: to our our dormitories you know so anyway i just thought i'd tell you that that's where they're
[0:31:21] Voice 12: headed it seems uh dealing with and then the other aspect is that uh as you mentioned we are not um
[0:31:31] Voice 12: we're not a business like we're not in this to make we're not making money off these structures

[0:34:08] Planner: have septic and water uh right there and connecting easily connected that makes our
[0:34:15] Planner: our recommendation really easy to land on.

[0:34:25] Planner: and even when we get to the housing project,
[0:34:27] Planner: I think those two things really need to be front and center

[0:35:14] Trustee Maude: um it's um i i um it seems most ltcs are very sympathetic and very open-minded towards any
[0:35:22] Trustee Maude: sort of um expansion of residential uses so you know it's it's it's out there and but most
[0:35:29] Trustee Maude: certainly this one is special um it is definitely for the benefit of the community now as a whole
[0:35:37] Trustee Maude: whole it is a non-profit society so um i i'm not surprised nobody's saying anything negative
[0:35:44] Trustee Maude: because it is a very positive project in my opinion yeah so if there's nothing else somebody

[0:36:43] Trustee Morrison (probable): housing versus how other property is being used for housing so we have to be a little bit careful

[0:36:51] Planner: the best way to frame that would be like this in the fire in the
[0:36:54] Planner: fire uh uh hall's case it's an accessory use to the yeah to

[0:37:01] Planner: services and if those workers aren't sleeping there they're sleeping somewhere else on the
[0:37:06] Planner: island that night right so that's where your density doesn't versus you know creating a a
[0:37:11] Planner: little tiny house next to yours where then you're renting and of course that's solving another
[0:37:16] Planner: problem but it's a different thing you're right yeah

[0:41:22] Planner: you have a request for variance for three structures.
[0:41:27] Planner: The primary dwelling, there's currently on the property
[0:41:31] Planner: an existing primary dwelling, an existing cottage,
[0:41:34] Planner: and several outbuildings both the primary dwelling in the cottage in this
[0:41:39] Planner: case would be replaced and replaced with a new primary dwelling a new cottage and
[0:41:46] Planner: there's also a proposal for a an accessory studio games games room kind
[0:41:53] Planner: of building so in this case staff are recommending that the LTC can consider
[0:41:59] Planner: that are not approving the variance for the primary dwelling,
[0:42:04] Planner: given the size of the house is significantly larger
[0:42:08] Planner: than the new house floor area limits
[0:42:12] Planner: that were just established by the LTC in 2023
[0:42:17] Planner: through your land use bylaw project of 4,500 square feet.
[0:42:24] Planner: And staff are recommending that you consider approving
[0:42:29] Planner: the variance to the cottage which is approximately a thousand feet over the allowable thousand
[0:42:36] Planner: square foot size and a height variance for the accessory structure which will be tucked well
[0:42:45] Planner: back into the property away from the view of any neighbors or sight lines staff also have
[0:42:53] Planner: concerns with the primary dwelling around potential impacts to sight lines and uh
[0:42:58] Planner: tree removal and vegetation removal uh required to site the uh house that's proposed uh with
[0:43:08] Planner: respect to the cottage uh it's largely being uh built on existing footprint and the size of the
[0:43:18] Planner: the variance while large you know 2,000 square foot structure is a moderate size versus the
[0:43:25] Planner: proposed size of the house which is 11,700 square feet 270 percent above your 4,500 square foot
[0:43:36] Planner: maximum and with that there are OCP policies around limiting house sizes to maintain and
[0:43:49] Planner: preserve the rural character of uh north pender i think that's where staff really struggled with
[0:43:55] Planner: this recommendation around whether to uh approve the house size or not uh we went back and forth a
[0:44:04] Planner: lot uh i think the impacts are relatively minimal to the adjacent properties in that it's a really
[0:44:11] Planner: really big lot. And, you know, those direct impacts are not there, but the house is sited
[0:44:20] Planner: right on the edge of Razor Point. There would definitely be visual impacts from the marine
[0:44:26] Planner: environment and likely adjacent houses as well. I
[0:44:32] Planner: think that I'll just pass it back to the chair
[0:44:35] Planner: and to the applicants at this point with any questions you might have in the staff report
[0:44:40] Planner: rather than go through it with any further detail.
[0:44:42] Planner: I should say also the applicant has had a First Nations cultural advisor visit the site
[0:44:51] Planner: and they had no particular concerns with existing archaeological sites or concerns.
[0:44:59] Planner: And there is a letter in your package from that cultural worker.
[0:45:05] Planner: worker. There was no input received from the DVP notice. I will admit I made an error in the notice
[0:45:14] Planner: in the first notice that was sent out. The house size was indicated as much smaller. So staff
[0:45:21] Planner: reissued notice and there was no response to that reissued notice or the first one. So there's been
[0:45:28] Planner: no concerns or uh or any input from the community uh received uh with respect to the statutory

