[0:03:05] Trustee Luckham (probable): territory and recognize and see before me the uh um this place which is has an incredible rich
[0:03:12] Trustee Luckham (probable): rich history. Not all of it is joyful. There's lots of sadness and grief, and we need to
[0:03:18] Trustee Luckham (probable): recognize that, and we need to move forward for a better future together. And I'm proud
[0:03:22] Trustee Luckham (probable): of the work the Alliance Trust is doing in that respect. So I'm grateful to be here today.

[0:07:32] Voice 4: you uh we have a lot to report on and i will be as brief as possible but i don't
[0:07:38] Voice 4: want to ignore anything because all of these webinars and meetings that i attend help inform
[0:07:45] Voice 4: form all of the decisions that I make as a trustee at the local trust committee level
[0:07:50] Voice 4: and council. So I think I'm just going to try to group them together according to subject.
[0:07:58] Voice 4: I'm going to do the Islands Trust Conservancy first. I am elected to be on the board of the
[0:08:07] Voice 4: Islands Trust Conservancy. Trustee Elliott is also on the Conservancy, which is a real boon,
[0:08:12] Voice 4: So last night, there was a webinar on species at risk, and that was coordinated with the
[0:08:23] Voice 4: Honest Trust Conservancy and the Trust Programs Committee.
[0:08:26] Voice 4: It was a great webinar.
[0:08:28] Voice 4: There were three speakers, one from Canadian Wildlife Service, one from the Ministry of
[0:08:35] Voice 4: Environment, and we had our director of planning, Stephanie Cermak, who was just great.
[0:08:42] Voice 4: we have 27 species at risk terrestrial in the trust area that does not include marine species
[0:08:48] Voice 4: like the southern resident killer whale and it's part of our job to do everything we can to protect
[0:08:55] Voice 4: those ecosystems where those species live and we we rely even as human beings we rely on the help
[0:09:04] Voice 4: of those ecosystems they provide services to us carbon storage water retention climate regulation
[0:09:12] Voice 4: So, in the trust area, a lot of land is in private hands, so in order to do preservation
[0:09:20] Voice 4: and protection, we have to get a lot of cooperation from the landowners.
[0:09:26] Voice 4: And the way we do that is through some of the programs like, for example, covenants
[0:09:33] Voice 4: on special areas for protection, or the Nature Stewards Program, for example, that the NS
[0:09:39] Voice 4: Trust Conservancy helps to do support. So I'm just going to focus on the main
[0:09:47] Voice 4: things that the trustees can do that Director of Planning Sarah Mack
[0:09:55] Voice 4: emphasized. One of them is really big. It's our Trust Policy Statement. What do
[0:10:00] Voice 4: we have in the Trust Policy Statement, which is supposed to be the guiding
[0:10:04] Voice 4: document for all of our OCPs, what do we have in there that ensures that we
[0:10:08] Voice 4: protect species at risk. The next one is the Honest Trust strategic plan. Same thing. The
[0:10:15] Voice 4: local trust committee work programs. How do we support the Honest Trust conservancy as
[0:10:21] Voice 4: trustees and the public? And what I really liked what he said was make good resolutions
[0:10:30] Voice 4: and vote. And interestingly, Planner Ceremak said basically the planners for the trust
[0:10:39] Voice 4: urban are re-planners because most of the land has already been designated so it's a lot of
[0:10:48] Voice 4: re-planning and sometimes it's really hard to to do the preserve and protect unless you have a lot
[0:10:56] Voice 4: of operation from landholders so it was very useful very glad to attend last night
[0:11:04] Voice 4: next thing relating to islands trust conservancy was the nature reserve monitoring that's done
[0:11:12] Voice 4: every year in the spring and summer on all of the trust islands on may 31st it was give you a look
[0:11:19] Voice 4: and we have three nature reserves and trustee elliott
[0:11:23] Voice 4: attended as well for some of that
[0:11:25] Voice 4: monitoring one of them is burns acres one of them is shall we spray and the other one is the
[0:11:32] Voice 4: coat smell stove. So even though Burns Acres is only five acres it has a remarkable variety of
[0:11:40] Voice 4: little mini ecosystems and that was that was put into conservation by a private landowner
[0:11:48] Voice 4: on Fabriola who decided that she wanted those five acres to have special protection.
[0:11:56] Voice 4: So that's a really good example of how private landowners can help with the preserve and
[0:12:03] Voice 4: protect.
[0:12:03] Voice 4: It was a great day.
[0:12:05] Voice 4: It took all day, right until three o'clock, to do some of the monitoring.
[0:12:09] Voice 4: And something that was really helpful was to see how much the Invasive Species Committee
[0:12:18] Voice 4: of GALT on Gabriela, how much good their work has done with pulling broom, pulling Daphne,
[0:12:26] Voice 4: me removing holly and finally getting rid of these two gorse plants that took two years of
[0:12:32] Voice 4: sawing and chipping to get rid of them before
[0:12:35] Voice 4: they took over so that was a great day it's really nice
[0:12:38] Voice 4: to actually do the work on and see the results so on this trust uh conservancy board meeting
[0:12:48] Voice 4: we had may 28th we had a board meeting now that board meeting our members across the salish sea
[0:12:56] Voice 4: from Trust Council. They live in several unceded ancestral Coast Salish territories, and one of us
[0:13:04] Voice 4: always gives a land acknowledgement, and this time it was Lisa Goldgrove from Galliano Island,
[0:13:10] Voice 4: which is in the Pahulukuminum language. She reminded us during her land acknowledgement
[0:13:16] Voice 4: that nature is not just about resources, and I reflect on that a lot, especially this time of
[0:13:23] Voice 4: year when I'm out in the woods with children from school doing field trips and looking at all the
[0:13:29] Voice 4: berry bushes which are incredibly important to First Nations culture and livelihood.
[0:13:38] Voice 4: Lisa Gover also reminded us that the natural world is the basis for our health and our well-being.
[0:13:46] Voice 4: At that meeting, Senior Indigenous Relations Advisor Joe Elliott attended and he told us
[0:13:53] Voice 4: some of his ancestral history and we found that fascinating all the way from chief sale in the
[0:14:00] Voice 4: place we now call seattle to the zumindest first nation so he also has a wealth and breadth of
[0:14:06] Voice 4: knowledge that he brings to us as an advisor and something i wanted to mention also is the
[0:14:14] Voice 4: island's trust conservancy does an annual report every year and this year the chair risa smith
[0:14:21] Voice 4: made a special note of all the local conservancies across the trust area and what great work they do
[0:14:29] Voice 4: for preserving and protecting. Just for an example, the Island Trust Conservancy basically
[0:14:37] Voice 4: approved a fund to help pay Bowen Island Conservancy to help them do a formal appraisal
[0:14:46] Voice 4: of the fair market value for the 24 lots at cape roger curtis on bowen where i've been it is a very
[0:14:55] Voice 4: sensitive ecosystem area with great conservation value and it is at risk of imminent development
[0:15:02] Voice 4: or sale by metro vancouver so a little bit of financial assistance that the conservancy was
[0:15:09] Voice 4: able to give to that local conservancy it's going to make a big difference
[0:15:13] Voice 8: on
[0:15:16] Voice 4: the fairy advisory committee because i'm on that i will try to keep it really quick
