[0:00:26] Voice 6: 6, and we as always want to begin by acknowledging with respect and humility that we are meeting

[0:00:35] Voice 6: today on the unceded ancestral lands and waters of Salish peoples, in particular the Wasaytnich

[0:00:43] Voice 6: Nation and Tsimshon speaking peoples, whose deep connection with these islands and waters

[0:00:49] Voice 6: continues to this day.

[0:00:51] Voice 6: We honor their enduring presence, constitutional rights, and responsibilities.

[0:00:57] Voice 6: My name is Toby Elliott. I'm serving in my capacity here as chair of the South Pender Local Trust Committee, and I'm joined by your two local trustees, Christine Evans and Dave Falk. Would you like to say any words, introduction or opening?

[0:02:09] Voice 6: we're here to conduct the business before us today with that we'll get into the agenda

[0:02:16] Voice 6: are there any amendments and I know there is one late addition um which we'll put under new

[0:02:23] Voice 6: business or is that to go under yeah that'll just be new business 17.3 is there anything else

[0:02:33] Voice 9: the new item oh

[0:02:34] Voice 6: it's the expenses um it's the budget for 2027 28 budget request

[0:02:42] Voice 6: set up last night I think.

[0:02:44] Voice 9: Yeah I know I got it. Yeah yeah great.

[0:02:49] Voice 6: So with that we'll take it by

[0:02:51] Voice 6: general consent that the agenda be adopted as presented and so we've been to trustees

[0:02:58] Voice 6: for your reports. Who would like to go first?

[0:03:01] Trustee Evans: I think it's been a relatively quiet

[0:03:08] Trustee Evans: few months since our last regular meeting here. I think the only meetings I've been involved in

[0:03:14] Trustee Evans: have been the Trust Programs Committee meeting and the CAO performance evaluation meetings.

[0:03:27] Trustee Evans: So Trust Programs, we were going over the stewardship boards and discussing business

[0:03:35] Trustee Evans: cases for the upcoming budget. So it was a relatively brief meeting. It wasn't too much

[0:03:42] Trustee Evans: on that agenda package either um so yeah it's been summers it's pretty quiet and i just wanted to say

[0:03:49] Trustee Evans: thank you to everybody in the community um this is our last meeting of this term for this local

[0:03:57] Trustee Evans: trust committee as we sit here and i just want to say thank you very much for all of your input and

[0:04:03] Trustee Evans: for all of your participation and um i've definitely felt the support for the issues that

[0:04:09] Trustee Evans: that are on the table through your letters and involvement

[0:04:17] Trustee Evans: has been highly appreciated.

[0:04:19] Trustee Evans: And also thank you to Paul and Monica

[0:04:21] Trustee Evans: for their reconciliation updates and reports.

[0:04:24] Trustee Evans: Those I think have been very valuable to this community

[0:04:28] Trustee Evans: and also to the peoples that they represent as well.

[0:04:31] Trustee Evans: So I wanted to say thank you to them as well.

[0:04:38] Voice 9: Along the same lines, I've been very thankful for the

[0:04:41] Voice 9: the participation that we've had at our local trust committee meetings of 15 to 25 people

[0:04:48] Voice 9: on a pretty regular basis except today and I think I feel okay good about our engagement that

[0:05:01] Voice 9: we've talked about the issues the difficult issues we've had agreements we've had disagreements but

[0:05:06] Voice 9: We've all been very respectful, I feel, of each other.

[0:05:12] Voice 9: We haven't, I don't recall any kind of yelling sessions

[0:05:14] Voice 9: or any kind of upheaval in that kind of way,

[0:05:17] Voice 9: which I'm happy for.

[0:05:19] Voice 9: It's not too late.

[0:05:21] Voice 9: There were a couple.

[0:05:24] Voice 9: And yeah, minor, you know.

[0:05:26] Voice 9: And so, yes, I'm very thankful for that.

[0:05:28] Voice 9: I really appreciate the fact that we live on an island,

[0:05:31] Voice 9: that we have engagement.

[0:05:33] Voice 9: You know, it's not like we're sitting at home

[0:05:34] Voice 9: or everybody's sitting at home just going whatever.

[0:05:36] Voice 9: they're just doing their business but I don't care what they're doing. There's a number of

[0:05:41] Voice 9: people that are interested so I appreciate that.

[0:05:45] Trustee Evans: And I just also don't want to add on

[0:05:47] Trustee Evans: the thing that I love about this community the most is no matter whether we agree or disagree

[0:05:51] Trustee Evans: in this room as soon as we step out we're neighbours first and foremost. Thank you both.

[0:06:02] Voice 6: for my chair's report um i'm going to run through just a few items that

[0:06:08] Voice 6: we've been reviewing at executive committee in preparation for trust council that may be of

[0:06:14] Voice 6: interest um corporate planning process update uh will be presented i won't go into that but it

[0:06:21] Voice 6: helps define a process um to towards which invents the strategic planning process the

[0:06:30] Voice 6: the operational priorities, which are defined by senior staff, leadership team and trust and working with the CAO.

