[0:00:26] Voice 8: begin the meeting today by acknowledging we're fortunate to be able to gather here today in the
[0:00:30] Voice 8: territory of coast salish peoples and in particular the penelicate tribe stewards of these lands and
[0:00:36] Voice 8: waters since time immemorial land and territory acknowledgements are important today because
[0:00:43] Voice 8: colonialism is not just historical problems ongoing in the present day first nations title
[0:00:49] Voice 8: although recognized in canadian law has yet to significantly shape first nations canadian
[0:00:54] Voice 8: relationships in many areas and i want to
[0:00:57] Voice 8: acknowledge in particular that the galliano
[0:00:59] Voice 8: on a local trust committee and the Connecticut tribe have embarked on an important journey of
[0:01:03] Voice 8: relationship building together and the chief and council and trustees and staff have all been part
[0:01:10] Voice 8: of coming together for this important work and I really appreciate the work of each and every one
[0:01:16] Voice 8: of you to bring us to where we are today and the commitment um we've all made to keep working
[0:01:20] Voice 8: together and I also want to single out Councillor Ken Thomas uh for your invaluable role as being
[0:01:28] Voice 8: liaison coming to so many of our meetings i think has really been helpful to to build the back and
[0:01:34] Voice 8: forth that that's brought us to where we are today which i feels like a really positive space compared
[0:01:41] Voice 8: to where things were in the past and so i would appreciate all of you for that um my name is tim
[0:01:49] Voice 8: peterson i'm elected on mesquite island and i am the chair of the galliano island local trust
[0:01:54] Voice 8: Committee. With me today are local trustees Ben Maberly and Lisa Dubrow and this is a forum for
[0:02:04] Voice 8: the business of the local trust committee to consider land use planning and associated
[0:02:10] Voice 8: matters. Joining us also is our planner Kim Stockdale and online doing our meeting and
[0:02:18] Voice 8: administration is Lisa Millard all for your work here so we have an agenda before us and
[0:02:27] Voice 8: I'll look to trustees to see if there's anything uh amendment today trustee Mabry yeah um we
[0:02:35] Voice 9: received a letter from Colleen Doty in regards to um the self-provision um and it is requiring
[0:02:44] Voice 9: requiring or asking for us to discuss removing the requirement for road dedication?
[0:02:55] Voice 4: Yes, through the chair if I may. I haven't had a chance to go through it and look at the request.
[0:03:00] Voice 4: So I can do that as we're going through the meeting, but it may require something where staff comes back with a staff report
[0:03:07] Voice 4: with a motion. I'll have to dig into it a little bit more.

[0:03:46] Voice 4: good afternoon everyone uh since our last meeting
[0:03:50] Voice 4: i've been meeting with community members attending an in-person trust conservancy meeting
[0:03:57] Voice 4: and participating in my first trust programs committee meeting as you may have heard that
[0:04:03] Voice 4: trust programs committee has been tasked to work on the policy statement with the goal of completing
[0:04:09] Voice 4: a first walk through the trustee amendments um and also being ready being ready for the june trust
[0:04:15] Voice 4: council meeting i put my name forward at the march trust council to be on the committee and i was
[0:04:22] Voice 4: appointed along with a few others we brought in that membership like quite a bit i can't remember
[0:04:29] Voice 4: exactly how many members are thank you yeah as well yeah um again i look forward to these meetings
[0:04:38] Voice 4: I found that last May extremely productive.
[0:04:43] Voice 4: At
[0:04:44] Voice 5: the end of March, I had the privilege
[0:04:45] Voice 4: of attending a local event hosted by the Galliano Library,
[0:04:49] Voice 4: one book reading program.
[0:04:52] Voice 4: The book is titled, A Mind Spread Out on the Ground
[0:04:56] Voice 4: by Mohawk author Alicia Elliott.
[0:04:59] Voice 4: The book was chosen by a group of indigenous members
[0:05:01] Voice 4: in the Galliano community for its resonance and insight.
[0:05:06] Voice 4: in sight. The book has been described as a bold and profound meditation on trauma, legacy,
[0:05:13] Voice 4: oppression, and racism in North America. The event was widely attended and closely modeled
[0:05:21] Voice 4: after the Maine Islands Initiative One Book series. The Galeano One Book Project invites
[0:05:28] Voice 4: all Highlanders to read a book that supports truth and reconciliation. And also as part
[0:05:35] Voice 4: As far as the series, I had the opportunity to meet with the author, Alicia Elliott, right here in the hall.
[0:05:41] Voice 4: And the event took place in late January and was a deeply meaningful experience.
[0:05:48] Voice 4: In other news, you may have heard that Trustee Patrick O'Sullivan was elected to Chair of Honest Trust Council.
[0:05:56] Voice 4: And I'm delighted to let everyone know that Trustee Peterson here will continue on to serve as Chair of the Gallium Committee.