[0:49:27] Voice 6: approach uh building here on site um sensitively um i wanted to understand the process and so in
[0:49:37] Voice 6: in that i mean with specific uh reference to deb to um to your question around you know not uh
[0:49:46] Voice 6: either subdividing brad mentioned rezoning trying to figure out how to build a bunch of homes um
[0:49:53] Voice 6: That is not my interest. I don't foresee that ever to be my interest. And so I did pursue with Brad and had a nice conversation with Robert, who I see is on the call as well, about, okay, well, how could I do that? How could I provide some assurances?
[0:50:08] Voice 6: Of course, we know that my neighbor to the north, and I don't know the whole story, but was a development which has recently been acquired in conservation.
[0:50:18] Voice 6: conservation um so i now abut conservation and then beyond that of course the winery
[0:50:24] Voice 6: i see myself being a pretty suitable um continuation of that land because
[0:50:31] Voice 6: i'm my use on it um my intended use on it is very light so i did ask the question around
[0:50:37] Voice 6: covenant conservation easement um etc and it led to this it led as brad just mentioned to this
[0:50:44] Voice 6: well okay why don't you apply for a rezoning and then you know maybe we're not setting precedent
[0:50:49] Voice 6: maybe we can you know have the zoning be very specific to razor point and what you want to do
[0:50:55] Voice 6: and then when i said sure tell me more and i started to sort of understand the timing that
[0:51:00] Voice 6: would be associated with that um i i just you know we just determined well i'd like to give
[0:51:06] Voice 6: those assurances i guess if you can't codify it uh it's just going to take too long which is why
[0:51:11] Voice 6: why we ended up in this process. So I remain very open to dialogue, diarizing, documenting my
[0:51:19] Voice 6: commitment to, you know, preserving the property in, you know, its relative natural state. And
[0:51:29] Voice 6: what I wanted to avoid was saying, okay, well, if we build a house of this size, which is conforming,
[0:51:35] Voice 6: or perhaps doesn't have the 270% number on it, okay, well, then I'm just going to want to
[0:51:40] Voice 6: subdivide down here and build another house the same size to 5000 square foot houses. And, you
[0:51:46] Voice 6: know, as we got into that, it just felt like administrative gymnastics, if I'm being honest.
[0:51:52] Voice 6: And so what we said was, let's identify the areas of least disturbance. You know, I guess one small
[0:52:00] Voice 6: editorial on Brad's comment that it's close to the point, there is a site over my shoulder,
[0:52:05] Voice 6: which is really close to the point, half the people that come here say, why wouldn't you apply
[0:52:08] Voice 6: to build your home down there right on the point which could be applied for and within setbacks
[0:52:15] Voice 6: and that wasn't the i don't think that's the right place and i think that you know ultimately
[0:52:20] Voice 6: we landed on let's build on the existing sites where the structures exist today to a because i
[0:52:27] Voice 6: think they're the right spots and b because it will require the least amount of disturbance and
[0:52:31] Voice 6: tree removal and so my intention again maybe being long-winded about it is to preserve the natural
[0:52:39] Voice 6: site as much as possible. Indeed, that's why I'm here. I don't believe that, you know,
[0:52:46] Voice 6: it's funny, I was surprised where the setbacks are. You can see how the existing house, which
[0:52:50] Voice 6: is totally conforming, sits compliant. The variance that we're applying for, I think,
[0:52:58] Voice 6: is a couple meters in places and is, you know, sort of decks and overhangs. So I don't believe
[0:53:03] Voice 6: that if you're a a sailor or something and going by in a boat from the water that it's going to
[0:53:10] Voice 6: look yes it's bigger but it's not gonna it's not all of a sudden you know hanging out over to the
[0:53:14] Voice 6: beach or something like that so um yeah yeah
[0:53:19] Voice 6: i guess to to circle back you know and that's kind
[0:53:22] Voice 6: of how we got here and not wanting to subdivide and rezone and build multiple houses multiple

