[0:00:00] Trustee Luckham: So, good morning, everyone. Welcome to the Gabriola Island Local Trust Committee regular meeting of August the 8th.

[0:00:08] Trustee Luckham: We're well into summer here in these scorching hot days.

[0:00:14] Trustee Luckham: And as always, I'd like to reflect on where I live and the privilege and honor that I believe comes with that.

[0:00:26] Trustee Luckham: We live here in Coast Salish Territory and beautiful summer days like this would, for me, just highlight the magnificence of this place and the people that have lived here since time immemorial.

[0:00:41] Trustee Luckham: And indeed, the joys and blisses that we experience associated with summer have been experienced here again since time immemorial.

[0:00:52] Trustee Luckham: That said, a lot has changed since colonization of Canada and certainly the British Columbia coast here where we live.

[0:01:04] Trustee Luckham: And things have changed and not all of it good.

[0:01:09] Trustee Luckham: Certainly, there are lots of benefits to what's happened, but there are also a lot of negative things that have happened.

[0:01:18] Trustee Luckham: And at the Islands Trust, we are conscious of that and want to work towards reconciliation, want to sort out the inequities and injustices that have occurred and fix many things that we simply need to as a governing body and appreciate the opportunity to have that work and take it seriously, which I do.

[0:01:42] Trustee Luckham: and i know that my colleagues here um gabriella ltc do as well and on council

[0:01:47] Trustee Luckham: um so with that said just uh briefly introduce uh trustee elliott all

[0:01:55] Trustee Elliott: right natus good morning

[0:01:57] Trustee Elliott: everyone uh toby elliott here on beautiful gabriola island in santa monica first nation

[0:02:31] Voice 4: month has been a rather happy, sad time of listening to stories and plays written by First

[0:02:39] Voice 4: Nations authors. And I just find them profoundly moving. And they really help me. They just remind

[0:02:46] Voice 4: me every time of both the place where I'm living. So thank you for that.

[0:04:40] Trustee Luckham: Well, thank you, Director Craig.

[0:04:42] Trustee Luckham: I must say, just in passing, your name comes up all the time

[0:04:46] Trustee Luckham: and often in many places and many conversations

[0:04:48] Trustee Luckham: that are being had throughout this local region.

[0:04:52] Trustee Luckham: region and just want to appreciate the work that you do. And as chair of the electoral area,

[0:04:59] Trustee Luckham: if I'm not mistaken, and in very many of the committees that you participate in. Thank you

[0:05:04] Trustee Luckham: very much. All right. So let us look to the agenda and I'll look for approval of the agenda.

[0:05:10] Trustee Luckham: You know, it's interesting. We get late correspondence that comes in a couple of

[0:05:15] Trustee Luckham: days before the meeting and um and often that's difficult to uh manage uh with respect to our

[0:05:23] Trustee Luckham: meeting agendas and we had two pieces come in just this morning i think even or late last night

[0:05:29] Trustee Luckham: and very difficult to add to the agenda and also just note that in terms of adding items to the

[0:05:35] Trustee Luckham: and so i'm less inclined to add late correspondence because we're not really

[0:05:38] Trustee Luckham: necessarily prepared everybody may not have read it we may not have uh uh backup information to

[0:05:44] Trustee Luckham: support anything that we might do although certainly if we've read them we can certainly

[0:05:49] Trustee Luckham: consider the topics that are included but i just also make mention of as we go along

[0:05:56] Trustee Luckham: correspondence that is sent to us anonymously it's very difficult to handle and some would

[0:06:03] Trustee Luckham: suggest that something that's sent that is sent anonymously is a rumor not necessarily articulated

[0:06:09] Trustee Luckham: articulated fact of any kind, not to say that we're not receiving facts and that we're not

[0:06:16] Trustee Luckham: prepared to consider ideas and thoughts and concepts that are included in anonymous correspondence,

[0:06:23] Trustee Luckham: but it doesn't end up on our agenda because there's no ability to verify the facts, so to

[0:06:30] Trustee Luckham: speak. And that's applied across the board without bias. And so, although I'm not saying that any

[0:06:38] Trustee Luckham: correspondence we ever received it doesn't have facts in it but it just needs to be equal amongst

[0:06:43] Trustee Luckham: all uh communications received by us so just want to say that right at the start and so i'm not

[0:06:49] Trustee Luckham: inclined to add them to these correspondence although certainly the thoughts that are

[0:06:52] Trustee Luckham: contained in that might become part of a discussion um so asking for any other items to add to our