[0:06:19] Voice 9: here those things like to say that the um press council held elections and uh was elected so
[0:06:26] Voice 9: let me say good news as lisa pointed out that kim's going to be our chair for a while and you
[0:06:31] Voice 9: I think it's always important to get that small island sort of outlook on the way things are run, but I'm sure Laura will do a great job.
[0:06:48] Voice 9: At that Trust Council meeting, we also approved the budget for everybody.
[0:06:54] Voice 9: I did not vote in favor of the budget.
[0:06:57] Voice 9: um i just think at this time of um you know what's happening out there in the real world um
[0:07:05] Voice 9: you know a good time for trust council to sort of look within itself and see whether there was
[0:07:12] Voice 9: ways that we could have uh um saved my hand and uh sort of tighten things up a bit but the budget
[0:07:19] Voice 9: was approved and uh and so we can move on from there also before a motion um to have the trust
[0:07:27] Voice 9: policy statement brought to trust council at um at the next trust council meeting in june i believe
[0:07:32] Voice 9: tim might seconded it and what we're looking to do at that point is get that document available
[0:07:39] Voice 9: approved and available to go out to public and first nations and sort of take that next big
[0:07:45] Voice 9: step with this document so really hoping that that happens at trust council in june um apart
[0:07:51] Voice 9: from that i think
[0:07:52] Voice 9: that's about it

