[0:00:02] Trustee Elliott: Good morning, everyone. It's Gwail, and thank you for joining us today for the regularly scheduled business meeting of the Thetis Island Local Trust Committee.
[0:00:12] Trustee Elliott: I'll note that it wasn't, well, it was scheduled originally for a month ago, so thanks for bearing with us as we had to juggle some things.
[0:00:21] Trustee Elliott: I want to begin the meeting by acknowledging that we are grateful to be able to live, work,
[0:00:28] Trustee Elliott: and gather today in locations across the traditional territory of Coast Salish peoples.
[0:00:33] Trustee Elliott: The nations with interest in this local trust area include Penelope Trotter and the Accent
[0:00:38] Trustee Elliott: First Nation.
[0:00:39] Trustee Elliott: We are grateful to the nations for their continued stewardship and relationship to these lands
[0:00:44] Trustee Elliott: and waters, as well as for engaging with us as we learn how to co-steward and co-manage.
[0:00:52] Trustee Elliott: I want to offer my congratulations, and I'm sure on behalf of the LTC, to Cowichan Nations
[0:00:59] Trustee Elliott: for the victory in the BC Supreme Court in the decision to uphold the nation's rights
[0:01:06] Trustee Elliott: to Teotihuacan's lands, the river, and Cowichan's hereditary fishing rights.
[0:01:14] Trustee Elliott: The recognition of Cowichan Nations, which of course includes Cowichan tribes, Seneas,
[0:01:20] Trustee Elliott: Connecticut, Palo Alto, and L'Aix and Fitch Nations,
[0:01:25] Trustee Elliott: recognizes Cowichan Nation's presence and long-standing connection to the south arm of the Cowichan River,
[0:01:31] Trustee Elliott: which is now known as the Fraser River South Arm,
[0:01:34] Trustee Elliott: where their ancestors lived, fished, and thrived for generations.
[0:01:40] Trustee Elliott: After more than 150 years of struggles since the land was taken from Cowichan during the colonial era,
[0:01:45] Trustee Elliott: It is wonderful to see this ruling affirm their constitutionally protected right and title.
[0:01:53] Trustee Elliott: So, with that, I'll go to introductions. I'm Toby Elliott, the Chair of the Local Trust Committee, elected on Giverloa Island in San Diego First Nation Territory.
[0:02:04] Trustee Elliott: I'm joined today by Thetis Island Trustees, Peter Loughlin, and Ken
[0:02:09] Voice 14: Hunter, and
[0:02:11] Trustee Elliott: together we make up the Thetis Island Local Trust Committee.
[0:02:14] Trustee Elliott: We are joined by some staff members today. For the first time, Rene Jamerat, Regional Planning Manager.
[0:02:23] Trustee Elliott: And you manage how many LTCs in the Northern Mongols?
[0:02:26] Trustee Elliott: Six local trust areas.
[0:02:28] Trustee Elliott: Six local trust areas, okay. This is your first time to feed us.
[0:02:32] Voice 13: Yeah, thank you.
[0:02:33] Trustee Elliott: Everybody behave.
[0:02:36] Trustee Elliott: And Margo Tomaitis, our long-standing planner here.
[0:02:40] Trustee Elliott: Thank you for joining us.
[0:02:41] Trustee Elliott: So can you update us a little bit?
[0:02:44] Trustee Elliott: Are you still island pattern?
[0:02:46] Trustee Elliott: Are we changing?
[0:02:47] Trustee Elliott: So Nargo will continue to support the public-local
[0:02:51] Trustee Elliott: .
[0:02:52] Trustee Elliott: Right.
[0:02:52] Trustee Elliott: But I'll be more involved in the local trust
[0:02:55] Trustee Elliott: .
[0:02:58] Trustee Elliott: OK.
[0:03:01] Trustee Elliott: Thanks for that.
[0:03:02] Trustee Elliott: Thank you.
[0:03:03] Trustee Elliott: And of course, Lisa Millard, meeting facilitator and minute taker, thank you for joining us.
[0:03:09] Trustee Elliott: Background.
[0:03:10] Trustee Elliott: this meeting is being live streamed and recorded for those unable to attend in person and the
[0:03:15] Trustee Elliott: recording will be available on the island's website in the next few days this meeting
[0:03:20] Trustee Elliott: is an official forum for your local trust committee to make decisions about land use
[0:03:24] Trustee Elliott: planning matters and discuss relevant business so we'll move to approve the agenda are there
[0:03:30] Trustee Elliott: any additions or amendments yes so
[0:03:34] Trustee Luckham (probable): i would just like to add today today's agenda so i
[0:03:37] Trustee Luckham (probable): I'd like to chair the correspondence from Paul Duncan and so we can have it on the record
[0:03:43] Trustee Luckham (probable): and have a discussion about the content.
[0:03:47] Trustee Elliott: Okay. So noting that late correspondence, we can't add it to the minute, but if maybe
[0:03:54] Trustee Elliott: you can raise some of the points in that letter so that they can be recorded in the minutes
[0:04:00] Trustee Elliott: that way. And then perhaps Mr. Duncan might address this during the public participation
[0:04:06] Trustee Elliott: periods. Okay. Hello, welcome.
[0:04:10] Trustee Elliott: I'm just waiting for everyone to join us.
[0:04:12] Voice 7: I'm still on the camera.
[0:04:13] Voice 13: Is there
[0:04:14] Trustee Elliott: any other changes?
[0:04:19] Trustee Elliott: Is somebody sitting?
[0:04:21] Voice 3: The camera.
[0:04:24] Voice 3: The camera?
[0:04:26] Trustee Elliott: Yeah, over the camera.
[0:04:27] Trustee Elliott: Are
[0:04:27] Voice 3: you all right?
[0:04:28] Trustee Elliott: You're okay. Mr. Walsh, if you wish to, well, I'm sorry.
[0:04:34] Trustee Elliott: I think we're good.
[0:04:37] Trustee Elliott: If you can move just a teeny bit so I don't have to try on the states here today. That's great. Appreciate that.
[0:04:43] Trustee Elliott: I thought I'd move your chair back a
[0:04:44] Trustee Luckham (probable): little, or lean back. Anyway, that's good.
[0:04:50] Trustee Luckham (probable): You don't necessarily want to be here.
[0:04:53] Voice 3: Not necessarily.
[0:04:56] Voice 3: Okay.
[0:04:57] Trustee Elliott: Well, if there are no more changes,
[0:05:01] Trustee Elliott: the agenda will be approved as intended.
[0:05:06] Trustee Elliott: And we'll move into reports.
[0:05:09] Trustee Elliott: Who would like to go first, trust me?
[0:05:15] Trustee Luckham (probable): Who's got news?
[0:05:17] Trustee Luckham (probable): Well, I don't have a lot to report,
[0:05:21] Trustee Luckham (probable): although there might be things that I'm going to omit.
[0:05:24] Trustee Luckham (probable): It's been some time since we had a last meeting.
[0:05:27] Trustee Luckham (probable): in fact um here we are today um uh i think probably the one significant that i did as
[0:05:37] Trustee Luckham (probable): an individual not so much as the ltc was attend the um the um the it's all the name of it actually
[0:05:47] Trustee Luckham (probable): on august the uh first the event in in germany it was uh remembering the children a recognition
[0:05:54] Trustee Luckham (probable): recognition of the children, extremely well attended by members of the public and significant
[0:06:02] Trustee Luckham (probable): presentations by a number of people from across the province, including the person whose name
[0:06:11] Trustee Luckham (probable): is Gation at the moment that started the Orange Shirt Day movement, and humbling, and I was
[0:06:23] Voice 7: I was glad to be able to sit and be witness to them,
[0:06:26] Voice 7: those who presented and those who were there.
[0:06:33] Voice 7: Otherwise, it's been relatively fine.
[0:06:37] Voice 5: Yes, and for me, obviously, very quiet on CEDIS
[0:06:40] Voice 5: during the summertime, except very, of course.
[0:06:45] Voice 5: I did read a book by Bruce MacGyver
[0:06:48] Voice 5: called Reconciliation in One Minute,
[0:06:51] Voice 5: and he was citing 200 or 300 different court cases
[0:06:57] Voice 5: has shaped what is now becoming reconciliation and in the back of his book he had a place there
[0:07:05] of course we could email him if we had questions so then the telephonic
[0:07:09] Voice 5: decision came down and so
[0:07:11] Voice 5: i emailed him i said what do you think of that one he forwarded back and said well my colleague
[0:07:19] Voice 5: kate dunn wrote a piece on that and he referred me to it and very very interesting so
[0:07:26] Voice 5: So if anyone
[0:07:27] Voice 5: wants to check that out, I'd be happy to send the link.
[0:07:31] Trustee Elliott: Thanks again.
[0:07:34] Trustee Elliott: That's wonderful, Trustee Hector.
[0:07:36] Trustee Elliott: Yeah, I do follow Bruce McIver's work, and he publishes a regular blog with a big summary of case results and decisions.
[0:07:48] Trustee Elliott: That's fantastic.
[0:07:51] Trustee Elliott: Okay, that's it for you, Trustee Hector?
[0:07:54] Trustee Elliott: Okay, so for my chair's report, I was very pleased to attend the Phoebus Island Water Fair on July 27th.
