SUBJECT: Referral, Proposed Bylaw 526 – Farm Housing Project (Salt Spring)
RECOMMENDATION(S): That the Islands Trust Conservancy (ITC) Board recommend approval of Salt
Spring Island Local Trust Committee Bylaw 526, subject to the following conditions:
1) Increase of setbacks from all lot lines adjacent to the McFadden Creek Nature Sanctuary of
200m, due to potential heron nesting areas;
2) Increase of setbacks from all lot lines adjacent to ITC conservation areas to 30 m;
3) Restrictions on timing of construction to September 15 – January 15 for lots adjacent to ITC
conservation areas;
4) Implementation of erosion controls and soil compaction controls during construction for lots
adjacent to ITC conservation areas; and
5) Consideration of conditions 2-4 for all lots adjacent to other conservation areas and/or near
sensitive ecosystems.
1 PURPOSE: To review the referral of Salt Spring Island Local Trust Committee (SSI LTC) Bylaw 526
and provide a response from the Islands Trust Conservancy (ITC) Board to the SSI LTC.
2 BACKGROUND:
In December 2021, the Province of BC amended the Agricultural Land Reserve (ALR) Use
Regulation to expand flexibility of residential construction in the ALR. In response, the SSI LTC is
amending its Land Use Bylaw to allow for an expansion of residential flexibility for agriculturally
zoned lands. Proposed amendments include:
a secondary suite as a permitted accessory dwelling;
a second accessory dwelling unit for lots classified as a farm under the Assessment Act,
such accessory dwellings not to exceed:
o 56m

(~600 sq feet) in floor area for lots between 1.2 ha and 2 ha;
o 90m
2
(~970 sq feet) in floor area for lots greater than 2-ha; or,
o 186m
2
(~2,000 sq feet) in floor area for lots greater than 40-ha;
updates specific to campground regulations (i.e. for agri-tourism consistent with ALR Use
Regulation);
updates to accessory uses (e.g. home-based business);
amendment of Section 3.17 of Salt Spring Island Land Use Bylaw No. 355 to permit the
use of subdivision potential for farmworker housing outside agricultural zoned properties
for land classified as a farm under the Assessment Act; and,
addition of Subsection 3.11.5 which restricts all dwelling units on Salt Spring Island to a
maximum floor area of 500m
2
(~5,380 sq feet).
SSI LTC has referred the bylaw to ITC as it impacts lands adjacent to ITC conservation areas
(covenants and nature reserves) as noted in the table below.
