[0:00:22] Voice 5: Gabriela Island, and I'm joined, of course, by your two local trustees, Janine Dodds and David

[0:00:27] Voice 5: David Mott, and we've got our two island planners,

[0:00:30] Voice 5: or sorry, Island Planner, Nerissa Chadwick,

[0:00:33] Voice 5: and Bruce Selcher is joining us,

[0:00:36] Voice 5: who's an island planner too,

[0:00:39] Voice 5: working out of the south office.

[0:00:41] Voice 5: As always, we want to begin by acknowledging

[0:00:44] Voice 5: that we are living, working, and making decisions today

[0:00:46] Voice 5: on the traditional and unceded territories

[0:00:49] Voice 5: of the Coast Salish peoples,

[0:00:51] Voice 5: in particular, the Tsenchawhthyn-speaking peoples

[0:00:53] Voice 5: and of the state niche peoples.

[0:00:57] Voice 5: And so we want to uphold the principles of respect,

[0:01:01] Voice 5: reconciliation, reciprocity, and relationship building

[0:01:42] Voice 6: to say that we have members of the Filipino community who live on Main

[0:01:47] Voice 6: Island and that

[0:01:48] Voice 6: we would like to unanimously express our condolences to

[0:01:52] Voice 6: to the Filipino community within our area,

[0:01:56] Voice 6: as well as Vancouver and all of BC and all of Canada.

[0:01:59] Voice 6: So I think we're all touched by what happened.

[0:02:01] Voice 6: It's appropriate that we mention it in this meeting.

[0:02:11] Voice 5: pretty much communities all across BC.

[0:02:22] Voice 5: it and uh and now we'll open our town hall and the opportunity to ask questions of your local

[0:02:30] Voice 5: trust committee um who can also ask questions of staff so i'll just remind you that this place is

[0:02:35] Voice 5: this is a place of employment and staff have the right to a safe and respectful workplace

[0:02:40] Voice 5: so um if you've got questions or comments please stick to the issues and not personalities and

[0:02:48] Voice 5: direct your questions to the local trust committee and then we can ask staff as needed

[0:02:53] Voice 5: please if you want to address us just raise your hand state your name and go for it anybody here

[0:03:21] Voice 11: the infamous floating dock stuff is it something that i talk about

[0:03:33] Voice 11: 750 stewart drive cordon bay yes sorry

[0:03:37] Voice 11: and we had um so i was in contact with warren i think warren bingman so we had a conversation

[0:03:46] Voice 11: regarding the controversial docks, and prior to signing a consent letter, which we shouldn't have, but we did, in good faith,

[0:03:58] Voice 11: he had communicated to me that if I attach the dock to the uplands part of my property,

[0:04:07] Voice 11: therefore it becomes out of his hands, in essence, so almost word for word.

[0:04:13] Voice 11: he said if you attach the dock the floating dock to the uplands part of your property it becomes a

[0:04:20] Voice 11: transport canada thing so or or another file that gets so i went and spent a thousand bucks

[0:04:28] Voice 11: on chain and attached my my dock to the uplands part of our property and then i got a fifty four

[0:04:34] Voice 11: hundred dollar fine um shortly after that so i uh from

[0:04:40] Voice 21: which agency from

[0:04:42] Voice 11: uh warren's office i guess

[0:04:45] Voice 11: so the bylaw by law office by law i i didn't i couldn't find the folder at the last minute

[0:04:51] Voice 11: uh so just that discrepancy where all of my neighbors still have their floating dogs

[0:04:59] Voice 11: docs none of them were silly enough to sign the consent letter i guess so i did in kind of good

[0:05:07] Voice 11: faith and what warren had communicated to me so i'd like to have that on the record um and i mean

[0:05:14] Voice 11: i'll still pull the doc i'm not that interested in paying 50 or 100 bucks for a doc that's still

[0:05:20] Voice 11: sitting there with everybody else's docs in horton bay until the issues i guess dealt with

[0:05:27] Voice 11: or with everybody, so I don't mean to be of shit to everybody. So

[0:05:31] Voice 5: what are the dates,

[0:05:33] Voice 5: if I can just get up to speed, you might know, or just approximately?

