[0:06:33] Trustee Busheikin: should go ahead with it or not. And I've been thinking about it since then. And I just would

[0:06:41] Trustee Busheikin: somehow do it when we have lisa with us although

[0:07:23] Trustee Busheikin: the local trust committee to give its input on the draft before it goes to review and then back

[0:07:32] Trustee Busheikin: for first reading then I mean I can't say I'm really prepared for that because I just didn't

[0:07:38] Trustee Busheikin: know because I just I think like right now it's we don't even have a we don't even have a um a

[0:07:44] Trustee Busheikin: consultation plan for it so it just was very confusing and I didn't do a lot of like I kind

[0:07:49] Trustee Busheikin: of looked over some of my notes and gathered some thoughts but i just i guess what i if if this is

[0:07:54] Trustee Busheikin: the one chance the ltc is going to get to give input into this and it's important i'd like to

[0:08:51] Chair Fast (probable): came a number of decisions that i'm going to report i'm going to read them out uh here today

[0:08:57] Chair Fast (probable): so um this is in um yeah this is i'm reading from the draft closed me minutes uh by general consent

[0:09:07] Chair Fast (probable): sent the LTC resolve to rise and report the following.

[0:09:11] Chair Fast (probable): We appointed members to the APC,

[0:09:13] Chair Fast (probable): the Advisory Planning Commission,

[0:09:15] Chair Fast (probable): Adina Johnston, Anne de Cosson, Thomas Sawila,

[0:09:19] Chair Fast (probable): C. Urquhart, and George McCray.

[0:09:32] Chair Fast (probable): that the Denman Island Local Trust Committee clarify.

[0:09:35] Chair Fast (probable): clarify so this is relating to the 45-day limit on vacation accommodation so the denman island

[0:09:44] Chair Fast (probable): local trust committee clarify that reference to a 45-day limit for venice visitor accommodation

[0:09:50] Chair Fast (probable): means 45 days for one client and that otherwise there are no limits on how many days per visitor

[0:09:56] Chair Fast (probable): per year a visitor accommodation home occupation can operate and that this temporary policy remain

[0:10:05] Chair Fast (probable): remain in place until this regulation is reviewed so that was for clarification uh resolutions were

[0:10:12] Chair Fast (probable): adopted respecting first nations that the denman island local trust committee requests staff to

[0:10:16] Chair Fast (probable): provide a briefing and public speaking notes about ongoing work to protect cultural heritage sites

[0:10:21] Chair Fast (probable): on denman island and that the denman island local trust committee requests staff to explore options

[0:10:26] Chair Fast (probable): for implementing the comox first nation cultural heritage policy on denman island and we adopted

[0:10:33] Chair Fast (probable): opted the minutes from the May 4th 2021 in-camera meeting and that's the RISEN report. So having

[0:10:42] Chair Fast (probable): said all that staff can fill you in on any members of the public in on any questions that you might

[0:10:48] Chair Fast (probable): have or of course speak to any of us. Trustee reports who would like to

[0:11:10] Trustee Critchley: you so i'll just note that um i attended the trust council special

[0:11:15] Trustee Critchley: meetings in uh early july um purpose of which was to discuss um or to have some public input

[0:11:24] Trustee Critchley: in respect of the draft of trust policy statement amendments uh just note for the record

[0:11:32] Trustee Critchley: I hope this is accurate, but I had 131 participants noted, plus that was in addition to the trustees.

[0:11:42] Trustee Critchley: And also to note the main item of business was to consider whether to give that first

[0:11:47] Trustee Critchley: reading or not.

[0:11:48] Trustee Critchley: The motion for first reading was defeated on a vote.

[0:11:55] Trustee Critchley: And so we continue on with public consultation and there'll be more said about that I'm sure

[0:12:01] Trustee Critchley: during the course of this meeting.

[0:12:03] Trustee Critchley: Secondly, I attended a select committee meeting,

[0:12:07] Trustee Critchley: which is the Management and Governance Review.