[0:08:06] Trustee Elliott: I was here just for the one day and presented as part of a panel some of the updates on the Islands Trust water work,
[0:08:16] Trustee Elliott: specifically with a focus on Gabriola and how the freshwater, the groundwater
[0:08:25] Trustee Elliott: analysis is potentially going to result in OCP policies. We have not yet received the
[0:08:32] Trustee Elliott: consultant's report but it is coming imminently and so how that works with our OCP review will
[0:08:38] Trustee Elliott: really be a model, I think, for other local capital areas to follow. So it's very important
[0:08:45] Trustee Elliott: work and I was very grateful to be included and invited.
[0:08:52] Trustee Elliott: June 3rd was our last meeting here on data, so it's been quite a time. I guess significant
[0:09:00] Trustee Elliott: items is that there was a cabinet shuffle. I think folks, Van Heert, Minister Ravi Kalon
[0:09:06] Trustee Elliott: is no longer our Minister of Municipal Affairs and in fact the day that the
[0:09:11] Trustee Elliott: Catalan Shuffle was announced, Executive Committee was to have a meeting with
[0:09:15] Trustee Elliott: Minister Calon and that was of course cancelled. So now Christine Boyle is our
[0:09:21] Trustee Elliott: Minister and we have a meeting scheduled for September 15th and sort of an update on
[0:09:26] Trustee Elliott: where Owens Cuts is at, we've established a relationship and I think she's keenly
[0:09:32] Trustee Elliott: be interested in following along our going-ons. We do have Trust Council coming up on Gabriela
[0:09:41] Trustee Elliott: Island in September. That is in 16, 17, 18. We're just reviewing the agenda for Executive
[0:09:53] Trustee Elliott: Committee tomorrow. And I'll note for folks that are interested in sort of management
[0:09:59] Trustee Elliott: and operational reviews and efficiency, our CAO has a really good, our Chief Administrative
[0:10:09] Trustee Elliott: Officer's report has some highlights about the corporate planning process framework and
[0:10:16] Trustee Elliott: the updates moving forward with that.
[0:10:19] Trustee Elliott: There's been quite a bit of work, which our new CAO jumped in with both feet really and
[0:10:26] Trustee Elliott: and undertook an operational review starting to be in the springtime and at the June meeting
[0:10:32] Trustee Elliott: Islands Trust staff participated in an exercise to share their perspectives and opportunities
[0:10:37] Trustee Elliott: to improve operational process, practices and policies.
[0:10:41] Trustee Elliott: So those two pieces, the operational review as well as the corporate planning process
[0:10:47] Trustee Elliott: framework, really will probably be the areas that will provide the most information on
[0:10:55] Trustee Elliott: on our updating, modernizing some of our processes.
[0:10:59] Trustee Elliott: So for those of you interested in that, please do follow.
[0:11:04] Trustee Elliott: And one other item of note, the Governance Committee recommendations,
[0:11:08] Trustee Elliott: there's going to be a substantial discussion on that at the U.S. Council.
[0:11:13] Trustee Elliott: There's quite a number of recommendations coming out of the Governance Committee work.
[0:11:18] Trustee Elliott: A few of the recommendations from the 2022 Governance Report are prioritized,
[0:11:23] Trustee Elliott: and they're asking the council to, well, we're going to debate it and basically get some permission.
[0:11:32] Trustee Elliott: And then following trust council is UBCM.
[0:11:35] Trustee Elliott: So the Union of BC Municipalities annual convention is going to be held in Victoria this year,
[0:11:40] Trustee Elliott: the 22nd to the 26th.
[0:11:43] Trustee Elliott: I'll be attending along with our chair, Laura Patrick, and our vice chair, Peterson,
[0:11:50] Trustee Elliott: along with two staff.
[0:11:51] Trustee Elliott: and you have I know how many times can I go to a meeting without mentioning tiny
[0:11:59] Trustee Elliott: homes I don't know if I ever have but the RDN Regional District of Long Island
[0:12:06] Trustee Elliott: director Vanessa Craig put together a seminar proposal on the findings from
[0:12:12] Trustee Elliott: our tiny homes project which was a joint project between the RDN and Long Island's
[0:12:17] Trustee Elliott: Trust, although I'm just paid for it. And it was accepted six
[0:12:23] Trustee Elliott: out of over 100 submissions, one of six. So we will be presenting
[0:12:28] Trustee Elliott: on the Tuesday morning, a one hour seminar and sort of a ton
[0:12:31] Trustee Elliott: of discussion with those findings. And it's quite an
[0:12:34] Trustee Elliott: exciting time there. Well, I think that's it for me. That's a
[0:12:37] Trustee Elliott: lot of overview. So we have no electoral area directors report
[0:12:46] Trustee Elliott: unless, is Jesse here today?
[0:12:49] Trustee Elliott: We got some participants.
[0:12:51] Trustee Elliott: No.
[0:12:52] Trustee Elliott: Okay.
[0:12:55] Trustee Elliott: An Honest Trust Conservancy report.
[0:12:57] Trustee Elliott: There is an update in this agenda.
[0:13:00] Trustee Elliott: And I will just say that we are celebrating our 35th
[0:13:03] Trustee Elliott: anniversary this year.
[0:13:06] Trustee Elliott: Very thankful for the work of the Think Conservancy
[0:13:10] Trustee Elliott: that you do.
[0:13:12] Trustee Elliott: And I just want to say how critical the partnerships
[0:13:14] Trustee Elliott: are with the local Conservancy group.
[0:13:16] Trustee Elliott: So I'm always happy to field or direct materials if anybody wants to contact me about conservancy stuff on that board.
[0:13:29] Trustee Elliott: So now, here we are. Let's stop talking. Public comment period. Public participation period.
[0:13:38] Trustee Elliott: So just a reminder that this is a place of employment and our staff have a right to a safe and respectful workplace.
[0:13:45] Trustee Elliott: place so we do ask that you keep your comments to issues that have been the jurisdiction of
[0:13:51] Trustee Elliott: first the local trust committee then um let's trust more broadly uh we ask that you uh state
[0:14:00] Trustee Elliott: your first and last name and the topic involved we have typically 15 minutes allocated for this
[0:14:07] Trustee Elliott: and each member of the public may speak for three minutes i know there was a request for a
[0:14:13] Trustee Elliott: delegation i don't know if they are here though the water there's a water really do you remember
[0:14:21] Trustee Elliott: that is
[0:14:22] Trustee Elliott: you sir oh perfect so delegations typically are allocated more time but we need to
[0:14:30] Trustee Elliott: see the materials in advance and they get added to the agenda so if you can participate and if you
[0:14:35] Trustee Elliott: need to go longer than three minutes we'll just have a vote
[0:14:38] Voice 9: on that yeah
[0:14:39] Voice 9: probably pretty close
[0:14:42] Voice 9: close to three minutes i i guess i mean that much it's just a quick thing
[0:14:48] Trustee Elliott: okay great so um anybody
[0:14:51] Trustee Elliott: wish to address the trust committee oh and one more thing if you've got an application on our
[0:14:56] Trustee Elliott: agenda you'll be able to speak to your application at that point so you can say your comments for
[0:15:06] Voice 11: Sure, I'd like to speak to the mail that I sent out, but Peter was trying to get into
[0:15:13] Voice 11: the minutes.
[0:15:14] Voice 11: Could
[0:15:15] Trustee Elliott: you just state your name for
[0:15:16] Voice 11: the board meeting?
[0:15:16] Voice 11: It's Paul Duncan.
[0:15:17] Voice 11: Okay, thanks.
[0:15:19] Voice 11: And I'm not...
[0:15:20] Voice 11: It's sort of a process question.
[0:15:22] Voice 11: First, how do I get questions included in the minutes, or is it just not part of the
[0:15:29] Voice 11: rules?
[0:15:29] Voice 11: I sent this out a week ago, thinking that would be plenty of time for it to be part of the agenda.
[0:15:37] Trustee Elliott: Perhaps a regional planning manager can answer that.
[0:15:39] Trustee Elliott: Through the Chair, you're welcome to, any member of the public is welcome to send your questions directly to the elected officials on email.
[0:15:48] Trustee Elliott: If you would like them on the agenda or time to speak to them, you can do that through this public comment period.
[0:15:57] Trustee Elliott: period, but the LTC may not be able to have that conversation with you during the comment
[0:16:02] Trustee Elliott: period. It would be just for you to share those questions. If you would like to have
[0:16:07] Trustee Elliott: a bit more questions and discussion, you can always request a delegation. That's usually
[0:16:13] Trustee Elliott: at least two weeks before a weekend. Staff can have that with you. If it's something
[0:16:19] Trustee Elliott: where you would like questions and a response, you can send it to the local trust committee
[0:16:24] Trustee Elliott: community and you can also send it to more info at islands trust yeah so just for the timing if
[0:16:34] Trustee Elliott: you have correspondence that you want to appear on the agenda so this agenda came out august 26
[0:16:39] Trustee Elliott: which i think is the date that your correspondence was sent but typically we need to receive it
[0:16:46] Trustee Elliott: before you know as the agenda is getting put together so september 2nd 26th basically if
[0:16:54] Trustee Elliott: we receive it by the Friday before, like the 22nd, then it can be included. Pardon me, yes, and for
[0:17:01] Trustee Elliott: items that you'd like to be in correspondence with on the agenda itself. That's correct.