[0:05:39] Voice 6: There are a whole lot of docks in Horton Bay anchored to marine buoys, which it's not zoned

[0:05:45] Voice 6: for, and

[0:05:46] Voice 6: my understanding is if you have a dock on your land and you attach your float to that dock

[0:05:53] Voice 6: and you've got a permit from the Ministry of Resources

[0:05:58] Voice 6: to have that dock, then

[0:06:00] Voice 6: that's legitimate

[0:06:02] Voice 6: because your property, I do believe, is zoned to have a dock,

[0:06:05] Voice 6: but you have to get permission to have the dock.

[0:06:07] Voice 6: So I don't know where the misunderstanding came from.

[0:06:11] Voice 6: That you should actually write up as a formal email

[0:06:14] Voice 6: to the trust committee to pass on,

[0:06:17] Voice 6: but that's usually how it works.

[0:06:20] Voice 6: If you've got a proper dock, then you can attach a float to it.

[0:06:23] Voice 6: My understanding is that all the various docks that are not attached to zoned legal ramps are not permitted.

[0:06:33] Voice 6: And that right now we understood we at the last meeting, we had a group who are going to apply for a temporary use permit who are

[0:06:40] Voice 6: storing their docks at Horton Bay for the winter.

[0:06:42] Voice 6: her right so

[0:06:43] Voice 6: that's the only group to my knowledge that we've heard from um and that the bigger

[0:06:47] Voice 6: question of all the individual docs out there that are not permitted under our city are just

[0:06:53] Voice 6: city in limbo because we don't permit it within our zoning okay and

[0:06:57] Voice 6: uh and we actually never

[0:06:58] Voice 6: formally i've never formally seen an application from a whole bunch of people with docs floating

[0:07:04] Voice 6: to ask us to either change the zoning it's zoning that we inherited from certainly i didn't create

[0:07:11] Voice 6: that's only right it's been around for a long time okay but

[0:07:14] Voice 6: the actual attach yeah you can't just

[0:07:15] Voice 6: chain a doctor for short no so i think if that you know and so i think you need to send us a

[0:07:21] Voice 6: letter and clarify something yeah and then you can then we can at least have some idea of how we can

[0:07:28] Voice 6: clarify what happened there okay perfect fair

[0:08:06] Voice 14: As Janine and David are aware, we're having difficulties

[0:08:10] Voice 14: with understanding what the parameters are around having

[0:08:13] Voice 14: a contract-less yard on what has been continuously termed

[0:08:18] Voice 14: residential in the appearance it gives the residential zoning

[0:08:23] Voice 14: and what is actually agriculture and silviculture

[0:08:28] Voice 14: as part of the land use and the multi-land use.

[0:08:32] Voice 14: I'm not here to speak specifically about that,

[0:08:35] Voice 14: and I know you don't want to,

[0:08:38] Voice 14: and we'll deal with the specifics of the case

[0:08:43] Voice 14: with the process that you have in place,

[0:08:46] Voice 14: so I appreciate that.

[0:08:48] Voice 14: here is more to make a statement

[0:08:49] Voice 14: and

[0:08:50] Voice 5: make

[0:08:51] Voice 14: a statement to Orleans Trust

[0:08:52] Voice 14: that you are not only letting down myself,

[0:08:56] Voice 14: myself, you're actually letting down the complainants with the process you currently have. And I've

[0:09:02] Voice 14: experienced, we had a Zoom meeting with Warren Dingman and David Worthington around, post

[0:09:10] Voice 14: the town hall there. I had a meeting with them, which I can only describe as a disgrace

[0:09:17] Voice 14: trace to Islands Trust. It has completely demolished the word trust. I don't know who

[0:09:26] Voice 14: gave you that other than it's an entity in itself. However, I don't see how any contractor

[0:09:32] Voice 14: could possibly trust, based on Oxford Dictionary, the Islands Trust. It was unprofessional,

[0:09:39] Voice 14: it was uh slanderous and there were um even a racial comment was made okay

[0:09:48] Voice 5: i'm gonna stop you

[0:09:49] Voice 5: there so when we're talking about um uh the understressed employees there is a process if

[0:09:55] Voice 5: you have complaints um i've

[0:09:57] Voice 14: been through it this is relative to my statement it's

[0:10:00] Voice 5: going to go

[0:10:00] Voice 5: through the cao so i will ask not to make statements about our staff in this ltc meeting

[0:10:07] Voice 5: because we cannot do anything about it.

