[0:03:00] Voice 7: and some resolution hopefully which is on the short-term rentals and also the issue of um

[0:03:07] Voice 7: the olsen farm for the festival and the um ball fair that's an issue

[0:03:45] Voice 7: short-term rentals hopefully we can get some resolution to that and there's also the issue

[0:03:49] Voice 7: of Olsen Farm, Rose New York Farm,

[0:03:53] Voice 7: so that we can make sure that the summer festival

[0:03:56] Voice 7: and the fall fair can happen this year

[0:03:59] Voice 7: be a total tragedy to a lot of people on the island,

[0:04:02] Voice 7: a lot of businesses that we rely on.

[0:04:05] Voice 7: So hopefully we can get resolution for that as well.

[0:04:08] Voice 7: We've got Yerger here, he's very keen

[0:04:21] Trustee Peterson (probable): anyway uh okay so for my chair's report uh don't go on too long uh trust council uh met uh

[0:04:34] Trustee Peterson (probable): jesus was it only last week yes it was last week uh for our quarterly meeting focused uh as usually

[0:04:41] Trustee Peterson (probable): remark meetings are on the budget um quite a lot of wrangling uh we still ended up with a

[0:04:49] Trustee Peterson (probable): fairly substantial um uh budget in a tax increase um and despite the alarming looking numbers i did

[0:05:01] Trustee Peterson (probable): get from staff that the estimate is it's really going to translate on the uh average property

[0:05:09] Trustee Peterson (probable): across the trust area is valued at eight hundred and sixty seven thousand dollars

[0:05:15] Trustee Peterson (probable): and this budget is going to have an impact estimated between 20 and 40 dollars

[0:05:21] Trustee Peterson (probable): for a property of that value um and then as the ongoing policy statement uh review project staff

[0:05:33] Trustee Peterson (probable): identified um it's unrealistic to expect that we will complete the project before the end of the

[0:05:40] Trustee Peterson (probable): term at this point and there's a large number of public responses and those will still be compiled

[0:05:46] Trustee Peterson (probable): and analyzed as well as responses from the local trust committees first nations and the other

[0:05:51] Trustee Peterson (probable): agencies with which we work work is expected to continue to organize those responses and further

[0:05:57] Trustee Peterson (probable): consideration by trust council but it is no longer deemed realistic that that project will get

[0:06:05] Trustee Peterson (probable): completed before the end of term uh so i'm gonna just cut my um remarks short there so i don't want

[0:06:14] Trustee Peterson (probable): to go too long don't believe we have the electoral area director joining us today um so we have a

[0:06:24] Trustee Peterson (probable): public comment period coming up here and um we have a busy meeting and uh only so much time

[0:06:33] Trustee Peterson (probable): so uh by the meeting procedures bylaw we have a 15 minute window for public comments

[0:06:39] Trustee Peterson (probable): um and just explain to you if uh trustees wish after that 15 minutes it's up to pass a motion to

[0:06:47] Trustee Peterson (probable): extend that period of time then that can happen and if a motion isn't passed then we we just move

[0:06:52] Trustee Peterson (probable): on into the uh the rest of the agenda so with that in mind um and we have received many many

[0:07:23] Trustee Peterson (probable): um new information um that we or new new insights um as much as possible and uh and we all know that

[0:07:35] Trustee Peterson (probable): short-term vacation rental is top of mind for probably i'm going to guess most of you in the

[0:07:40] Trustee Peterson (probable): room um but also if there is a comment on um the central road application uh then we'd also like

[0:07:49] Trustee Peterson (probable): to hear that so just wanted to preface by saying we know our time is short so i still want to give

[0:07:56] Trustee Peterson (probable): you guys a space but if we give everyone three minutes we won't get out of here um in a reasonable

[0:08:02] Trustee Peterson (probable): time today so i'm not going to presuppose whether trustees want to give a long public period or not

[0:08:51] Voice 23: Yeah, I'm Luke Fanger. I've been coming to Hornby for 49 years.

[0:08:55] Voice 23: I have to maintain my summer place I've rented to friends over those 49 years.

[0:09:03] Voice 23: And I am concerned that short-term vacation rentals are not permitted in the winter months.

[0:09:09] Voice 23: and I think measures contribute to the economy of the island

[0:09:14] Voice 23: and I'm not sure why non-residents are being prohibited

[0:09:21] Voice 23: from or discriminated against and can no longer rent

[0:09:26] Voice 23: if this goes through as proposed.