[0:15:21] Voice 4: um at the june 11th meeting of the gabriel fairy advisory committee um we talked about the
[0:15:30] Voice 4: shutdown of the two terminals that's going to happen to birth next spring when they do their
[0:15:40] Voice 4: first upgrade we're not talking about any upland upgrades that we've been begging for as far as
[0:15:47] Voice 4: safety like sidewalks and crosswalks and lights and you know paths up to the village we're talking
[0:15:56] Voice 4: about total shutdown of the Nanaimo and the Gabriola terminals while they do their upgrades
[0:16:03] Voice 4: and they estimate that will be April and May of 20, it's actually 2026, and there will
[0:16:13] Voice 4: be no ferry, as we know it. I don't even want to joke about that right now.
[0:16:23] Voice 4: We know what it's like going to Green War. We've done that before in the past, but that
[0:16:28] Voice 4: was only like a third of the population that they aren't in. So another interesting workshop
[0:16:35] Voice 4: I attended a couple of nights ago. What night was that? I don't even know. It was this week,
[0:16:41] Voice 4: earlier this week. And this was a community workshop. So not just fairy advisory commission,
[0:16:47] Voice 4: it was Gabriel's, Marjana's, whoever wanted to, that was from DeForsy. And it was basically
[0:16:55] Voice 4: busy ferries showing us how they have responded to our constant request for safety changes at the
[0:17:05] Voice 4: terminals for example things like please don't make us wait out on on the terminal avenue in the
[0:17:13] Voice 4: in the boiling sun for three ferry waits because you will not fill that lot well like so like that's
[0:17:23] Voice 4: just nuts and they had excuses like well we have to do the count and like we can see you doing the
[0:17:28] Voice 4: count you count them as loading onto the vehicle you can still build a lot so we had some pretty
[0:17:34] Voice 4: tense discussions about that um yeah um and and just yeah so it was mainly about the safety issues
[0:17:46] Voice 4: and it also included a good talk about additional dangerous cargo sailing dangerous wind sailing
[0:17:52] Voice 4: on Fridays to provide additional capacity because we've had some really
[0:17:57] Voice 4: sticky situations where businesses are getting a lot of that depend on that
[0:18:02] Voice 4: dangerous cargo sailing are not getting their fuel and that's nuts so what that
[0:18:07] Voice 4: will require however is us a regular public giving up a sailing for dangerous
[0:18:13] Voice 4: cargo so we talked about that well what if there isn't a dangerous cargo what
[0:18:17] Voice 4: if they book but they don't show up can you sail it as a regular sailing so
[0:18:22] Voice 4: So possibly, anyway, all that kind of thing, all the things we've been asking for.
[0:18:30] Voice 4: Well, I've got a giant big zero here.
[0:18:34] Voice 4: What being married is working on.
[0:18:37] Voice 4: However, we keep trying.
[0:18:40] Voice 4: And there's, yes, the shift in the schedule for to accommodate the busy, busy summer traffic.
[0:18:47] Voice 4: So the shift in the schedule is something we've asked for.
[0:18:51] Voice 4: what it's going to mean and they they're going to do it they said they're going to do it
[0:18:56] Voice 4: fridays from july 5th to august 30th the morning sailings will be replaced by two afternoon sailings
[0:19:03] Voice 4: so we're not getting any extra sailings they're just going to shift the schedule
[0:19:08] Voice 4: and then monday august 12th to friday august 16th they're going to try that again for the whole week
[0:19:15] Voice 4: not just Fridays and see what happens. So it means no 7.05 from Descanso, no 7.35
[0:19:24] Voice 4: from Nanaimo and then an extra sailing 5.40 from Nanaimo and 6.15 from Descanso.
[0:19:32] Voice 4: And that's because in the summertime the traffic at the end of the day is, that's
[0:19:37] Voice 4: when we get those three sailing waves with people sitting out all the way down
[0:19:42] Voice 4: of the Hulot Ferry and the helicopter and thought they're sitting in their vehicles not being able
[0:19:47] Voice 4: to move, not being able to get out of their cars because they don't know when the line is going to
[0:19:51] Voice 4: move. Peter's silent is so much easier even though well
[0:19:56] Trustee Luckham (probable): until the bus back into the shelter. I know
[0:19:58] Voice 4: which I saw a week ago. We
[0:20:02] Trustee Luckham (probable): have our own issues.
[0:20:03] Voice 4: That's right. Still a lovely, wise person.
[0:20:07] Voice 4: The Financial Planning Committee.
[0:20:09] Voice 4: Again, it's just kind of unusual
[0:20:11] Voice 4: that both Trustee Elliott and I
[0:20:13] Voice 4: are both on the Financial Planning Committee,
[0:20:15] Voice 4: but I'm really glad that we are
[0:20:16] Voice 4: because we really know how to advocate
[0:20:19] Voice 4: for all the right things
[0:20:20] Voice 4: for our local trust committee
[0:20:22] Voice 4: and for trust control.
[0:20:24] Voice 4: So just very briefly,
[0:20:25] Voice 4: we have two clean audits
[0:20:27] Voice 4: for the Islands Trust
[0:20:28] Voice 4: and the Islands Trust Conservancy.
[0:20:31] Voice 4: And that reflects really well
[0:20:33] Voice 4: on the financial planning team
[0:20:34] Voice 4: team and the director Julia Moss. So yay for that. Okay on to um I'm just about done two more things
[0:20:45] Voice 4: but we had so many meetings this past month. Highlights of Trust Council. I'm sticking to two
[0:20:52] Voice 4: because it's a three-day meeting and there were several highlights. It was our 50th anniversary
[0:20:58] Voice 4: street of the island's trust and i felt a little bit sad that we haven't accomplished more but a
[0:21:06] Voice 4: little bit happy that we're still there and um one of well one of the highlights was hearing from
[0:21:12] Voice 4: adam wilson the mla for sanich and the north islands and then i heard this morning that he's
[0:21:19] Voice 4: retiring and i felt really really sad he is an incredible advocate for the whole island's trust
[0:21:26] Voice 4: area, not just his own. So that makes me sad. So highlight number one, Bill Henderson singing
[0:21:33] Voice 4: the praises of the Islands Trust in the delegations. And it was so beautiful. He still has a lovely
[0:21:40] Voice 4: voice after all these years. He was main singer for Chilliwack. He was there and he really
[0:21:47] Voice 4: supports the trust. So that made me pretty happy. Another highlight for me was a unanimous
[0:21:56] Voice 4: council vote which never happens on the dark sky initiative so we'll be pursuing that and we had
[0:22:04] Voice 4: a presentation a few months ago from a local fellow here in gabriel on urging us to do that
[0:22:09] Voice 4: very thing so that made me really happy too yay for unanimous vote on that so my last item is
[0:22:15] Voice 4: something we get at every trust council meeting it's a quarterly legislative monitoring report
[0:22:21] Voice 4: sounds boring it's not and the reason it's not is because of the way it's
[0:22:27] Voice 4: organized so that we can make the best use of it what's planned legislation
[0:22:32] Voice 4: what's the legislation in process what's new legislation in effect and how does
[0:22:38] Voice 4: that affect the Islands Trust so again I just picked two from this list
[0:22:44] Voice 4: super easy list to go through the way it's organized so two good ones just to
[0:22:51] Voice 4: give you an example protect the southern resident killer whale initiative that's been going on for
[0:22:59] Voice 4: some time now so our reaction is not only did we watch that but we have we appoint one of our
[0:23:07] Voice 4: trustees from council to transport canada's general vessels technical working group i