[0:10:09] Voice 14: That wasn't about a staff member.

[0:10:11] Voice 14: That was about statements.

[0:10:15] Voice 14: It's reiterating the fact that Islands Trust is letting down

[0:10:22] Voice 14: the people it supposedly serves, not just myself,

[0:10:27] Voice 14: but also the complainants because here we are with a feud

[0:10:29] Voice 14: between myself and the local residents that is getting out of hand

[0:10:35] Voice 14: And none of us really have enough time on this planet to deal with it.

[0:10:41] Voice 5: I'm making a

[0:10:45] Voice 14: statement for the Red Board that you're letting us down.

[0:10:49] Voice 5: In what manner?

[0:10:51] Voice 14: That this would even be allowed.

[0:10:54] Voice 14: And I had the letter from the CAO stating the lack of professionalism that has been indicated by a staff member

[0:11:02] Voice 14: but that they were unprofessional in the way they handled the situations.

[0:11:06] Voice 14: I'm here to make a statement.

[0:11:08] Voice 5: Okay.

[0:11:11] Voice 5: This is really, it's not for us to adjudicate professional behaviour of our staff.

[0:11:21] Voice 5: Not

[0:11:21] Voice 16: asking for that.

[0:11:22] Voice 5: So I am unclear what you're asking the Local Trust Committee to do.

[0:11:27] Voice 5: And as far as making a statement for the public,

[0:11:30] Voice 5: this is not the appropriate place to talk about that there is a process and that goes to the cao

[0:11:36] Voice 5: if there's an issue with staff so

[0:11:37] Voice 14: you'd rather just put it behind a curtain no and

[0:11:41] Voice 14: not be present

[0:11:42] Voice 14: to the public that these things are actually in our community public

[0:11:46] Voice 5: is not here to adjudicate

[0:11:47] Voice 5: that it's a business play it's a place of employment and there is

[0:11:53] Voice 5: is there is a process to be followed if you have a complaint about staff.

[0:12:02] Voice 6: We, the local trust committee, do not deal with complaints about staff.

[0:12:06] Voice 6: That goes directly to the CAO of the Islands Trust.

[0:12:10] Voice 6: That's who has to deal with it.

[0:12:12] Voice 6: And for you to come and talk about, obviously, you have problems,

[0:12:17] Voice 6: but you're talking to us about things we have no jurisdiction over.

[0:12:44] Voice 14: The process is failing the people it's supposed to serve,

[0:12:53] Voice 6: this is an island stress one you can come yeah it's

[0:12:57] Voice 6: almost an island so

[0:12:59] Voice 5: going to address this address this about your issues you can't really speak on behalf of other

[0:13:03] Voice 5: people in the community so the complainants if they have an issue they can come to your local

[0:13:08] Voice 5: trustees and talk to them about it um i do suggest that um you come and talk personally to your

[0:13:14] Voice 5: your trustees here if you have a problem with the process but I'm not clear about what is the

[0:13:25] Voice 5: purpose of making your statement here today. I

[0:13:28] Voice 14: thought this would be the perfect forum to

[0:13:30] Voice 14: actually try and present a voice that beyond one person the COO and I won't say his name

[0:13:37] Voice 14: has been extremely professional about the matter however the lack of trust this whole ordeal has

[0:13:44] Voice 14: is delivered with Islands Trust,

[0:13:47] Voice 14: I do not believe there's any corrective measures

[0:13:50] Voice 14: put in place for such things.

[0:13:52] Voice 14: You've just referenced, what did you reference?

[0:13:55] Voice 14: Respect, reconciliation and relationship building.

[0:21:25] Voice 7: land conservancy, that discussion is about trying to identify who might want to be able to hold land for housing.