[0:06:37] Voice 6: And that's going to give more coherence to how decisions are made operationally,

[0:06:42] Voice 6: as well as the long term view of, for instance, budget and departmental work plans function.

[0:06:50] Voice 6: So it's a very functional document. It's not everybody's favorite.

[0:06:55] Voice 6: I don't completely understand corporate planning, but I'm thankful that there are those on council,

[0:07:00] Voice 6: including and our CAO who do and it's a very important process to ensure that we're not

[0:07:07] Voice 6: just randomly making decisions for instance. There's also a briefing on council committee

[0:07:14] Voice 6: structure a recommendation for how the structure may be revised we have a number of standing

[0:07:20] Voice 6: committees at trust council but there's an opportunity to create select committees and

[0:07:26] Voice 6: And that may be a way that is more functional.

[0:07:31] Voice 6: So that's going to be for Trust Council to decide.

[0:07:35] Voice 6: There's also a significant briefing on major and minor project consideration and the criteria for decision making.

[0:07:42] Voice 6: This is important for local trust committees because as you look at what are the needs arising from your community and through the discussions that we've had in the past four years,

[0:07:52] Voice 6: looking ahead how to make sort of the case that this is a minor project that needs to be

[0:07:58] Voice 6: undertaken but how does that work within the available resources so there is some new criteria

[0:08:05] Voice 6: coming forward that'll come to council but really it's it's responding to um some some things that

[0:08:14] Voice 6: we've seen even here which is reviewing work that was sort of done on a previous land use bylaw

[0:08:21] Voice 6: law amendment and so that may not be possible in the future so it's just wise for us to look at

[0:08:27] Voice 6: that the bill 15 infrastructure projects act um we had asked staff to engage with the province

[0:08:36] Voice 6: on the implications of that because when we saw it in the legislative monitoring report it seemed

[0:08:44] Voice 6: to have some, well, I had concerns that there would be certain designated projects that

[0:08:51] Voice 6: would have an expedited environmental assessment process.

[0:08:54] Voice 6: And so, you know, if we're talking about major projects landing in the trust area to reduce

[0:09:03] Voice 6: the assessment process from five years, let's say, to 20 months, it's an incredibly, it's

[0:09:10] Voice 6: a huge change.

[0:09:11] Voice 6: and so we needed to ask staff what are the implications specifically for the trust area

[0:09:16] Voice 6: so there is a briefing that's going to council conversation is ongoing but this is kind of

[0:09:23] Voice 6: related to another piece that's very important it's about marine shipping advocacy and this is

[0:09:30] Voice 6: where I just want to highlight and celebrate the function of a senior policy advisor not everyone

[0:09:37] Voice 6: Everyone understands, including myself, what a senior policy advisor can do.

[0:09:41] Voice 6: But when you read this briefing on marine shipping advocacy and the research that goes into what are the implications when and if the federal government approves a major project such as a pipeline to land without any of the usual checks and balances and overriding local authorities,

[0:10:05] Voice 6: what are the effects of that and so this briefing which it covers the gateway strategy the roberts

[0:10:12] Voice 6: bank terminal expansion project rail infrastructure optimization environmental protections and all of

[0:10:18] Voice 6: those implications that islands trust we are really this is the government here to intervene

[0:10:24] Voice 6: on behalf of the environment and to to to coordinate advocacy efforts so this staff has

[0:10:33] Voice 6: raised and I think it is quite actually it's an alarming project because the

[0:10:40] Voice 6: effects of increased shipping will mean many many more container ships many much

[0:10:47] Voice 6: more noise much more and and and so they're talking about shortening the

[0:10:51] Voice 6: window and that really we only have until September 18th to to express our

[0:10:58] Voice 6: views and opinions on whether a project should be designated in the national

[0:11:02] Voice 6: interest so i'm kind of pulling in too much here but i really encourage constituents and trustees

[0:11:08] Voice 6: to look at the executive committee agenda in advance because this briefing in particular

[0:11:13] Voice 6: is very important

[0:11:14] Voice 21: um

[0:11:15] Voice 6: and this if islands trust does take an active position it would definitely

[0:11:22] Voice 6: align with council's previous successful advocacy efforts since 2010 related to marine shipping

[0:11:28] Voice 6: impacts and oil spill prevention and response so that's a really key piece that i think is going

[0:11:34] Voice 6: to affect all of our lives including indigenous peoples food sources transportation island

[0:11:43] Voice 6: communities for a long time in the future so um executive committee also put forward its budget

[0:11:50] Voice 6: staffing requests there is you know operational costs continue to rise if you want to understand

[0:11:57] Voice 6: and why, please do look at those budget requests, particularly in two areas, engaging with communities

[0:12:07] Voice 6: and engaging with First Nations. This all takes very careful, tailored work because

[0:12:15] Voice 6: each of our island contexts are different and engaging with nations where they're at

[0:12:20] Voice 6: is all very different. So having adequate resources for that is really important. And

[0:12:27] Voice 6: And so, do you want to share some final words as your chair?