[0:07:55] Voice 8: uh so next is the chair's report indeed uh trustee uh patrick
[0:08:00] Voice 8: from salt spring is the new chair she's going to do a great job i've worked with her of course lots
[0:08:04] Voice 8: on my role of chairs of the salt spring local trust committee i appreciate ben's comments also
[0:08:13] Voice 8: note that uh trustee maverly declined a nomination for chair himself um uh yes uh trust council did
[0:08:22] Voice 8: pass it as a budget for for the fiscal year there was um uh an omnibus uh set of uh proposals to
[0:08:33] Voice 8: reduce the budget and um unfortunately because of that format it it didn't pass and uh it may have
[0:08:43] Voice 8: been more successful it was broken down into individual pieces but the mover didn't choose
[0:08:48] Voice 8: to do that and because of our rules about reconsidering the same um subject for resolutions
[0:08:55] Voice 8: within the same meeting we weren't then able to go back and pull it apart so um
[0:09:01] Voice 6: procedurally that
[0:09:02] Voice 6: kind of maybe got in our way um do note that this year we were able to get some firm numbers uh
[0:09:09] Voice 6: from the province so we're able to show that on um on an average uh property across the island's
[0:09:17] Voice 6: trust area of around 850 000 value the uh
[0:09:22] Voice 8: the net increase is going to be about 32
[0:09:24] Voice 8: based on this budget so that brings i believe that brings up again for the this average of
[0:09:32] Voice 8: around 850 000 property brings up violence trust taxes to about 435 dollars a year
[0:09:40] Voice 8: so good to get those hard harder numbers from the province so we can actually see
[0:09:46] Voice 8: what the real impact is on the ground um the core elements of the strategic plan
[0:09:52] Voice 8: uh a draft strategic plan for 2025 to 2028 were approved um so that gets us into better shape for
[0:10:02] Voice 8: the work ahead of us at the end of this term and trying to set up next term
[0:10:05] Voice 8: in a good way and really integral to that is the is working towards a new model of strategic
[0:10:16] Voice 8: planning and combining strategic planning and and financial planning in the form of corporate
[0:10:22] Voice 8: planning so it's new territory for islands trust but i think by the end of this term we'll be in
[0:10:29] Voice 8: in good shape to sort of align those two streams of work
[0:10:33] Voice 8: so that the budgetary and the strategic items are aligned.
[0:10:39] Voice 8: And the Peace Affairs held a workshop
[0:10:43] Voice 8: with the trustees at Trust Council in an evening session
[0:10:47] Voice 8: where I think there was only eight of us attended.
[0:10:51] Voice 8: And certainly I think you've heard loud and clear
[0:10:53] Voice 8: from those that did attend that the process
[0:10:56] Voice 8: process by which the ferry advisory committees were disbanded was not good. There was a lot
[0:11:06] Voice 8: of frustration and upset on the islands around the way it was done, and in particular, the
[0:11:16] Voice 8: ending of that system that's been in place for around 30-odd years, and in the absence
[0:11:22] Voice 8: of what is going to replace it so that those big question marks don't help um when we're trying to
[0:11:30] Voice 8: discuss you know what's coming next is a big question mark so i think they heard us pretty
[0:11:35] Voice 8: loud and clear uh around that uh remains to be seen what what's going to come out of all of that
[0:11:42] Voice 8: as uh trustee cavarro mentioned the remaining remaining work on the draft policy statement
[0:11:47] Voice 8: has been transferred from committee of the whole to the trust programs committee with new members
[0:11:53] Voice 8: we did have a very productive uh first meeting and a i'm actually feeling pretty good that we're
[0:11:59] Voice 8: going to get to a point where we have a draft to consider at trust council in june um and this
[0:12:06] Voice 8: trustee maybe he said to then get it out to first nations and the public for comment the uh chief
[0:12:12] Voice 8: administrative officer performance evaluation evaluation committee uh continues to work on the
[0:12:17] Voice 8: the first six month probationary period items.
[0:12:20] Voice 8: That seems to be going well.
[0:12:22] Voice 8: Our new CO seems to be fitting in well,
[0:12:25] Voice 8: getting up to speed on the processes.
[0:12:28] Voice 8: And I know he's been spending lots of time with staff
[0:12:32] Voice 8: to do some in-house assessments there,
[0:12:36] Voice 8: but all in all things seems like it's a good fit
[0:12:40] Voice 8: and everyone seems to be pretty pleased so far.
[0:12:43] Voice 8: Also on the committee, the whole we're having,
[0:12:46] Voice 8: we've got plans to uh do a bit more of a deep dive on the 2022 governance report trust council
[0:12:54] Voice 8: as a whole has not um has not considered that report in its entirety uh also a review of a
[0:13:02] Voice 8: new code of conduct policy the current status of conduct is out of date and no longer meets
[0:13:09] Voice 8: with the sort of minimum standards based from the province.
[0:13:15] Voice 8: And the Committee of the Whole is a relatively new tool for Trust Council,
[0:13:18] Voice 8: and we're hoping that the use of it helps forward the ongoing work
[0:13:24] Voice 8: and prepares for discussion at a regular quarterly meeting
[0:13:26] Voice 8: so that we can get more done in a slightly more nimble fashion.
[0:13:31] Voice 8: And then finally, I'll just note that the Association of Vancouver Island Coast Communities Convention
[0:13:36] Voice 8: starts this weekend or well starts Friday in Nanaimo and myself and Vice-Chair Elliott and
[0:13:44] Voice 8: Chair Patrick and CEO Broney are all going to be there. I'm speaking on behalf of the
[0:13:52] Voice 8: local leaders for mental health ad hoc group that came out of UBCM last year.
[0:14:00] Voice 8: we're looking to uh to get the more broad uh uh support from the province for for local leaders
[0:14:09] Voice 8: and so that concludes my chair's report
[0:14:15] Voice 8: have no electoral area director with us today so next up is first nations report

[0:14:40] Voice 5: experiencing now compared to before so you know it's you know i'm just you know glad we're going
[0:14:48] Voice 5: this way and the communication is open enough and hopefully we keep going this way

[0:14:57] Voice 5: something that's important to all of us
[0:15:00] Voice 5: i just had to say that again but um just one request from uh
[0:15:10] Voice 5: send the uh
[0:15:15] Voice 7: schedule like the whole schedule for a year to myself and chief
[0:15:22] Voice 7: back so we can find
[0:15:24] Voice 5: the time to come over yeah

[0:15:37] Voice 9: think when we're doing those schedules too i think it would be great if we
[0:15:40] Voice 9: could schedule our our meetings there as well you know we should try and get to the island probably
[0:15:47] Voice 9: at least twice a year to sit down with um the chief and council and just go over anything