[0:46:26] Voice 20: the foreshore, and it was determined that the work did not comply with zoning, the area

[0:46:38] Voice 20: siting in the sub-battery from the natural boundary of the sea, and we see various applicants

[0:47:55] Voice 20: There are no identified sensitive ecosystems within the proposed development area, but

[0:48:01] Voice 20: nothing has identified eelgrass meadows and eelgrass portal in the presence of cases to

[0:48:07] Voice 20: the proposed riprap construction.

[0:48:11] Voice 20: The shoreline stabilization structures are designed to prevent further erosion of these

[0:48:16] Voice 20: the existing slope. So the soil is primarily soil where the erosion is taking place and the mesh

[0:48:24] Voice 20: wire secured with soil anchors would hold the existing soil in place and the riprap structure

[0:48:31] Voice 20: is designed to armor the shoreline at the toe of the slope to prevent wind and wave related erosion

[0:48:37] Voice 20: based on a high water analysis included in the professional engineer's report.

[0:48:42] Voice 20: If the permits are not approved, the shoreline may be at risk of further erosion due to really

[0:48:48] Voice 20: high rainfall events in the short term and sea level rise in the long term.

[0:48:52] Voice 20: The DC Ferries buildings adjacent to the slope may need to be removed or relocated from their

[0:48:59] Voice 20: distant location to allow their use to continue.

[0:49:02] Voice 20: The applicant could also explore alternative options.

[0:49:07] Voice 20: shorelines, shoreline stabilization that would not involve the structures

[0:49:11] Voice 20: cited in the National Boundary Setback and belong before

[0:49:15] Voice 20: if the application wasn't approved.

[0:49:19] Voice 20: And if the TUP is granted, the applicant would be permitted

[0:49:23] Voice 20: to begin construction work prior to completing the rezoning process

[0:49:27] Voice 20: for the foreshore adjacent to the property.

[0:49:30] Voice 20: A condition of the TUP would require the applicant to begin the application

[0:49:35] Voice 20: process for rezoning prior to expiry of the TUP. And if the TUP were to expire and a rezoning application was not made by the applicant, then the construction work would be non-compliant with the land use

[0:49:50] Voice 20: bylaw work would need to be removed and the site restored to its pretty certain condition

[0:49:55] Voice 20: staff considers that the proposed rationale is reasonable as shoreline

[0:49:59] Voice 20: stabilization structures can protect the village bay ferry terminal from further solar erosion

[0:50:10] Voice 20: impacts on adjacent properties the environment and public use of the village bay uh temporary

[0:53:08] Voice 13: rationale for um proceeding with the tup um but given your explanation i think for future

[0:55:47] Voice 15: pursuing that route with the first nations and we are in communication with them on that

[0:56:06] Voice 5: sort of that engagement with LIACS and SARTLEP?

[1:05:55] Voice 7: before we sent it out to other people and so the way that this so this property is is um it's zoned

[1:14:16] Voice 7: one little element and one bigger element here. The first is just an update to the project charter, just to indicate that the fiscal 2025-26 costs and a little bit of tweaks to the anticipated date by about a month ahead.

[1:14:42] Voice 7: questions you might have. At the last meeting in February, staff

[1:14:48] Voice 7: was provided direction to draft bylaws. And there were some

[1:14:58] Voice 7: things that needed to be sort of revisited. And so that's what

[1:15:01] Voice 7: we're that's what this report does is it looks at those, the

[1:15:06] Voice 7: conversations that were had at the last meeting comes back with some of the um the things that

[1:15:10] Voice 7: were requested from the ltc so um the objective here if we can is to get to a point where we can

[1:15:18] Voice 7: go to those uh get into the draft draft bylaws and resolve any outstanding or identify if there

[1:15:25] Voice 7: are any outstanding to be further uh discussed we can still move forward with with drafting the

[1:15:30] Voice 7: the bylaws for everything, and if there is need for further discussion, we can discuss those items

[1:15:36] Voice 7: forward. So I'll just move through things sort of methodically as I have in the past.