[0:12:12] Trustee Critchley: They were talking about their schedule

[0:12:15] Trustee Critchley: and conducting a number of interviews.

[0:12:18] Trustee Critchley: The plan has been, and I think it will be completed,

[0:12:24] Trustee Critchley: to interview all 26 trustees.

[0:12:27] Trustee Critchley: I have had my interview and it took one and a half hours was set aside for that purpose.

[0:12:34] Trustee Critchley: It was a very engaging and thorough interview, I thought.

[0:12:37] Trustee Critchley: So I had quite a positive reaction to that experience.

[0:12:42] Trustee Critchley: The group that is conducting these interviews said that they will be going up through through the month of September,

[0:12:50] Trustee Critchley: I believe, and hopefully finished by the end of this month.

[0:12:54] Trustee Critchley: so the intention is all trustees which is 26 in number approximately seven staff and

[0:13:02] Trustee Critchley: leaving approximately 17 interview slots for quote others so that could be members

[0:13:10] Trustee Critchley: of the public who would have a presumably some special knowledge an interest in the trust

[0:13:19] Trustee Critchley: So that's the status of that process. Thirdly, I attended the Trust Programs Committee meeting

[0:13:25] Trustee Critchley: August 27th. We talked somewhat about the Trust Policy Statement process and the public engagement.

[0:13:36] Trustee Critchley: We talked also about the fact that in the Southern Gulf Islands there has been a moratorium

[0:13:44] Trustee Critchley: unilaterally imposed by the provincial government on dock building.

[0:13:49] Trustee Critchley: And that was a concern to a number of trustees and people in the southern Gulf Islands.

[0:13:55] Trustee Critchley: I think from the trust point of view, not so much the fact of it being instituted as a moratorium,

[0:14:01] Trustee Critchley: but the fact that the trust was not consulted in any form with respect to this before it happened.

[0:14:06] Trustee Critchley: That is a concern.

[0:14:09] Trustee Critchley: Yes, so that

[0:14:22] Trustee Busheikin: you so i also um attended the trust council special meetings about the policy statement

[0:14:28] Trustee Busheikin: uh and um i won't comment on it um i attended a gathering on hornby island to announce uh the

[0:14:40] Trustee Busheikin: major funding award for um a fiber optic cable to come to denman this is something that community

[0:14:48] Trustee Busheikin: groups on both islands have been working on for years and about a year and a half ago on denman

[0:14:54] Trustee Busheikin: the the committee folded saying it was impossible or that they couldn't make it happen but then they

[0:15:00] Trustee Busheikin: rose from the ashes ashes uh like a phoenix and um so we will be getting a fiber optic

[0:15:09] Trustee Busheikin: to every home that wants to so that was quite a big deal and our mla was there um who's also

[0:15:16] Trustee Busheikin: the minister i think she was there with her minister hat on as minister of municipal affairs

[0:15:21] Trustee Busheikin: um or no probably anyway both hats uh so it's just also a good chance to to touch base with her

[0:15:28] Trustee Busheikin: um and chat um also um it's not exactly in the uh auspices of trust but i did get somehow involved

[0:15:41] Trustee Busheikin: involved into COVID response on Denman, because I co-chair this network of community organizations

[0:15:49] Trustee Busheikin: that's been meeting once a month since COVID started, just to share information, really,

[0:15:55] Trustee Busheikin: and brainstorm solutions to challenges. And so somehow in that capacity, I ended up organizing

[0:16:03] Trustee Busheikin: a Zoom meeting with our regional medical health officer, Charmaine Enns, and writing a report

[0:16:09] Trustee Busheikin: on that and this was just before the new mask mandate came in and there just was a lot of um

[0:16:15] Trustee Busheikin: stress and uncertainty on denman there was a lot of rumors about cases on denman and that kind of

[0:16:21] Trustee Busheikin: thing and so i wanted to get i actually just called him with a question and we ended up talking