[0:53:38] Voice 6: and if there was a path to do that that would give the trustees or the community more comfort

[0:54:24] Voice 9: conversations and understand more what a what an applicant was really looking to do or accomplish
[0:54:32] Voice 9: on their property and why they wanted to go bigger and and I've had an opportunity to go and
[0:54:37] Voice 9: and meet with joey and and speak on the phone a bit and uh and i you know i i don't believe that
[0:54:45] Voice 9: you you know in the discussion would want to build sort of your your home with 18 other houses
[0:54:56] Voice 9: surrounding it in a community type uh setting no no more than i myself would want to develop out
[0:55:02] Voice 9: my farm to be a subdivision of people that um I would get to see every day I I quite like seeing
[0:55:10] Voice 9: the trees and and whatnot out around me as opposed to somebody else's house so uh yeah I'm I'm uh

[0:58:22] Planner: subdivision so you could create a section 219 that says you can only create five lots here in
[0:58:27] Planner: the future instead of the 10 or you can only have the one lot you know whatever he whatever the
[0:58:32] Planner: applicant would be willing to agree to you could also have like a naptep covenant which uh you know
[0:58:37] Planner: you uh continue to own the entire portion and you separate a portion out where you you know agree
[0:58:44] Planner: through covenant to no development but all of those things take time and none of those things
[0:58:50] Planner: are can can be guaranteed today is the challenge with the variance versus going through a rezoning
[0:58:55] Planner: discussion which you know all of those things are arrived at through that process and so at the end
[0:59:01] Planner: of the day uh the applicant gets what they want in exchange for something tangible like a covenant
[0:59:07] Planner: that restricts future uh so i think it's really up to the trustees today to to if you to decide
[0:59:18] Planner: you you don't have any guarantees available today other than the the word of the applicant and so
[0:59:25] Planner: So that's up to you to decide what to
[0:59:28] Voice 9: do with that.
[0:59:29] Voice 9: I'm more thinking,
[0:59:30] Voice 9: I guess, future as we start to look at things like this.
[0:59:35] Voice 9: And I'm sure this won't be the last application that we have that comes up that is like this.

[0:59:45] Voice 9: But yeah, I don't see that as an option for this particular one right now.