[0:09:29] Voice 23: And the final question is if there's a firm cap is set

[0:09:33] Voice 23: on short-term vacation rentals on Hornby,

[0:09:35] Voice 23: what is the selection process

[0:09:37] Voice 23: process if the applicants which meet all the criteria for temporary use permits are received.

[0:09:45] Voice 23: So that's unclear to me. So I'm hoping to continue my rentals and looking for support

[0:09:55] Voice 23: to do that.

[0:09:58] Voice 23: Thank you.

[0:10:05] Voice 24: Ian Thomson, on short-term rentals, assuming a number of 135 and a total housing stock

[0:10:12] Voice 24: stock of 700, that represents almost 20% of the total housing stock. Quite an interesting

[0:10:18] Voice 24: number. In terms of the number of rental units versus total population, permanent population

[0:10:27] Voice 24: it works at about 1 in 10, 1 in 9, 1 in 10, which is quite an impact on the community

[0:10:34] Voice 24: when you think in terms of a constantly rotating neighbourhood.

[0:10:40] Voice 24: Now, 130-odd rental units, the stewards of this are the trustees.

[0:10:50] Voice 24: The trustees are supposed to represent the interests of the entire population of the island.

[0:10:56] Voice 24: The short-term rental unit population represents a very small part of that.

[0:11:01] Voice 24: I urge the trustees to understand that they are responsible for the whole of the population

[0:11:09] Voice 24: and not just a vocal minority.

[0:11:15] Voice 21: Hello, folks. My name is Ian Bowen. I'll do this very quick.

[0:11:18] Voice 21: I would like you to reconsider the permanent residence requirement.

[0:11:23] Voice 21: We have been here since 68, coming up every year.

[0:11:27] Voice 21: And I think that the future consequences for the young people of Hornby Island are severe.

[0:11:32] Voice 21: year if you put on a permanent residence requirement um the 2021 census had 41 percent

[0:11:39] Voice 21: i believe of the island residences having permanent residents and so that has all sorts

[0:11:48] Voice 21: of implications i mean if you want to be i don't uh anyway that's that's that's my only comment

[0:11:53] Voice 21: i'm going to pass it on to other people i would like you to reconsider that and uh not restrict

[0:12:02] Voice 21: The nature of Point B Island and that percentage is extremely different from all the islands

[0:12:07] Voice 21: where 75% of them are permanent residents and so on.

[0:12:11] Voice 21: And so that's inappropriate, we're going to have negative consequences for the economy

[0:12:16] Voice 21: and young people can't just look at it from the seniors perspective, you know, the quiet

[0:12:20] Voice 21: island.

[0:12:29] Voice 22: Greg's here. I have a connection to Hornby going back 40 years, so I've been here as a kid, teen, a young man, and now a dad.

[0:12:42] Voice 22: I love this island. I'm not a resident, but I love it. My kids love it. We come here as much as we can, enjoy it.

[0:12:51] Voice 22: I'm not a resident of this island, but I feel I'm a part of the community of this island.

[0:12:58] Voice 22: And I urge the trustees to consider those of us that are part of the community.

[0:13:05] Voice 22: And I know it's hard to build consensus, but I urge you to do the hard work.

[0:13:11] Voice 22: It feels like, from what I understand, it's been close to reaching consensus.

[0:13:15] Voice 22: census please represent the entire community and look out for those of us that have connection

[0:13:24] Voice 22: to the island but who rely on shorter rentals to keep it in the family and thank you for the hard

[0:13:32] Voice 22: work you do and yeah that's my perspective good

[0:13:45] Voice 12: afternoon or good morning um i just want to

[0:13:48] Voice 12: before i start correct a couple things there are 1117 as of 2021 buildings on the island

[0:13:53] Voice 12: 41 which are part-time residents um and vacation rentals represent less than 10 percent of the um

[0:14:02] Voice 12: of the population coming to the island in the summer um now sorry i'll start and i am going

[0:14:10] Voice 12: to try and keep an eye on you um my mom dedicated her life to creating our home here the idea that

[0:14:16] Voice 12: a material decision may give them an independent assessment of this impact the course is heartbreaking

[0:14:23] Voice 12: cornby is the only island where vacation rentals are illegal property use we are unique most

[0:14:30] Voice 12: members of our communities now face irrevocable harm we can't just see what happens most of our

[0:14:37] Voice 12: families won't survive and experiment with our livelihoods

[0:14:41] Voice 11: the amenities successfully

[0:14:42] Voice 11: are sworn to secure and protect, encompass the responsibility

[0:14:47] Voice 11: to

[0:14:50] Voice 12: protect the lives of the people who made this island work,

[0:14:54] Voice 12: regardless of their residency.