[0:17:08] Trustee Elliott: Okay, thank you. But we can't retroactively add material to the minutes, but you can speak to it
[0:17:13] Trustee Elliott: as we hope you will do right now. And to clarify, we do, for any correspondence that comes in after
[0:17:20] Trustee Elliott: the agenda is published they get captured in the records of the agenda
[0:17:24] Trustee Elliott: they're just not
[0:17:25] Trustee Elliott: um they just don't appear as part of the approach okay but they are captured and saved
[0:17:32] Voice 11: yeah so my questions are around the abrupt shellfish license and my first question is
[0:17:40] Voice 11: there been any change in the status since the provincial minister approved that license
[0:17:46] Voice 11: And I guess where I'm heading is, how will you know, how will our compliance officers
[0:17:52] Voice 11: know if something starts happening in Creedy Harbour, or will it just be word of mouth,
[0:17:59] Voice 11: or is there some way of monitoring that?
[0:18:03] Trustee Elliott: I don't have an update from our by-law enforcement manager.
[0:18:07] Trustee Elliott: They are watching everything closely.
[0:18:11] Trustee Elliott: But I guess there's two parts to your question.
[0:18:14] Trustee Elliott: the the matter of jurisdiction and any potential dispute between the minister of water and lands
[0:18:26] Trustee Elliott: and islands trust we would work through the protocol agreement and there has been no meetings
[0:18:34] Trustee Elliott: to date on that however we did an ask for a meeting at ubcm and we got one with the ministry
[0:18:41] Trustee Elliott: of water lands and resources and it is to talk about crown lands and the disposition of crown
[0:18:48] Trustee Elliott: lands and um my intention is to speak strongly for the islands trusts um interests that they
[0:18:56] Trustee Elliott: not be overridden by provincial um priorities if it's to come up against the preserve and protect
[0:19:04] Trustee Elliott: mandate we will have to engage with them over any dispute over the interpretation
[0:19:13] Trustee Elliott: of that
[0:19:14] Voice 13: that's
[0:19:16] Trustee Elliott: at UBCM so it's a meeting with the minister and perhaps one of the
[0:19:21] Trustee Elliott: staff and I've asked for an update from our senior staff but they're in a
[0:19:24] Trustee Elliott: management meeting this morning so nothing I don't think there has been any
[0:19:29] Trustee Elliott: um back and forth on the protocol agreement as far as i understand through the chair
[0:19:37] Trustee Elliott: i don't have any updates to share i have heard that there's nothing been happening but
[0:19:44] Trustee Elliott: eyes and ears on the water would be and if you see anything you can circulate it to your local
[0:19:50] Trustee Elliott: trustees and they'll go forward to staff okay
[0:19:54] Voice 11: my third question uh relates to the it policy
[0:19:58] Voice 11: Policy Statement 3.5.19, and it's quoted in my, I'm not going to read it all out, it's quoted there, point number three.
[0:20:07] Voice 11: It did put in bold areas that are recreational significance, which I would think community harbors would probably qualify for that.
[0:20:19] Voice 11: So does this, do you think that this new policy will prevent a license like aquaculture in the future?
[0:20:30] Trustee Elliott: Do you want to take that one?
[0:20:32] Trustee Elliott: I
[0:20:33] Trustee Luckham (probable): have a bunch of questions for you, actually, in the perspective of the Executive Committee regarding this topic.
[0:20:38] Trustee Luckham (probable): And so I'll reserve some of my comments for that. But having provided the opportunity, one, I completely agree with you.
[0:20:46] Trustee Luckham (probable): however the language that is here that may be slightly different than what the language is
[0:20:54] Trustee Luckham (probable): in our policies existing policy statement and in the existing protocol that we have with our
[0:21:00] Trustee Luckham (probable): ministry that and even provincial regulation that indicates that a land use or in this case
[0:21:08] Trustee Luckham (probable): and agriculture use must be compliant with local zoning
[0:21:14] Voice 15: it is not
[0:21:16] Voice 15: what's
[0:21:18] Trustee Luckham (probable): the problem and so this is
[0:21:20] Trustee Luckham (probable): a very serious conversation with not only our new minister but with also with the minister
[0:21:26] Trustee Luckham (probable): of environment because i think our minister needs to support the land use regulations that are in
[0:21:31] Trustee Luckham (probable): place so i don't you know i don't know that any new policy statement is going to make
[0:21:38] Trustee Luckham (probable): any change to the interpretation or actions of a provincial body which i can say is objectionable
[0:21:50] Trustee Luckham (probable): and i certainly hope that we will be able to take a stance in this the island's trust
[0:21:55] Trustee Luckham (probable): because it's not just the theater's island trust area it affects the entire trust very important
[0:21:59] Trustee Luckham (probable): So
[0:22:00] Trustee Elliott: your comments on the draft policy statement would be most welcome at this point.
[0:22:07] Trustee Elliott: We are now engaging in a six-month period with communities, with the LTC.
[0:22:12] Trustee Elliott: That's one of the items on our agenda is to give comment on this.
[0:22:16] Trustee Elliott: And the LTC would probably want to, on the basis of this one event,
[0:22:22] Trustee Elliott: to give a strongly worded recommendation that those policies should be um um should well be
[0:22:30] Trustee Elliott: supported respect from from what i can see the yeah 3.5.19 so right now this is a draft
[0:22:37] Trustee Elliott: um but we want to hear what people think and so but the other piece is that the policy statement
[0:22:44] Trustee Elliott: informs how your ocp is developed right and so um it just would direct that we must direct
[0:22:55] Trustee Elliott: commercial agriculture tenures to appropriate locations which we did we don't have jurisdiction
[0:23:00] Trustee Elliott: over this disposition of crown land which is where the conflict is coming in right now right so i
[0:23:07] Trustee Elliott: think this policy statement draft is very strong we'd love to hear your comments on it um but again
[0:23:13] Trustee Elliott: Again, it's that interagency dispute.
[0:23:17] Voice 11: Okay, so my next question, I'm going to move on,
[0:23:22] Trustee Luckham (probable): just want to comment, because it hasn't been mentioned,
[0:23:24] Trustee Luckham (probable): and I'll just look for confirmation that at our November 9th meeting, we will be having a formal opportunity for comment on the policy statement
[0:23:35] Trustee Luckham (probable): as part of the scheduled public consultation process.
[0:23:39] Trustee Luckham (probable): So that would be kind of the end of that process in November the 4th, I think it was.
[0:23:45] Trustee Luckham (probable): Yeah, I'm getting nods there. So make sure that you've got that material and comments in for us by then.
[0:23:51] Trustee Elliott: Yeah. Thank you.
[0:23:54] Trustee Elliott: And you can always comment as a member of the public.
[0:23:57] Trustee Elliott: The website is Islands 2050 and it has the draft there.
[0:24:04] Trustee Elliott: It's got a survey open and there will be a forgot to mention this a virtual town hall on September 10th
[0:24:11] Trustee Elliott: 2025 so you do need to register for that you can ask these questions there
[0:24:17] Trustee Elliott: An executive committee and other trustees will be there and it's open to all Q&A portion
[0:24:22] Trustee Elliott: So be an appropriate place to get that
[0:24:26] Trustee Elliott: something else
[0:24:32] Trustee Luckham (probable): I just
[0:24:33] Trustee Luckham (probable): want to acknowledge if he had any mark with respect to the question and then we can
[0:24:41] Trustee Luckham (probable): let Paul continue.
[0:24:42] Trustee Luckham (probable): Are we
[0:24:42] Voice 5: talking about the Shelby?
[0:24:43] Voice 5: Yes.
[0:24:44] Voice 5: Yeah.
[0:24:44] Voice 5: Did we not have a legal review of that or our chances of dealing with the provincial
[0:24:51] Voice 5: governor if it got to the court case scenario?
[0:24:56] Trustee Elliott: Well, because there is a protocol agreement with the Ministry responsible, and there is
[0:25:02] Trustee Elliott: a dispute resolution process in that, we're following that through not going to sue at
[0:25:10] Trustee Elliott: this point.
[0:25:10] Trustee Elliott: At this time?
[0:25:11] Trustee Elliott: Yeah, there isn't legal action.
[0:25:12] Voice 5: No, there's no legal action, but I thought we asked for a legal opinion about our stance
[0:25:18] Voice 5: on the security.
[0:25:20] Voice 13: I
[0:25:21] Voice 7: have to look at the minutes.
[0:25:22] Voice 7: because I think we can get the minutes in this time because we're not going in time.
[0:25:29] Trustee Elliott: We did have discussion on that.
[0:25:31] Trustee Elliott: I just tried to see.
[0:25:35] Voice 13: I
[0:25:36] Trustee Elliott: think we asked for it, and it was too early to ask for a legal review.
[0:25:42] Trustee Elliott: Do you agree, Mary?