[0:07:00] Trustee Luckham: agenda and the late correspondence will show up on a future agenda just that is got somebody's name

[0:07:07] Trustee Luckham: attached to it um the vice chair elliot you had a question or yes

[0:07:11] Trustee Elliott: um so in the piece of

[0:07:14] Trustee Elliott: correspondence that we do have 10.1 um will we be able to discuss that and raise it for action

[0:07:23] Trustee Elliott: should we add that to new business no

[0:07:25] Trustee Luckham: absolutely that is the

[0:07:27] Trustee Luckham: correspondence and uh whatever action

[0:07:31] Trustee Luckham: we want to take associated with that particular piece of congress correspondence and uh certainly

[0:07:35] Trustee Luckham: really appreciative of that piece and um looking forward to that discussion with all of you

[0:07:42] Trustee Elliott: and i had one more question um it's actually about future agenda for september

[0:07:47] Trustee Elliott: could we uh perhaps in first nations relationship building 12.6 a brief discussion on um uh inviting

[0:07:57] Trustee Elliott: elder uh perhaps elder geraldine to open our meeting in september and some of the

[0:08:04] Trustee Elliott: um some of the activities in our uh standing resolution around reconciliation we might want

[0:08:11] Trustee Elliott: to action those so i just wanted a bit of a discussion there if we could we

[0:08:16] Trustee Luckham: can so are

[0:08:17] Trustee Luckham: you talking the upcoming meeting of the gabriola lpc well

[0:08:20] Trustee Elliott: i think it'd be good if we discussed it

[0:08:22] Trustee Elliott: now so that we can um have something for september no

[0:08:28] Trustee Luckham: i understand um and happy to have that we can

[0:08:31] Trustee Luckham: have that conversation in upcoming meeting but you are talking about a gabriola ltc meeting

[0:08:36] Trustee Luckham: in september not a trust council meeting in september yes yeah

[0:08:40] Trustee Luckham: okay perfect so let's talk

[0:08:41] Trustee Luckham: about that at 14.1

[0:08:42] Trustee Elliott: uh 12 oh upcoming meetings oh okay sure that

[0:08:47] Trustee Luckham: makes the most sense to me

[0:08:49] Trustee Luckham: okay and would be happy to uh support that so let's talk about that there so we'll just call

[0:08:54] Trustee Luckham: that 14 yeah we'll just add it to 14.1 i'll count on you to raise that in case it escapes my

[0:09:02] Trustee Luckham: for some reason so if there's nothing else to add to the agenda then i'm going to take it that the

[0:09:09] Trustee Luckham: agenda be approved as uh presented and that definitely brings us to the reporting out

[0:09:14] Trustee Luckham: section of our agenda so trustee reports so um who would like to go first uh trustees

[0:09:21] Trustee Elliott: prefer to susan i seem to have okay

[0:09:28] Voice 4: relating directly to the islands trust we had a wonderful meeting i thought

[0:09:33] Voice 4: on mudge island i think that was july 16th and trustee elliott and i and planner stephen bow

[0:09:40] Voice 4: went over by water taxi and we met for i think five and a half hours at the mudge island community

[0:09:49] Voice 4: community hall which is actually their fire their emergency center a very very large Quonset hut

[0:09:56] Voice 4: and they were very gracious and it was great to see parts of Majana that I have not seen for

[0:10:02] Voice 4: a long time so I was thankful for that meeting and secondly I do have a ferry advisory committee

[0:10:10] Voice 4: report relating to the terminal upgrades that we probably now all know about because there's been

[0:10:19] Voice 4: some information in the local newspaper so we did have we as a fact we sent five questions

[0:10:27] Voice 4: to Tamara Olson who is the community relations manager and I'll just very quickly go over the

[0:10:34] Voice 4: questions and the answers so first question what upgrades are planned well for the Nanaimo Harbor

[0:10:41] Voice 4: terminal they plan realigning the berth for better efficiency that is if they get the replacement

[0:10:48] Voice 4: option if that's what they want to do and they plan installing charging

[0:10:53] Voice 4: stations for electric vessels and they plan on building a new lay-by

[0:10:58] Voice 4: berth for the overnight parking. For the Gabriola terminal extending the

[0:11:04] Voice 4: lifespan of the marine infrastructure upgrading the berth to meet flood design

[0:11:09] Voice 4: levels if they opt for the replacement option and then installing charging

[0:11:15] Voice 4: stations for electric vehicles. Second question was how long will the terminals

[0:11:21] Voice 4: be shut down and they are estimating a shutdown of six to eight weeks in the