[0:14:56] Voice 12: These changes will harm the families who are excluded,

[0:15:01] Voice 12: the full-time residents who maintain these properties,

[0:15:04] Voice 12: the artists who depend on the summer economy and the local businesses

[0:15:07] Voice 12: trying to keep their doors open year round.

[0:15:10] Voice 12: The problem explicitly excluded the Island's Trust from the permanent resident requirement.

[0:15:18] Voice 12: For our trustees to think about it now with no independent information to determine the impact

[0:15:24] Voice 12: creates a discriminatory barrier against the 41% of women who are part-time residents.

[0:15:31] Voice 12: Almost everyone agrees that 162 in 2018, the number of rentals had grown far too much.

[0:15:38] Voice 12: Today there are between 80 and 100. That is a 40 to 50 percent reduction in eight years.

[0:15:52] Voice 12: An Ireland's first staff report from 2012 determined 80 to 100 is a contained and

[0:15:59] Voice 12: compatible number for Hornaby's rural character. What is the rationale that has changed that

[0:16:05] Voice 12: assessment. Where is the independent analysis that supports either a permanent resident

[0:16:10] Voice 12: requirement or a cap below that baseline? By forcing a cap of 65 for the permanent resident

[0:16:17] Voice 12: requirement, the LTC is effectively closing the door on the merits of neighbors who have

[0:16:22] Voice 12: been compliant for decades. While good regulations

[0:16:34] Voice 12: will improve our rentals, penalizing local

[0:16:50] Voice 12: I ask the LTC to acknowledge that with a 40 to 50% reduction, growth has not just been

[0:16:58] Voice 12: contained, it has been reversed.

[0:17:01] Voice 12: That at less

[0:17:02] Voice 12: than 10% of the summer population, rentals are too small a proportion for more

[0:17:07] Voice 12: cuts to have a noticeable impact on ferry weights or water usage. Just because they aren't printed

[0:17:12] Voice 12: does not mean they will be empty. Based today's decision on the objective history of this island,

[0:17:20] Voice 12: 80 to 100 rentals offered by all categories of residents remain a contained and compatible

[0:17:26] Voice 12: number. I urge the LTC to remove the permanent resident requirement and set a cap based on the

[0:17:32] Voice 12: actual number of legal compliant vacation rentals please choose a path of alignment over division

[0:17:55] Trustee Peterson (probable): booze are welcome so i i totally get that you may be uh in alignment with the sentiments you heard

[0:18:24] Voice 3: saying it's a very important topic very important a little while ago a few months ago a number of

[0:18:32] Voice 3: months ago there was a very important thought that came up and the island's trustees said

[0:18:38] Voice 3: we're going to let you talk as long as you want to talk because it's very important

[0:18:43] Voice 3: um what i'm hearing now is hey you've heard enough that you haven't because nothing's

[0:18:49] Voice 3: changed in four years four years ago when you were asked why are you doing this is because

[0:18:55] Voice 3: the fairies overloaded the sewers the water today last meeting what did we hear the fairies the

[0:19:06] Voice 3: the water, the sewer, right?

[0:19:09] Voice 3: So you've heard nothing else.

[0:19:10] Voice 3: You haven't heard what's,

[0:19:11] Voice 3: you haven't taken into account what has been done,

[0:19:14] Voice 3: what people are trying to do,

[0:19:16] Voice 3: how we're trying to get control of it,

[0:19:18] Voice 3: and the weight difference that we're making.

[0:19:20] Voice 3: Not hearing that, you don't want to hear it.

[0:19:22] Voice 3: You have a decision, you've made it up,

[0:20:21] Voice 3: island because i can tell you most of us here feel that you haven't heard a thing that would set

[0:20:37] Voice 9: my name is sean peterson and i'm just gonna make a comment on the process

[0:20:41] Voice 9: because i have never seen a process that is so flawed as this one has been it is there's i think

[0:20:48] Voice 9: i i don't know i

[0:20:49] Voice 9: think you know all of these types of uh assertions and it's the most subjective

[0:20:54] Voice 9: process I've ever seen. There's nothing objective that speaks to this. This should be set aside

[0:21:00] Voice 9: for now until a new council has been elected and a process is put in place to put the right

[0:21:07] Voice 9: information in front of everyone so decisions can be made. There is nothing that speaks to