[0:12:32] Voice 6: It's been a pleasure.

[0:12:33] Voice 6: Honestly, I echo your words, trustees.

[0:12:37] Voice 6: I've never seen a community so engaged and so willing to step up and respectfully share

[0:12:44] Voice 6: your views.

[0:12:44] Voice 6: And even when you do disagree, you let those views come forward so that we can all hear.

[0:12:49] Voice 6: And that's important.

[0:12:50] Voice 6: That is how we can make decisions.

[0:12:53] Voice 6: because unless you talk to us about what you're seeing and hearing your trustees

[0:12:58] Voice 6: can't don't have the information to make good decisions so you are as much an

[0:13:02] Voice 6: important part of the local government process as the elected people are and I

[0:13:07] Voice 6: just want to really honor this community for how you do step forward I will say

[0:13:15] Voice 6: that in this agenda I'd like to spend a little time on the future projects list

[0:13:18] Voice 6: list because I believe that the next, just in my personal view and from what I've heard from this

[0:13:27] Voice 6: community, shoreline protections are going to be the next big issue that really the incoming

[0:13:34] Voice 6: trustees, I believe, should focus on. This isn't just about South Pender. All of the shorelines

[0:13:41] Voice 6: across i mean we're all coastline it's where the land meets the sea they're all sensitive

[0:13:48] Voice 6: ecosystems they're all important to first nations and they're all being subject to different

[0:13:54] Voice 6: pressures because of ocean coastal processes and changes and climate change and erosion

[0:14:02] Voice 6: and storms and so when people are facing an imminent decision of my house that was built in

[0:14:10] Voice 6: 1960 on this footprint which was adequate back then but now is being impacted in a very you know

[0:14:18] Voice 6: time urgent way by coastal processes what do i do and if we're having property owners go through

[0:14:26] Voice 6: individual applications which are quite lengthy with you know lots of environmental reports lots

[0:14:33] Voice 6: lots of professional reports, how can we make that process much more clear at the front

[0:14:40] Voice 6: and synergize and use Islands Trust federal powers to create, for instance, shoreline

[0:14:47] Voice 6: DPAs that are appropriate for different areas that have different environmental considerations.

[0:14:53] Voice 6: So in my view, this is one of the key areas that Islands Trust should actually be doing

[0:14:59] Voice 6: work on.

[0:15:00] Voice 6: i think it's larger than a minor project for the south pender local trust committee i think this is

[0:15:06] Voice 6: you know island islands trust wide but if south pender thinks that's a value it would be good to

[0:15:13] Voice 6: raise your um sort of raise that and say you know this should be looked at by the next ltc so i'd

[0:15:19] Voice 6: like to have a little discussion at the future projects report and if you can think about all

[0:15:25] Voice 6: of the things that you've heard from the community and put those into sort of the list of considerations

[0:15:32] Voice 6: that the next LTC, even though you're all sitting here, you're all coming to the meetings,

[0:15:37] Voice 6: you know what the issues have been, but whoever the next planner is and the next LTC is has

[0:15:43] Voice 6: a really coherent list of here's the concerns and here's sort of, and can prioritize.

[0:15:48] Voice 6: prioritize um so yeah how we consider first nations interest in shoreline processes is going

[0:15:55] Voice 6: to be the key question i think for the next decade so oh one more note sorry from regional planning

[0:16:01] Voice 6: committee groundwater is also a huge concern uh for the future and for planning purposes

[0:16:09] Voice 6: any community that's doing an ocp review really has to think about where is the water how is it

[0:16:17] Voice 6: flowing, how is climate change affecting it? Two out of three British Columbians are concerned

[0:16:22] Voice 6: about a major water crisis in their community within the next few years. We are seeing a lot

[0:16:28] Voice 6: of effects from drying rivers, farmers facing crop losses, and that may not be imminent here,

[0:16:37] Voice 6: but it affects planning to a huge degree. So good news that Islands Trust Freshwater

[0:16:43] Voice 6: sustainability project has been running for 10 years what the public doesn't really see or know

[0:16:51] Voice 6: is what what has been done what do we know about the state of water in the islands and there

[0:16:56] Voice 6: actually is quite a lot and we're just at the point that the atlas which is a way for the public

[0:17:04] Voice 6: to engage with the different elements of the tools and the groundwater science that's been undertaken

[0:17:10] Voice 6: across the trust area that's coming out in in the fall so stay tuned there'll be communication

[0:17:16] Voice 6: materials about that probably be some test runs but another opportunity for learning would be if

[0:17:23] Voice 6: this ltc wanted to request that the freshwater specialist make a presentation in early in the

[0:17:30] Voice 6: next term about the state of like what do we know about freshwater and specifically for south pender