[0:25:43] Trustee Elliott: The other
[0:25:44] Voice 5: thing is my brother lives on the shoreline here in the affected area in Preeti Harbor,
[0:25:49] Voice 5: and whenever he sees a boat out there that looks like they might be doing something he calls me so
[0:25:55] Voice 5: there are eyes on the area yeah there are lots of eyes so
[0:26:02] Trustee Elliott: i think our final resolution on that
[0:26:04] Trustee Elliott: was that the phoebus local trust committee requested executive committee to advocate
[0:26:08] Trustee Elliott: to the ministry of municipal affairs regarding those issues and that advocacy has it's still
[0:26:15] Trustee Elliott: proceeding. And that was the reason we asked for a meeting with the minister is pretty
[0:26:19] Trustee Elliott: much on this one issue. The legal opinion. Yeah, but thanks for raising that. We think
[0:26:29] Trustee Elliott: we tried to ask for a legal opinion. It's just like not yet. Okay.
[0:26:34] Voice 11: Sorry, back to you,
[0:26:35] Voice 11: Mr. Duncan.
[0:26:36] Voice 11: Oh, yeah, thank you. So there was a lot of talk between the policy, the draft policy
[0:26:42] Voice 11: see about engagement. On Thetis Island we have this Thetis Island assembly on a periodic basis,
[0:26:51] Voice 11: like two or three times a year, so I was wondering if that would be a good opportunity for at least
[0:26:57] Voice 11: one of the trustees to be able to come to that assembly and just say here's what's going on in
[0:27:03] Voice 11: Islands Trust. It just seems to me such a perfect opportunity when you've got the community in the
[0:27:13] Voice 11: room for Islands Trust to have a voice and we hear what's going on. That's where I started this
[0:27:23] Voice 11: this question around aquaculture set the assemblies.
[0:27:28] Voice 11: So I'm just suggesting that.
[0:27:31] Voice 11: And finally, when I read the job policy,
[0:27:38] Voice 11: I didn't see anything in there
[0:27:41] Voice 11: from the taxpayer stakeholder perspective.
[0:27:47] Voice 11: I'm a member of TIER,
[0:27:49] Voice 11: the Island Resident and Repairers Association,
[0:27:52] Voice 11: which is kind of, I guess, our tax group.
[0:27:57] Voice 11: So I'm just wondering, did I miss it,
[0:27:59] Voice 11: or is it, like, this is a multi-stakeholder kind of a model.
[0:28:06] Voice 11: And by the way, I would think that the taxpayers
[0:28:10] Voice 11: would somehow be in the draft policy.
[0:28:15] Voice 11: I'm wondering why. Did I just miss it?
[0:28:18] Voice 11: or how
[0:28:19] Trustee Elliott: the stress regulates land use and so taxpayers are representative they are presented
[0:28:25] Trustee Elliott: by the residents and visitors who live here and i'm not sure how to answer the question of how
[0:28:34] Trustee Elliott: they're representative of the policy statement except the policy statement directs how we use
[0:28:39] Trustee Elliott: land well
[0:28:40] Voice 11: in in my email to you i suggested there's various aspects of that maybe i should
[0:28:45] Voice 11: start with the Chief Administrative Officer's review. Maybe that'll answer some of my questions,
[0:28:53] Voice 11: but you know perspectives like how does this government relate to other levels of government
[0:29:00] Voice 11: in terms of effectiveness in implementing their policies. Another whole line of thinking is
[0:29:10] Voice 11: contingency planning. Like if there's a disaster, an environmental disaster,
[0:29:16] Voice 11: this Islands Trust has policies in place. Another example that comes to mind is we've got the
[0:29:24] Voice 11: federal government saying they're going to fast track infrastructure projects. They've already
[0:29:31] Voice 11: when you started with ports on the eastern side of Canada,
[0:29:37] Voice 11: it's the contingency of the government
[0:29:40] Voice 11: that decides that they're going to greatly expand
[0:29:42] Voice 11: the port of Vancouver.
[0:29:43] Voice 11: And what's that going to do to the sailing sea?
[0:29:46] Voice 11: So those are all kind of things
[0:29:50] Voice 11: that kind of represent what the taxpayer is wanting.
[0:29:55] Voice 11: But I didn't see any of that in there.
[0:29:57] Trustee Elliott: It wouldn't be captured in the policies.
[0:30:00] Trustee Elliott: statement the policy statement is a very specific bylaw that directs what needs to be included in
[0:30:07] Trustee Elliott: each community's official community plan it is not um a an interagency agreement
[0:30:17] Trustee Elliott: if we were talking emergency services that would be the couch and regional districts
[0:30:25] Trustee Elliott: district's realm because they have services and how the honest trust engages with
[0:30:31] Trustee Elliott: powhatan district would be i'm trying to think of an example from my local area can you
[0:30:38] Trustee Elliott: can you help me with this local trustees well
[0:30:42] Trustee Luckham (probable): i was uh i was carefully listening to what you're
[0:30:45] Trustee Luckham (probable): saying and you portrayed the picture very well actually i think i think to kind of summarize it
[0:30:51] Trustee Luckham (probable): The policy statement is a guiding principles document. It's not a financial management or a business process document. And there are other policies that exist within the Islanders Trust that facilitate that, particularly those policies that guide the financial planning committee and that how they make decisions and allocation and recognition of communities, et cetera, is covered in those policies.
[0:31:16] Trustee Luckham (probable): And what you picked up on there as a good example is an emergency continuation of business, emergency measures process.
[0:31:24] Trustee Luckham (probable): In fact, we did that at the beginning of the pandemic.
[0:31:30] Trustee Luckham (probable): Measures that exist within policy to provide for continuity of a business plan was invoked by the CAO.
[0:31:38] Trustee Luckham (probable): And I would say, actually, I congratulate Russ Hotson-Pillar
[0:31:42] Trustee Luckham (probable): on a very successful management of a continuation of business plan
[0:31:46] Trustee Luckham (probable): for the Ops Trust during very, very difficult times.
[0:31:50] Trustee Luckham (probable): You know, I'll just say moving 50 people to work at home, for instance,
[0:31:54] Trustee Luckham (probable): and ensuring telephones and internet and computers were accessible
[0:31:58] Trustee Luckham (probable): to allow people to work in that space.
[0:32:00] Trustee Luckham (probable): And, of course, now we're transitioning back into that space
[0:32:02] Trustee Luckham (probable): and, you know, the world has changed.
[0:32:04] Trustee Luckham (probable): You know, we have Zoom meetings for everything now.
[0:32:07] Trustee Luckham (probable): and we never had that before so those policies that you're interested in are embraced and do
[0:32:12] Trustee Luckham (probable): exist and certainly more input from members of the public and those interested is welcome
[0:32:20] i think the um the
[0:32:22] Trustee Luckham (probable): planning what's this new document the plan the corporate plan the
[0:32:27] Trustee Elliott: corporate planning is
[0:32:28] Trustee Luckham (probable): a new piece that we're working on um to address some of the shortfalls
[0:32:33] Trustee Luckham (probable): also do exist for sure and so you'll definitely want to pay attention to that and
[0:32:38] Trustee Elliott: and thank you
[0:32:40] Trustee Elliott: for that and you've also reminded me that after the policy statement whatever is approved in the
[0:32:46] Trustee Elliott: end as we do need to update it there will be an implementation plan and so when for instance you
[0:32:53] Trustee Elliott: look at directive policies for managing growth and development community facilities and services
[0:32:58] Trustee Elliott: Like how is that to be implemented is going to be very specific to each local trust committee. Each community has evolved very differently, has a different relationship with the regional district of whatever regional district there and other agencies.
[0:33:13] Trustee Elliott: So it's the implementation of it that will guide how all those different services work together.
[0:33:20] Trustee Elliott: But that is not, it's not a fit in those overall policies.
[0:33:24] Trustee Elliott: Those overall policies are supposed to be very broad and embracing.
[0:33:28] Trustee Elliott: And what are we preserving and protecting, essentially?
[0:33:32] Voice 7: Thank you
[0:33:33] Trustee Luckham (probable): for raising the implementation plan.
[0:33:35] Trustee Luckham (probable): Because if there's anywhere where taxpayers may want to be concerned,
[0:33:40] Trustee Luckham (probable): it's in that implementation of new policies.
[0:33:43] Trustee Luckham (probable): And indeed, many trustees have raised that point already,
[0:33:46] Trustee Luckham (probable): how we can implement this and what are the impacts going to be.
[0:33:49] Trustee Luckham (probable): And so certainly, I will be paying attention to that, and I know others are,
[0:33:54] Trustee Luckham (probable): because it needs to recognize the financial implications on the taxpayer
[0:33:59] Trustee Luckham (probable): associated with implementing new and changed policies and policy statements.
[0:34:08] Trustee Elliott: Okay. Thank you for your questions, Mr. Duncan.