[0:16:25] Trustee Busheikin: and came up with that idea and it was good to get some clear information and at the same time

[0:16:30] Trustee Busheikin: um there isn't i mean there's so much still contradictory information uh and i put actually

[0:16:37] Trustee Busheikin: a lot of time into that and you know um i'm conscious that that it isn't really in the core

[0:16:43] Trustee Busheikin: of what we do so i'm you know trying to be careful about that uh i attended a financial planning

[0:16:50] Trustee Busheikin: committee meeting and a meeting of the audit committee among both those committees the audit

[0:16:54] Trustee Busheikin: committee was very reassuring we're in a strong financial position they said that's a direct quote

[0:17:00] Trustee Busheikin: and no no issues with the audit uh at financial planning committee we're just working towards

[0:17:07] Trustee Busheikin: the next budget cycle and um that's the main thing we did we also initiate well we actually

[0:17:15] Trustee Busheikin: didn't initiate it we uh re uh invigorated a review that had started but not finished

[0:17:23] Trustee Busheikin: of trustee remuneration uh just to look at that in light of recommendations that came from

[0:17:29] Trustee Busheikin: union of bc municipalities about best practices and that is the timing is good because it's lined

[0:17:36] Trustee Busheikin: up that we'll be considering it whatever comes out of before the next election so that removes

[0:17:40] Trustee Busheikin: you know when you're looking at trustee remuneration um you need to watch out you know

[0:17:47] Trustee Busheikin: because you're voting on your own pay it's a little funny so when you're looking at the next

[0:17:51] Trustee Busheikin: term that removes some of those issues um i attended regional planning committee uh for

[0:17:57] Trustee Busheikin: any one of the public who might be listening that's a committee of uh trustees from across

[0:18:02] Trustee Busheikin: across the trust area, looking at those planning projects we do that are done for the whole region.

[0:18:09] Trustee Busheikin: So that isn't local planning, but more ways we serve the whole region. And that was really

[0:18:15] Trustee Busheikin: interesting. We talked about the restructuring of the whole planning department, which is called

[0:18:19] Trustee Busheikin: the Planning Services Review, which is, you know, moving along to a conclusion. And, you know,

[0:18:27] Trustee Busheikin: one of the big questions that we kept posing is this wall we keep hitting and we can't answer yet

[0:18:33] Trustee Busheikin: is, and I quote from another trustee who put the question this way, how will we dig ourselves out

[0:18:40] Trustee Busheikin: of our plan, out of our deep planning deficit, and how to find and carry out overdue LUB and OCP

[0:18:47] Trustee Busheikin: reviews? I continue to be concerned about that. And the planning review is great, but it's like

[0:18:55] Trustee Busheikin: if you have a certain amount of food in your fridge, you just move it all into different

[0:18:58] Trustee Busheikin: shelves and create some great new recipes, but it's just the same amount of food. You have so

[0:19:04] Trustee Busheikin: many people to feed and it's not enough. It's still not enough. So I don't know. But it's good

[0:19:09] Trustee Busheikin: that we're doing the review. It certainly is looking at efficiencies and some new ways of

[0:19:13] Trustee Busheikin: thinking about it. Also last point at regional planning committee, our freshwater specialist,

[0:19:18] Trustee Busheikin: William Shuba did a presentation for everyone on the work he's doing across the trust area about

[0:19:24] Trustee Busheikin: groundwater mapping and studies, water budget studies, saltwater intrusion mapping, just looking

[0:19:30] Trustee Busheikin: at aquifers. And there is actually a lot of work that's been done on Denman and he has some amazing

[0:19:35] Trustee Busheikin: maps and there's 3D modeling and they're learning a lot. It's not ready for presentation to the

[0:19:44] Trustee Busheikin: public yet, which I find frustrating, but he's working with the province and they have information

[0:19:52] Trustee Busheikin: information that's um i guess private and um but i did i have been in touch with him about

[0:19:59] Trustee Busheikin: possibly coming to our next meeting in october and at least presenting something so that we can