[0:11:26] Voice 4: spring of 2026 and they'll be developing an alternate service plan in

[0:11:33] Voice 4: consultation with the community. The planning process for that is supposed to

[0:11:39] Voice 4: begin this fall. Third question how will vehicles be able to get on and off

[0:11:45] Voice 4: gabriela during the birth closure we plan to provide a tug and barge service fourth question

[0:11:53] Voice 4: what kinds of alternative means of transit are for passengers they are in the early development

[0:12:00] Voice 4: stages and i guess we'll know more about that a little bit later and the last question um

[0:12:07] Voice 4: what about the emergency wharf it will not be impacted by the terminal work

[0:12:12] Voice 4: and if it's needed during an emergency we will use an alternate location for that water taxi run

[0:12:19] Voice 4: and that practice has been successfully used in the past so that's about as much as we know right

[0:12:27] Voice 4: now for that those two upgrades thank you okay

[0:12:33] Trustee Luckham: very good thank you um both of you think

[0:12:37] Trustee Luckham: So, Trustee Elliott, now your report.

[0:12:41] Trustee Elliott: Thank you, Chair.

[0:12:43] Trustee Elliott: It has been, July was a very busy month for me.

[0:12:48] Trustee Elliott: I just wanted to report the wonderful success of the Muna Canoe fundraiser for Snanamik First Nation members.

[0:12:56] Trustee Elliott: June 28th, we held our fundraiser at Sumi Luntzen.

[0:13:01] Trustee Elliott: Sumi Luntzen, I believe it's called, Twin Beaches.

[0:13:04] Trustee Elliott: It was hugely successful.

[0:13:07] Trustee Elliott: And we raised $2,700 altogether, which was about a quarter of the funds needed to send Munna Canoe to Puyallup.

[0:13:19] Trustee Elliott: And they celebrated.

[0:13:20] Trustee Elliott: There's lots of great photos online if anybody wants to follow Munna Canoe family and see what that event looks like.

[0:13:28] Trustee Elliott: And I'm actually hoping to go next year.

[0:13:30] Trustee Elliott: It's just it looks like a wonderful bringing together of lots of different people.

[0:13:35] Trustee Elliott: and they do welcome a non-First Nation people too.

[0:13:39] Trustee Elliott: July 1st, Canada Day, both Trustee Yates and I attended at the museum.

[0:13:45] Trustee Elliott: There was prayers by Elder Geraldine Matson and Elder Dave Bodley.

[0:13:51] Trustee Elliott: And Susan gave a lovely reading.

[0:13:53] Trustee Elliott: And yeah, it's a great event.

[0:13:56] Trustee Elliott: Culturally committed, we continue to meet.

[0:13:59] Trustee Elliott: We've had our third quarterly community call.

[0:14:03] Trustee Elliott: so that's when we get together it's less formal it's not a workshop we ask questions

[0:14:09] Trustee Elliott: and the conversation turned around indigenous place names and we sort of talked a little bit

[0:14:17] Trustee Elliott: about Powell River and some of the rhetoric that's emerging there Powell River the city

[0:14:24] Trustee Elliott: known as Powell River is located on the traditional territory of the Tla'amen people

[0:14:28] Trustee Elliott: We're a self-governing nation. The regional district has already changed its name to Cathette Regional District, but the city itself is really struggling through a name change process.

[0:14:41] Trustee Elliott: And so the mentors at Culturally Committed spoke to how central and important names are to places, to understanding the places and what sort of functions they serve people and nature.

[0:14:58] Trustee Elliott: And so I just wanted to celebrate and recognize the work of the Gabriela Museum and Historical Society, which has launched their new Szenemuk First Nation Gallery.

[0:15:10] Trustee Elliott: This was conceived and directed by Elder Geraldine Matson.

[0:15:15] Trustee Elliott: It was her vision, and it's a crucial step in respecting the heritage and the understanding of this place.

[0:15:22] Trustee Elliott: The interactive exhibit was launched June 22nd on National Indigenous Peoples' Day and features a touchscreen with interviews, Hul'q'umeenim language information maps, and Sinéamik stories.

[0:15:34] Trustee Elliott: So I'm really proud of the way our Gabriela Museum has really taken the lead on restoring Sinéamik or Hul'q'umeenim place names here.