[0:17:37] Voice 6: what are the different pieces that are that have been undertaken just want to be cognizant of time

[0:17:43] Voice 6: yeah i'm done now to cover yeah yeah so that was just um yeah groundwater and it was really helpful

[0:17:51] Voice 6: at thetis that we had a presentation by senior freshwater specialist william shulbaugh and this

[0:17:57] Voice 6: ltc may want to do the same sorry for the long introduction and summary and lisa i'll send you

[0:18:04] Voice 6: some notes so that you don't have to try to capture all that so we'll come into our public

[0:18:09] Voice 6: participation period uh there's no electoral area director's report and so um so just as before we

[0:18:21] Voice 6: get into this as chair my responsibility shared with local trustees is to ensure that this meeting

[0:18:27] Voice 6: is a respectful inclusive and culturally safe space for everyone so that means we ask you to

[0:18:33] Voice 6: speak respectfully. There is no place here for racism, stereotypes, or comments that target

[0:18:39] Voice 6: Indigenous peoples or any group in our community. We acknowledge concerns and questions without

[0:18:45] Voice 6: causing harm. You are totally free to seek clarity, express uncertainty, challenge ideas,

[0:18:53] Voice 6: but we ask that you not say it in such a way that it would harm another person or people group.

[0:19:00] Voice 6: we uphold cultural safety, we recognize that public meetings have not always been safe or

[0:19:06] Voice 6: welcoming for Indigenous peoples and so we're going to be mindful of how language affects people

[0:19:12] Voice 6: and we'll keep the conversation constructive. So speak to your ideas, your issues, bring your

[0:19:18] Voice 6: opinions and knowledge and lived experience. All voices deserve to be heard. With that I'll open

[0:19:24] Voice 6: the floor and if anybody wants to address the Local Trust Committee pop up your hand and take

[0:19:30] Voice 6: as much time as you should yes go ahead so

[0:19:32] Voice 17: junker her chuck two things one i'm glad to hear that at

[0:19:36] Voice 17: the trust committee level that there's actually attention being paid in terms of shoreline

[0:19:42] Voice 17: shoreline protections uh certainly that's something that i've mentioned in regard to

[0:19:47] Voice 17: riprap walls and so forth and we had a discussion about whether that was going to be referred to

[0:19:53] Voice 17: apc and and so it's good to hear that at least there's something else going on about it in the

[0:19:59] Voice 17: context of uh the prospect of doubling shipping traffic that goes by my door every day uh and uh

[0:20:06] Voice 17: already seeing the effects of sea level rise and the king tides and storm storm surges and things

[0:20:15] Voice 17: you know the the uh wash wake wash is also a contributor to erosion and uh it's just going

[0:20:22] Voice 17: to become increasingly prominent and so in speaking to some members of the community

[0:20:26] Voice 17: who have expressed that, you know, if it was their property, that, you know, they would

[0:20:34] Voice 17: take action unilaterally to harden their foreshore. I think that having a discussion here is

[0:20:42] Voice 17: of vital importance and establishing policy in that regard. My second question, or my second

[0:20:50] Voice 17: comment, do we know what the status of the Christie report is and where the variance

[0:20:55] Voice 17: is we

[0:20:58] Voice 19: can um the

[0:21:00] Voice 4: status is we're still waiting for the archaeological uh report and my understanding

[0:21:05] Voice 4: is it does take a long time i think six months or so so we're still waiting for that and once we

[0:21:11] Voice 4: staff receive it then we'll be taking a look at that and bringing it back to the ltc

[0:21:16] Voice 4: six months minimum six months minimum

[0:21:18] Voice 17: no geotech no geotech at this point not

[0:21:21] Voice 4: to my understanding

[0:21:22] Voice 4: you know thank you

[0:21:23] Voice 4: thanks paul

[0:21:27] Voice 12: petrie thank you um chair thank you for your report i found a lot

[0:21:33] Voice 12: of helpful information in what you were sending and uh i think it was time well taken um i

[0:21:42] Voice 12: especially appreciate you putting the future projects list up for discussion because to me

[0:21:48] Voice 12: looking at that list the um shoreline protection is certainly one of the key ones there

[0:21:56] Voice 12: water is another key one uh and first nations is one of the key ones we uh i'm still quite

[0:22:04] concerned that we had a plan in place for an ocp amendment that was well

[0:22:10] Voice 12: situated to be approved

[0:22:12] Voice 12: and it got essentially dismissed without much community discussion.

[0:22:20] So those three issues have some convergence.

[0:22:26] And I think it's important as we plan

[0:22:28] Voice 12: our next project

[0:22:30] Voice 12: that we look at how those three things work together

[0:22:33] Voice 12: because First Nations have serious and very deep concerns

[0:22:40] about shoreline protection and disturbance.

[0:22:43] That's their history, that's their legacy.

[0:22:48] And Chief Pelkey, when he came and spoke here,

[0:22:52] made it clear that that was his view.