[0:34:11] Trustee Elliott: These are really good ones, and they get to the heart of why governance
[0:34:14] Trustee Elliott: governance is very interesting in the trust area so um any other speakers and we went way over a
[0:34:22] Trustee Elliott: few minutes but I'm going to stop well we
[0:34:25] Trustee Elliott: don't have to cut you
[0:34:27] Voice 9: oh you want to hand people first
[0:34:29] Voice 9: so that he could set the precedent for time
[0:34:31] Trustee Elliott: and
[0:34:33] Voice 13: i'll give you
[0:34:38] Voice 9: this one after i just put the
[0:34:41] Voice 9: full front my daughter made it oh james
[0:34:43] Voice 9: your
[0:34:44] Trustee Elliott: name again yeah
[0:34:46] Voice 9: david ray uh lock 208 and that's what
[0:34:49] Voice 9: this one i used to use the city richmond always i don't know right um um i have kind of there are
[0:34:58] Voice 9: two parts to this one is just kind of a quick thing to note the event i included the um the
[0:35:05] Voice 9: article that mary shane and myself wrote for the cornerly about anything that the big thing about
[0:35:11] Voice 9: i think about the article is that it was we did an awful lot in two days um i mean uh site visits
[0:35:20] Voice 9: the amount of people that went to the site visits was amazing um and they're all covering different
[0:35:26] Voice 9: Doug had the compostable toilets, we had a water collection from Alex, an amazing system he has.
[0:35:36] Voice 9: Went to Matthias and learned about his water collection systems and got to look at his crazy house again too.
[0:35:47] Voice 9: If you have never seen this crazy house, you should go there.
[0:35:52] Voice 9: And so I just wanted to pull that, put that article that she wrote better than I could and throw that in.
[0:36:03] Voice 9: The next part is kind of like the next steps, right?
[0:36:07] Voice 9: And we had like over a hundred people.
[0:36:12] Voice 9: The island doesn't have a large population, so a hundred.
[0:36:16] Voice 9: and a lot of those people were
[0:36:18] Voice 9: visitors. I'm not necessarily saying that
[0:36:20] Voice 9: it's a thing, but we were definitely
[0:36:25] Voice 9: a large number
[0:36:27] Voice 9: you could say a quarter of the
[0:36:30] Voice 9: population if you wanted to
[0:36:33] Voice 9: of the
[0:36:34] Voice 9: people attended one of the
[0:36:36] Voice 9: seven events.
[0:36:39] Voice 9: And
[0:36:39] Voice 9: other people
[0:36:42] Voice 9: attended all of them.
[0:36:44] Voice 9: And so it
[0:36:45] Voice 9: It became clear that this was, we had a fellow that came from Calgary, didn't even have a home here, but was thinking of getting a home, flew from Calgary on Friday night, attended the events, and flew back to Calgary Sunday night.
[0:37:00] Voice 9: And then sent a letter thanking the group for the events.
[0:37:06] Voice 9: It's, and so it's something that we did, and then as we get there, we feel like we just really just scratched the surface.
[0:37:14] Voice 9: So, a few of us have gotten together, and Mike Harris is very leading on the science on this,
[0:37:24] Voice 9: because I know this talk with Mike Harris knows that he's water systems and things,
[0:37:33] Voice 9: he can talk until it hurts, and he would be here, except he's in Newfoundland,
[0:37:41] Voice 9: the fact there's a lot of people that would be here, but when I invited them they basically
[0:37:46] Voice 9: reminded me that they also have a life. But following the meeting I reached out to
[0:37:53] Voice 9: people I know with the CBRD Environmental Services and we were able to schedule a meeting with
[0:38:02] Voice 9: I'm not sure of his name, Galen McMann and he works with them and he's working on their water
[0:38:09] Voice 9: water strategy right now. In fact, the water strategy was set in 2020 that they did, and
[0:38:19] Voice 9: so now we're in 2025. And a lot of it had to do with the rivers and streams and such.
[0:38:29] Voice 9: So I kind of felt like I was the person that goes with the tags for your shoes or whatever,
[0:38:38] Voice 9: where they show up and you say,
[0:38:40] Voice 9: oh, I'm ready to choose.
[0:38:41] Voice 9: Oh, yes, we're just thinking of you
[0:38:44] Voice 9: and they'll be ready next week.
[0:38:45] Voice 9: So when seeing Galen,
[0:38:47] Voice 9: yes, we were thinking of you,
[0:38:49] Voice 9: we're coming right up to it,
[0:38:51] Voice 9: is what his view was.
[0:38:54] Voice 9: Though fair enough to him,
[0:38:56] Voice 9: he has been already reaching out
[0:38:57] Voice 9: to the Analysts Trust
[0:39:00] Voice 9: to work on that.
[0:39:01] Voice 9: So what came out of your presentation
[0:39:04] Voice 9: was that this is a multi-government thing.
[0:39:06] Voice 9: uh thing i wanted to thank you for your presentation as well it was a it was a very
[0:39:10] Voice 9: very helpful and and it started us along with reed but it it's multi multi-level
[0:39:17] Voice 9: thing so that's uh the islands trust the regional district the provincial government and also
[0:39:24] Voice 9: some other community agencies are all going to be part of the solution
[0:39:30] Voice 9: What we have identified is that there are an awful lot of people that are willing to participate on that.
[0:39:39] Voice 9: One of the simple things is the test wells. There are no test wells.
[0:39:48] Voice 9: Some people talk about there may be some. The CDRD knows of none.
[0:39:54] Voice 9: There is one.
[0:39:56] Voice 9: The alien doesn't know it.
[0:39:58] Voice 9: Okay.
[0:40:01] Voice 9: But the fact that it's aware of the data, when is it getting tested is the question then.
[0:40:08] Voice 9: If you're a test well that never tested, is it a tree in a forest?
[0:40:11] Voice 9: for it um um and so uh the uh the question is we have people i think uh uh people in this room
[0:40:21] Voice 9: have volunteered to have their wells watered on top of that we have already had a rainwater
[0:40:27] Voice 9: collection uh being monitored um by uh keith rush but keith rush and four or five other people
[0:40:35] Voice 9: are monitoring the rainwater collection um we have so we uh we have a lot of on the ground
[0:40:45] Voice 9: readiness for this for this project um and we just so this coming here is just to make sure
[0:40:53] Voice 9: um that we are staying top of mind right is that because uh and we're we're um mike harris and i
[0:41:03] Voice 9: our meeting with the CDRE again. We're having a face-to-face meeting in the end of September
[0:41:10] Voice 9: with them to talk about their plan. And then I met with Pam Kooling from
[0:41:18] Voice 9: Debra Poporowski's office to talk about provincial government participation as well.
[0:41:23] Voice 9: And so this thing's all starting to roll down the hill. And I just mostly want to
[0:41:34] Voice 9: keep in mind the two things are that the data collection and the data analysis is not well
[0:41:39] Voice 9: there's an awful lot of data collection that's gone all that has never been analyzed which is
[0:41:46] Voice 9: the way it's not really that helpful but the data collection and data analysis is one side of it
[0:41:52] Voice 9: the other side is i've been speaking for the people in this room there's an awful lot of us
[0:42:00] Voice 9: that water understanding is top of mind,
[0:42:05] Voice 9: but it's not top of mind for everybody
[0:42:08] Voice 9: that comes to the island
[0:42:09] Voice 9: and even people that live on the island.
[0:42:12] Voice 9: And so I think there needs to be an education process
[0:42:17] Voice 9: and I think it needs to be a CSI-owned
[0:42:20] Voice 9: specific educational process.
[0:42:22] Voice 9: We don't need a pamphlet
[0:42:24] Voice 9: that's been put out by somebody somewhere.
[0:42:27] Voice 9: We need something that speaks to our issues.
[0:42:31] Voice 9: And so we will be coming to the CERD, we'll be coming to the province, we'll be coming to you for resources and help to get this stuff done.
[0:42:41] Voice 9: And that's just my report is just to say that we want to let you know we're coming.
[0:42:47] Trustee Elliott: Excellent. So I did update the community that the Freshwater Atlas is also coming.
[0:42:54] Trustee Elliott: Yes. And so as far as data collection goes and what we know about Thetis, Thetis was captured in the first mapping for, anyway, I
[0:43:10] Trustee Elliott: did give that up and I can't quite remember.
[0:43:12] Trustee Elliott: So you have a request to build a working group with residents from the CBRD Islands Trust
[0:43:19] Trustee Elliott: of the Province and our island community.
[0:43:20] Trustee Elliott: Are you asking for participation at this point?
[0:43:25] Trustee Elliott: How can the Islands Trust support, or is this just sustaining communication about the community?
[0:43:30] Voice 9: I will be making a presentation to the assembly, we'll be meeting with the CBRD, I think the
[0:43:39] Voice 9: The CBRD, because they have their strategy that they're working on, may end up taking the lead on this.
[0:43:48] Voice 9: For sure.
[0:43:49] Voice 9: And it's also kind of nice to have somebody taking the lead that's behind the computer rather than volunteers.
[0:43:56] Voice 9: And so they've got a problem with you taking the lead.
[0:43:59] Voice 9: This is more kind of an FYI, more than just saying we need something today.
[0:44:06] Trustee Elliott: Okay.
[0:44:07] Trustee Elliott: That's good.
[0:44:08] Voice 9: Well,
[0:44:09] Trustee Elliott: we'll be in communication, and I have had a feedback and forth with the members of your group, but I'll update you because I do sit on the regional planning committee, and that's where the work, the freshwater amounting work is project.
[0:44:23] Trustee Elliott: Yeah, the stress
[0:44:24] Trustee Elliott: is being captured, so I'll let everybody know.
[0:44:29] Trustee Elliott: I
[0:44:29] Trustee Luckham (probable): have some questions and remarks for the presenters, so thank you, David, for being
[0:44:34] Trustee Luckham (probable): here today, and thank you for you and everybody else that was involved in creating this water
[0:44:41] Trustee Luckham (probable): weekend.