[0:15:45] Trustee Elliott: um july 9th i participated in the not samat ocean wellness network it was the first in-person

[0:15:52] Trustee Elliott: meeting on gabriela island and the topic was emergency preparedness in relation to weather

[0:15:59] Trustee Elliott: and heat domes and cold weather events so we defer to of course the rdn has the emergency

[0:16:06] Trustee Elliott: management planning for that function but it's really good to know what our community groups

[0:16:12] Trustee Elliott: groups are doing to um to plan uh in coordination with the rdn cultivate festival on july 11th uh

[0:16:21] Trustee Elliott: director craig was also there our mla sheila malcolmson and mp lisa marie barron were

[0:16:27] Trustee Elliott: in attendance it was a lot of fun um i've finally managed to post an update on the

[0:16:35] Trustee Elliott: trustees corner and I'm hoping to write there more often and so my latest update is on the

[0:16:43] Trustee Elliott: Gabriela OCP plan review and sort of the discussion on the relationship between principles

[0:16:50] Trustee Elliott: values and goals and so we're going to have a discussion on that today but just wanted to

[0:16:57] Trustee Elliott: highlight that throughout the summer staff and trustees are going to be at public locations

[0:17:01] Trustee Elliott: uh the saturday farmers market the sunday silva bay market concert on the green um some of the

[0:17:08] Trustee Elliott: brickyard jams to canvas and engage with community members for your thoughts on the draft principles

[0:17:16] Trustee Elliott: so i'll be at the farmers market this saturday and the silva bay market on the 18th and anyone

[0:17:23] Trustee Elliott: can participate through the survey so anyway that's all in the trustee update which i think

[0:17:28] Trustee Elliott: was published in the paper i'm finally getting organized with reports it's the name of days uh

[0:17:34] Trustee Elliott: it was august 26 to 28 and i was able to go on saturday to watch some of the canoe races so that's

[0:17:41] Trustee Elliott: that was really really cool it's just so great to see everyone turn out and cheering on especially

[0:17:47] Trustee Elliott: the youth in this sport um regional planning committee work i we're not meeting until september

[0:17:57] Trustee Elliott: 4th, but I've actually been working over the summer with a group of trustees on a draft

[0:18:06] Trustee Elliott: tiny home pathway. I'm not really sure what to call it yet, but it's what are the options

[0:18:11] Trustee Elliott: available for creating options for tiny homes. And it's sort of a study by a trustee-led working

[0:18:20] Trustee Elliott: So we're hoping to have that ready for UBCM on September 16th to 20th.

[0:18:26] Trustee Elliott: And then also to report on for UBCM, which I'll be in attendance with Chair Luckham.

[0:18:35] Trustee Elliott: And actually, there's, I think, six trustees going this year.

[0:18:38] Trustee Elliott: The Islands Trust has a resolution requesting that the province review the guidelines for composting toilets and greywater practice.

[0:18:48] Trustee Elliott: and that's advanced through avicc and we'll go to ubcm for decision i've been doing quite a bit

[0:18:56] Trustee Elliott: of research on it and speaking to some uh some experts such as highland regional district

[0:19:02] Trustee Elliott: councillor gourd baird who runs uh the eco sense company uh and they concur that the manual is

[0:19:10] Trustee Elliott: overly conservative and does not reflect the scientific knowledge about pathogen decay and

[0:19:16] Trustee Elliott: and phytotoxin control.

[0:19:18] Trustee Elliott: So the resolution proposes that the Ministry of Health

[0:19:21] Trustee Elliott: deal with these barriers by requesting a review

[0:19:24] Trustee Elliott: of this seven-year-old manual

[0:19:26] Trustee Elliott: and is also requesting funding to support demonstration projects

[0:19:32] Trustee Elliott: so that practitioners can learn about the best practices

[0:19:37] Trustee Elliott: and updated the science on the regulation there.

[0:19:43] Trustee Elliott: And finally, I know this is long,

[0:19:46] Trustee Elliott: But I was able to submit an application for a Connects climate preparedness hub, which is, I think, a learning group.

[0:19:55] Trustee Elliott: So Trustee Yates and I and a few community members, Faye Weller and perhaps others.

[0:20:04] Trustee Elliott: I think there's four or five learning modules throughout the fall on information on climate preparedness.

[0:20:11] Trustee Elliott: and so we'll be bringing that back to community groups if accepted it was an application so

[0:20:17] Trustee Elliott: I'm pretty sure we'll get in but looking forward to that learning thank you okay

[0:20:25] Trustee Luckham: much Toby very full month for you so my chair's report fairly straightforward

[0:20:36] Trustee Luckham: extracurricular activities we'll call it I've certainly had community information

[0:20:40] Trustee Luckham: community meetings in the Gambier local trust area that's Gambier and Keats Island and House

[0:20:46] Trustee Luckham: Sound. We had a public hearing there as well and both of these are promoting OCP and bylaw

[0:20:52] Trustee Luckham: work in the Gambier LTC. We've had some meetings with respect to the CAO hiring committee

[0:21:00] Trustee Luckham: and for the benefit of the LTC as well as the public that work is advancing with a consultant

[0:21:08] Trustee Luckham: that is in a recruiting process looking for a potential CAO.