[0:22:55] His view is that there should be no blasting

[0:22:59] along the shoreline area.

[0:23:01] And we raised that issue with trustees last time.

[0:23:07] and we had no uptake on it. We did have some uptake on fireworks but to

[0:23:14] Voice 12: me that was a little

[0:23:16] Voice 12: consequence. The Atlas, I'm quite excited about the Atlas. I've been reading about

[0:23:26] Voice 12: where that's at and look forward to seeing it. To me the key question is how is that important data

[0:23:33] are going to be applied to the development application process.

[0:23:39] I

[0:23:40] Voice 12: regret that Trust Council did not approve

[0:23:43] Voice 12: the professional biologist funding for that position,

[0:23:48] Voice 12: which would be a key factor in that kind of application.

[0:23:52] Voice 12: So I'm quite concerned, and I just want to share that with you,

[0:23:57] Voice 12: that that was a mistake.

[0:24:00] Voice 12: I've also written to Trust Council about my concern that development application fees, which Trust policy requires there be full recovery for the expenditures to process those fees, but the fees are set at a minimal level between 10 and 15%.

[0:24:24] And to me, that is at minimum an embarrassment for trust counsel, and that's been an ongoing thing.

[0:24:35] So those are concerns that I have.

[0:24:39] I think I'll leave it there at

[0:24:42] Voice 12: this point and hear from others.

[0:24:45] Voice 12: Thank you.

[0:24:50] Voice 9: Can I just ask you for a little bit more clarity on the, you said something was dismissed and

[0:24:58] Voice 9: I just, I may have missed a little bit.

[0:25:00] Voice 12: I'm talking about bylaw 123, the OCP bylaw that was approved by the previous local trust

[0:25:08] Voice 12: committee.

[0:25:08] Voice 12: It was approved by the executive committee.

[0:25:12] Voice 12: It was referred to the minister for final review, which is part of the process for an OCP bylaw, and the minister, I think, was put in an awkward position because the ministry received a submission from the Wasanage Elders Council, strongly supporting that OCP recommendation,

[0:25:40] Voice 12: but it came in after the public hearing.

[0:25:44] Voice 12: So in an abundance of caution,

[0:25:46] Voice 12: the minister referred that the issue back to the local trust committee

[0:25:53] Voice 12: for further review to ensure that consultation with First Nations

[0:25:58] Voice 12: had been complete.

[0:26:00] Voice 12: I thought that was a very subtle and very effective move.

[0:26:05] Voice 12: This local trust committee decided to take no further action.

[0:26:09] Voice 12: That was one of the options that was presented to you, and I think that's a decision that

[0:26:15] Voice 12: all three of you should regret, because I think that was a huge loss for this community

[0:26:20] Voice 12: and a huge miss in terms of an effective relationship with our participation's neighbours.

[0:26:27] Voice 12: So I hope that clarification helps.

[0:26:30] Voice 12: Thank you.

[0:26:31] Trustee Evans: And if I may just also respond with a reminder, there were two parts that were in there.

[0:26:36] Trustee Evans: the one part was not going to move forward the other part so it had to be split and started as

[0:26:43] Trustee Evans: a new project that was the issue so we put it back to the community what project did you want

[0:29:41] Voice 17: There are resources on the Island Struggles site.

[0:29:48] Voice 17: they have a dedicated,

[0:29:52] Voice 17: they have dedicated DPAs for fire suppression area,

[0:32:24] Voice 15: in addition to that should be water catchment in ponds, reservoirs, cisterns.

[0:32:41] Voice 15: and go down to the bench on the Enchanted Forest Park there

[0:32:44] Voice 15: where the waterfall is and watch how much water is running into the ocean.

[0:32:49] Voice 15: Sit there and think about how many gallons a minute go into the ocean.

[0:32:54] Voice 15: Could we be saving that water?

[0:32:56] Voice 15: And as well, about fire suppression.

[0:33:00] Voice 15: We've been lucky so far, but what was it, 15 years ago,

[0:34:19] Voice 6: requested and there's interesting wording here to incorporate freshwater capture and storage

[0:34:25] Voice 6: infrastructure such as cisterns and holding ponds other appropriate systems designed to retain

[0:34:32] Voice 6: fresh water from natural on island sources and so planners are alive to this um issue that it's not

[0:50:44] Voice 13: and um uh so yeah the the sort of trajectory that we're currently on uh is really to look

[0:50:53] Voice 13: at more comprehensive OCP reviews because we as a team and as an organization, there's been a

[0:51:00] Voice 13: commitment under policies to keep our OCPs up to date and to use the best information, etc. So

[0:51:09] Voice 13: we are working on a way to really do that because many of ours are quite out of date. And oftentimes

[0:51:16] Voice 13: these targeted reviews actually in the end do become comprehensive reviews because just every

[0:51:22] Voice 13: issue is often quite connected to the other. So that's one kind of comment is I almost might

[0:51:29] Voice 13: suggest you could say comprehensive review to be consistent with sort of how the policy