[0:26:59] Voice 4: project to add the staff-initiated item, which we see on our agenda today, the By-law Compliance
[0:27:05] Voice 4: and Enforcement Policy.
[0:27:07] Voice 4: So Warren noted in that meeting that it seems to be we are behind other local governments.
[0:27:15] Voice 4: There's just like, I don't know why it didn't occur to us, but this was really missing.
[0:27:20] Voice 4: And so I'm really pleased that staff brought that forward and sort of took the initiative
[0:27:26] Voice 4: initiative to have a much clearer policy, which you'll see on the agenda today.
[0:27:32] Voice 4: So specific sections for other islands and associated islands and the LTC.
[0:27:37] Voice 4: And so I know that's advanced.
[0:27:39] Voice 4: But anyway, we can talk about that.
[0:27:43] Voice 4: I'll talk a little bit about some reconciliation community work that's been going on behind
[0:27:47] Voice 4: the scenes and has come to fruition.
[0:27:49] Voice 4: um tomorrow there's an event on gabriela um at sumi lutsen which is twin beaches
[0:27:59] Voice 4: and everyone's invited um it's a fundraiser for the manakunu family and it's a bit
[0:28:07] Voice 4: reconciliation is not a straight path it's really about building relationship
[0:28:11] Voice 4: and so i it just happened i attended some hulking and language classes in nanaimo
[0:28:17] Voice 4: one led by the name of elder gary manson and we developed a bit of a connection and he said hey
[0:28:23] Voice 4: would the gabriel community be interested in fundraising for uh to support our youth going
[0:28:29] Voice 4: on tribal journeys and i didn't know much about that but if an elder asks you something um you
[0:28:35] Voice 4: say yes and even if you're terrible at organizing events like me um you do your best and so we are
[0:28:43] Voice 4: having this wonderful event the gabriola and much community vendors stepped up we've got some raffle
[0:28:49] Voice 4: baskets and lots of pre-registrations to actually go out in in a paddle in their journey canoes
[0:28:55] Voice 4: so the tribal journey is an annual cultural event they leave their community and travel
[0:29:01] Voice 4: down and visit the community for around 10 days and they all end up in one place
[0:29:07] Voice 4: Puyallup Washington is the destination and so yeah it was a wonderful opportunity. Gabriel
[0:29:14] Voice 4: is super excited and so we're going to welcome the journey canoes or about 17, 18 man canoes
[0:29:21] Voice 4: and actually take people out on a paddle so there's going to be a lot of them.
[0:29:27] Voice 4: I did attend the mud bylaw and enforcement education session on June 25th that was
[0:29:32] Voice 4: was really informative wasn't able to go to the first one um i learned a lot especially about the
[0:29:39] Voice 4: aspects of the much land use bylaw that are very um shall we say restrictive and don't seem to
[0:29:49] Voice 4: be a match with some of the other land use bylaws and so i'm really glad that we're
[0:29:55] Voice 4: addressing that in an open manner and we seem to be moving forward
[0:30:00] Voice 4: just recognizing that some things were uh probably onerous right and uh there is a very large
[0:30:07] Voice 4: percentage of bylaw enforcement files open and the reason for that might be that land use bylaws
[0:30:13] Voice 4: have a touch so um moving on trust council meeting on salt spring island was lively um frankly lots
[0:30:24] Voice 4: lots of protesters which
[0:30:26] Voice 14: I
[0:30:27] Voice 4: did five years in Montreal at journalism school and we used to
[0:30:31] Voice 4: joke that there's a protest not just every day of the week but probably lunchtime afternoon and
[0:30:38] Voice 4: dinner time but this was like kind of refreshing it's it's when people are engaged and they care
[0:30:44] Voice 4: and they come out and show you I appreciate that a lot of people were saying get back to the
[0:30:50] Voice 4: mandate you know protect the environment and very strong language about that um for myself i i wanted
[0:30:58] Voice 4: to understand conditions on salt spring a bit more so i reached out to a young man who hadn't been
[0:31:04] Voice 4: able to attend trust council to address us but wanted to because he works during the day and i
[0:31:10] Voice 4: ended up going on a tour of the island and seeing a lot of the unregulated and illegal trailer parks
[0:31:16] Voice 4: concepts honestly and heard some absolutely heartbreaking stories of people living in
[0:31:23] Voice 4: conditions and extremely substandard housing because we have not been able to address that
[0:31:28] Voice 4: and so I really felt I got to see both sides people who you know we all want to see the
[0:31:35] Voice 4: environment protected we also need to develop policies so people can live here and they're
[0:31:40] Voice 4: working folks who service all of our lifestyles um can have a safe place to live so there's some
[0:31:47] Voice 4: really illuminating conversations and um but i thought was pretty heart-wrenching there's several
[0:31:53] Voice 4: first nations representatives who addressed us as well uh one from the penelope chief and council
[0:31:58] Voice 4: and frankly he said we're concerned about the state of the land um you know we harvest shellfish
[0:32:04] Voice 4: and don't feel great about, you know, the sewage being dumped in the harbors
[0:32:09] Voice 4: and effluent and people don't live aboard.
[0:32:12] Voice 4: So there's that tension, too, as First Nations are wanting to return to the land
[0:32:15] Voice 4: and exercise their rights to hunt and harvest the fishes formerly.
[0:32:20] Voice 4: We have to make sure that the ecosystems are productive
[0:32:25] Voice 4: and have that biodiversity that everyone is entitled to enjoy.
[0:32:31] Voice 4: There was a lawyer from West Coast Law giving us an update
[0:32:34] Voice 4: on the Sue Big Oil campaign, clarified that, and we're still in debate about this, they're asking
[0:32:42] Voice 4: for a pledge from all local governments of about a dollar per person to do a class action lawsuit
[0:32:48] Voice 4: against oil companies. The Islands Trust, it would only be 50 per cent per person because the
[0:32:55] Voice 4: regional district would put in another 50 cents and it would just be a pledge at this point. So
[0:33:00] Voice 4: So Trust Council is not yet decided if that's the course you want to take.
[0:33:04] Voice 4: So finally, I would encourage everyone to listen.
[0:33:10] Voice 4: If you can go back to 545 on Tuesday last week at Trust Council at MLA, Adam Olson's
[0:33:17] Voice 4: address was phenomenal.
[0:33:19] Voice 4: It was about 30 minutes.
[0:33:23] Voice 4: He understands the governance struggles in the Islands Trust area probably better than
[0:33:29] Voice 4: anyone else and he's been battling with ministers and cabinet and the premier to get some attention
[0:33:38] Voice 4: to the trust area for almost a decade i think he said he's attended 15 islands trust breakfasts
[0:33:44] Voice 4: half his constituency is in the islands trust area he really cares so this is sanich
[0:33:51] Voice 4: peninsula the province's responsibility is to update its statutes and it has not done that with
[0:33:58] Voice 4: the islands trust act it must update the act to ensure it is capable of achieving the goals of
[0:34:04] Voice 4: the communities and the object of the trust this province is solely responsible we can't do that
[0:34:10] Voice 4: ourselves so what trust council did rally around was like yes we need to do a call to the province
[0:34:15] Voice 4: to review the islands trust act and the governance structure and the funding structure we cannot
[0:34:21] Voice 4: actually accomplish what we're supposed to do and it's the province's responsibility so
[0:34:26] Voice 4: So I really encourage you to have a listen
[0:34:28] Voice 4: on that Tuesday evening address
[0:34:30] Voice 4: and really understand in the context
[0:34:33] Voice 4: of working for nations.
[0:34:36] Voice 4: And we just need the resources to do that