[0:21:13] Trustee Luckham: And the committee is advancing that

[0:21:16] Trustee Luckham: and we hope to fulfill that in the not too distant future.

[0:21:22] Trustee Luckham: But we'll be able to make some announcements later on.

[0:21:27] Trustee Luckham: Not gonna say any more than that

[0:21:29] Trustee Luckham: because sometimes it takes longer than one anticipates,

[0:21:32] Trustee Luckham: but certainly that work is underway

[0:21:33] Trustee Luckham: way and we're well supported by the consultant leaders international that is doing the search

[0:21:40] Trustee Luckham: for us. We're also at the beginning early stages of preparation for council in September which is

[0:21:47] Trustee Luckham: now going to be held in Nanaimo. There was certainly an effort to try and hold that

[0:21:51] Trustee Luckham: on Gabriola again but the opportunity for a location and accommodation proved too challenging

[0:22:00] Trustee Luckham: still at the tail end of summer there, and we certainly look forward to coming back to

[0:22:06] Trustee Luckham: Nanaimo, to Gabriela in the future, but the next meeting will be in Nanaimo.

[0:22:11] Trustee Luckham: And indeed, as Trustee Elliott has spoken to, a number of the executive and trustees

[0:22:20] Trustee Luckham: will be attending the Union of British Columbia Municipalities conference in September as

[0:22:26] Trustee Luckham: well. And there's some preparation work underway to have some strategic plan associated with

[0:22:35] Trustee Luckham: ministers and conversations that we want to have to support the work of the Islands Trust.

[0:22:40] Trustee Luckham: Certainly the composting toilets and sewage management is definitely a topic of discussion

[0:22:47] Trustee Luckham: discussion that since April at AVICC and thank you for that work Toby and yeah there'll be lots

[0:22:57] Trustee Luckham: of report out from from UBCM and looking forward to that opportunity so that's it for my report I'm

[0:23:08] Trustee Luckham: going to go to electoral area director Vanessa Craig for your report good

[0:23:16] Voice 7: morning again and yeah

[0:23:19] Voice 7: I sent just a brief description of some things that I wanted to highlight for you.

[0:23:26] Voice 7: One of the big ones that's upcoming is that there's new waste regulations for multifamily residential business, institutional and industrial property.

[0:23:36] Voice 7: So basically, everybody who isn't a residence that currently has the three separated streams of waste into organics, recycling and garbage.

[0:23:47] Voice 7: garbage. So starting in January, restaurants, stores will all be required to do that stream

[0:23:55] Voice 7: separation. And in concert with that, we've brought in also, and this is done through the

[0:24:03] Voice 7: province. We had to get permission from the province to do this as a pilot because it's not

[0:24:08] Voice 7: done anywhere else in the province with waste hauler regulation and licensing. And so they'll

[0:24:14] Voice 7: They'll also get benefit of reduced tipping fees when they're a licensed hauler that's bringing those waste separated loads because we don't want the people to go to the effort of separating stuff, but then stuff to come to the landfill still in one big container.

[1:01:07] Trustee Elliott: individuals who identify themselves to staff trustees or through the survey. We'll also

[1:01:12] Trustee Elliott: receive an invitation to the focus group meeting. I'm concerned that some of these topics with the

[1:01:20] Trustee Elliott: the number of groups and potentially individuals attending are going to be huge.

[1:01:28] Trustee Elliott: And the purpose of this is for participation of, you know, local knowledge holders and

[1:01:37] Trustee Elliott: people who've been doing work in this space.

[1:01:40] Trustee Elliott: But if we get, you know, five people from GALT, Growls, Sustainable Gabriela, Climate

[1:01:47] Trustee Elliott: Climate 12, 12, 12, GILs, and five participants,

[1:01:51] Trustee Elliott: it's going to be a huge group.

[1:01:54] Trustee Elliott: And I think that's pretty unmanageable for one facilitator.

[1:01:59] Trustee Elliott: I think effective focus group discussions are usually limited to eight to 10

[1:02:04] Trustee Elliott: participants.