[0:20:04] Trustee Busheikin: see what's being done because i think after this summer everyone's really seeing the need to

[0:20:09] Trustee Busheikin: understand the state of our aquifers so i've just been privately emailing with him and that probably

[0:20:15] Trustee Busheikin: will come up um hopefully uh if he's available that he can come to our next meeting give a report

[0:20:43] Chair Fast (probable): attended uh participated in meetings as a bowen island municipal councillor over here on bowen

[0:20:51] Chair Fast (probable): and um a number of uh a few executive committee meetings um as well and islands trust conservancy

[0:20:59] Chair Fast (probable): the first one that you'll read about at section 13.1 in our agenda and financial planning committee

[0:21:06] Chair Fast (probable): and then coming up uh so all of this is keeping the work going um tomorrow i have an another

[0:21:13] Chair Fast (probable): executive committee meeting and uh we've shifted some dates around because we are

[0:21:18] Chair Fast (probable): are um going to working towards getting ready for trust council which comes up september 21st to 23rd

[0:21:25] Chair Fast (probable): and um so at that meeting you'll find out more about the trust policy statement

[0:21:30] Chair Fast (probable): and the additional uh public input that's going to be uh gathered the consultation and uh and then

[0:21:39] Chair Fast (probable): next week is union of bc municipalities so that's where we'll have a number of um uh sessions

[0:21:47] Chair Fast (probable): sessions electronically this year with all other uh elected folks in british columbia who designed

[0:21:53] Chair Fast (probable): to who decide to join the convention and um so very interesting sessions and we give input to

[0:22:00] Chair Fast (probable): the province and um we also meet with ministers and with ministry staff so there's a number of

[0:22:05] Chair Fast (probable): meetings uh planned as well so i'll participate both with my um islands trust vice chair hat

[0:22:12] Chair Fast (probable): hat and my Bowen Island municipality hat which is sometimes pretty funny they say didn't I just see

[0:22:19] Chair Fast (probable): you so I have a question about um uh for trustee Bushaken can you remind me you mentioned the two

[0:22:25] Chair Fast (probable): hats uh that um um minister Josie Osborne Moore which is can you well

[0:22:32] Trustee Busheikin: she's our MLA and she's also

[0:22:34] Trustee Busheikin: the minister of municipal um affairs or whatever it's called right

[1:00:38] Trustee Busheikin: that at least that housing piece be incorporated into this because so much of uh residential land

[1:00:48] Trustee Busheikin: is in the ALR on Denman, and housing is really, probably housing and climate change, in my

[1:00:57] Trustee Busheikin: estimation, are the two biggest topics on the mind of Denman Islanders, but also on my mind,

[1:01:03] Trustee Busheikin: and, you know, obviously there's a huge overlap between them, and people have been waiting a long

[1:01:10] Trustee Busheikin: time for a housing review, so being able to at least look at housing to some degree through the

[1:01:14] Trustee Busheikin: lens of this review I think would be useful and I think that uh farmers really want to know I had

[1:01:21] Trustee Busheikin: a long talk last week or a couple weeks ago with a farmer about employee housing um uh you know

[1:01:28] Trustee Busheikin: farms and this is this is these are all fairly new things certainly when the farm plan was written it

[1:01:33] Trustee Busheikin: wasn't as dire like this farmer who was a major farmer on demo was saying well we're changing all

[1:01:37] Trustee Busheikin: our planting plants for next year and we're going to not do as many labor intensive things because

[1:01:42] Trustee Busheikin: because we can't get farm help.

[1:01:46] Trustee Busheikin: And if we could house them without too much complexity,

[1:01:50] Trustee Busheikin: that could change it.

[1:01:51] Trustee Busheikin: So that's really, that really hit me

[1:27:36] Voice 4: The other thing we're suggesting is that there be some instances where professional site plans are drafted for applications.