[0:44:42] Trustee Luckham (probable): I apologize for not being able to attend, but I was already committed for that entire
[0:44:45] Trustee Luckham (probable): weekend somewhere else, I wasn't even on an island, but certainly water is on all of our
[0:44:52] Trustee Luckham (probable): lines, and I'll just note that actually a conversation I had yesterday, I won't say
[0:44:56] Trustee Luckham (probable): who was with or whether they don't want to necessarily infer anything um except that the
[0:45:02] Trustee Luckham (probable): comment was it's been a busy summer and the response back to that was yes and a lot of water
[0:45:08] Trustee Luckham (probable): load so and and when was the last time it actually rained does anybody remember i don't
[0:45:15] Trustee Luckham (probable): so a couple of thoughts with what you're saying the test well clearly we need to nail down that
[0:45:21] Trustee Luckham (probable): that that exists and that the province
[0:45:23] Trustee Luckham (probable): is doing testing on that or not.
[0:45:26] Trustee Luckham (probable): Because when the CVRD actually presented
[0:45:30] Trustee Luckham (probable): the original financial request of Thetis Island
[0:45:33] Trustee Luckham (probable): with respect to the work that they're doing in the water,
[0:45:35] Trustee Luckham (probable): Jen, we're being taxed for that work.
[0:45:37] Trustee Luckham (probable): They indicated that there was a test well on Thetis.
[0:45:41] Trustee Luckham (probable): I remember that.
[0:45:42] Trustee Luckham (probable): And they had indicated that they would like
[0:45:44] Trustee Luckham (probable): to add another one.
[0:45:45] Trustee Luckham (probable): Okay, well, nobody's called me because guess what?
[0:45:48] Trustee Luckham (probable): You can come and use my well.
[0:45:49] Trustee Luckham (probable): so do you know the location of it i do not i've only been told over the years
[0:45:53] Trustee Luckham (probable): so good question a question for william in fact in fact i assume that william is probably the liaison
[0:46:02] Voice 2: yes
[0:46:03] Trustee Luckham (probable): um so two water board oh that's deciding two so the waterboard yeah so um it would be
[0:46:14] Trustee Luckham (probable): interesting to know that if they're finally getting around after five years to thinking about
[0:46:18] Trustee Luckham (probable): But Thetis Island is, and I'm sure it interests Paul Deacon here, with respect to the taxes
[0:46:25] Trustee Luckham (probable): that have been collected on Thetis in respect of the value to Thetis, because we are very
[0:46:30] Trustee Luckham (probable): interested in that.
[0:46:34] Trustee Luckham (probable): It'd be good if I could read my own writing.
[0:46:36] Trustee Luckham (probable): I wonder what thoughts or the position that you have might be with respect, because it's
[0:46:42] Trustee Luckham (probable): a topic of discussion at this table, is the requirement for rainwater catchment on new
[0:46:48] Trustee Luckham (probable): construction bills i'd be interested in anything you have to offer there um and has there been any
[0:46:56] Trustee Luckham (probable): engagement with the new mla on this topic
[0:46:59] Voice 9: um and deborah just had uh two hipster plates so she's
[0:47:09] she wasn't as invisible right now as other times um and she's obviously being um with
[0:47:18] provincial government and Cowichan tribes. She's very
[0:47:22] Voice 9: involved in another issue as well.
[0:47:25] Voice 9: But yes, I reached out to Pamela about getting her involved and I'll be following up on that
[0:47:37] Voice 9: over the next weeks. Regarding the catchment area, we haven't discussed it as a group,
[0:47:44] Voice 9: so i can't speak for myself i'm always a person that hates a new rule until you can prove that
[0:47:53] that new rule um is uh is is
[0:47:57] Voice 9: absolutely necessary um maybe it is absolutely necessary i'm not
[0:48:03] Voice 9: disputing that i'm just saying i don't like um uh making rules because you also have to make a
[0:48:12] Voice 9: rule you have to make an enforcement you have to also yeah
[0:48:16] Trustee Elliott: so i'll just there will be opportunity
[0:48:18] Trustee Elliott: for public comment on
[0:48:20] Trustee Elliott: that because it's part of the land use bylaw review that we are undertaking
[0:48:24] Trustee Elliott: so it's just maybe not to capture your personal views on that right now but just to encourage
[0:48:29] Trustee Elliott: everybody listening that rainwater harvesting catchment is still captured under the proposed
[0:48:38] Trustee Elliott: I think we're going very far
[0:48:43] Trustee Elliott: down the road here, but thank you for that presentation
[0:48:46] Trustee Elliott: and for coming here today to advise us that education is important and that we need to
[0:48:54] Trustee Elliott: be working together and it sounds like this community is figuring out sort of the landscape
[0:49:00] Trustee Elliott: so that you can understand where all the different agencies need to, well, who needs to be poked
[0:49:06] Trustee Elliott: at what time. Okay, so I didn't mean to cut you off. Is there anything else from, yes?
[0:49:14] Voice 6: Specifically to this contact, I mean, part of it was reaching out to him, trying to get
[0:49:21] Voice 6: his office to engage, and Bynar's office were fantastic, made those sort of connections
[0:49:29] Voice 6: happen to show up from watching the video per se, here's the link, but no, I don't believe
[0:49:36] Voice 6: anybody at CCR has ever received a final email or, you know, sort of from one or somebody.
[0:49:43] Voice 6: Okay,
[0:49:43] Trustee Elliott: so we'll just, maybe we can speak about that privately after we speak.
[0:49:47] Voice 6: You know, all of us think that's part of the connection, so that seems to be certain.
[0:49:51] Trustee Elliott: I have addressed, I have addressed that with the Director of Planning Services, and it's
[0:49:58] Trustee Elliott: just that there are so many water projects happening um i think the senior freshwater
[0:50:06] Trustee Elliott: specialist is focused on areas where there is a project running and thetis does not have that
[0:50:12] Trustee Elliott: right now but and he's always consulting on uh for instance on this land use bylaw review that would
[0:50:18] Trustee Elliott: be rainwater catchment the language and everything like that so that's how his expertise is um
[0:50:25] Trustee Elliott: be incorporated but until there's an active project it's it's not like you can just send an
[0:50:30] Trustee Elliott: email and get that attention because there's a lot going on
[0:50:33] Voice 6: that's good if you're aware about
[0:50:36] Voice 6: that i
[0:50:36] Trustee Elliott: have made that um thanks a lot just
[0:50:41] Trustee Luckham (probable): a related question jesse mcclinton is obviously
[0:50:44] Trustee Luckham (probable): our regional director and obviously that's a connection that should be able to move the cbrd
[0:50:50] Trustee Luckham (probable): in some direction. And I lost track of the conversation where Jesse was going to appoint
[0:50:55] Trustee Luckham (probable): a deputy. Carolyn Askew. Carolyn Askew. Oh, okay. Thank you. So I didn't know that. So
[0:51:03] Trustee Luckham (probable): Carolyn Askew is obviously another person that was in that. That's cool. Okay. Thank
[0:51:08] Trustee Luckham (probable): you. Okay.
[0:51:11] Trustee Elliott: Any other items that are not captured on our agenda? No? Okay. Thanks. Well, with
[0:51:22] Trustee Elliott: that we will close the public comment period. Thank everybody
[0:51:27] Trustee Elliott: for your engagement. This is really important work and we
[0:51:31] Trustee Elliott: need to hear from you. So move to item 6.1. Does anybody need
[0:51:38] Trustee Elliott: a break? Are we doing all right? Okay. So we have local trust
[0:51:43] Trustee Elliott: committee minutes from January 3 2025 for adoption. Page three
[0:51:48] Trustee Elliott: Maybe, are there any issues or amendments?
[0:51:59] Voice 16: Okay,
[0:52:15] Trustee Elliott: so I'll take it by general consent
[0:52:16] Trustee Elliott: that the minutes of June 3rd, 2025 be adopted.
[0:52:28] Trustee Elliott: Lisa, you got that?
[0:52:34] Trustee Elliott: Okay, we have resolutions about meetings.
[0:52:37] Trustee Elliott: Do we have any, or it's just an update there?
[0:52:40] Trustee Elliott: no advisory planning commission minutes and we'll go with the follow-up action list at 7.1 are there any questions for staff or updates staff page 10 here
[0:52:51] Trustee Elliott: um i
[0:53:02] Trustee Luckham (probable): just note that um oh sorry i skipped over the resolution of that meeting i thought that was in the
[0:53:09] Trustee Luckham (probable): follow-up action but oh i see um the resolution there seems to indicate we moved the meeting from
[0:53:14] Trustee Luckham (probable): june the 10th to june the 3rd and i think that must have been june the 10th to july the 3rd
[0:53:20] Trustee Luckham (probable): No, we moved it because you were going on vacation.
[0:53:23] Voice 13: Okay.
[0:53:24] Trustee Luckham (probable): Okay, that's fine then.
[0:53:26] Trustee Luckham (probable): So that makes more sense.
[0:53:27] Trustee Luckham (probable): It was an original change.