[0:35:56] Trustee Luckham (probable): if that was just had not been created and uh what's important to all of us at trust council
[0:36:02] Trustee Luckham (probable): is to make um island trust relevant to today and um certainly that's the work that we're seeing in
[0:36:08] Trustee Luckham (probable): our policy statement initiative reviewing our uh guiding principles document and that's a piece of
[0:36:14] Trustee Luckham (probable): work underway. We're also working towards a better corporate planning process so that there's
[0:36:21] Trustee Luckham (probable): more structure and accountability within the framework of how we actually govern financially
[0:36:26] Trustee Luckham (probable): and manage the work that we need to undertake in the trust area. So that's ongoing. We've also
[0:36:33] Trustee Luckham (probable): and recently started a completely new process that we've not done before, which is committee
[0:36:38] Trustee Luckham (probable): of the whole. That's something that
[0:36:40] Trustee Luckham (probable): is practiced in municipalities and regional districts.
[0:36:42] Trustee Luckham (probable): We've not had that opportunity, so we've amended our bylaws to allow that, and the policy statement

[0:41:07] Voice 4: on some of the work that you've been doing and putting in a temporary hiatus on bylaw enforcement
[0:41:14] Voice 4: under certain conditions with year-round RV living where it doesn't
[0:41:20] Voice 4: threaten the environment, they're septic properly, taking care of potable water
[0:41:24] Voice 4: and while we are working on various phases obviously that doesn't apply here
[0:41:30] Voice 4: it's in some other electoral areas but with the housing crisis it's requiring
[0:41:35] Voice 4: some flexibility in how we're thinking and pursuing. I know a lot of
[0:41:41] Voice 4: People are excited to know we're taking over all of our points as an RDN park managed by the park service. So we will be putting in new benches there.
[0:41:50] Voice 4: And not taking on a brickyard is a regular question. We're looking at expanded yard waste collection in the organic part. And so there's a lot of interest in people being able to
[0:42:02] Voice 4: fire smart more and having bigger bins to put that in but uh so there'll be a survey coming
[0:42:08] Voice 4: out in the fall to better understand how people use it and this um addition would actually sound
[0:42:13] Voice 4: like it would be opt-in so you don't necessarily have to um have that option but i think on our
[0:42:19] Voice 4: in our community um there's a lot of interest in fire smarting and being able to get rid of
[0:42:24] Voice 4: more materials even even beyond composting in your backyard so that's still a good question
[0:42:31] Voice 4: to director greg often individual households are often as a because that's yet to be determined
[0:42:36] Voice 4: well it would it would be either it's either by electoral area or um individuals and my thought
[0:42:43] Voice 4: isn't it's going to be similar to the waste card so the amount that you pay is determined on the
[0:42:49] Voice 4: size of your waste card and so i think it might be along those lines but that is yet to be determined

[0:48:57] Voice 9: brooks i'm one of the directors the chair of the lunch island community association so i'm one of
[0:49:05] Voice 9: the people responsible for putting forward the letter to the Islands Trust that outlines the
[0:49:11] Voice 9: concerns that we have. You know, that letter was submitted June 7th, so I'm sure you all had an
[0:49:19] Voice 9: opportunity to read it. So
[0:49:21] Voice 9: I've got a bunch of things that I'll try and blast you fairly quick
[0:49:26] Voice 9: to keep it short and everything. But first, I'd really like to thank you for adjusting the
[0:49:35] Voice 9: agenda. I think that's a great move to trying to get the whole thing fleshed out fairly quick.
[0:49:43] Voice 9: So the other thing I'd like to do is thank Warren Damon for doing the two webinars
[0:49:52] Voice 9: for our community. The last one was July 25th and they were an exception. Very well done
[0:50:00] Voice 9: And I think that the community really appreciated it and had a much, much, much better understanding
[0:50:09] Voice 9: of what the bylaws are, how they work, and what the community's responsibilities are
[0:50:17] Voice 9: in this process.
[0:50:19] Voice 9: So I think it was a very good one, and the community appreciates it.
[0:50:24] Voice 9: Um, so, uh, next, uh, I understand that the trust committee will be coming to much on
[0:50:33] Voice 9: July 16th.
[0:50:35] Voice 9: Um, so, uh, when, uh, the MICA community has, has had a couple of town hall meetings and
[0:50:43] Voice 9: has dialogue, obviously, with our community.
[0:50:46] Voice 9: And what I can tell you is that the community is very excited to, to attend the meeting,
[0:50:51] Voice 9: to meet you, to express some of their thoughts, concerns, and have some dialogue as to how
[0:51:01] Voice 9: we can work together to moving ahead through some of our community problems and issues.
[0:51:10] Voice 9: So moving ahead and back to our letter of June 7th, there's a couple of things in the
[0:51:18] Voice 9: letter that are really uh paramount to the community and our association and one was that
[0:51:25] Voice 9: we were hoping that today uh the trust committee could uh move forward uh put forward a motion to
[0:51:32] Voice 9: recognize the committee as the uh um representatives of lunch island and uh to develop a working
[0:51:41] Voice 9: working relationship. And then the second component was that we were hoping that a motion
[0:51:48] Voice 9: could be put forward where a minor project could be developed with a bit of funding set
[0:51:57] Voice 9: aside so that we can work on some of these policies and bylaw updates that need to be
[0:52:05] Voice 9: done. I think the community doesn't see major changes to the to the bylaws, but there's some
[0:52:15] Voice 9: tweaking I think that we'd like to see and hopefully we can develop a foot size of funding
[0:52:24] Voice 9: for you know the MICA committee and our community to work with staff in developing policies and
[0:52:33] Voice 9: and the bylaws to try and move the situation around much.
[0:52:37] Voice 9: I think the community is bought into trying to find a way
[0:52:45] Voice 9: and accepting that changes have to be done.
[0:52:50] Voice 9: So, and then last but not least,
[0:52:53] Voice 9: one of the things that we picked up on
[0:52:58] Voice 9: is that item 12.1, there's a staff report
[0:53:03] Voice 9: that's being put forward and again thank you for moving that up in the agenda
[0:53:08] Voice 9: um and what it is is the proposed bylaw compliance and enforcement policy and um
[0:53:16] Voice 9: uh it's brand new to us we just had the opportunity to review it and um it's it's
[0:53:24] Voice 9: quite apparent that there's been a tremendous amount of work put into that and uh there's uh
[0:53:30] Voice 9: a lot of great, great work and ideas that are in there.
[0:53:35] Voice 9: And in working sort of parallel to that,
[0:53:40] Voice 9: our committee has also, you know,
[0:53:42] Voice 9: thought about different policies
[0:53:45] Voice 9: and what could also be incorporated.
[0:53:49] Voice 9: And there's a lot of parallels and things that are similar,
[0:53:52] Voice 9: but there's other things that, you know,
[0:53:56] Voice 9: we hope that could be considered to be added to it.
[0:53:58] Voice 9: You know, the report and the proposal is very good, but, you know, we'd like the opportunity to work with the trust members and staff, bylaw enforcement and the planners, to developing that policy through a consultation process.
[0:54:16] Voice 9: I think it would be very good, and it would be meaningful to the community that, you know, we have some input to it.
[0:54:24] Voice 9: And I think through that process, we'll have better results.
[0:54:28] Voice 9: in the community if there's if the community is part of that process so i think it's so important
[0:54:35] Voice 9: that the community our association you know are part of developing that that policy and certainly
[0:54:43] Voice 9: you know moving forward to you know tweaking some of these violence so those are the things
[0:54:48] Voice 9: you know we're hoping that you can consider um you know through this through this meeting today
[0:54:53] Voice 9: day. And yeah, that's pretty much it. So try and cut it as short and sweet as possible.

