[0:06:19] Trustee Luckham: exists on our Exenja at 13.5, that
[0:06:22] Trustee Luckham: we have recently entered into a protocol agreement with the Stanninas
[0:06:27] Trustee Luckham: and we're awaiting a formal signing of that
[0:06:31] Trustee Luckham: document. But that, I think, is something important to report
[0:06:36] Trustee Luckham: as their interests are significant
[0:06:39] Trustee Luckham: on the bolinas from chelsea islands so um i

[0:07:02] Trustee Luckham: was rather fortunate um uh about two weeks ago now um and it was just sort of a general round
[0:07:08] Trustee Luckham: table update talking about events that they are holding um primarily in the region qualicum
[0:07:16] Trustee Luckham: nanus area uh regarding the mountain irish smith biosphere region um um region
[0:07:25] Trustee Luckham: and they often meet in qualicum in person which is a difficult place to get to um from thetis
[0:07:34] Trustee Luckham: and particularly they start earlyish in the morning but they've got an office up there and
[0:07:38] Trustee Luckham: So that's where they're focused as opposed to being focused at the university in the NIMO previously.
[0:07:43] Trustee Luckham: So I certainly look forward to joining them in the future.
[0:07:47] Trustee Luckham: I was planning on going up to visit them to attend that meeting in person, but then it was cancelled and turned into electronic.

[0:08:33] Trustee Luckham: today and so we had some challenges all of us with getting into the meeting electronically so

[0:09:00] Trustee Luckham: you and nice to be in a conversation with respect to Mistaken Island. I have fond memories of
[0:09:06] Trustee Luckham: standing on Vancouver Island and looking out towards your island and doing scuba diving off
[0:09:11] Trustee Luckham: of the point there. And so it's certainly a lovely part of the world. But we have
[0:09:17] Trustee Luckham: development permit 2024.1 before us. And the process that we go through is we ask staff to
[0:09:26] Trustee Luckham: provide us a report and then the opportunity would be for you to speak to the report and if you have
[0:09:31] Trustee Luckham: any additional information and then we may have questions for staff about the report um or
[0:09:37] Trustee Luckham: yourself and um and then we'll have a discussion here about approving it or not um and um so if
[0:09:44] Trustee Luckham: that's all right with you do you have any questions well

[0:09:50] Voice 3: we'd be participating so uh we've been looking forward to this okay

[0:09:59] Trustee Luckham: on previous occasions you're still the original owners there that have been there for some years

[0:10:07] Voice 3: yeah yeah we've uh lived on the island for uh 26 years full time right
[0:10:12] Voice 3: and suzy uh she was born in 1956 and right around that time her grandmother bought the island so
[0:10:21] Voice 3: she's been here all her life amazing
[0:10:24] Trustee Luckham: thank you and so thank you for being with us today so i'll
[0:10:29] Trustee Luckham: turn to Planner Belcher, thank you, to summarize the report for us.
[0:10:39] Trustee Luckham: Thank
[0:10:39] Voice 2: you. So yeah, this is a new development permit application for Mistaken Island within
[0:10:45] Voice 2: the Bolinas and Chelsea Islands Local Trust Area, and the application is for the new construction
[0:10:51] Voice 2: and renovation of a single-family dwelling located within the shoreline development permit area.
[0:10:57] Voice 2: The application also requires a development variance permit for the setback to the natural
[0:11:03] Voice 2: boundary of the sea and the property is zoned residential and makes up the entirety of Mistaken
[0:11:09] Voice 2: Island and is 12.95 hectares or 32 acres in area. The 30 meter buffer area from the natural
[0:11:17] Voice 2: boundary of the sea makes any construction and land alteration required to receive a shoreline
[0:11:23] Voice 2: development permit. The specific building location was chosen to limit any tree and
[0:11:30] Voice 2: vegetation removal as the area has previously been disturbed. Three trees have been identified
[0:11:37] Voice 2: as danger trees and will need to be removed through the construction. The proposed to relocate
[0:11:45] Voice 2: the existing cabin and building the new structure 2.5 meters further from the natural
[0:11:52] Voice 2: boundary seat that natural boundary of the seat than the previous location and
[0:11:58] Voice 2: through the application an environmental impact assessment was completed by a
[0:12:02] Voice 2: registered professional biologist which is attached to the staff report and a
[0:12:07] Voice 2: flood hazard assessment was completed by a professional engineer which is also
[0:12:12] Voice 2: attached and they were both submitted in support of the application and provided
[0:12:18] Voice 2: conditions for construction. These reports meet all of the development permit area objectives
[0:12:24] Voice 2: and guidelines, and they meet the development approval information bylaw requirements for
[0:12:31] Voice 2: a shoreline development permit application. All recommendations have been included within
[0:12:37] Voice 2: the draft development permit. And yeah, so based on this, staff recommends that the executive
[0:12:43] Voice 2: Acting as the Local Trust Committee for Bolinas-Winchelsea Islands, approve issuance of Development Permit Application EX-TP-2024.1.
[0:12:55] Trustee Luckham: Okay, very good. Thank you very much. Thank you for a great report.
[0:12:58] Trustee Luckham: So I'll just turn to the applicant to see if you have any remarks or new information you'd like to share with us, and that you concur with the recommendation of staff.