[0:15:56] Voice 7: that would be a good step, like I was saying, when you guys came over before
[0:16:06] Voice 8: it was the first time, I think, for
[0:16:10] Voice 8: us
[0:16:12] Voice 5: to come to our nation and have that communication and that back and forth, just to keep communication going.
[0:16:37] Voice 8: I think we all appreciated the invitation and the opportunity to come and be there with you.
[0:17:01] Voice 4: Would the LTC like to consider scheduling something? It would be an LTC meeting, but we'll move over to the LTC Council as a part of perhaps a special meeting there.
[0:17:16] Voice 4: No, the LTC Council special meeting will be one of your meetings.
[0:17:20] Voice 4: days. June, late June might be a good idea because that's when the new project is just starting, just the initial stages. We're going to be a draft by law, the LTC is just kind of still figuring out the key issues. Also, with the four major
[0:17:39] Voice 4: resumings right now um one is on the agenda today and the other three will be on the agenda
[0:17:44] Voice 4: so later in june might be a great time to provide updates to the council yeah
[0:17:52] Voice 8: that's great i know
[0:17:52] Voice 8: sounds good okay um next up we have the town hall of questions so remind everyone to
[0:18:05] Voice 8: um use respectful language speak to the issues not individuals and uh ideally what's on our agenda
[0:18:12] Voice 8: and secondarily what's uh what's within the jurisdiction of the local trust committee

[0:18:32] Voice 9: and thank my seven neighbors for stepping up and offering to serve
[0:18:37] Voice 9: on the advisory planning commission there's a couple of them here today with us and i know that
[0:18:44] their diverse backgrounds experience and their commitment to galliano will help the
[0:18:49] Voice 8: ltc in its
[0:18:51] Voice 8: land use deliberations especially with the ocp review renewal on the urban horizon
[0:18:57] Voice 8: And I have a couple of questions. I also have applications, but all for the lawyers for
[0:19:05] Voice 8: purpose.
[0:19:07] Voice 5: Thanks, Chair Beggerson. I'm Paula. I noticed that the ExaltSpringLTC voted to ask to be
[0:19:19] Voice 5: be included in the new provincial that
[0:19:23] Voice 8: requires a very common sense approach to STVRs, which
[0:19:28] Voice 8: is their region history, that they only be operated by residents of their islands.
[0:19:36] Voice 8: As you know from the Explantage project out the road, we're building some purpose-built
[0:19:40] Voice 7: housing over here, but
[0:19:42] Voice 8: more and more, we see non-resident, let's call them, Airbnb
[0:19:46] Voice 8: and B firms by not properly equipping them to SQBR is not right, which is a total cash flow.
[0:19:51] Voice 8: So I would like to request that this LTC, I know it's not on your agenda for today,
[0:19:55] Voice 8: but that you consider perhaps talking to your colleagues at the SSI LTC. They would have had
[0:20:01] Voice 8: some deep thought and research, I'm sure, before they made such a community-based decision.
[0:20:07] Voice 8: I'm requesting that you guys consider joining the SSI LTC in that request.
[0:20:17] Voice 8: yeah i am the chair of the salt spring local trust committee so i have a little bit of insight there
[0:20:25] Voice 8: certainly the there was there were meetings with the stakeholders the operators uh the
[0:20:30] Voice 8: chamber of commerce there and um there's a general consensus that opting into the principal residency
[0:20:36] Voice 8: requirements was appropriate for salt spring um there is a the deadline yearly is march 31st so
[0:20:46] Voice 8: that would be for galliano uh local trust committee we would have to you know have to
[0:20:52] Voice 8: get prepared to to consider whether that was appropriate next march but
[0:20:57] Voice 6: there's there's a
[0:20:57] Voice 6: timeline so you opt in uh or not on the 31st of
[0:21:01] Voice 8: march and then that becomes a a legal requirement
[0:21:05] Voice 8: in november of the same year and similarly you can choose to opt back out um one thing that's
[0:21:13] Voice 8: change of course is the uh the provincial registry for short-term vacation rentals which is not an
[0:21:19] Voice 6: opt
[0:21:20] Voice 8: -in situation it just applies broadly to all operators um there are some some considerations
[0:21:28] Voice 8: from the local trust committee
[0:21:30] Voice 6: kind of point of view is that means that the
[0:21:35] Voice 8: province then
[0:21:39] Voice 8: uh takes a role in um part of the enforcement action which can be a reduction of resources for
[0:21:48] Voice 8: for islands trust by law enforcement action so there are there are some sort of ancillary
[0:21:53] Voice 8: benefits um to the organization more broadly that that can take place but certainly that's a that's
[0:22:00] Voice 8: a community discussion um i think for any local trust committee to consider whether that's
[0:22:04] Voice 8: appropriate and uh we can certainly have and i encourage the local trustees of course to go out
[0:22:10] Voice 8: and see see what uh people think but certainly we could have that discussion here at this table
[0:22:17] Voice 8: um anytime between now and march uh 31st of next year follow up for the chair yeah um so you
[0:22:25] Voice 8: referenced that the threshold for you guys making that decision on salt spring was cohesion in the
[0:22:31] Voice 8: community around um business right so you reference the chamber just were there other
[0:22:38] Voice 8: specific kind of benchmarks that you guys were looking for before you proceed well
[0:22:42] Voice 6: i think that
[0:22:43] Voice 6: really um i think that really collapsed i'd have to find somewhere in here
[0:22:51] Voice 8: i've got a
[0:22:53] Voice 6: list of of of
[0:22:55] Voice 8: the groups that we heard of on salt spring but there was
[0:22:59] Voice 8: there was general agreement through those groups for those you know essentially maybe the operator
[0:23:05] Voice 8: groups that it was a good idea um so thank you yeah i could find you more information on that