[0:59:06] Voice 2: spoken to. I would like to thank Warren for your work on the staff report for updating the policy
[0:59:14] Voice 2: by law enforcement.
[0:59:16] Voice 2: I think there's a lot of really great things in there.
[0:59:19] Voice 2: And we were happy that we were given access to review it.
[0:59:23] Voice 2: But personally, I feel it's not,
[0:59:26] Voice 2: I think my understanding is it's being presented
[0:59:29] Voice 2: for adoption today.
[0:59:31] Voice 2: And I don't think it's ready for adoption.

[1:00:37] Voice 6: recommendation of new policies um i will just throw a few specific examples at you
[1:00:44] Voice 6: knowing that i will still go through the magi island community association in making
[1:00:48] Voice 6: these recommendations one specific example is you are suggesting a two complaint minimum before
[1:00:56] Voice 6: before enforcement, which is something that, and this is in the Part B that applies only to much.
[1:01:03] Voice 6: Very interesting. We have talked about how we'd like to see that. However, you're saying two
[1:01:07] Voice 6: complaint minimum before enforcement. You're still going to come out and investigate. You're still
[1:01:12] Voice 6: going to spend an incredible amount of time looking into things, and then you're going to
[1:01:16] Voice 6: tell, oh, well, it was only one complaint. Therefore, we're going to stop before enforcement
[1:01:20] Voice 6: until we get that second complaint. I would consider the difference between enforcement
[1:01:24] Voice 6: and investigation if it were possible to simply say two complaints before investigation now you're
[1:01:31] Voice 6: saving an incredible amount of staff time another example is notice before inspection is not
[1:01:38] Voice 6: mentioned there but would love to see more notice before you show up on much many part-time residents
[1:01:45] Voice 6: on much consider adding to part b that maybe because of the unique nature of you know where
[1:01:51] Voice 6: people are and they're not always at home on much they do want to be there when you come

[1:01:56] Voice 6: would love more notice um and your vexatious and repeat complaint policy
[1:02:03] Voice 6: written out when i read it i realized there's a huge missing piece which is false complaints

[1:02:15] Voice 6: makes 20 false complaints, you haven't acknowledged that in the vexatious how you're going to address
[1:02:22] Voice 6: that complaint, right? And I just mentioned that because you've talked, and I think it's part eight
[1:02:31] Voice 6: in this policy. So this is all getting in the weeds, just letting you know that
[1:02:35] Voice 6: we see some missing pieces. We'd love to see this improved before it's adopted.

[1:02:51] Voice 6: to briefly touch on a phrase I heard recently regarding how much feels that we want to be left

[1:03:05] Voice 6: I would I would modify that to say we'd like to be treated fairly and with understanding
[1:03:12] Voice 6: that's what we're looking for and that's why many of us are here today um there is an incredible
[1:03:18] Voice 6: diversity of lifestyles on much sometimes we are all thrown into one basket oh those are those
[1:03:25] Voice 6: folks who you know there's there's simply misunderstandings about who we are because
[1:03:29] Voice 6: we're so many different things we're part-timers we're full-timers we're waterfront folks we're
[1:03:34] Voice 6: folks living in a tiny little cabin up on a hill we're folks who kayak who rowboat who have
[1:03:40] Voice 6: beautiful miniature yachts going all the way to Nanaimo or going to Vancouver. We're just a
[1:03:47] Voice 6: diverse community and the more understanding that the Honest Trust has in regards to who we are and
[1:03:53] Voice 6: how we are getting by, it would just be helpful and this has been helpful. So thank you for

[1:08:10] Voice 11: I rushed here from a meeting with the RCMP,
[1:08:12] Voice 11: so that was...
[1:08:16] Voice 11: So the report that was prepared for the Local Trust Committee,
[1:08:22] Voice 11: what it does is it does present a proposed compliance
[1:08:26] Voice 11: and enforcement policy.
[1:08:27] Voice 11: policy. The actual recommendation is not for adoption, it is for consideration by the Global
[1:08:34] Voice 11: Trust Committee so that they can edit them in and receive further consultation as they
[1:08:41] Voice 11: wish. The report outlines or provides brief information on the current number of files
[1:08:48] Voice 11: for the Gabriel Global Trust area. You've got, it should be 120 plus files, of which
[1:08:55] Voice 11: now the majority is on much and that's an outline but it's got uh gabriel has 50 plus files uh
[1:09:05] Voice 11: might is approximately 70. um that's never happened before that is atypical for all of the
[1:09:13] Voice 11: local trust areas you never have an associated islands with more fly law files complaints and
[1:09:19] Voice 11: files open than the so-called principal or may not right it just doesn't happen there have been
[1:09:26] Voice 11: similar circumstances in the past where a large number of complaints have come in from associated
[1:09:31] Voice 11: lands but they've never exceeded the principal island. So you do have this circumstance now where
[1:09:39] Voice 11: you have a majority of the complaints and files open on lunch and so that's an indication that
[1:09:45] Voice 11: there may be problems that need to be addressed. There may be concerns with the land use bylaw.
[1:09:50] Voice 11: So, as part of our by-law enforcement review as a whole for Island's Trust, and our review
[1:10:00] Voice 11: of Trust Council policies, I looked at it and saw that there were gaps, one, that Trust
[1:10:08] Voice 11: Council policies don't address, the fact that Trust Council policies delegate to the local
[1:10:14] Voice 11: trust committees, you adopt your policies, you close files, you get over files, you can
[1:10:18] Voice 11: adopt your policies for your specific issue so one of the things that local trust committees do is
[1:10:24] Voice 11: they for file enforcement especially they adopt standing resolution so one of the reasons for the
[1:10:30] Voice 11: proposed document is to have all the standing resolutions in one document put it all into the
[1:10:35] Voice 11: policy document so it's there for everyone to see it's in one place you don't have to go even staff
[1:10:41] Voice 11: sometimes have to be searching for all these standing resolutions especially if they're
[1:10:44] Voice 11: say there's a dozen we'll put all those policies into one place and then it can be amended in the
[1:10:51] Voice 11: future if you want to address any other issue non-compliant problems whatever it is as short