[1:16:22] Voice 7: smaller lots but there was interest in having a maximum size for those that were on lots

[1:16:28] Voice 7: point of one acre to 1.5 acres essentially so 0.4 hectares to 0.6 hectares

[1:16:35] Voice 7: and so the draft there would limit that maximum floor area to 2500 square feet and so

[1:16:48] Voice 7: that's what we we've established for flex housing so basically this would be for those lots between

[1:16:54] Voice 7: one acre and 1.5 acres that are outside the flex housing area within the flex housing pilot area

[1:17:01] Voice 7: that's already the established uh maximum quality any questions on that okay so i think the next

[1:17:11] Voice 7: Next item, I'll require a little bit of dialogue, and I think Trustee Dodds has the colored

[1:18:22] Voice 7: agricultural hall as kind of our center for the rings are um one kilometer two kilometers and

[1:18:28] Voice 7: three kilometers away from the eye call and there's a stars there's stars on the eye call

[1:18:33] Voice 7: and there's stars at that very middle center so that's you know it gives you a general sense of

[1:18:37] Voice 7: where things are at um so in the the shaded area the darker shaded area is the um is the existing

[1:18:48] Voice 7: flex housing and then you see the the blue uh the sort of turquoisey blue there's like a gradient of

[1:18:55] Voice 7: of color that i did and those colors are indications of size so when i looked at it

[1:19:01] Voice 7: I limited it to lots that were over 0.3 hectares and I mean again that's up to you if you want to

[1:19:11] Voice 7: go that small and so that's the sort of bluey color you can see that the keys

[1:19:17] Voice 7: there and then

[1:19:18] Voice 7: and then there's I've indicated which ones are are between like 1.4 hectares and 5.04 hectares

[1:19:38] Voice 7: um so this was all based on that so the other criteria that we discussed was um to not not

[1:19:46] Voice 7: include those within the miners bay area because of salt water intrusion issues and also those that

[1:19:53] Voice 7: are accessed from the Georgina Point Road because of the concerns around the safety of that road.

[1:20:01] Voice 7: You'll note that Maple Drive are not included because that was a discussion I wanted to have

[1:20:11] Voice 7: with you. I know there were issues around the flooding of those so I'm not sure if you wanted

[1:20:16] Voice 7: to include those but this provided and I imagine that those that are on the water side would

[1:20:23] Voice 7: probably have similar like salt water infusion issues as the Maple Bay area properties. So

[1:20:30] Voice 7: yeah so the map is really here as a starting point for discussion and I think it provides

[1:20:37] Voice 7: a nice illustration of what some of the possibilities are and one of the other

[1:20:41] Voice 7: questions I wanted to sort of ask to you so this is really based on those criteria that we discussed

[1:20:48] Voice 7: us uh the safety issues around georgia point georgia point not not putting them into miners

[1:20:53] Voice 7: bay and focusing around the the core uh essentially of the island um and uh i didn't dive into any

[1:26:23] Voice 5: create for the community without let it being exploited by um you know for cash or profit

[1:26:29] Voice 5: development um density banks have been used we we know that they're also being taken off the books

[1:26:38] Voice 5: for some communities um but is there a process other than temporary use permit where like a

[1:26:47] Voice 5: a potential like the the density could be allocated or the the density is allocated in theory but it's

[1:26:53] Voice 5: not zoned for it until the landowner can make an application to the ltc and say this is what i'm

[1:27:00] Voice 5: going to use my extra two cabins for or my cat cottage and a an adu um to at least state their

[1:27:11] Voice 5: their intentions and you know the person and it but the people change

[1:27:15] Voice 5: yeah and people change and

[1:27:17] Voice 5: i agree it goes with the land so it goes with so that's okay oh

[1:27:22] Voice 6: i guess the only thing i see

[1:27:24] Voice 6: if this doesn't give you the subdivision rights no okay so so if you are a developer the best

[1:27:31] Voice 6: you can do is develop a strata with all these limitations on it and hope you find buyers for

[1:27:36] Voice 6: or your strata units at this higher debt, if you choose to do that.

[1:27:41] Voice 6: And it doesn't control what the rents would be or the prices of the dwellings.