[0:21:13] Voice 9: this change so far. It needs to be set aside and you need to wait until we have a process that

[0:21:19] Voice 9: accommodates everyone's needs and an understanding of what's truly happening on the island. Because

[0:21:23] Voice 9: can tell you fixing eight percent of the septic fields doesn't fix the second problem on this

[0:21:27] Voice 9: island last two two sessions ago if it is causing a water problem on this island we need to deal

[0:21:34] Voice 9: with that as an island not not eight percent so anyways um set it aside uh wait for another day

[0:21:48] Voice 18: my name is ariane baxter um i've been coming up for about 40 years now

[0:21:52] Voice 18: um originally we had a place on the island and for probably 30 years we rented short rental

[0:21:59] Voice 18: And that allowed them to keep coming.

[0:22:02] Voice 18: Sorry, it's so glitchy.

[0:22:03] Voice 18: That's me and a mic.

[0:22:05] Voice 18: You know, and I guess now we're going to place it again.

[0:22:08] Voice 18: But we're not permanent residents.

[0:22:10] Voice 18: We are partner residents.

[0:22:11] Voice 18: And we do rent our house out, and that's how we keep it.

[0:22:15] Voice 18: I just want to speak to the fact that my family wouldn't have had a chance to love the island the way we do if we couldn't have rented during all those times.

[0:22:23] Voice 18: And if you had limited the access to that sort of rentals.

[0:22:26] Voice 18: you know we became really good friends with the people we stayed with and it was magic so and then

[0:22:32] Voice 18: back to your original process four years ago you were trying to just cap the 130 by taking it away

[0:22:37] Voice 18: but then the provincial government threw you a really good curveball with their um removing the

[0:22:43] Voice 18: grandfathering like you had a good plan and you were letting it go away by attrition you were

[0:22:48] Voice 18: going to disallow it but the provincial government threw you a curveball and so as far as the last

[0:22:54] Voice 18: meeting on the 3rd, I just think

[0:22:56] Voice 18: I don't, like other people

[0:22:59] Voice 18: I think your cap of 65 is

[0:23:00] Voice 18: a random number, you're

[0:23:03] Voice 18: not even listening to your own staff that found

[0:23:04] Voice 18: me 87, you know, did the data research

[0:23:06] Voice 18: on how many are

[0:23:08] Voice 18: registered with the provincial government and are trying

[0:23:10] Voice 18: to do it right, so I think I'd really

[0:23:12] Voice 18: encourage you to re-look at your cap

[0:23:14] Voice 18: if this is the post-issue going, and I would

[0:23:16] Voice 18: really encourage you to look at what

[0:23:18] Voice 18: principal resident means

[0:23:20] Voice 18: you're throwing around different terms

[0:23:23] Voice 18: and whether you're going to go with what the province is doing you need to look at that

[0:23:27] Voice 18: seriously if you look at what tofino struggling with they're trying to pull back out and if you

[0:23:32] Voice 18: are trying to support some young people here who might rent or other families who then could maybe

[0:23:36] Voice 18: rent out in the summer like go away rent their home out they won't be considered principal

[0:23:41] Voice 18: residents if they just rent here so you really need to look at what that does because that's

[0:23:46] Voice 18: what tofino has experienced so if you consider opting into the province you really need to take

[0:23:51] Voice 18: some time to look at what that means um and you need to get your terminology principal residence

[0:23:57] Voice 18: is a very different meaning than permanent resident which is a very different mean the

[0:24:01] Voice 18: primary business so i just really encourage you to do your homework you have a fabulous staff

[0:24:06] Voice 18: so please ask them for their help and i also just really appreciate that you're not in your

[0:31:48] Voice 20: Our intention is to ensure that the relationship between legally operating accommodation providers,

[0:31:55] Voice 20: workforce housing, and the funding that supports these initiatives is clearly understood and that

[0:32:02] Voice 20: the implications for mrdt supported programs are carefully considered before making any decisions

[0:33:24] Voice 20: letter of support for the affordable workforce housing initiative and crown land tenure request

[0:33:29] Voice 20: we are working with the cbrd and believe that project could move forward and we need the

[0:33:35] Voice 20: endorsement of our local zoning authority the second is to fast track the pua zoning

[0:33:41] Voice 20: zoning, the by-law correction, and reinstate community housing as an allowable use.

[0:45:56] Voice 14: Hornby Island and its community are at the heart of the Fall Fair and the Hornby Festival, and our mandates are to serve the community at large.