[1:11:44] Voice 11: So that's being addressed in these policies, which is being presented to each local trust area and trust committee one at a time.
[1:11:53] Voice 11: Denman has adopted theirs.
[1:11:55] Voice 11: They're presented to Salt Spring, but they're going to go through a process of, it's going to have to be revised and reporting back to them because they have concerns about the policies.
[1:12:04] Voice 11: And I anticipated that all the local trust committees would want to do that.
[1:12:08] Voice 11: I was actually quite surprised when Denman said, no, this is perfect.
[1:12:11] Voice 11: And we're good with all that.
[1:12:14] Voice 11: because that is not it's not in my report the adoption today was never the plan the actual
[1:12:19] Voice 11: recommendation is for the lbc to consider make edits amendments as necessary so within this
[1:12:25] Voice 11: time we were trying to cover off on those issues that aren't addressed by trust council policies
[1:12:31] Voice 11: um but i will note uh one question about opening investigations the local trust committee does not
[1:12:37] Voice 11: have the authority to do that from trust council as far as saying to violent enforcement officers
[1:12:43] Voice 11: you can't open files.
[1:12:44] Voice 11: Trust council policies dictate,
[1:12:46] Voice 11: we receive a written complaint and then we open a file.
[1:12:51] Voice 11: So once the investigation is completed,
[1:12:54] Voice 11: the local trust committee can receive a report
[1:12:55] Voice 11: and say, oh, we're not concerned about this.
[1:12:57] Voice 11: And then, okay, please post the file.
[1:12:59] Voice 11: That's within their authority to do.
[1:13:02] Voice 11: So the investigations,
[1:13:06] Voice 11: that is really direction for the trust council
[1:13:08] Voice 11: as far as the opening of the files.
[1:13:09] Voice 11: and I'll always say that that process should always happen because before we can make any
[1:13:15] Voice 11: determination and do any investigation of the property, we should have an open file.
[1:13:20] Voice 11: So we contact the property owner, fully investigate it, and then make determinations or decisions
[1:13:25] Voice 11: based on that.
[1:13:27] Voice 11: I don't think we should be doing, essentially, investigations in secret for anyone's property.
[1:13:33] Voice 11: So when we get a complaint, I review it, the file's open, we notify the property owner,
[1:13:38] Voice 11: and we start investigating.
[1:13:40] Voice 11: i would never recommend where we're getting complaints and then we start some sort of
[1:13:44] Voice 11: investigation into your property without you knowing about it i don't think that's an open
[1:13:48] Voice 11: and transparent process and i don't think press council would adopt that i don't think the local
[1:13:52] Voice 11: trust committee would want us to do it that way so that's why we do it the way we do it and press
[1:13:58] Voice 11: council has policies that state that the trustees and local trust committees do not get involved in
[1:14:04] Voice 11: investigations so that's why i use the language of open file investigate then report
[1:14:10] Voice 11: We have a completed investigation and the local trust committees can make the
[1:14:14] Voice 11: determinate whether they want to continue with enforcement or close it.
[1:14:18] Voice 11: And there are a number of local trust committees that are doing it that way.
[1:14:22] Voice 11: Main Island, Denman Island, quite specifically, they want that type of
[1:14:26] Voice 11: reporting. So in the end, in those islands, if we're proceeding with
[1:14:29] Voice 11: enforcement or is there somewhat of a bylaw with this, that's because the local
[1:14:34] Voice 11: trust committee has received a report from a bylaw officer and they're saying
[1:14:37] Voice 11: yes proceed. The local trust committee is considered whether or not they want that issue.
[1:14:44] Voice 11: It's within the interest of the community to proceed with enforcement and this local trust
[1:14:50] Voice 11: committee can do the same. Proceed that type of reporting and then proceed with your decisions.
[1:14:57] Voice 11: In regards to the word vexatious, part of I think the meaning of vexation is false
[1:15:02] Voice 11: but for clarity we can use the word faults in there right now even though that there is no
[1:15:09] Voice 11: vexatious policy from trust council if i determine that someone has submitted repeated faults
[1:15:16] Voice 11: complaints because we fully investigated that i consider them vexatious and i will not open up
[1:15:21] Voice 11: files based on the complaints anymore but we do need that amended policy in the trust council
[1:15:27] Voice 11: policy and also for the local press committees as far as what action they want to take
[1:15:32] Voice 11: if people are being truly vexatious or submitted false complaints or be
[1:15:38] Voice 11: wish to determine. I will say that true vexatious or false complaints it's
[1:15:46] Voice 11: 1% of our files may have been opened because it's a neighborhood dispute
[1:15:51] Voice 11: there's vexatious or something like that so it's not a chronic problem it does
[1:15:57] Voice 11: occur, people do submit complaints with false names. I can usually discover that
[1:16:04] Voice 11: very quickly and so I don't open a file based on that complaint.
[1:16:10] Voice 11: The Trust Council policy doesn't specifically use the word anonymous, but we
[1:16:14] Voice 11: consider that an anonymous complaint and then we don't open a file. As for Trust Council
[1:16:18] Voice 11: policy and for the local Trust Council policy, maybe that language could be more
[1:16:23] Voice 11: more explicitly as far as making it clear to everyone why we're doing what we're doing
[1:16:30] Voice 11: and the fact that we are going to take into consideration whether or not someone is using
[1:16:37] Voice 11: melatonin or trying to be frivolous or vexatious or whatever, being nefarious in any way, trying
[1:16:45] Voice 11: trying to abuse this process we truly uh are aware that there are people who do try to abuse it
[1:16:53] Voice 11: and we take steps to ensure that abuse doesn't take place so in the end what the policy does
[1:17:00] Voice 11: it introduces uh actual bylaw officer discretion uh as far as you know we do deal with folks who
[1:17:08] Voice 11: are absolutely financially unable to comply there's just you discover very quickly they're
[1:17:13] Voice 11: destitute or wherever they may be land rich but they have no means to comply so uh for years we
[1:17:20] Voice 11: have not been enforcing all those people but we should put that into a formal policy the trust
[1:17:26] Voice 11: council level certainly the whole trust to make level that people can't financially comply we
[1:17:33] Voice 11: shouldn't be proceeding with things and because those cases do exist um and i think i mean really
[1:17:43] Voice 11: I want to stress that I actually don't want a repeat of Denman, where they just adopted
[1:17:49] Voice 11: it immediately.
[1:17:50] Voice 11: I would like for more discussion and input to the local press committee and I put in
[1:17:57] Voice 11: this section, a separate section for Mudge on land use by law, we could put in a separate
[1:18:01] Voice 11: section for DeCourcy, that's up to the local press committee, and how they want to handle
[1:18:06] Voice 11: these disputes or complaints.
[1:18:10] Voice 11: There may be more definitions that are required within the document.
[1:18:16] Voice 11: For us, I've used the term environmentally sensitive areas.
[1:18:22] Voice 11: That includes really any setback from water or the sea.
[1:18:25] Voice 11: That's one thing that everyone should be aware of.
[1:18:28] Voice 11: So if you do go forward with a policy of you want two complaints on munch before proceeding,
[1:18:34] Voice 11: that wouldn't apply to people along the waterfront, properties along the waterfront where you've
[1:18:39] Voice 11: we've got some type of structure and setback
[1:18:42] Voice 11: that will naturally bother the city.
[1:18:44] Voice 11: And if that language needs to be changed,

[1:18:54] Voice 11: it's really up to LTC and what they want to receive.