[1:31:24] Trustee Busheikin: And, you know, I think we've all seen lots of issues that come up down the road when something, whether it's a setback to a neighboring property or a water course or anything like that.

[1:31:37] Trustee Busheikin: And I think that's part of our job also to protect those sensitive areas.

[1:31:42] Trustee Busheikin: And, yeah, and we have setbacks from the sea that, you know, are increasingly important due to climate change and rising sea levels, all of that.

[1:31:55] Trustee Busheikin: So yeah, I guess what I'm, I'd like to bring up something related to siting and use permits that isn't in here. And it's the idea of not requiring siting and use permits for when it's a secondary dwelling that is permitted by temporary use permit.

[1:32:20] Trustee Busheikin: And this gave me the idea that that also could be maybe mitigated also to do with being close to a setback, that if it was close to a setback, then you would need the siting and use permit.

[1:32:33] Trustee Busheikin: And my reasoning for this is that the temporary use permits have had almost no uptake.

[1:32:40] Trustee Busheikin: And I don't think that making it a little bit easier will hugely change that.

[1:32:44] Trustee Busheikin: at. So, you know, that's one thing to think about. We'd really be talking about, you know, maybe

[1:32:51] Trustee Busheikin: at the rate of, you know, one, we've had one temporary use permit in five or six years. So

[1:32:58] Trustee Busheikin: even if we double that, it's very minor. So we're not kind of opening the door to chaos. And the

[1:33:04] Trustee Busheikin: temporary use permit was meant to be an accessible approach to secondary dwellings. And, you know,

[1:33:14] Trustee Busheikin: for whatever reason and we could do some analysis of why that there hasn't been uptake there just

[1:33:19] Trustee Busheikin: hasn't and part of it is that um you know you need to get your temporary use permit and then

[1:33:27] Trustee Busheikin: you need to get a siting and use permit so it's quite a it seems like a long uh process with two

[1:33:33] Trustee Busheikin: separate permits two separate applications two separate fees uh a lot of i mean the way the

[1:33:39] Trustee Busheikin: temporary use permits work it's not although the one we have is actually for building i think when

[1:33:44] Trustee Busheikin: When we created that option, it was people coming to us and saying, you know, there's people already living in buildings or buildings that could be used for housing, but they're illegal.

[1:33:54] Trustee Busheikin: Can't we just at least legalize what we have?

[1:33:57] Trustee Busheikin: And the other thing is people living in tiny homes and RVs, which, you know, I know in terms of building permits, that's not hugely supported, but it is more and more all over Canada and North America.

[1:34:10] Trustee Busheikin: It's the reality of if it's the only kind of housing you can get, it's pretty precious housing.

[1:34:17] Trustee Busheikin: So what I'd like to see, and I don't think it can be done right now, but I'm wondering if we could go ahead with this.

[1:34:24] Trustee Busheikin: but also, and I think it would be administrative, look at the option of waiving the requirement for a siting and use permit for secondary dwellings permitted by a temporary use permit, except when they are within one meter of a setback.

[1:59:38] Trustee Critchley: season i just breathe a sigh of relief and we got through another one and i know that there are

[1:59:43] Trustee Critchley: there have been several incidents of close calls you know where they have been small fires which

[1:59:48] Trustee Critchley: have been called in very quickly and being able to be suppressed but it's an ongoing issue of

[1:59:54] Trustee Critchley: utmost concern so if staff has a comment on that i'd be interested in knowing

[2:04:27] Chair Fast (probable): alberta and the okanagan and uh so i would look at the salt spring uh i would watch them they

[2:04:33] Chair Fast (probable): in fact i can probably send you some links if you're interested uh from meetings webinars that

[2:04:40] Chair Fast (probable): they had back in the early summer i believe it was so i'll just make myself a note of that

[2:04:49] Chair Fast (probable): But Islands Trust-wide, I'm not aware of Trust-wide things that we certainly don't have that kind of thing on our Trust Council strategic plan.