[0:13:13] Voice 9: want to say, I mean, we tried hard to, I think the biologist had even said that she was impressed with the stuff we're trying to do.
[0:13:25] Voice 9: We were already planting trees long ago and we don't remove vegetation except for just a trail from the house.
[0:13:32] Voice 9: So we don't, we're not trying to get some big view and we have adjustments we tried to make to make it better for the environment
[0:13:51] Voice 9: without having impact on things that we want to derive and like the next happy with what we're doing.
[0:14:00] Voice 9: And, yeah, I think this has been a fairly smooth process.
[0:14:07] Trustee Luckham: Okay, very good. Thank you.

[0:14:09] Voice 3: just add to that.
[0:14:12] Voice 3: Susie mentioned the trees.
[0:14:14] Voice 3: This is the late 50s.
[0:14:19] Voice 3: The island's never been logged, so we have a multigenerational tree species,
[0:14:28] Voice 3: some trees over 400 years old and some five years old, and a lot of stuff in between.
[0:14:34] Voice 3: And around the perimeter of this site is some old growth trees and a region coming along.
[0:14:44] Voice 3: It would
[0:14:45] Voice 3: cut trees down.
[0:14:50] Voice 3: So we really wanted
[0:14:52] Voice 3: to stay within the already disturbed impact site.
[0:14:57] Voice 3: And we like to live small.
[0:14:59] Voice 3: And, you know, the cabin part existing in a story and a half where people,
[0:15:10] Voice 3: sort of the way we try and make our impact low on the planet.
[0:15:21] Trustee Luckham: Okay, well, thank you very much.
[0:15:24] Trustee Luckham: appreciate that you've moved the building back and that indeed you're maintaining a small footprint
[0:15:29] Trustee Luckham: on the on the island so thank you for that so i'll turn to executive committee and ask if you
[0:15:35] Trustee Luckham: have any questions for um staff or the applicant toby elliott um
[0:15:43] Trustee Elliott: there were two building designs
[0:15:45] Trustee Elliott: proposed are we supposed to choose between those two options
[0:15:49] Voice 2: they had chosen option number one

[0:15:53] Voice 2: what we yeah okay

[0:15:59] Trustee Elliott: that includes the removal of the willow tree then i

[0:16:06] Trustee Elliott: um i was just reading through the permit conditions

[0:16:23] Trustee Elliott: and is it typical sorry uh restoration i'm on page 45k the following construction any
[0:16:30] Trustee Elliott: proposal area should be seeded with local grassy covered with organic mulch this is just pretty
[0:16:36] Trustee Elliott: standard this
[0:16:37] Voice 2: uh most of these most of the environmental stuff was taken from the report
[0:16:41] Voice 2: just so we have so it's been
[0:16:44] Trustee Elliott: constructed with the recommendation of the okay as for the
[0:16:47] Voice 2: The geotechnical aspects, they have attached the report as part of the permit
[0:16:53] Voice 2: because it's more technical.
[0:16:57] Voice 2: So both of those should be included.
[0:16:59] Voice 2: And
[0:17:00] Trustee Elliott: I'm just curious about machinery and equipment, I guess, to the applicants.
[0:17:05] Trustee Elliott: Do you already have all the equipment on Mistaken Island for the demolition and construction?
[0:17:11] Trustee Elliott: No.
[0:17:12] Trustee Elliott: So,
[0:17:13] Voice 3: I mean, we live kind of a hand and drive life.
[0:17:18] Voice 3: Like, we only have wheelbarrows, have any kind of track, 26 years that way.
[0:17:25] Voice 9: And
[0:17:32] Voice 3: fiberglass landing bars from Susie's father from 40 years ago,
[0:17:36] Voice 3: anyway, from the 70s.
[0:17:38] Voice 3: And we brought over previously for installing some infrastructure
[0:17:42] Voice 3: for our wind power excavator.
[0:17:51] Voice 3: You can get it.
[0:17:52] Voice 3: It actually goes down to only three feet wide.
[0:17:54] Voice 3: It's called a 1700.
[0:17:56] Voice 3: It's what they use to gut in backyards.
[0:17:59] Voice 3: that so that's the only piece of equipment we've ever had here and we will be bringing one on that
[0:18:07] Voice 3: we're doing a part that we're living in it's going to be a crawler which everything else is
[0:18:17] Voice 3: it on here but even underneath us so better for heating because what we're trying to do one of
[0:18:29] Voice 3: the reasons that spurt is on for this building is uh to make an aspect because we want to lower our
[0:18:35] Voice 3: use of using would be heat and that and that's an environmental statement we're going to have
[0:18:40] Voice 3: triple glazed windows and and we're going to
[0:18:43] Voice 3: seal it up like i'm a special everybody would know as
[0:18:48] Voice 3: net zero
[0:18:50] Trustee Elliott: wow and composting toilets too that's wonderful so there's no septic yeah we
[0:18:55] Trustee Elliott: there's um
[0:18:56] Voice 3: there's a guy um up in the highlands of victoria that is a company called eco sense i'm familiar
[0:19:03] Trustee Elliott: with
[0:19:03] Voice 3: some of you may have heard of yeah
[0:19:05] Voice 3: and we went and took we went and took a training course
[0:19:09] Voice 3: with them on their compost human manure toilet system which he's written a book
[0:19:15] Voice 3: on and gotten in the building code so we took a course there five years ago and
[0:19:21] Voice 3: we've adopted it ever since and we're actually about three years ago so we're
[0:19:26] Voice 3: about to have
[0:19:29] Trustee Elliott: gallons
[0:19:30] Voice 3: of water in our house and we have a Japanese style
[0:19:39] Voice 3: bathing because I've actually built some homes in Japan I learned that the bathing
[0:19:48] Voice 3: and we use the ocean like we go in the ocean at least one a couple times a week year round

