Item 3.1.1 Nighthawk Hill NAPTEP Covenant Permission to use Pond for Irrigation, North
Pender
The Board approved Andreas Nowak & Mary Reher’s request for consent to use the man-made
pond in the Covenant Area of the Islands Trust Conservancy covenant (the “Covenant”) over
Parcel Identifier: 001-081-110, Lot 38, Section 7, Pender Island, Cowichan District, Plan 32261,
Except Part in Plan 35333 (the “Land”) as provided for in section 4.2(c), 4.2(a)(ii), 4.2(a)(iii), 4.2
(a)(iv), 4.2(a)(vi) and 4.2 (a)(viii) of the Covenant, with significant conditions to protect the
covenant area.

9.1.Motion to Close the Meeting
That the meeting be closed to the public in accordance with the Community Charter,
Part 4 Division 3, section: 90 (1) (a) personal information about an identifiable
individual who holds or is being considered for a position as an officer, employee or
agent of the board or another position appointed by the board; and that staff be
invited to remain in the meeting.