[2:05:08] Chair Fast (probable): And Islands Trust Conservancy is going to be looking at, I believe in the next year, how they can better, whether there are things they can do to manage protected areas that would be helpful in terms of managing wildfire prevention.

[2:05:31] Chair Fast (probable): And partly because big trees, big old trees, for example, people think that they're a fire risk, but they're actually protective. Some of the more recent information. So high quality older forests, healthy older forests are actually protective.

[2:07:04] Trustee Critchley: um they have a threshold there that it doesn't kick in until i think it's a gathering of 400

[2:07:10] Trustee Critchley: people or more than 400 something something like that um which of course seems like it would be uh

[2:07:18] Trustee Critchley: of no use at all even if it were to apply to denman but as i understand it um although we

[2:07:25] Trustee Critchley: are in the cvrd that bylaw uh exempts denman and hornby from its application so the question is uh

[2:07:33] Trustee Critchley: And more broadly for our local trust committee is whether we should, down the road, be looking at having some sort of events bylaw to try and get a bit of a handle on larger events, particularly in the summertime, where it presents a heightened risk of wildfire.

[2:07:53] Trustee Critchley: I know that the fire chief locally is concerned about this and thinks that it would be useful to have that as a tool to manage larger events on private property, which currently it's very restricted as to what can be done about it.

[2:08:12] Trustee Critchley: But it does pose a threat to immediate neighborhoods and for that matter to the entire island, because we know we've seen what's going on in the interior.

[2:08:23] Trustee Critchley: if these things get going they don't stop anyway that's uh so just on the list generally

[2:08:30] Trustee Critchley: uh i would be interested in having a brief discussion on that well

[2:13:54] Trustee Critchley: because if it were being held this afternoon or tomorrow,

[2:13:59] Trustee Critchley: I think I'd be more comfortable with it,

[2:14:02] Trustee Critchley: but the fact that it's three weeks down the road

[2:14:06] Trustee Critchley: and we know that this Delta variant is circulating around,

[2:14:13] Trustee Critchley: it's a lot more virulent, easily transmissible.

[2:14:16] Trustee Critchley: We've got kids just going back to school, many of whom are not vaccinated.

[2:14:23] Trustee Critchley: I think we can, as non-medical people even, probably anticipate that there's going to be some rise in the incidence of COVID in the next few weeks.

[2:14:36] Trustee Critchley: Possibly three weeks from now could be a different situation.

[2:14:41] Trustee Critchley: I'm concerned that as a trust-sponsored sort of activity, does it look bad, put the trust in a bad light, putting on a public gathering, which is, although desirable, it's certainly not essential or necessary.

[2:15:02] Trustee Critchley: So, you know, I'm kind of worried about the public appearance aspect of the thing in terms of how the situation looks three weeks down the road.

[2:15:14] Trustee Critchley: And we're just glancing into a very hazy crystal ball they're trying to figure out.

[2:15:20] Trustee Critchley: But my inclination is, in the time spent thinking about that, has gotten kind of more conservative.

[2:15:27] Trustee Critchley: conservative uh and thinking you know could we not do this maybe you know when the situation

[2:15:34] Trustee Critchley: was a little a little clearer i mean the situation has been clearer i think in i've attended

[2:15:39] Trustee Critchley: events at the community hall and felt quite safe and so forth but three weeks from now i'm not so

[2:15:48] Trustee Critchley: sure how it's going to be and you know it's not one of those things that could really cancel on

[2:15:52] Trustee Critchley: a moment's notice or at least that's not a desirable thing so i'm leaning towards saying

[2:51:58] Chair Fast (probable): line and i just wanted to point out here that this has the uh magic figure of 47 million dollars

[2:52:06] Chair Fast (probable): total appraised value of properties protected by the kick-starting grants um we as the islands

[2:52:12] Chair Fast (probable): trust conservancy uh um award to uh conservation partners uh to do have a survey done or to

[2:56:09] Trustee Critchley: what sort of monitoring and what sort of interface with other governmental agencies such as

[2:56:18] Trustee Critchley: Department of Fisheries and Oceans, for example.