[0:19:55] Trustee Elliott: you offering spa retreats
[0:19:57] Voice 3: it sounds
[0:19:59] Trustee Elliott: amazing it's uh i'm a big fan of gordon and baird's work so and and actually
[0:20:05] Trustee Elliott: the islands trust is advancing an advocacy position to um review the guidelines around
[0:20:12] Trustee Elliott: composting toilets and gray water um management so i think i'm hoping that this is going to be
[0:20:18] Trustee Elliott: more broadly adopted so congratulations on taking the lead thank you it's great that's all my

[0:20:24] Voice 3: yeah they're great people and uh we've taken two courses from them and uh they're yeah

[0:20:43] Voice 5: I know that in general, the development permit applications don't require the claims that your notifications as things like rezoning and such.

[0:21:05] Voice 5: and just bring to awareness that that's the case and that we're on
[0:21:13] Voice 5: the brink of signing
[0:21:14] Voice 5: an agreement, the protocol agreement with them.

[0:21:20] Voice 3: might that protocol, with that protocol, are you indicating that anything...

[0:21:31] Trustee Luckham: That is definitely a question that I have for staff with respect to the new protocol
[0:21:36] Trustee Luckham: call agreement. Are there obligations for us associated with the assurance of development
[0:21:43] Trustee Luckham: permit? Normally, a development permit, if it's compliant with the OCP, does not require
[0:21:49] Trustee Luckham: referral out to nations or other agencies. And I'm just wondering what you have considered with
[0:21:55] Trustee Luckham: respect to our commitment to working with Stenas First Nation there.
[0:22:01] Voice 6: With regard to this application,
[0:22:02] Voice 6: I don't think that we have considered it.
[0:22:05] Voice 6: It's known as agreement a little bit younger
[0:22:06] Voice 6: than this application and its advancement,
[0:22:08] Voice 6: the book, the processing of it.
[0:22:13] Voice 6: So I think this is probably one that we haven't.
[0:22:15] Voice 6: However, as pointed out by yourselves earlier,
[0:22:19] Voice 6: we do need to acknowledge,
[0:22:20] Voice 6: we need to incorporate that agreement now
[0:22:22] Voice 6: into the business of the Williams from Chelsea
[0:22:24] Voice 6: Local Trust Committee.

[0:22:28] Voice 6: that's something we'll need to turn our minds to.

CAO Hotsenpiller provided an update on the Follow Up Action List.
5.2 Local Trust Committee Chair Updates
Vice-Chair Peterson reported out on the latest Hornby Island and Salt Spring Island Local
Trust Committee meetings. The Hornby Island Local Trust Committee was informed that
the Crown land referral from the province regarding the Roger’s cell tower has arrived,
and more information will be forthcoming. In addition, the Salt Spring Island Local Trust
Committee had a joint meeting with Capital Regional District directors and the Salt
Spring Local Community Commission, which proved to be a good first step in agreeing to
meet more often to see where collaborative work can be done.

5.3 Islands Trust Conservancy Liaison Update
Vice-Chair Elliott reported that the Islands Trust Conservancy held a special closed
meeting on June 12

, to consider applications for a new board member.

Discussion ensued around public comment period opportunities at Trust Council, and the Chair
recommended a vice-chair bring this up at the next Executive Committee meeting.
7.5.7 Committee of the Whole – Alternate Chair
The Chair reported that the three vice-chairs and trustee Bernardo have put
their names forward to chair Committee of the Whole meetings. At the end of
Trust Council on Thursday, after the adoption of the next Committee of the
Whole meeting date, Trust Council will have a session at 20.2 to elect a chair for
the next Committee of the Whole meeting.
7.6 Glenn Stevens - Delegation Materials

Trustees raised concern that the delegation is referencing Salt Spring Local Trust
Committee issues, not Trust Council issues. Chair will remind Mr. Stevens to keep it to
Trust Council business.
Regarding the Trust Council public comment session, the Chair will limit the speakers to two minutes
and a vice-chair will monitor the time.