[1:48:03] Voice 7: you know amount of water that you know maybe of the sustained families through a three month

[1:48:09] Voice 7: drought period and also um looking at so the the request here was to double check

[1:48:17] Voice 7: cistern sizes and so um you can get from Van Isle Water which seems to be the

[1:48:24] Voice 7: uh big supplier of cisterns for the islands uh you can get three gallon and two or two

[1:48:31] Voice 7: three thousand gallon and two thousand gallon sizes so um um you could you know one of each

[1:48:36] Voice 7: would satisfy that requirement then there was also interest from the LTC in having a smaller

[1:48:43] Voice 7: smaller cistern for dwellings that were under a thousand square feet and um the three thousand

[1:48:50] Voice 7: gallons is what you currently have for secondary suites and so the recommendation um from staff is

[1:48:56] Voice 7: just to keep it at that keep that keep it at that for secondary so you can keep it at that for

[1:49:01] Voice 7: dwellings under a thousand square feet that makes sense okay that's great um okay yeah so there were

[1:49:11] Voice 7: a few other topics so those are those are all the pieces that um related to the bylaws and then

[1:49:20] Voice 7: other topics uh that sort of came up one was exploring the reduced cost for

[1:58:56] Voice 7: maintenance needed you could rent it out right away it can maintain it you know it can maintain

[2:17:06] Voice 5: And a really interesting report that was commissioned by the Union of BC Municipalities

[2:17:15] Voice 5: um anticipating if there's no stimulus spending there'll be a 1.5 reduction in gdp across the

[2:17:23] Voice 5: country and loss of something like 64 000 jobs um this was a presentation by ebcm president

[2:17:29] Voice 5: trish mandewo and so the province is really really turning its mind to economy and uh jobs

[2:17:39] Voice 5: And that is really going to limit, I think, some of the softer, more, a lot of the programs that we've been blessed to have under this current government.

[2:17:53] Voice 5: So it'll be interesting to see how that works out.

[2:17:56] Voice 5: um i did a presentation on the results of a tiny home regulatory project uh sort of jointly with

[2:18:06] Voice 5: the rdn and the island's trust regional district of nanaimo and this was coming out of september

[2:18:11] Voice 5: 2024 island's trust council had funded an initiative to convene technical working group

[2:18:17] Voice 5: of our planners and building inspection experts and industry and wastewater servicing professionals

[2:18:26] Voice 5: to develop options for a regulatory framework our piece regional planning committee will receive

[2:18:31] Voice 5: that final report um at our upcoming meeting on may 9th but the steering or the little steering

[2:18:38] Voice 5: committee for tiny homes has seen it and because we had to do a presentation right away we had to

[2:18:44] Voice 5: vet it and make sure it was okay um but the the amazing thing is we came up they came out with a

[2:18:51] Voice 5: finding that regional district of Nanaimo said oh we didn't realize that industry had gotten

[2:18:57] Voice 5: so close to the building code with this manufactured home design so the CSA Z240MH

[2:19:05] Voice 5: designation manufactured home designation not the RV she said they're so close

[2:19:13] Voice 5: knowing that they'd already reached that building standard meant they could actually issue a building

[2:19:18] Voice 5: permit for it oh oh my goodness um the building chief building inspector stated it would still

[2:19:24] Voice 5: need to be tied down to some kind of foundation and that's been a challenge in the past but there

[2:19:29] Voice 5: are multiple ways we can reach that um in tie downs meeting the building code or finding

[2:19:34] Voice 5: alternative ways with the structural engineer so they stated that there's a number of options that

[2:19:39] Voice 5: tiny homes can be on wheels and still be tied down and meet code requirements so this is really

[2:19:45] Voice 5: really good news and and actually the rdn was very excited about it and ready to sort of promote this

[2:19:51] Voice 5: through the building interaction professionals industry and so um the crd is also expressed

[2:19:59] Voice 5: interest uh pulpit is right in there with the uh the steering committee and uh we're continuing to

[2:20:05] Voice 5: have meetings and and figuring out how to keep

[2:20:10] Voice 5: so that was my significant uh piece