[2:56:23] Chair Fast (probable): And I brought up the heat dome because it only happened like the week or two before that July meeting.

[2:56:30] Chair Fast (probable): And I wondered what people had been, whether the staff who were out doing the field work in the summer had been noticing that.

[2:56:39] Chair Fast (probable): And I think I brought up your point that you could, Trustee Critchley, that you had said you could smell it from where you were living.

[2:56:49] Chair Fast (probable): and that staff didn't have an answer for me

[2:56:55] Chair Fast (probable): because they concentrate on protected areas and stewardship.

[2:57:18] Chair Fast (probable): And, but other than that, I haven't seen any scientific reports or formal monitoring plans yet, because it's such a new idea. And people weren't sure what to expect. I've seen photos of empty barnacle shells, and empty mussel shells and things like that.

[2:57:39] Chair Fast (probable): But you folks on Denman, I think, have more shallow shellfish flats than many of us do.

[2:57:48] Chair Fast (probable): I'm

Chair Fast called the meeting to order at 10:00 am. She introduced Trustees, staff and recorder, 
and acknowledged that the meeting was being held in territory of the Coast Salish First Nations.  
2. APPROVAL OF AGENDA 
 The following additions to the agenda were presented for consideration: 
 An addendum to the regular meeting agenda: 13.6 Trust Conservancy Report dated August 
24, 2021. 
 The addition of item 12.3 for discussion about the upcoming September 26, 2021 film 
screening of Dust ‘n Bones regarding Covid concerns. 
By general consent the agenda was approved as amended. 
3. RISE AND REPORT - IN CAMERA MEETING JULY 6, 2021 
Chair Fast reported that at the July 6, 2021 In Camera meeting, the Local Trust Committee (LTC) 
resolved by general consent to rise and report the following: 
 The appointment of Edina Johnston, Anne de Cossen, Thomas Zawila, C. Urquhart, and 
George McRae to the Advisory Planning Commission. 
 A standing resolution was adopted: That the LTC clarify that the reference to a 45-day limit 
for visitor accommodation means 45 days for one client and that otherwise there are no 
limits on how many days per year a visitor accommodation home occupation can operate; 
and that this temporary policy remain in place until this regulation is reviewed. 
 Resolutions were adopted respecting First Nations: That the LTC request staff to provide a 
briefing and public speaking notes regarding ongoing work to protect cultural heritage sites 
on Denman Island; and that the LTC request staff to explore options for implementing the 
K’ómoks First Nation Cultural Heritage Policy on Denman Island.

 July Trust Council Special meeting at which the motion to give first reading to the 
Islands Trust Draft Policy Statement was defeated; 
 A personal interview meeting with the Trust Council Select Committee-governance 
and management review in August; 
 August Trust Programs Committee meeting at which discussion included the recent 
provincial government moratorium on dock building being imposed without Islands 
Trust input. 
Trustee Busheikin provided a summary of activities and meetings attended: 
 July Trust Council Special Meetings regarding the Islands Trust Draft Policy 
Statement; 
 An August event on Hornby Island attended by the MLA for Mid Island-Pacific Rim 
and Minister of Municipal Affairs Josie Osborne to discuss and celebrate the recent 
funding announcement for fibre optic internet connectivity installations upcoming 
on Denman and Hornby Islands; 
 Covid response electronic meetings on Denman Island; 
 Financial Planning Committee Meetings for the upcoming budget cycle; 
 Regional Planning Committee of Island Trustees at which the Planning Services 
Review was discussed; 
 Presentation by Islands Trust Senior Freshwater Specialist William Shulba.  
4.2 Chair's Report 
  Chair Fast provided a summary of activities and meetings attended: 
 Chairing Hornby, Gambier and Keats Islands LTC meetings; 
 Bowen Island meetings as a Municipal Councillor; 
 Several Executive Committee meetings;