[0:51:34] Voice 13: is evolving and the structures and supports that we're building here. And the other thing to

[0:51:42] Voice 13: think through and we have been thinking through is really trying to be effective and efficient in

[0:51:48] Voice 13: in terms of doing some of the baseline data work where we can having efficiencies like if we know

[0:51:54] Voice 13: we're going to be working next year in South Pender or whichever you know North Pender you know

[0:51:57] Voice 13: can we do maybe some shoreline work that as we work with Salt Spring and potentially Galliano

[0:52:04] Voice 13: but maybe get the data for the whole area this kind of thing to develop models that then can

[0:52:10] Voice 13: be adopted as minor projects so this is I know I hope I'm speaking in a way that's understandable

[0:52:16] Voice 13: But like, because there's a lot of thinking that's been going into this to more sort of address the policies that the Trust Council has adopted in order to really make sure that we're, you know, using best efficient use of resources while being, you know, sensitive to context, different contexts on different islands.

[0:52:40] Voice 13: encountering when we have started doing some digging on salt spring is that the sea the

[1:03:58] Voice 1: Earl Claxton Jr. has been a key elder

[1:04:01] Voice 1: who has generously shared his cultural knowledge

[1:04:04] Voice 1: and guidance with the Stayus Pender community.

[1:04:08] Voice 1: Earl has led many ethnobotany walks,

[1:04:11] Voice 1: sharing his expertise in indigenous plants

[1:04:14] Voice 1: and medicines with islanders.

[1:04:17] Voice 1: Earl played a key role in identifying the historical

[1:04:20] Voice 1: Camas and Chocolate Lily Legacy Garden at Gowland Point

[1:04:24] Voice 1: that will be recognized with the installation of two Osanich-inspired cultural panels this fall.

[1:04:33] Voice 1: Perhaps Earl's most memorable contribution is through his many traditional open-fire salmon bakes and cultural pit cooks.

[1:04:42] Voice 1: many pit cooks and salmon feasts with the tender school students

[1:04:45] Voice 1: gave students a hands-on experience with food preparation

[1:04:50] Voice 1: and a cultural lesson with the stories shared at these all-day events.

[1:04:55] Voice 1: The Pender School honored Earl on June 18th, National Indigenous Peoples Day,

[1:05:03] Voice 1: with a day-long special recognition ceremony, including a slideshow prepared by Ben McConkie and Principal Marco Landau,

[1:05:17] Voice 1: of learning stations prepared by the students and teachers, and a school assembly

[1:05:22] Voice 1: where Earl was gifted with a carved paddle signed by all the students. And I believe the paddle was

[1:05:33] Voice 1: August 2026, for the seventh consecutive year, a group of the same

[1:05:39] Voice 1: at you, made the journey in two canoes from the Saanich Peninsula to the dock near their

[1:05:46] Voice 1: reserve land at Hay Point on South Kendra. Over two days, the 16 young men and women

[1:05:54] Voice 1: set the shoal, the reef net, near the mouth of Bedwell Harbour in the Pelkey family's traditional

[1:06:01] Voice 1: fishing area connected to the village of Honolulu, where the poet school resort is today. The youth

[1:06:09] Voice 1: camped at the reserve. They were accompanied by elders in motorized boats who assured their safety

[1:06:16] Voice 1: in canoes on the water. Successive generations of young Wissanich are learning the technology of

[1:06:24] Voice 1: making the reef nets and then deploying them between the two canoes. The four panel art and

[1:06:32] Voice 1: history installation at the waterfront of Poets Cove illustrates the setting of the reef net and

[1:06:38] Voice 1: and how its construction allowed for the escape

[1:06:41] Voice 1: of the leading salmon,

[1:06:43] Voice 1: which assured biodiversity was conserved

[1:06:46] Voice 1: in the salmon that went on to spawn in the Fraser River.

[1:34:04] Voice 11: policies that are before you in regards to a biocompliance and enforcement

[1:34:08] Voice 11: policy for self-dependent

[1:34:11] Voice 11: presented presenting a staff report purpose of the report is to present a draft by the compliance

[1:34:17] Voice 11: enforcement policy document for review and consideration by the trust committee the

[1:34:23] Voice 11: proposals to incorporate all current standing resolutions for compliance and enforcement into

[1:34:28] Voice 11: a single document and clarity on current policies so the honest trust has completed over the past

[1:34:35] Voice 11: couple years, a Violent Enforcement Review. They have adopted new policies which are attached.