[0:46:04] Voice 14: We do not impact the land of Rosemere Farm or the viability of farming on this property.

[0:46:11] Voice 14: There is no other suitable non-ALR venue on the island capable of hosting the Hornby Festival or the Fall Fair.

[0:48:47] Voice 14: pause for a year without significant organizational consequences. Reopening after a hiatus would be

[0:48:54] Voice 14: difficult, if not impossible, as seen with the recent closure of several Canadian music festivals.

[0:49:02] Voice 14: Stability and sustainability depend on continuity of experienced staff and board leadership,

[0:49:09] Voice 14: multi-year funding relationships, and the ongoing engagement of returning volunteers and audiences.

[0:49:16] Voice 14: At present, we are already contracting local, provincial, national, and international artists whose tours are planned around our festival.

[0:49:26] Voice 14: We have legally binding agreements in place and cancellation would result in substantial financial penalties and hardship.

[0:49:32] Voice 14: We also have contractual obligations to staff and government funders.

[0:49:38] Voice 14: without the required tup and alc approvals in place

[0:49:42] Voice 14: right we will it would not be possible to operate this year our third request is that if timely

[0:49:53] Voice 14: approval is not achievable we request consideration of a one-year grace period including a motion

Chair Peterson reported the following: 
• The recent Trust Council meeting focused on the adoption of the budget which 
will result in a property tax increase of $20 to $40 based on the average value of 
homes located within the Trust Area; 
• The Draft Trust Policy Statement project will not be completed by the end of the 
current term as referral responses and community feedback continue to be 
analysed and considered by Trust Council.

5. PUBLIC COMMENTS 
Chair Peterson noted the Meeting Procedures Bylaw specifies a public comment period be 
limited to 15 minutes, which can be extended by the Local Trust Committee. He stated a 
significant number of comments have been received regarding short-term vacation rentals 
during previous public comment period, at the March 3 special meeting, and through email 
and asked that members of the public speak to new information not already heard. 
Several members of the public spoke to the requirement of permanent residency as a 
condition of operating a short-term vacation rental and the following points were recorded: 
• Part time residents have been coming to the island for years and are considered 
members of the community; 
• The requirement will impact the younger population and the economy negatively; 
• Over 40% of home owners are part time residents and members of the community will 
be harmed if the permanent residency requirement is enacted; 
• Those that are not permanent residents will be cut off from coming to the island that 
they have been coming to for years; 
• Many island homes are multi-generational properties and without the ability to offset 
costs through vacation rentals there will be a permanent loss of families; 
• Families have inherited properties and if they can not rent them, they will sell them and 
this will change the demographics of the island; 
• Islanders share the same values of sustainability regardless of residency status. 
A member of the public spoke to short-term rentals not being permitted in winter months, 
the negative impacts of the residency requirement, and asked what the selection process 
would be if all applicants met the requirements of a Temporary Use Permit and there were 
more applications than the cap. 
A member of the public stated the number of rental units compared to population works out 
to 1 in 10 which results in negative impacts on the community and Trustees are supposed to 
represent the entire island and not only rental operators who make up a small percentage of 
the population. 
A member of the public stated vacation rentals represent less than 10% of the population 
coming to island in the summer months, members of community will be harmed due to the 
impacts of the permanent residency requirement, the province excluded the Gulf Islands 
from this requirement, there has been no independent analysis to support a cap or 
residency requirement, the Local Trust Committee is closing the door on operators that 
have been compliant for decades, and short-term rental growth has been contained. They 
asked the Local Trust Committee to remove the permanent resident requirement and set a 
cap based on the current number of legal operators. 
A member of the public stated four years ago the reasons given to cap short-term rentals 
were ferry overload and water and septic issues, the Local Trust Committee has not taken 
into account what has been done in the four years since, the decision will affect workers, 
operators are doing a good job, and they think Trustees are not hearing what is being said. 
A member of the public stated the process is flawed, there is no objectivity, and the issue 
should be set aside until a new council is elected and can put a process in place that 
accommodates everyone.