[0:23:26] Voice 7: some references to their official community plan uh review um but the um report from the trust
[0:23:37] Voice 7: council budget that i saw um mentioned official there's funding for official community plan
[0:23:43] Voice 7: reviews for a number of a number of islands um but not for
[0:23:49] Voice 8: galliano i was wondering why that
[0:23:51] Voice 8: that one that was okay and i can i can before i pass it over to staff i can say that the um
[0:23:59] Voice 8: our the way our funding model works is that uh when uh a project is uh estimated to be around
[0:24:06] Voice 8: five thousand dollars or less it doesn't need to get approval from trust council and when it
[0:24:12] Voice 8: when it goes when it's expected to go over that then a business case is put together and travels
[0:24:18] Voice 8: through financial planning committee and eventually gets to trust council for approval
[0:24:22] Voice 8: so uh and staff would we have a a brief report on review here but i'll leave it to staff to speak
[0:24:28] Voice 8: around the finding issues absolutely
[0:24:31] Voice 4: thank you um just this the staff report that's in the agenda
[0:24:35] Voice 4: today it's really just going over some basic information on what um an official community
[0:24:41] Voice 4: plan review may look like different timelines so so there are questions to the ltc um that
[0:24:46] Voice 4: staff need prior to even initiating the project charter but if this does um if this is something
[0:24:52] Voice 4: ltc wants to pursue would be included in the 2026 and 2027 budget so not this fiscal year
[0:25:00] Voice 4: but next fiscal year so
[0:25:02] Voice 7: what you're saying is the other
[0:25:04] Voice 8: islands already did that work
[0:25:06] Voice 8: that's right and in most cases they had that going out or ready to go out business being
[0:25:14] Voice 8: ready to go out by september so um again if this local trust committee wants to think about that
[0:25:21] Voice 8: it's a good idea to maybe by our july meeting to have given staff some direction on business
[0:25:27] Voice 8: cases so that it gets into the the pipeline of the of the financial committee as early as possible
[0:25:32] Voice 8: i think that's that's helpful certainly that's what we did on on liscadia and salt spring and
[0:25:41] Voice 7: um
[0:25:42] Voice 8: thank you
[0:25:44] Voice 4: um i just have a couple of comments and and a couple of questions regarding the
[0:25:50] Voice 4: fomberg application and um forgive me if any of these have been covered in a previous meeting
[0:25:56] Voice 4: so um this appears to be quite a significant land use change um for this property with potential
[0:26:06] Voice 4: impacts on the surrounding neighbourhood in terms of quiet, water and traffic.
[0:26:13] Voice 4: And I was just looking at many of the letters that are on the website in reference to the application
[0:26:22] Voice 4: and see that many of them comment on the likeability and the contribution of the owner to the community.
[0:26:30] Voice 4: That is, of course, irrelevant to consideration of the application, but I know that's a common
[0:26:40] Voice 4: thread in our small community when it comes to things like this.
[0:26:44] Voice 4: So I was just
[0:26:46] Voice 4: wondering if consideration has been given to referring this application to
[0:26:52] Voice 4: the Advisory Planning Committee.
[0:26:54] Voice 4: And full disclosure, I've just become a member of that committee, but I'm not aware of very many applications over the last, maybe, if any, over the last year going to that committee for consideration.