Planner Zupanec presented the Staff report addressing minor recommendation 
amendments to Denman Island Housing Agreement Bylaw No. 239, 2020.

that the Denman Island Local Trust Committee Bylaw No. 239 cited as “Denman Island 
Housing Agreement Bylaw No. 239, 2020”, is amended as follows: 
a. Terms of Instrument, Part 2 be amended to replace the Denman Community 
Land Trust Association address from 3900 Lacon Road to 3771 East Road. 
b. Schedule B, Replace section 2. With the following text: “2. Only Seniors, that is, 
persons 65 years of age and over (to a maximum of 2 such persons) may apply 
for an Affordable Dwelling Unit. Seniors of all ethnicities and races including but 
not limited to all on-reserve and off-reserve, status and non-status, and self-
identifying indigenous, Inuit and Metis people, as outlined in Calls for Justice 
#4.1 of the “Final Report of the National Inquiry into Missing and Murdered 
Indigenous Women and Girls and 231 Calls for Justice” (June, 2019) may 
become “tenants” upon entering into a tenancy agreement. 
c. Schedule B, Section 9(i), 10(ii), add the words “Subject to Section 13 below” at 
the beginning of each subsection. 
d. Schedule B, add a new section 13. That reads: “The requirements of subsections 
9(1), 10(i) and 10(ii) will be waived for indigenous elders who are seniors and 
whose ancestry relates to those First Nations having territorial claims to 
Denman Island.

following resolution was made to defer this item pending formal process.

10. LOCAL TRUST COMMITTEE PROJECTS 
10.1 Farming Regulation Review Project - Staff Report 
Planner Eggen presented the staff report requesting the LTC to consider endorsing the 
newly revised Denman Island Farming Regulations Review Project Charter dated 
September 7, 2021, previously known as the Denman Farm Plan Implementation 
Project.  Islands Trust was recently awarded a grant of $18,000.00 as a 50% contribution 
towards the project, from the BC Investment Agriculture Foundation (IAF), and that 
August 1, 2022 is the deadline for draft bylaws to be completed according to the IAF 
funding agreement.

that the Denman Island Local Trust Committee request that the Denman Island Farming 
Regulations Review Project Charter dated September 7, 2021 be amended to add, under 
“In Scope”, a third bullet: consideration of new Agricultural Land Commission options

12.1 Siting and Use Permit Bylaw Update - Staff Report 
Regional Planning Manager Kauer presented the staff report that asks the LTC to 
consider passing Bylaw No. 240 cited as “Denman Island Local Trust Committee Siting 
and Use Permit Bylaw 240, 2021, to modernize the original 1990 bylaw and to add the 
requirement of professional site plans for all applications or just for specific situations 
such as setbacks from watercourses. Surveyor costs were estimated at, aside from travel 
costs, between $380.00 to $540.00. Historically, applicants have provided their own 
drawings.

Trustees discussed drought, forest health, wildfire concerns and the Comox Valley 
Regional District summertime events bylaws as topics to bring up. 
Chair Fast noted the emerging awareness that very large trees and older mature forests 
were protective in terms of mitigating forest fires.  
12.3 Dust ‘n Bones Film Screening Event at the Denman Island Community Hall on 
September 26, 2021 
 Trustees discussed the possibility of canceling the event given the complications of 
Covid protocols, new requirements for vaccine passports and rising Covid cases.

Chair Fast presented the report ‘Highlights of Islands Trust Conservancy July 13, 2021 
Board Meeting (Open Portion)’ noting the following:  
 In the most recent edition of the quarterly Islands Trust Conservancy’s Heron 
Newsletter available online or in hard copy, it was highlighted that $47,000,000.00 
worth of conserved property had been protected in the Salish Sea through Kick-
start grants given to conservation partners. 
 A new Species at Risk Program for the Trust area has recently been initiated and a 
coordinator hired through federal grant funding. 
A trustee noted that the recent concerning heat dome event of late June could warrant 
further beach monitoring.