[1:19:01] Voice 11: I can take all the submissions from MICA
[1:19:04] Voice 11: and try and incorporate that into a report

[1:19:08] Voice 11: with their recommendations and then it'll basically be the option the options will be
[1:19:13] Voice 11: up to local trustee either after especially after july 16th you'll want to adopt them

[1:19:25] Voice 11: into a staff report and into a an amended policy document that everyone from my job can read

[1:21:46] Voice 11: be a large number of people but probably on each island in all trust areas there's be someone who
[1:21:52] Voice 11: absolutely there's no point writing this person's ticket they're probably not going to be able to

[1:21:59] Voice 11: we even talk to family members as well who get involved and they can tell us yes
[1:22:04] Voice 11: this person just does not have the means to financially comply so

[1:22:27] Voice 11: about okay you're giving the by-laws a discretion to do this you may not wish to do it that way you

[1:23:37] Voice 4: In my mind, both of those things would be good.

And then I have to spend hours talking to the ombudsperson about their concerns.
[1:24:21] Voice 11: They can it's a way for them to come to me first, right? We can do it in the public forum, have the discussion, and maybe that'd be better. But that's all of this is entirely up to the local trust committee on how they want to do this.
[1:24:34] Voice 4: I see that both of these, which we're doing right now, are various, right?
[1:24:42] Voice 4: Yeah, great piece of work and I think this is a starting point. I don't think it's a finished draft, so I definitely want to see a lot of conversations, particularly around priorities.
[1:24:55] Voice 4: So 4.1 and 4.2, we just have two priorities and I think, not really set priorities today, but it would be, would it be helpful for the LTC to consider,
[1:25:09] Voice 4: are you know here's this the order of chunks of um the land use bylaw that you know critical

[1:25:30] Voice 4: that um inspection i had a question about 5.1 the any reasonable time um in other local governments
[1:25:40] Voice 4: do they define the hours uh that you can enter a lot or days of the week so provincial laws
[1:25:48] Voice 11: of the local government act that's really what it comes from and all of the land use bylaws
[1:25:55] Voice 11: uh except for some would say they want prior notice or i think it's prior notes
[1:26:01] Voice 11: i think it's just by policy right now that um then maybe 24-hour notice they will probably

[1:26:36] Voice 11: week in advance right it's just about okay we always make an attempt by prior notice anyway

[1:26:46] Voice 11: are open it's about talk to us and then we can arrange time if we need time to go over

[1:26:56] Voice 11: we don't necessarily don't need to visit your property you can provide professional reports

[1:35:17] Voice 11: going to allocate resources are we going to limit the number of files and what we
[1:35:22] Voice 11: can do as far as legal action and the process of proving legal action uh so that the budget issues
[1:35:31] Voice 11: are taken care of as far as staffing and the amount of resources that you are going to put
[1:35:36] Voice 11: to file on course this document is it's the local document

[1:37:33] Voice 11: and I believe it is right in the Trust Council policies, there is a risk that if you complain,
[1:37:39] Voice 11: even though we're supposed to keep it confidential, through legal action, it could be released.
[1:37:44] Voice 11: Somehow through FOI request it could be released. I don't know of any person's name being released
[1:37:51] Voice 11: through an FOI request, but it is possible through legal action. If Honest Trust gets sued over one
[1:38:00] Voice 11: of these, we've taken them to court, they have a counter claim, a judge can decide, yeah, everything
[1:38:05] Voice 11: will be disclosed. There'll be full discovery of the person's name. But again, those are rare
[1:38:10] Voice 11: incidents where and of course if eventually if we want that complainant as a witness they are
[1:38:17] Voice 11: going to make themselves they must make themselves known to the court but you're never going to use
[1:38:22] Voice 11: them as a witness but we almost never need them as a witness i mean they're reporting something
[1:38:28] Voice 11: concerned to us and it's a bylaw officer who goes and investigates and either there's a
[1:38:33] Voice 11: contravention or offense or there isn't and then it's the bylaw officer who is the accuser of
[1:38:38] Voice 11: people view their complainant as the appealant. It's actually the file officer or honest trust
[1:38:43] Voice 11: says, okay, I accuse you of meth. This is an offense. So it shouldn't be directed at the
[1:38:49] Voice 11: complaint. We're going to confirm whether or not there's an offense. We don't write tickets. We
[1:38:54] Voice 11: don't issue penalties based just on a complainant's information. We need to investigate first and then
[1:39:01] Voice 11: proceed from there. So there are lots of people who will not, they'll call me or they'll call
[1:39:06] Voice 11: the office but they won't submit written complaints just under that fear that um they'll be discovered
[1:39:13] Voice 11: and some of them do legitimately fear for their personal safety eyeless the people crying on the
[1:39:18] Voice 11: phone because they're concerned they feel bullied by their neighbors or whatever and they won't make
[1:39:22] Voice 11: complaints and there's nothing i can do we can't we don't take any verbal complaints must all be
[1:39:29] Voice 11: written but there are those island residents out there who they're concerned but they can't do it