[0:42:50] Voice 8: council for the province to open up and look at the act with with the goal of of implementing
[0:42:57] Voice 8: being crippled within the honest trust act that's a piece that we haven't maybe had capacity fully

[1:00:11] Voice 4: Statement. But as discussed earlier, there was a reference to policy 4.2. So if the LTC wants to,
[1:00:20] Voice 4: rather than have that as not applicable, you can make a draft motion stating that that policy is
[1:00:30] Voice 4: satisfied or in compliance or if there's concerns that the LTC has with that policy because but no
[1:00:37] Voice 4: it's not in compliance so just wanted to mention that the LTC can make those changes as well
[1:00:43] Voice 4: so I'm going to first talk about the land use bylaw as mentioned or as mentioned previously
[1:00:51] Voice 4: the subject property is currently zoned rule two and it will be it's proposed to be rezoned to a

[1:01:15] Voice 4: including production storage and sales staff have actually didn't add a contractor workshop
[1:01:23] Voice 4: workshop to the draft bylaw, thinking that it would be included or satisfied by the contractor
[1:01:30] Voice 4: yard definition, but after discussions with the applicant, we're actually staff is recommending
[1:01:36] Voice 4: putting contractor workshop into the draft bylaw. So there is a motion, a draft motion
[1:01:44] Voice 4: for the LTC's consideration. If the LTC does give first reading, staff recommend that that draft
[1:01:53] Voice 4: final be amended first to include contractor workshop to the draft final before the first
[1:02:00] Voice 4: reading is given. The draft final also has some regulations added to restrict the height
[1:02:07] Voice 4: of building structures associated with those proposed new uses, land screening requirements,
[1:02:15] Voice 4: the addition of parking and sign regulations, and also the addition of a contract with our
[1:02:21] Voice 4: definition, and this is a standard definition that we use in other land use bylaws.
[1:02:26] Voice 4: In terms of further regulating hours of operation, number of vehicles that are permitted on site,
[1:02:35] Voice 4: that would be addressed through a section 219 covenant.
[1:02:39] Voice 4: So there's a list there on page 25 of the agenda
[1:02:43] Voice 4: of items that staff intend to discuss with the applicant
[1:02:47] Voice 4: to include those conditions in the draft covenant.
[1:02:52] Voice 4: So how a draft covenant generally works is
[1:02:54] Voice 4: the LTC can review the list.
[1:02:57] Voice 4: If the LTC feels that something should be included,
[1:03:00] Voice 4: you can do that at this meeting.
[1:03:03] Voice 4: Staff will then go back to the applicant
[1:03:05] Voice 4: and the applicant and staff will work together on putting together that draft covenant.
[1:03:09] Voice 4: And then that draft covenant will come back to the LTC to review, and if the LTC wishes to make any changes, the LTC can do that.
[1:03:19] Voice 4: Also, the water management plan, staff have been in discussion about the requirements for that,
[1:03:24] Voice 4: and the applicant is waiting to hear back from staff on particulars of that water management plan.
[1:03:30] Voice 4: So the holdup is not from the applicant, it is on staff's end.
[1:03:33] Voice 4: So I'm sure that that is set by the applicant.
[1:03:37] Voice 4: And there's also a discussion or a consideration to the restriction of the rental of the side
[1:03:43] Voice 4: re-inquiry for special or private events.
[1:03:45] Voice 4: It's not something that staff has had a discussion with the applicant about, but that's something
[1:03:49] Voice 4: in the future the applicant and the NTC and staff may want to have a discussion about
[1:03:53] Voice 4: in terms of permitting it, or that's something the applicant would like to add specifically
[1:03:59] Voice 4: specifically to plan just by law or by the section in terms of the official community plan and then
[1:04:10] Voice 4: the official community plan the rural designation the principal uses right now in residential
[1:04:19] Voice 4: agriculture and i'm just going to turn if the ltc could take a look at page 24 of the agenda
[1:04:24] Voice 4: Back in 2011, the rural designation, the only principal use was residential.
[1:04:34] Voice 4: But during the OCP venue, agriculture was added as a primary use or principal use as well.
[1:04:42] Voice 4: And staff believe that policy E should have also been amended at that time.
[1:04:47] Voice 4: Policy E states that within this designation a number of different zones may be applied
[1:04:54] Voice 4: allowing different levels of uses accessory to residential uses.
[1:04:58] Voice 4: So staff have put together, drafted an OCP amendments by-law that's attached to the staff report
[1:05:04] that would include residential agriculture
[1:05:08] Voice 4: uses to Policy E.
[1:05:10] Voice 4: It's important that we do that or the LTC adopts that bylaw as the applicant right now
[1:05:18] Voice 4: has no current intention of constructing a dwelling unit on that property.
[1:05:26] Voice 4: The current use is agriculture.
[1:05:28] Voice 4: So in order for the land use bylaw, the draft land use bylaw, to be in compliance with the
[1:05:34] Voice 4: DOCP, policy E would have to be amended to include that reference to agriculture uses.
[1:05:44] Voice 4: Now, I'm just going to quickly go over the statutory requirements.
[1:05:50] Voice 4: Staff are recommending kind of separating the two processes for draft bylaw 296, which
[1:05:58] Voice 4: is the OCP in my new bylaw and bylaw 297 which is when I use bylaw and the reason for that is 296
[1:06:08] Voice 4: the OCP bylaw will need to be approved by the minister and that unfortunately has taken
[1:06:14] Voice 4: quite a few months right now I think it's we're sitting at about six months
[1:06:19] Voice 4: so staff are proposing for the LTC to give direction to give first reading to the OCP bylaw
[1:06:26] Voice 4: and also to give direction to hold a CIM public hearing for that by-law,
[1:06:31] Voice 4: potentially scheduling that for the July meeting, just so the OCP by-law can move along quicker,
[1:06:38] Voice 4: and that gives time for the LTC and staff and the applicant to work on the land use by-law process.
[1:06:47] Voice 4: If the OCP by-law is adopted and first reading isn't given to the land use by-law yet,
[1:06:55] Voice 4: the LTC does have the option to waive or permit, start waiving, is getting notice of first
[1:07:01] Voice 4: waiving for by-law 297. Or a public hearing can also be held for the land use by-law 297.
[1:07:10] Voice 4: That decision doesn't have to be made yet. Really, staff just want to ensure that the
[1:07:15] Voice 4: LTC agrees that the OCP amending by-law can continue forward and we can schedule a CIM