[1:00:14] Planner: farthest to the east there is tree removal there required to build that and so the removal of those
[1:00:20] Planner: trees is a habitat impact it also is a visual impact to the marine environment when and so
[1:00:26] Planner: So you are going to have a massive house out on that point.
[1:00:29] Planner: It's hard to make a 12,000 square foot house look small.
[1:00:33] Planner: And so, you know, the staff struggled around the rural character question.
[1:00:40] Planner: But, you know, that's, it was not easy to land on that versus.
[1:00:47] Planner: I
[1:00:47] Voice 6: think, Brad, worth noting, and you guys have done a good job of diarizing this.
[1:00:52] Voice 6: I thought your recap, although it wasn't what I wanted to hear.
[1:00:56] Voice 6: In terms of your recommendation, I know you struggled with or wrestled with it because
[1:01:00] Voice 6: we've been in pretty active dialogue.
[1:01:02] Voice 6: A good portion of that is not visible because it's underground vis-a-vis a basement.
[1:01:10] Voice 6: The tree removal, sure, I concede, but I'm relatively speaking, relative to what I see
[1:01:17] Voice 6: driving around the island, I think the amount of trees that are, I'm not sure you could
[1:01:24] Voice 6: could count them on two hands, but not much more than that. I mean, we are working with the
[1:01:29] Voice 6: existing footprint here. We could certainly quantify that if necessary, but I would say it
[1:01:35] Voice 6: is very low touch on tree removal for the same reasons that Aaron identified as wanting to live
[1:01:41] Voice 6: in a place like this. You know, I'm not looking to clear cut this site. That's not the view that
[1:01:46] Voice 6: i want and um you know maybe uh porting that over to deb's query around um environmental
[1:01:54] Voice 6: sensitivity sustainability considerations of the house i certainly do not want to speak out of turn
[1:02:01] Voice 6: here because we are it might be slightly premature but i what i can say is that we've just hired an
[1:02:07] Voice 6: awesome sort of water consultant and mechanical that's getting engaged obviously we're kind of
[1:02:15] Voice 6: waiting to see where today goes in terms of of you know re-accelerating those conversations but
[1:02:21] Voice 6: deb very interested in all of the technology that's available um you know people ask me a
[1:02:27] Voice 6: lot about solar these days but i and i'm always musing why why they're not asking more about
[1:02:31] Voice 6: geothermal i mean i'm asking those questions of mechanical and systems um elizabeth who's on the
[1:02:38] Voice 6: on the line is far more intelligent than i am about this this is what she does from an architectural
[1:02:43] Voice 6: perspective but we are you know we as you know i hired ryzak early on geotech that's what gave us
[1:02:48] Voice 6: the comfort to increase the size or requested size of the the main home because when they got
[1:02:54] Voice 6: into it they said you're actually you're building a safer house from a seismic perspective if you go
[1:02:59] Voice 6: down and anchor foundation down so they supported the basement from a geotech perspective um but we
[1:03:05] Voice 6: We are asking all those questions, water catchment and storage, solar, geothermal.
[1:03:13] Voice 6: This morning, I was wondering if I overlooked a wind turbine because it was kind of kidding,
[1:03:18] Voice 6: but it was howling pretty good here this morning.
[1:03:21] Voice 6: So I don't know.
[1:03:23] Voice 6: Again, this is one of those things kind of like the conservation easement.
[1:03:27] Voice 6: Other than you looking at me and having met me and listening to me speak, it is difficult
[1:03:33] Voice 6: difficult uh to to codify this and and and you know put something in writing that's binding
[1:03:39] Voice 6: um not just on me but as you bring up a potential future owner um so i i don't really know what else

[1:05:59] Trustee Morrison (probable): don't like respect the process of trying to like have a bigger conversation. And so that was where
[1:06:05] Trustee Morrison (probable): a lot of that came from. I do feel like that you're working with this and like, just given
[1:06:11] Trustee Morrison (probable): the other things that, you know, I know about the work that you've been doing, like generally in the
[1:06:15] Trustee Morrison (probable): the world I do feel like that you have a solid conservation backing so I also understand the
[1:06:22] Trustee Morrison (probable): problem of timing like if we don't do it this way then you you may end up in a longer process to get