[1:02:07] Trustee Elliott: So we might want to consider for some of these larger topics,

[1:02:13] Trustee Elliott: like the suitable land analysis, water balance.

[1:02:15] Trustee Elliott: do we want to have three facilitators and three different groups if say there's 30 people

[1:02:22] Trustee Elliott: interested in participating um that would be one thought um we may have missed out the gabriella

[1:02:36] Trustee Elliott: housing society uh they'd probably be interested in participating in the housing policies

[1:02:40] Trustee Elliott: policies discussion maybe density transfer and density bank and another topic that i don't know

[1:02:55] Trustee Elliott: if we i don't know if it's suitable for focus group discussion but marine and foreshore protection

[1:03:03] Trustee Elliott: um perhaps that's covered under environmental dpas but it just seems to me there's a lot in

[1:03:10] Trustee Elliott: those two categories suitable land analysis water balance ecosystems policies and environmental

[1:03:15] Trustee Elliott: mental DPA options to be covered in essentially two months. So I think we might need to break

[1:03:27] Trustee Elliott: this down a little bit more and think about the invite list and how to make sure that people who

[1:03:36] Trustee Elliott: are coming can participate. And it's not just going to be, you know, too large of a group to

[1:03:44] Trustee Elliott: to be effective.

[1:05:45] Voice 4: the focus groups because they are going to be too cumbersome but i would not endorse this unless we

[1:09:05] Trustee Elliott: and then another thought about the organizations to invite and this is just an idea would it be

[1:09:17] Trustee Elliott: Maybe better to say that there's, you know, 10 seats at the table. We invite two members or two representatives from these four groups. And we're looking for a youth representative and someone who represents families or a young family, for instance.

[1:09:42] Trustee Elliott: So that there's, yeah, just a more diverse representation. It's not just everybody who's focused on ecosystem protection shows up to the suitable land analysis. Well, that's not what suitable land analysis is all about.

[1:09:59] Trustee Elliott: out, it's also considering, you know, housing and water. So people who are going to live in

[1:10:07] Trustee Elliott: this community, as in children and families, probably should be at that table. So can we

[1:10:14] Trustee Elliott: structure it? Or is the planner willing to consider more limited focus groups with a sort

[1:10:22] Trustee Elliott: of a membership or a participation categories? I don't know how that would work. And I don't

[1:10:28] Trustee Elliott: want to limit participation anyway um but we're going to get a preponderance of engaged community

[1:10:36] Trustee Elliott: members from organizations we know that it's going to be a struggle to get families youth

[1:10:42] Trustee Elliott: and representatives from other demographics and i know that you know punner chadwick has

[1:10:48] Trustee Elliott: said we're going to do outreach this summer for families and youth who are underrepresented

[1:10:53] Trustee Elliott: representative underrepresented um but i'm just wondering if yeah what are your thoughts on

[1:25:16] Voice 4: And, and I read their edits of the proposed, you know, policy. I do agree with some of the edits. I'm not an expert. I don't agree with some of the edits. And for me to respond fully, I would really want to meet with, with Warren Dingman.

[1:25:36] Voice 4: I would want to meet, like as a committee, and just ask a whole bunch of questions. Because I have, you know, I have my own ideas about, well, I know why there was a 30 meter setback. And, you know, sometimes there's reasons for these things. And it had to do with the original development of Mudge Island.

[1:25:56] Voice 4: But what I know, and I really appreciate in Micah's letter, is that they say, their last paragraph says, the community supports continued investigation and enforcement of derelict buildings, trailers and vehicles, health and safety concerns, interference with cultural heritage sites, or possible environmental damage.

[1:26:19] Voice 4: So I would not be prepared to support a motion that defers any kind of enforcement on items that that really need enforcement.

[1:26:32] Voice 4: I think that the original, you know, standing resolution that we did was pretty helpful as far as, you know, if it's something requires enforcement, it comes to the LTC.

[1:26:46] Voice 4: We talk about it. But also just listening to Warren Dingman's report at the July 16th meeting on Mudge Island, it seems to me that the actual procedure that bylaw enforcement is doing right now with regard to Mudge Island is quite reasonable.