[1:07:29] Voice 4: the province. Those are the nations of interest. Worked out in Rhode Island LTC. Agencies and

[1:43:02] Voice 4: As discussed at the last meeting, an OCP review would be a major project
[1:43:08] Voice 4: under the Trust Council policy, and that requires a business case approved
[1:43:13] Voice 4: by the Trust Council for the next fiscal year, so for 2026 to 2027.
[1:43:19] Voice 4: A major project is generally assigned to the regional planning team, so it wouldn't necessarily be assigned to your LTC planner, but the LTC planner would assist with that project.
[1:43:35] Voice 4: So on page 53 of the staff report, the discussion is broken down into the project scope, the review process, and the budget.
[1:43:45] Voice 4: it and really the major discussion or decision making the LTC needs to make today is if the
[1:43:55] Voice 4: official community plan review should involve a complete review of the OCP so the entire thing
[1:44:02] Voice 4: between the entire OCP or a targeted review if you're just wanting to target certain sections
[1:44:09] Voice 4: like the forestry section or groundwater or whatever you may just have certain sections
[1:44:16] Voice 4: the LTC may want to target. So the difference between a complete review versus a targeted review
[1:44:23] Voice 4: would mean difference in budgeting and also timeline. If you're doing a complete OCP review
[1:44:29] Voice 4: the budget would obviously be greater and the timeline can be longer compared to a targeted
[1:44:35] Voice 4: review so you don't have to make a decision on what you want to target perhaps a discussion around
[1:44:41] Voice 4: yes we think a full review is needed or no maybe it's okay just to have certain aspects of those
[1:44:48] Voice 4: so that's really what we're looking for in this decision from the ltc because that will shape as
[1:44:55] Voice 4: i mentioned not only the budget and timeline but also the review process um i did want to mention
[1:45:03] Voice 4: a state or a staff report that the last time an OCP was reviewed was back in 2011, so we're
[1:45:11] Voice 4: almost creeping up to 15 years, and generally 15 years is a good time for a local trust
[1:45:16] Voice 4: community to come back and review their OCP.
[1:45:19] Voice 4: The previous OCP review was broken down into certain pieces.
[1:45:25] Voice 4: There were specific advisory planning commissions organized that focused on certain topics in
[1:45:33] Voice 4: the OCP and they reported back on the process which helped to prepare the draft bylaws and
[1:45:40] Voice 4: that's something that the LTC may consider. This project was born is also doing a similar type of
[1:45:48] Voice 4: engagement process with the LTCs but also to include Aboriginal First Nations as well. So the
[1:45:55] Voice 4: consultation with First Nations will be a major part of this project and that's included in the
[1:46:01] Voice 4: the draft work plan that Robert and Gina has put together.
[1:46:07] Voice 4: I don't need it there.
[1:46:09] Voice 4: As mentioned, really what staff is looking for now
[1:46:12] Voice 4: is some discussion from the LTC
[1:46:15] Voice 4: if this should be a targeted review or a full review.