APPLICATIONS AND REFERRALS 6.1 NP-DVP-2024.2 (Tretick) - Staff Report Planner Testemale reviewed the staff report. Discussion was held and the following comments were made: The accessory building will be completely unobservable from the road The school should be notified that the building is being constructed NP-2024-043 It was Moved and Seconded, that North Pender Island Local Trust Committee approve issuance of NP-DVP- 2024.2 (Tretick). CARRIED 6.2 NP-DP-2018.5 (PICSS – Hillel Archit.) - Staff Report Planner Testemale reviewed the staff report. Discussion was held and the following comments were made: There was no timeline for landscaping at the Driftwood to be completed Management of the Driftwood had indicated they will be making an application to amend their Development Permit, and this would provide opportunity for the Local Trust Committee to develop a schedule for landscaping NP-2024-044 It was Moved and Seconded, that North Pender Island Local Trust Committee approve issuance of Development Permit NP-DP-2018.5 (PICSS - Hillel Arch.). CARRIED 6.3 Mayne Island Local Trust Committee Referral for Draft Bylaw No. 193 (for Response) Discussion was held and comments were made about how this is a straightforward update to the Land Use Bylaw that should have no effect on North Pender Island. NP-2024-045 It was Moved and Seconded, that North Pender Island Local Trust Committee interests are unaffected by the Mayne Island Local Trust Committee Draft Bylaw No. 193. Discussion was held and the following comments were made: Community members will want to know whether they can provide similar accommodations on their properties The Local Trust Committee can discuss what form accessory dwellings may take The Pender Island Fire Protection Society must acquire a building permit for the positioning of the structures, and the structures must meet demanding compliance, safety, and accountability requirements set by the Canadian Standards Association (CSA) The Pender Island Fire Protection Society is a non-profit society that is providing a public service Anyone can put forward an application for a Temporary Use Permit This is not an expansion of residential density because the sites are used by people who will not be living in them full-time Support was expressed for including both fire halls in the application The buildings are strategically placed so there is no further site or neighbourhood disturbance This application relates to a critical community service that affects everyone on the island The units will be certified at the CSA A227 level – classification that allows for year-round safe living space NP-2024-046 It was Moved and Seconded, That North Pender Island Local Trust Committee approve issuance of Temporary Use Permit NP-TUP-2024.5 for a period of three (3) years. CARRIED 6.5 NP-DVP-2024.3 (Houssian) - Staff Report Island Planner Smith reviewed the staff report. Discussion was held and the following comments were made: The cap on house size was not meant to totally restrict house size, but rather to open conversation with applicants about what would be happening overall on a property Concern was raised about density issues and the applicant, or future property owners, wanting to subdivide and build multiple dwellings The applicant noted it is not his intention to subdivide to build multiple smaller houses The Trustees do not have guarantees beyond the word of the applicant A Section 219 covenant could limit the subdivide density into the future Trustees indicated they expect the applicant to pursue a covenant on the property North Pender Island Local Trust Committee Special Meeting June 14, 2024 ADOPTED Page 4 of 5 The applicant identified an area of least disturbance for the site of the proposed new buildings, which is primarily where the existing structures lie The applicant expressed a desire to preserve the natural site as much as possible The applicant hired a water consultant and expressed interest in the technology available to build energy efficient houses The proposed buildings would have green roofs NP-2024-047 It was Moved and Seconded, that North Pender Island Local Trust Committee approve issuance of Development Variance Permit application NP-DVP-2024.3. CARRIED 7. CLOSED MEETING (Distributed Under Separate Cover) 7.1 Motion to Close the Meeting NP-2024-048 It was Moved and Seconded, that the meeting be closed to the public in accordance with the Community Charter, Part 4, Division 3, s. 90(1)(a)(g) for the purpose of considering: (a) personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; (g) litigation or potential litigation affecting the municipality;. CARRIED 7.2 Recall to Order 7.3 Rise and Report Chair Maude reported: The Minutes of the February 23, 2024 Local Trust Committee in-camera meeting have been adopted Carly Bilney has been appointed Secretary of the North Pender Advisory Planning Commission The Local Trust Committee has requested that staff advertise for members of the North Pender Advisory Planning Commission North Pender Island Local Trust Committee Special Meeting June 14, 2024 ADOPTED Page 5 of 5 8.