[0:53:28] Trustee Luckham (probable): So on the follow-up action list, then, I guess this is my opportunity to ask about the agriculture
[0:53:38] Trustee Luckham (probable): license.
[0:53:40] Trustee Luckham (probable): Oh, I just want to actually follow up before that is the, on the September 5th, 2023, regarding
[0:53:50] Trustee Luckham (probable): and inviting Ken Thomas to an LTC meeting.
[0:53:53] Trustee Luckham (probable): I have not had that conversation.
[0:53:55] Trustee Luckham (probable): However, I'm conscious of the importance and value
[0:53:59] Trustee Luckham (probable): of the Penelope Nation members' time to attend a meeting
[0:54:04] Trustee Luckham (probable): that might be short and may not have significant value to them
[0:54:10] Trustee Luckham (probable): if we're not able to engage in a meaningful way.
[0:54:12] Trustee Luckham (probable): I do think that as we progress here on the bylaws
[0:54:16] Trustee Luckham (probable): bylaws that we're considering, the bylaw amendments that we're considering here, and even a policy
[0:54:23] Trustee Luckham (probable): statement for that matter, that there might be a better opportunity where we are engaging
[0:54:28] Trustee Luckham (probable): on more global issues that we're very much interested in support of the Connecticut nation
[0:54:35] Trustee Luckham (probable): on, and that might be a focal point for us to invite them to come to a conversation where
[0:54:43] Trustee Luckham (probable): where we can have some constructive work in front of us.
[0:54:46] Voice 2: Yeah.
[0:54:46] Trustee Luckham (probable): So I would just comment that I'd like to work with staff
[0:54:50] Trustee Luckham (probable): to facilitate that when we get to that place.
[0:54:53] Trustee Luckham (probable): All right, that's great.
[0:54:56] Trustee Luckham (probable): So then the next one would be at the July 2nd meeting,
[0:55:00] Trustee Luckham (probable): which is about Marine Areas Review Project,
[0:55:04] Trustee Luckham (probable): bylaws 113, 114, that that has been concluded,
[0:55:09] Trustee Luckham (probable): concluded, I'm presuming, at this point.
[0:55:13] Trustee Luckham (probable): However, there was a recommendation that a cover letter be written by the chair to the
[0:55:20] Trustee Luckham (probable): minister of environment advising him of this amendment to the bylaw, and whether or not
[0:55:25] Trustee Luckham (probable): that has been done, it says in progress, so it's not complete.
[0:55:29] Trustee Luckham (probable): And so I think that's an important step in our process of defending our bylaws, that
[0:55:35] Trustee Luckham (probable): that a bylaw amendment has supported no aquaculture leases
[0:55:39] Trustee Luckham (probable): in that zone and that has been confirmed by our ministry.
[0:55:45] Trustee Luckham (probable): And so I think that's an indirect support
[0:55:52] Trustee Luckham (probable): of the importance of the Local Trust Committee's bylaws
[0:55:55] Trustee Luckham (probable): because they didn't like it,
[0:55:56] Trustee Luckham (probable): they shouldn't have refused it and they didn't.
[0:55:58] Trustee Luckham (probable): And so I'd like to see that progress.
[0:56:01] Trustee Elliott: Okay, so we're looking at page 10.
[0:56:04] Trustee Elliott: Page 10, yeah.
[0:56:05] Trustee Elliott: the um the adopted bylaws 3114 i had forgotten about that i'm not sure where that was at that
[0:56:16] Trustee Elliott: that should be well the target date was the 31st marco do you have an update on that or
[0:56:24] Trustee Elliott: yeah i don't you know but certainly yeah staff support to have that and send it off
[0:56:35] Voice 13: yeah okay so
[0:56:37] Voice 7: with all due respect i would suggest that the letter should go out before you have the
[0:56:41] Voice 7: meeting that you can see okay so
[0:56:43] Trustee Luckham (probable): there's a piece of paper to address that one thank you
[0:56:49] Trustee Luckham (probable): um and then
[0:56:50] Trustee Luckham (probable): indeed the whole license of occupation out there um i i think that it would uh i'm keen to
[0:57:02] Trustee Luckham (probable): to understand where the executive committee is at with that conversation. It sounds like
[0:57:10] Trustee Luckham (probable): you've indicated that that's going to happen in September at UCM, but I'm also hoping that
[0:57:15] Trustee Luckham (probable): that conversation will come up with our new minister, because I believe that our minister
[0:57:20] Trustee Luckham (probable): needs to be our advocate. And
[0:57:23] Trustee Luckham (probable): ideally, our minister attends the meeting with the minister
[0:57:27] Trustee Luckham (probable): environment, assuming that there's support from our ministry for this, to advocate on
[0:57:35] Trustee Luckham (probable): such plans.
[0:57:43] Trustee Elliott: I don't believe, no, I don't think that two ministers would appear at the same meeting
[0:57:47] Trustee Elliott: our request for meeting with Ministry of Municipal Affairs was turned down, but, and the topics
[0:57:57] Trustee Elliott: that we're going to raise with the Ministry of Grounds, Water Grounds, is specifically
[0:58:04] Trustee Elliott: about this lease referral, so I think that's the appropriate place, but I'll just note
[0:58:12] Trustee Elliott: that April 23rd executive committee received an update on advocacy options so just trying to see
[0:58:27] Trustee Elliott: where that briefing was and it'll take me a while to find it so oh give me a second um trustee
[0:58:36] Trustee Elliott: hunter did you have something i'm
[0:58:37] Voice 5: just curious what is the actual intent of this local trust
[0:58:42] Voice 5: committee in regards to this shellfish are we intending to have it overturned or are we trying
[0:58:50] to show that it shouldn't have happened in the first place
[0:58:53] Voice 5: and we hope it isn't going to happen
[0:58:56] Voice 5: again i just want to know what your attitude is going into the meeting at ubcm you know is it our
[0:59:10] Voice 5: intent that we're going to try and get the french government to reverse this decision which i really
[0:59:16] Voice 5: really don't think it's going to happen very soon to
[0:59:20] Trustee Elliott: me their decision was a signal that
[0:59:25] Trustee Elliott: provincial priorities may be taking precedence over the mandate of the island's trust
[0:59:33] Trustee Elliott: and we need to have a conversation about how the mandate which is a provincial mandate and
[0:59:40] Trustee Elliott: and the Island Trust is an agency of the province.
[0:59:42] Trustee Elliott: When those two interests collide,
[0:59:50] Trustee Elliott: how do we work through the issues?
[0:59:53] Trustee Elliott: We were, the Theta Silver Trust is extremely strong
[0:59:56] Trustee Elliott: and I credit both of you.
[1:00:00] Trustee Elliott: for
[1:00:00] Voice 14: having
[1:00:01] Trustee Elliott: the chair who is very new in this to you know write letters and say we do not support
[1:00:06] Trustee Elliott: this we don't want any um aquaculture in this area so the message has already been conveyed but for
[1:00:12] Trustee Elliott: their own reasons um and i would add there isn't evidence that either an allocate or labs
[1:00:22] Trustee Elliott: supported this um they approved it anyway so i think there is a problem with
[1:00:29] Trustee Elliott: um whatever message their staff might be getting from um their minister that's where we need to
[1:00:39] Trustee Elliott: start is how does the preserve and protect mandate fit if provincial interests or whatever reason
[1:00:49] Trustee Elliott: economic or commercial use is going to override local jurisdiction and um that's a very big
[1:00:58] Trustee Elliott: problem i think our yeah so my intention is to advocate as strongly as possible that that should
[1:01:08] Trustee Elliott: not i mean there should have been much more conversation and respect for the local trust
[1:01:17] Trustee Elliott: committee's um decision-making zoning and if there hasn't been what were the reasons and
[1:01:23] Trustee Elliott: And how do we make sure that that doesn't happen again?
[1:01:27] Trustee Elliott: Okay, good.
[1:01:28] Trustee Luckham (probable): Chair?
[1:01:29] Trustee Elliott: Yes.
[1:01:30] Trustee Luckham (probable): So
[1:01:30] Trustee Elliott: if I
[1:01:33] Trustee Luckham (probable): might, notwithstanding that it's not evident to me that the province has consulted with the Pinellas Commission, right?