[2:22:25] Voice 13: so the the projects on the current and future projects this can be categorized categorized
[2:22:31] Voice 13: into either a major or minor project. So a major project takes place over multiple fiscal years,
[2:22:37] Voice 13: it's supported by a planner from the regional planning team that has a budget of over five
[2:22:42] Voice 13: thousand dollars. A minor project can be completed within 18 months, it's relatively limited in scope
[2:22:49] Voice 13: and requires a budget of less than five thousand dollars. The LTC is permitted to have one minor
[2:22:54] Voice 13: project at a time and currently the LTC has two active projects, they have one major project and
[2:22:59] Voice 13: one minor, the review of the Gabrielos and PN90s bylaws, a major project and a minor
[2:23:05] Voice 13: project to develop an ecological protection zone. So just regarding the current eco-protection zone
[2:23:15] Voice 13: project staff have reached out to me regarding the timing of the referral response and I understand
[2:23:21] Voice 13: that we should receive a response imminently in the next week or so, what I've heard most recently.
[2:23:29] Voice 13: we are expecting that fairly soon. For the future projects list, there's six projects
[2:23:36] Voice 13: on your future projects list and staff have compiled a table with some considerations
[2:23:43] Voice 13: for each of the future projects. The table also highlights some areas where additional
[2:23:48] Voice 13: information is needed from the LTC. So a couple of things that are not in the table are the
[2:23:57] Voice 13: budget and resource allocation for each project, the project's strategic alignment with Islands
[2:24:03] Voice 13: Trust Federation as a whole, and the LTC's objectives and goals for the remaining two years.
[2:24:10] Voice 13: Those are other things that we want to consider as well. So the first, and I believe the projects
[2:24:18] Voice 13: in this list are not in, I think they're just chronological really from when they were added
[2:24:24] Voice 13: to the future projects list. The one at the top of the list is the DeCourcy Island OCP and land use
[2:24:30] Voice 13: bylaw review and one of the questions is just to confirm that this is a project the LTC still
[2:24:37] Voice 13: wants to take on in the future. Next is the development approval information bylaw and again
[2:24:45] Voice 13: just looking for confirmation that that is still a project that LTC wants to take on and also some
[2:24:51] Voice 13: additional information about the purpose of the bylaw rewrite, there are a couple of development
[2:24:57] Voice 13: permit areas that should be added to that bylaw. But we're wondering if there's more
[2:25:04] Voice 13: that would require to be an entirely rewrite of that development approval information bylaw.

[2:25:51] Voice 4: but I understand perfectly the logic of waiting until the OCP is finished so we get all the

[2:27:22] Voice 4: okay if you kind of do and stuff like that, right? The language is just so soft in some of those DPAs.
[2:27:29] Voice 4: But the development and approval of the meeting by-law can be used for other things besides DPAs. So that's my main concern.
[2:27:36] Voice 4: I'm just unclear what applications it would affect. What have we seen come across the desk that would be affected by having a DAI by-law? Because I'm not clear how this would change any business. I would say all of them, but maybe I have to move them on.
[2:27:55] Trustee Luckham (probable): So this information, and Stephen you probably helped us, this information we would be typically looking for, right, would be hazardous slope conditions, water availability, sensitive ecosystems.
[2:28:10] Trustee Luckham (probable): What else would there be? And archaeological sites are something that came up earlier as well, in terms of impacts.
[2:28:17] Voice 13: Yeah, and it would of course depend on the particular application, but yeah, those are
[2:28:23] Voice 13: reports from professionals with expertise.
[2:28:27] Voice 13: One thing I can clarify too is that the LCT does have the ability often to ask for reports
[2:28:39] Voice 13: from applicants as well, when they come, so if there's an application you're considering
[2:28:45] Voice 13: and there's information that you need that's relevant to that application,
[2:28:51] Voice 13: the LTC could pass a motion to ask for additional information from the applicant.

Discussion ensued and Trustees made the following comments: Prioritizing the list is for the purpose of defining work for the next two years; ADOPTED Gabriola Island ADOPTED 5 Local Trust Committee Minutes June 27, 2024 Decourcy Island community has not identified a review of the Official Community Plan and Land Use Bylaw as a priority; Mudge Island Official Community Plan and Land Use Bylaw review need not be comprehensive and can be a targeted Land Use Bylaw project; Rezoning subject property is a priority; Development Approval Information Bylaw is related to development approval guidelines; Advisory Planning Commission Bylaw could be completed quickly but a request to commission members to set meeting times might accomplish the same result; and Heritage Register should follow the Official Community Plan review and be done in consultation with First Nations. GB-2024-051 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee Future Projects List be amended as follows: a) That the Decourcy Island Official Community Plan and Land Use Bylaw review be removed from the list; b) That the Development Approval Information Bylaw and the Heritage Register project be removed from the list and be considered part of and be subsequent to the Official Community Plan and Land Use Bylaw Review Major Project; and c) That the remaining items on the list be prioritized as follows: I. Local Trust Committee initiated Rezoning of PID: 003-134- 806; II. Advisory Planning Commission Bylaw; and III. Mudge Island Targeted Land Use Bylaw. CARRIED 7.4 Draft Letter Regarding Temporary Use Permits for Commercial Vacation Rentals - For Information Received for information. 8. APPLICATIONS AND REFERRALS 8.1 GB-TUP-2024.2 (Dewarle) - Staff Report The Planner summarized the Staff Report and noted the following: Commercial vacation rental is located within an accessory dwelling on the property; Temporary Use Permit (TUP) was issued in 2016 and renewed in 2019; Referral to Islands Trust Conservancy was not flagged in initial Staff Report and proximity of the subject property to Burns Acres Nature Sanctuary warranted referral; and Referral resulted in a requirement of assurance from the Applicant that public access is not permitted from the subject property to the Sanctuary. The Applicant was present but did not speak to the application. ADOPTED Gabriola Island ADOPTED 6 Local Trust Committee Minutes June 27, 2024 Discussion ensued and Trustees noted the following: Current zoning allows for four bedrooms, the vacation rental has two bedrooms, and the Temporary Use Permit should be restricted to two bedrooms; and Request the applicant include information on First Nations history and culture with materials provided to guests. GB-2024-052 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee approve issuance of GB-TUP-2024.2 for a period of three years subject to reducing the maximum number of bedrooms from four to two. CARRIED 11. NEW BUSINESS - none 12. STAFF REPORTS 12.1 Gabriola Island Local Trust Committee Bylaw Compliance & Enforcement Policy - Staff Report ADOPTED Gabriola Island ADOPTED 7 Local Trust Committee Minutes June 27, 2024 Bylaw Enforcement and Compliance Manager Dingman summarized the Staff Report and highlighted the following: Recommendation is not for adoption but for consideration of amendments; There are currently over 120 open files of which 70 are from Mudge Island; Number of files on Mudge Island indicate that there may be problems or concerns with the Land Use Bylaw; Bylaw Compliance and Enforcement Policy will be specific to each Local Trust Committee and will address policies not addressed by Trust Council policy; Trust Council Policy dictates that a complaint is investigated when received; Local Trust Committee has authority to close files but does not open them; Property owners are notified of bylaw complaints prior to investigation; Vexatious refers to false complaints; Actual false complaints make up approximately 1% of files and there are no concerns about the validity of current open files; and The Local Trust Committee can amend the proposed policies and determine the consultation process. Discussion ensued and Trustees provided the following comments: Public information and education sessions on bylaw compliance and enforcement are helpful; Period of reasonable notice to attend a property for investigation be defined; Definition of the term ‘unreasonable’ in regard to ability to comply be clarified; Cultural heritage areas be included in the list where contraventions need to cease immediately; and Clarity is required regarding the phrase ‘reasonable amount of garbage.’ Bylaw Compliance and Enforcement Manager Dingman indicated the following: Complainants names are not released though freedom of information requests; In a court action, the Bylaw Officer becomes the accuser; and Financial ability to comply can be determined through conversation and interviews. GB-2024-054 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee direct staff to revise and edit the proposed Bylaw Compliance and Enforcement Policy and consult with community members through Summer, 2024 and bring it forward by October, 2024 for the Local Trust Committee’s consideration.