[1:34:43] Voice 11: It was adopted in March during the March 26th Council meeting. The purpose of those policies

[1:34:51] Voice 11: was to ensure that the four compliance and enforcement policy procedure guidelines are

[1:34:56] Voice 11: administrative, fair, reasonable and transparent. And also as part of the process of the bylaw review

[1:35:02] a template for

[1:35:04] Voice 11: bylaw compliance and enforcement policy, a document was, a template for the document

[1:35:11] Voice 11: was developed and drafted for consideration by local trust committees in order to address their

[1:35:16] Voice 11: local issues, specifically their local enforcement issues. LTC's currently used standing resolutions

[1:35:23] Voice 11: to establish enforcement policy and the proposal to place all adopted standing resolutions into

[1:35:28] Voice 11: to one document, which also includes additional policy procedures for specific issues not

[1:35:33] Voice 11: addressed in Trust Council Policy 551. Some of those issues that won't be addressed in

[1:35:39] Voice 11: Trust Council Policy, because they're not the enforcement authority, the local trust

[1:35:44] Voice 11: committee is, are notice of site inspections, time to comply, prior to list of vexatious

[1:35:50] Voice 11: complaints, definition of minor contraventions and use of discretion by file officers when

[1:35:56] Voice 11: they're working on the files. So

[1:35:59] Voice 11: what is attached as well as the Trust

[1:36:01] Voice 11: Council policy is the proposed subpender item bylaw enforcement policy. It is

[1:36:11] Voice 11: attachment number

[1:36:12] Voice 10: two in your staff report. I believe it's six pages long. It

[1:36:23] Voice 11: contains two parts. Part A are the specific policies for compliance and

[1:36:32] enforcement and part b which is your screening

[1:36:39] Voice 11: officer powers and duties and policy uh as you

[1:36:44] Voice 11: do have a bylaw enforcement notice bylaw and so the with any disputed uh bylaw notice it must go

[1:36:54] Voice 11: to a screening officer and so this outlines who can screen which tickets, which duties

[1:37:04] Voice 11: each person has in the screening of a disputed by-law notice or ticket.

[1:37:09] Voice 21: It

[1:37:10] Voice 11: provides authorized reasons to cancel by-law violation notices and generally that is what

[1:37:23] Voice 11: what is outlined with the screening officer's duties and authority in order to deal with any disputed by-law notice

[1:37:33] Voice 11: and whether or not to consider whether or not the by-law notice should go to adjudication.

[1:37:42] Voice 11: One of the areas that we wanted to address with especially doing a LTC policy

[1:37:53] Voice 11: is how you wish to use your VIN bylaw. In section 6 there'll be specific

[1:38:02] Voice 11: references as to how much notice you're going to give to property owners or

[1:38:09] Voice 11: respondents before say the VIN system start to be used and section 6.6 states

[1:38:19] Voice 11: states that you would give a minimum, you know, a warning notice would be given first

[1:38:24] Voice 11: with a minimum of 45 days to comply before the actual violation notice is issued.

[1:38:32] Voice 11: Sections like this are added because it seems to be a fair way to administer the system

[1:38:38] Voice 11: and it's one that people find reasonable.

[1:38:41] Voice 11: You give the initial 90 days and then actually write a warning notice of 45 days.

[1:38:47] Voice 11: so there's no confusion as to what is expected of the respondents in any by-law enforcement matter.

[1:38:57] Voice 11: We've also placed within the document issues to deal with minor structures that don't need building permits,

[1:39:04] Voice 11: which can be reoccurring issues, and if they're minor in nature, that's within the Part A and the definitions.

[1:39:10] Voice 11: conditions, small wood sheds and whatnot are common complaints, but if you don't have more

[1:39:20] Voice 11: than one complaint about such small structures, maybe you should not be enforcing on them

[1:39:26] Voice 11: or spending resources to deal with minor structures.

[1:39:31] Voice 11: And I'll restate again about the need to ensure that vexatious complaints are dealt with.

[1:39:41] Voice 11: It's not, especially for south of Pender, it's not a major issue, but they do happen

[1:39:48] Voice 11: and so we should have a policy in place to deal with either vexatious complaints in regards

[1:39:57] Voice 11: to when we're investigating a file and if we've discovered that they are of a

[1:40:03] Voice 11: vexatious nature that we close the file. There are press council policies in place

[1:40:07] Voice 11: that will allow myself as the manager and the director of planning to deal

[1:40:13] Voice 11: with complaints that are received before we open the file and believe that they

[1:40:20] Voice 11: may be vexatious then we can make a decision on that or the director can and

[1:40:25] Voice 11: And then we won't open a pot during the process of investigating any complaint.

[1:40:32] Voice 11: Sometimes we do discover that the complaint is vexatious, or we just can't identify the person making the complaint.

[1:40:39] Voice 11: And we don't proceed with anonymous complaints.

[1:40:42] Voice 11: So that's why some of those policies are in the document.

[1:46:13] Voice 9: So it doesn't offer any protection for the property owner that may not wish to have his whole property or his or her inspected.

[1:49:35] Voice 11: you investigate? Well, if you can do it in a less intrusive way, then do it that way.