By general consent the public hearing period was extended by 10 minutes. 
A member of the public stated Hornby belongs to all of BC, tourism is being cut off, and 
concerns can be addressed in other ways by raising the bar on type of visitors that come. 
A member of the public, representing the Hornby Island Community Economic 
Enhancement Corporation stated approximately 60% of Municipal and Regional Tax (MRDT) 
revenues collected on Hornby are directed towards workforce housing, $250,000 has been 
accumulated and dedicated to affordable workforce housing, balancing housing needs and 
economic vitality is complex, their intention is to ensure the relationship between legally 
operating accommodation providers, workforce housing and the funding that supports 
these initiatives is understood and that implications for MRDT supported programs need to 
be considered before moving forward.  
A member of the public, representing the Hornby Island Community Economic 
Enhancement Corporation submitted a letter requesting the Local Trust Committee provide 
support for the affordable workforce housing initiative including reconsideration of a letter 
of support for securing tenure on the proposed Crown land site based on the progress that 
has been made through discussion with the Comox Valley Regional District and the urgency 
of the housing need. They also request that the correction to the Public Use zoning be 
separated from broader bylaw amendments and fast-tracked. 
A member of the public spoke to the potential negative impacts of the residency 
requirement and asked Trustees to not move forward, leave the decision for the next 
council, and hire professionals to provide information on how to keep the community 
economically viable.

regulations was on hold while the major project underway. 
The Local Trust Committee requested the item be moved to the Minor Projects list.

9. APPLICATIONS AND REFERRALS 
9.1 PLALR20260065 (9925 Central Road) - Staff Report 
The Planning Technician summarized the staff report and highlighted the following: 
• The application to the Agricultural Land Commission is to permit a non-farm use 
on land in the Agricultural Land Reserve; 
• The Local Trust Committee determines if they wish to forward the application to 
the Agricultural Land Commission; 
• The Property owner has applied for a Temporary Use Permit to allow the use on 
the property; 
• If the Agricultural Land Commission approves the application the Local Trust 
Committee can proceed with considering the Temporary Use Permit application. 
The applicant’s representative was in attendance and presented the following: 
• The owners of the property operate a cattle farm on land within the Agricultural 
Land Reserve; 
• The fall fair and festival events do not impact the land’s suitability for farming; 
• Requested the Local Trust Committee to forward the application to the 
Agricultural Land Commission without comment or delay, and provide a letter of 
support confirming the urgency of matter; 
• The application for a Temporary Use Permit needs to be in process for the 
Agricultural Land Commission application to be successful; however, they can 
not bring a Temporary Use Permit application forward until the Agricultural Land 
Commission approves the non-farm use application; 
• The Agricultural Land Commission has indicated applications take 3 months to 
process; therefore, it will not come back to Local Trust Committee in time for the 
applicant to organize and host the events; 
• A one-year hiatus will harm the long-term viability of the festival; 
• They are already contracting artists and cancellation would result in financial 
penalties; 
• Without required approvals in place it would not be possible to operate the 
events. 
Discussion ensued and the following comments were noted: 
• There is a letter of support included as part of the response; 
• The only way to allow a use not currently permitted is through a Temporary Use 
Permit or a rezoning application; 
• As long as the Temporary Use Permit application is open, and until such time a 
decision is made, the applicant can expect not to have bylaw enforcement to 
take place as confirmed by the Islands Trust Bylaw Enforcement Manager; 
• The Planner will consult with Agricultural Land Commission staff to confirm if a 
Temporary Use Permit can be issued in advance of the Commission’s decision, 
and if permitted it can be brought back to the Local Trust Committee at the May 
1 meeting.

10. LOCAL TRUST COMMITTEE PROJECTS 
10.1 Major Project: Hornby Island Official Community Plan and Land Use Bylaw 
Review - Staff Report 
The Regional Planning Manager summarized the staff report and highlighted the 
following: 
• Amendments, as directed at the March 3 meeting, have been incorporated into 
the draft bylaw including a cap of 65 Temporary Use Permits, the requirement for 
principal residency, and draft guideline language; 
• Should additional information be requested from staff it is unlikely that the 
bylaw would be approved prior to the end of the term. 
Discussion ensued and the following comments were noted: 
• The previous staff report recommended a cap of 87; 
• There is no rationale for the principal dwelling requirement; 
• Some Local Trust Areas have opted into the Provincial principal residency 
requirement; 
• A Trustee noted their rationale for a cap of 65 was based on most municipalities 
not allowing more than 10% of homes be allowed to operate a short-term rental, 
there are on 635 homes on Hornby; therefore, the cap represents more than10% 
of homes. 
• A Trustee stated if the cap was set at 65, priority could be given to principal 
residents leaving a number of Temporary Use Permits available to non residents; 
• Staff clarified the Local Trust Committee, through land use regulations, does not 
have authority to give priority to residents; 
• The Local Trust Committee will be provided with a staff report to see how the 
Temporary Use Permit process will be administered.