[1:27:05] Voice 4: and i would like to see that continue um i'm just looking at some of the files that have come to me

[1:27:13] Voice 4: from rob croker for example on closing investigations so clearly you know these

[1:27:20] Voice 4: are being looked at like okay great this we don't need to enforce on that um it's done we're closing

[1:27:26] Voice 4: it i really appreciate that and i i think that this procedure just needs to continue for a few

[1:27:33] Voice 4: few months to see how we're doing with it but I'm definitely I don't want to see the whole bylaw

[1:27:40] Voice 4: enforcement um rewritten for Mudge Island without a really good discussion between our LTC

[1:27:49] Voice 4: and manager Dingman and then taking that back to Mudge Island and saying what do you think

[1:29:51] Manager of Bylaw Compliance and Enforcement: involved in investigations and that actually follows ombudsperson's recommendation that

[1:30:00] Manager of Bylaw Compliance and Enforcement: Officials, councils, or committees make policies.

[1:30:03] Manager of Bylaw Compliance and Enforcement: They don't get involved in the day-to-day.

[1:30:06] Manager of Bylaw Compliance and Enforcement: So what needs to happen at the Trust Council level is whether or not there's going to be any possible changes to who initiates investigations and how and why.

[1:30:19] Manager of Bylaw Compliance and Enforcement: and once that's clear then we know the next steps to take and we can tailor make the policies for

[1:30:30] Manager of Bylaw Compliance and Enforcement: each land use bylaw and by the local trust committee if required if trust council says okay

[1:30:38] Manager of Bylaw Compliance and Enforcement: ltc's uh maybe you should have the power to say okay no where there's certain issues we just don't

[1:30:43] Manager of Bylaw Compliance and Enforcement: want to investigate it then we can change the policies and incorporate them and say okay

[1:30:48] Manager of Bylaw Compliance and Enforcement: Okay, here are the criteria where we're not going to have investigations, say, into unlawful dwellings.

[1:30:52] Manager of Bylaw Compliance and Enforcement: We don't want to enforce on unlawful dwellings, so there's no need to investigate them,

[1:30:56] Manager of Bylaw Compliance and Enforcement: unless there's certain other criteria that require investigation, like health and safety.

[1:31:04] Manager of Bylaw Compliance and Enforcement: So I think that is now an important step, that the Regional Planning Committee review the changes to the draft policies.

[1:31:13] Manager of Bylaw Compliance and Enforcement: Now they're going to go to Trust Council, along with the LTC template, those draft policies.

[1:31:22] Manager of Bylaw Compliance and Enforcement: RPC needs to review it, and then Trust Council needs to have their input on these proposed changes and the path forward.

[1:31:39] Trustee Elliott: I wasn't referring to investigations, though.

[1:31:42] Trustee Elliott: I was talking about the specific policy that you drafted for Mudge Island.

[1:31:52] Trustee Elliott: Can we not work through that with MICA and the LTC before October so that we can all get clear on the rationale, debate the merits of each change instead of just a bunch of correspondence back and forth?

[1:32:06] Trustee Elliott: I recognize that the Trust Council policy on commencing investigations needs to be discussed by Trust Council, but there's lots of elements in this red line version of your draft that really pertains to Mudge Island.

[1:32:24] Trustee Elliott: And I'd like to hear from those community members who are most affected as to why they'd want something changed or not so that then we can make a decision.

[1:32:34] Trustee Elliott: otherwise we're just going to be emailing a bunch of drafts back and forth and i think that's a

[1:34:21] Voice 4: And I'm of the opinion that if a concern comes in or a complaint comes in,

[1:34:30] Voice 4: and it has merit, it's not false,

[2:13:12] Trustee Luckham: that's fair enough. And you're absolutely right. But I think that this embraces that request staff to write a letter in that engagement of staff that will engage other staff resources, I think, to facilitate that.

[2:13:29] Trustee Luckham: I think it's demonstrating the interest in the LTC in advancing this communications. I think that's the intent there. Is that right, Trustee Elliott?

[2:13:41] Trustee Elliott: Well, honestly, to me, to my mind, we need to be proactive, but not a pest.

[2:13:51] Trustee Elliott: If it is, you know, if staff are already advancing and talking about the official community plan, we don't need to advance this.

[2:14:04] Trustee Elliott: Our council to council meetings, we haven't been able to address the topic of our OCP yet.

[2:14:09] Trustee Elliott: And so, frankly, I don't know where we're at with staff to staff conversations. So I think this is a formal letter from our government to the First Nation government saying, here's our projects coming up. We're engaging on the OCP. We're interested in hearing from you.

Chair Luckham called the meeting to order at 10:30 am. He acknowledged that the meeting was

preparedness related to climate events;

 Posted Official Community Plan Review engagement process update on Trustees

 Attending upcoming Union of BC Municipalities Convention during which Islands 
Trust will be requesting the Ministry of Health update the Manual of Composting 
Toilets and Greywater Practice; and 
 Applied to attend Conexts Climate Preparedness Hub. 
 