[1:49:47] Voice 11: even though there are going to be people who are going to object to a violence or even looking at

[1:49:52] Voice 11: their property but they can't object they can object to that they can't stop someone from

[2:03:42] Voice 11: negotiations and discover yeah this person is supported by the food bank the community members

[2:03:49] Voice 11: community knows he has no money it's obviously us he has no money so it's unreasonable to start

[2:03:56] Voice 11: issuing tickets that he obviously can't pay

[2:03:57] Voice 10: that

[2:03:59] Voice 11: that's the circumstances and some people will show

[2:04:01] Voice 11: us their bank account information see i'm poor i don't have any money i have no resources to do

[2:04:07] Voice 11: what you're asking me to do so it's a rare circumstance but it does happen uh you know

[2:04:13] Voice 11: we especially senior citizens being encountered living in places where um they shouldn't be living

[2:04:19] Voice 11: and it's obviously that they're destined to have no financial resources to fix things or apply for

[2:04:24] Voice 11: permits and

[2:04:25] Voice 6: we've also seen cases where um there's say a landowner and there's maybe some mental

[2:04:32] Voice 6: health issues and they have tenants that are causing problems on the property and there needs

[2:04:38] Voice 6: to be a different solution that it's not issuing tickets and issuing fines that's unreasonable

[2:04:45] Voice 6: to go through the normal process and so those kinds of things and maybe we can talk about how

[2:04:51] Voice 6: those cases might be brought to the local trust committee for further information and an in-camera

[2:04:57] Voice 6: or discussion about specific circumstances like that's that's not just up to the bylaw

[2:05:05] Voice 6: enforcement officer there might be more information sought by the local trust committee

[2:05:09] Voice 6: to determine that okay that's you know you're going to pause enforcement we're going to take

[2:05:14] Voice 6: another method so i've certainly we've seen that on a number of correct

[2:05:18] Voice 11: so through the chair yes

[2:05:19] Voice 11: there are certain times where bylaws or say okay i have concerns that this person just can't comply

[2:05:25] Voice 11: for any number of different reasons including financial so the best course of action for them

[2:05:29] Voice 11: to take is to write up a report and have it forward to the local trust committee can be

[2:05:34] Voice 11: discussed in camera and that's going to be local trust committees and decide what's reasonable

[2:05:38] Voice 11: do you want to close the file or do you want to try and force a person to comply

[2:05:45] Voice 11: you may even was okay do you take legal action against them but if they don't have any money

[2:05:50] Voice 11: need to even take steps to comply, that may be unreasonable. So we're going to put it in your

[2:05:55] Voice 11: lap and say, you decide what is reasonable or unreasonable to do with specific cases.

[3:44:15] Voice 13: This is actually a new process, I'm to understand.

[3:44:18] Voice 13: Like, typically, you have not seen this in the past.

[3:44:22] Voice 13: In the past, what's happened is financial,

[3:44:24] Voice 13: our financial colleagues within the Islands Trust

[3:44:26] Voice 13: Trust have drafted these budgets based on historical spendings and then included it in

[3:44:32] Voice 13: the consideration by Trust Council. So this RFD, I just want to also clarify that this is about

[3:44:39] Voice 13: the operating budget, as you can see by the line items, and not about the project's budget, which

[3:44:44] Voice 13: would be a separate thing. And the way that they did get these numbers, which is explained in the

[3:44:49] Voice 13: RFD, is basically taking last year's and then adding 3% for inflation. And then now we have

[3:44:55] Voice 13: have just presented them as such, but planning staff have reviewed and we did want to just

[3:45:00] Voice 13: raise verbally a few considerations that we were thinking of as well. And so the first was

[3:45:06] Voice 13: that you'd note on the line regarding advisory planning committee budget asks that very little

[3:45:18] Voice 13: has been spent within this year's to date and very little was spent the year previous.

[3:45:25] Voice 13: And so we think it might be worth your while to consider whether you really want to have quite that much, recognizing you don't have any major projects in the works, although obviously there can be larger, you know, current planning applications and such that you might want to refer to them.

[3:45:40] Voice 13: So that was one thing that sort of stuck out to us. And then the second item that stuck out was just around your communication dollars and especially noting that there will be a new term, new trustees potentially, you know, into the roles.

[3:45:56] Voice 13: And so there might be an indication you might want to add, you know, I don't know exactly how much, but maybe a small budget for that as well.

[3:46:04] Voice 13: And then, yeah, once you've considered it and you've made your amendments, yes, we are asking if you would mind passing a resolution that says, you know, the proposed draft that we submit this proposed draft operating budget for inclusion in the Trust Council draft 2027-28 budget.

[3:49:14] Trustee Evans: talk about what's going to be involved and regardless even if we're if we're just going

[3:49:21] Trustee Evans: with the minor we had um if we're looking at the budget that we've used on a minor project

[3:49:28] Trustee Evans: this is the amount that we're using this is just minor we've not had any majors

[3:49:31] Trustee Evans: and so I'm saying I'm comfortable keeping that there I wouldn't want to cut that anymore

[3:49:37] Trustee Evans: because we will be using or whoever is here will be using the APC for the next fiscal year