[1:48:13] Voice 9: confined process otherwise it's just going to drag on forever and and nothing will ever be
[1:48:19] Voice 9: accomplished and i mean that's been proven out when you look at ocp reviews that have been ongoing
[1:48:24] Voice 9: as it's brought up in the community all earlier about you know when you see it in the budget
[1:48:29] Voice 9: it's been in the budget for over 10 years i mean just a huge amount of time and money i think
[1:48:37] Voice 9: um and even frustration when you talk to trustees from those islands where those ocps
[1:48:42] Voice 9: you know they think they should have been completed and now the process has gone on for so
[1:48:46] Voice 9: long that they're having to go back and start a lot of the initial stages over again because
[1:48:52] Voice 9: of course consultation working with first nations has completely changed the landscape around what
[1:48:57] Voice 9: an ocp should look like so um so yeah let's you know as far as i can see let's go with a targeted
[1:49:03] Voice 9: review and then let's start to get feedback from the public on on what sections of the ocp they

[2:05:13] Voice 8: trying to tackle the whole uh entirety of the ocp in one go just

[2:05:25] Voice 9: we will endeavor around that path um my caution is that when when i look at the ocp reviews that

[2:07:46] Voice 7: agenda today, the addition of agricultural to a rural use, and also the addition of extra
[2:07:57] Voice 7: density for affordable housing came in to the OCP on that.

[2:08:14] Voice 9: today is just sort of let's get a layout of where we're going to get community input and not
[2:08:19] Voice 9: starting and so if the input is okay let's take it on this and we get it done in an efficient
[2:08:25] Voice 9: manner then we'll let them do so I'm just looking at what I'm seeing and just you know coming
[2:08:33] Voice 9: through trust council and not seeing that process being as efficient as it was in 2009 so

[2:09:24] Voice 8: more efficiently in some communities than others when you've got an engaged community willing to
[2:09:29] Voice 8: sit down and do the hard work a lot more can be done at a quicker time steve uh two comments i

[2:22:26] Voice 2: there was also a concern about the welfare of animals being left alone and the noise that was
[2:22:32] Voice 2: made from a rooster and one of the goats being cited as extremely loud for this zone the rr zone
[2:22:42] Voice 2: there is a bylaw 5472 that allows the structures for animals but they have to be cited at least
[2:22:51] Voice 2: 30 meters from any interior side lot line when we did an approximation of the property's side the
[2:22:59] Voice 2: size the width it's 45.8 meters wide so the structures for the accommodated accommodation
[2:23:08] Voice 2: of animals would not be permitted because it has to be at least 60 meters wide so i did meet the
[2:23:21] Voice 2: observed two goats and approximately eight chickens uh the property owner the respondent
[2:23:28] Voice 2: advised that she does have people that take care of her animals when she does leave the property
[2:23:33] Voice 2: which isn't very frequent and she also provided a document from her doctor confirming that the
[2:23:40] Voice 2: goats are designated her emotional support animals necessary for her to maintain her current mental
[2:23:45] Voice 2: health and stability. She did state that she will not be applying for a land use variance which
[2:23:52] Voice 2: is an option due to financial restraints. I wanted to just quickly go through the photos if you
[2:24:01] Voice 2: haven't seen them already. I'm currently on an aerial photo that shows the approximate width

[2:36:01] Voice 4: that concerns neighbors saying you know what happened what's going on like why was it filed
[2:36:06] Voice 4: we see it as an issue and we need to look at it not in a perspective of this one property