Trustee Yates reported the following: 
 Attended meeting on Mudge Island to discuss bylaw enforcement policy; and 
 Gabriola Ferry Advisory Committee sent questions to BC Ferries Community 
Relations Manager regarding the planned 2026 ferry terminal upgrades and 
received the following information:  
- Nanaimo Harbour terminal berth will be realigned, a lay by berth built, and 
charging stations to potentially be installed; 
- Gabriola terminal upgrades to extend lifespan of marine infrastructure, 
upgrade berth to meet flood design levels, and charging stations to potentially 
be installed; 
- Estimated shutdown of terminals will be 6 to 8 weeks in spring 2026 and 
alternative service plan will be developed with community consultation 
beginning in the fall; 
- Tug and barge service for vehicles will be provided during berth closure and 
alternative means of transit for passengers is under discussion; and 
- The emergency wharf should not be impacted. 
3.2 Chair's Report 
Chair Luckham reported the following: 
 Attended community meetings in Gambier Local Trust Area including a public 
hearing;  
 Continued CAO Hiring Committee work; 
 Preparing for Trust Council being held in Nanaimo in September; and 
 Attending upcoming Union of BC Municipalities Convention. 
3.3 Electoral Area Director's Report 
Electoral Area Director Craig reported the following: 
 New waste regulations for multi-family residential, business, institutional, and 
industrial properties and waste hauler licensing to be in effect January 2025; 
 Request for Statement of Qualifications for an organization to hold a contract to 
manage the Health and Well Being Coordinator position has closed and staff are in 
process of negotiating contract with the selected group; and 
 Regional District of Nanaimo has worked with the Province to supply water to 
Gabriola Community Bus and a cooling centre during upcoming heat warning event. 
3.4 First Nations Reports - none 
4. PUBLIC COMMENTS 
 Member of the public referred to the July 16, 2024 Local Trust Committee meeting on 
Mudge Island during which a member of the community spoke to a Local Trust Committee 
motion that was passed in April regarding putting a hold on investigations until the bylaw

policy was reviewed and had requested it be included in the bylaws, the Planner read the 
motion referred to and confirmed it only stated the policies and Trustee Elliott said she 
would bring it forward to add a new motion to support that the bylaws be included, and this 
discussion had not been included in the July 16 meeting minutes. They also asked the 
takeaways that Trustee Elliott listed at the end of the meeting be included in the minutes 
and requested confirmation that Trustee Elliott will advance the revised motion. 
o Trustee Elliott replied that she would need to review the meeting recording to 
determine specifically what was said and suggested approval of the July 16, 2024 
meeting minutes be deferred. 
 
 Member of public stated the Mudge Island Community Association has not heard anything 
in response to their letter of July 7 regarding bylaw enforcement policies and asked if 
Trustees have met or conferred with staff to discuss the letter.  
o Chair noted that all Local Trust Committee discussions are required to be held in 
open public meetings and Trustees cannot meet independently to discuss business. 
 
 Member of the Public noted at the July 16 meeting Trustee Elliott said she was going to look 
into the question as to whether or not an investigation is mandatory when a bylaw 
complaint is received. 
o Trustee Elliott replied she had emailed Director Cermak and Interim CAO Julia 
Mobbs with several details from said meeting and is awaiting response and she has 
asked that the files from the 2019 public hearing be made available so she can 
review the public comments as per the Mudge Island Community Association’s 
request.

The Planner summarized the Staff Report and asked Trustees for feedback on focus 
group invitees, timelines, and discussion topics presented in the report. 
Discussion ensued and the following comments were noted: 
 Limit focus group to 10 participants; 
 Engage under-represented groups; 
 Consider breaking down larger topics into smaller categories to focus discussions; 
 Add Gabriola Housing Society to list of potential participants; and 
 Separate marine and foreshore protection into a specific topic.

 Ombudsperson recommends elected officials, councils, or committees make

 Would like a meeting scheduled for Bylaw Compliance and Enforcement Manager 
Dingman to answer questions from Trustees and discuss Mudge Island Community 
Association’s recommendations; 
 Letter from Mudge Island Community Association indicates community support for 
continued investigation and enforcement of derelict buildings, trailers and vehicles 
and for reasons related to health, safety, environmental damage and interference 
with cultural heritage sites; 
 Files are being investigated and closed; 
 Some of the work is specific to Trust Council policy; and 
 Desire to work through the recommendations from Mudge Island Community 
Association to better understand rationale and merits of each proposed change.