[1:01:44] Trustee Luckham (probable): So notwithstanding that, the letter that we received from the minister who worked with us to advise us that,
[1:01:55] Trustee Luckham (probable): that's so sad was that they had issued the license and i'm not going to quote verbatim but it
[1:02:05] Trustee Luckham (probable): more or less says that the zoning for that area is unresolved well that is not true yeah this
[1:02:13] Trustee Luckham (probable): the ltc resolved unanimously to not support that result so it is contrary to the provincial
[1:02:24] Trustee Luckham (probable): regulation that a water use must conform with the zoning. And so are we asking the province
[1:02:36] Trustee Luckham (probable): to revoke their license or is the province asking us to overturn our decision? There's a real
[1:02:44] Trustee Luckham (probable): dilemma here that has to be resolved. And if the province wants to come forward and say
[1:02:52] Trustee Luckham (probable): something clearly about that they don't you know that they they are overruling the island's trust
[1:03:00] Trustee Luckham (probable): then i want to hear them say that yeah because
[1:03:03] Trustee Luckham (probable): i know that will have significant impacts
[1:03:06] Trustee Luckham (probable): across the entire so
[1:03:08] Trustee Elliott: one of the key actions that is one of the reports coming to trust council
[1:03:15] Trustee Elliott: is an update and an overview of all the letters of agreement between islands trust and every other
[1:03:21] Trustee Elliott: their agency um executive committee has asked two or three times for more specific briefings
[1:03:28] Trustee Elliott: on crown tenure application referrals and going back to the uh april 23rd meeting
[1:03:36] Trustee Elliott: just noting the third action that we i think we directed staff to to
[1:03:42] Trustee Elliott: to pursue this, reviewing the letter of understanding to provide the agreement with
[1:03:51] Trustee Elliott: the ministry to address LTC issues because the agreement is so dated that if ministry staff
[1:04:02] Trustee Elliott: wants to engage in that review, what would that look like? Could it contain a focus on seeking
[1:04:09] Trustee Elliott: agreement of the ministry to not issue tenure unless LTC approvals are in place so that's not
[1:04:19] Trustee Elliott: in the agreement currently I think the place to have this conversation is because this has happened
[1:04:25] Trustee Elliott: and the agreement is outdated is the ministry willing to update the agreement and will they
[1:04:31] Trustee Elliott: respect LTC approvals or not as um criteria for issuing a license so it
[1:04:43] Voice 7: is super complicated
[1:04:45] Voice 7: and
[1:04:46] Trustee Luckham (probable): you know quite frankly regarding Trustee Hunter's question about legal opinion we don't
[1:04:54] Trustee Luckham (probable): want to resolve this in the courts it would be incredibly expensive and time consuming
[1:05:00] Trustee Luckham (probable): And frankly, somebody would lose face of it.
[1:05:02] Trustee Luckham (probable): And whether that's our city of province, I don't know.
[1:05:05] Trustee Luckham (probable): But regardless of an outdated protocol agreement,
[1:05:11] Trustee Luckham (probable): the form and the regulation indicates
[1:05:14] Trustee Luckham (probable): that the use must comply with local government zoning.
[1:05:19] Voice 15: So it
[1:05:20] Trustee Luckham (probable): doesn't matter about what the communication protocol is.
[1:05:24] Trustee Luckham (probable): Unless I'm mistaken, my interpretation would be
[1:05:27] Trustee Luckham (probable): the regulation is clear and province is not respecting that regulation so sure let's update
[1:05:33] Trustee Luckham (probable): the protocol but let's not get lost in that and quite frankly that there's another large
[1:05:42] Trustee Luckham (probable): agriculture license which is approved somewhere else in the trust area
[1:05:44] Trustee Elliott: this is not about
[1:05:46] Trustee Luckham (probable): I'm going
[1:05:47] Trustee Elliott: to turn to RPM. So through the chair regarding this follow-up action item on page 10
[1:05:55] And
[1:05:55] Trustee Elliott: for this letter to go to the Ministry regarding this, it's related to the same topic about referrals from the Crown
[1:06:05] Trustee Elliott: and about abrupt shellfish and the zoning of this area, the land use of this area.
[1:06:15] Trustee Elliott: What kind of items or concerns would you like to see addressed in this letter
[1:06:21] Voice 15: that
[1:06:22] Trustee Elliott: goes to the Minister?
[1:06:23] Trustee Elliott: And we can also copy or capture other letters that have also been sent, whether it's from
[1:06:31] Trustee Elliott: a licensed population letter that was already sent to us.
[1:06:34] Trustee Elliott: So I'm hearing, capturing some, maybe some more pointed questions about upholding the
[1:06:45] Trustee Elliott: local trust committee's land use by laws for zoned areas within the trust that the Ministry
[1:06:50] Trustee Elliott: is taking personal concerns to account for seeking their comments explanations so perhaps um staff
[1:07:00] Trustee Elliott: can work with chair elliott on practice some of those letters no i think you're you're absolutely
[1:07:06] Trustee Elliott: right thank you for raising that i totally missed that cover letter but they are related so i think
[1:07:13] Trustee Elliott: you're right we need to capture those and make sure we make a strong statement again thank you
[1:07:20] Trustee Elliott: Sorry if I'm delaying it.
[1:07:21] Trustee Elliott: No, it's very important.
[1:07:24] Trustee Elliott: I was just trying to look for the date.
[1:07:25] Trustee Elliott: We had a really extensive briefing on Crown East referrals,
[1:07:28] Trustee Elliott: and still can't find it.
[1:07:30] Trustee Elliott: So it's all this.
[1:07:32] Trustee Elliott: Okay, back to our agenda.
[1:07:34] Trustee Elliott: Do we have any more comments or questions on our follow-up action list?
[1:07:38] Trustee Elliott: We are a patient.
[1:07:40] Trustee Elliott: The cleanup of Block 88, that has been completed.
[1:07:47] Trustee Elliott: There was a press release.
[1:07:48] Trustee Elliott: I believe there was a press release issue.
[1:07:50] Trustee Elliott: And I have answered some questions about that. So if anybody else has no questions, then, well, it's good news, finally, after 10 years.
[1:08:08] Trustee Elliott: So I guess the related item for Warren.
[1:08:13] Trustee Elliott: Warren, I see that you're online already. Oh, he's not quite there.
[1:08:17] Trustee Elliott: After 11.
[1:08:19] Trustee Elliott: So page 12.
[1:08:21] Trustee Elliott: Well, I got one by law enforcement staff
[1:08:24] Trustee Elliott: commenced investigation of committed uses
[1:08:26] Trustee Elliott: and staff discretion to time this action
[1:08:28] Trustee Elliott: after an initial letter from planning staff
[1:08:30] Trustee Elliott: has been sent to the license folder.
[1:08:34] Trustee Elliott: Maybe we can come back after 11 o'clock
[1:08:36] Trustee Elliott: and see if Warren has an update on that.
[1:08:38] Trustee Elliott: Okay.
[1:08:38] Voice 13: And
[1:08:39] Trustee Elliott: that's for Jaden.
[1:08:40] Trustee Elliott: That's item one
[1:08:42] Voice 13: under April 1st, 2025, page 21.
[1:08:54] Trustee Elliott: I can actually offer a draft update on that,
[1:08:56] Trustee Elliott: but the letter was sent oh um i guess yeah um manager dingman could speak to how enforcement
[1:09:04] Trustee Elliott: has been going but um your mother was definitely sent okay quite a few months ago yeah prior to the
[1:09:10] Trustee Elliott: challenge okay and it still says in progress and 10 percent so thanks for that day next time
[1:09:17] Voice 13: if he's got any more information for the public so the letter was sent okay
[1:09:27] Trustee Elliott: great to the license
[1:09:29] Trustee Elliott: is there any other through the chairs any other information you'd like from
[1:09:33] Trustee Elliott: manager demon just if there has been any activity or is there any response
[1:09:43] Trustee Elliott: how people would like to receive oh warren is here expressions of concern
[1:09:49] Trustee Elliott: hello manager demon good
[1:09:51] Manager of Bylaw Compliance and Enforcement: morning good
[1:09:53] Trustee Elliott: morning we're just going through our follow-up action
[1:09:56] Trustee Elliott: list and much of the conversation's been um on the aquaculture license and wondered if you had
[1:10:04] Trustee Elliott: any updates um after the letter was sent to the license folder has there been a response um
[1:10:11] Trustee Elliott: and has there been any activity on the water or anything of note so
[1:10:18] Manager of Bylaw Compliance and Enforcement: chair we didn't get any
[1:10:20] Manager of Bylaw Compliance and Enforcement: Any response in writing or a phone call?
[1:10:24] Manager of Bylaw Compliance and Enforcement: I did call Mr. Panikoui.
[1:10:27] Manager of Bylaw Compliance and Enforcement: I had a conversation with him.
[1:10:30] Manager of Bylaw Compliance and Enforcement: He's not willing to recognize local government jurisdiction over this matter.
[1:10:36] Manager of Bylaw Compliance and Enforcement: He did state that he may not place any structures like mooring buoys or security nets out in the license of occupation zone.
[1:10:46] Manager of Bylaw Compliance and Enforcement: own i guess in his way of trying to resolve the issue even though he's not recognizing a local
[1:10:54] Manager of Bylaw Compliance and Enforcement: government authority um there's a number of files that have been opened recently that involve the
[1:11:00] Manager of Bylaw Compliance and Enforcement: water around thetis including hudson island so uh planning a we need to rent a water taxi
[1:11:09] Manager of Bylaw Compliance and Enforcement: taxi, visit a number of properties and visit the occupation area, the license of occupation
[1:11:16] Manager of Bylaw Compliance and Enforcement: and see if any structures have been placed in that area or see what activity is happening.
[1:11:22] Manager of Bylaw Compliance and Enforcement: And that's the basic update I can provide now.
[1:11:27] Manager of Bylaw Compliance and Enforcement: And we have also received no new complaints about activity in the area or any inquiries
[1:11:35] Manager of Bylaw Compliance and Enforcement: to bylaw staff about what's been happening.
[1:11:38] Trustee Elliott: Okay.
[1:11:40] Trustee Elliott: thank you for that update um if there's anything that needs to be communicated to the community i
[1:11:47] Trustee Elliott: assume you'll go through the local trustees or um but yeah this is in your hands and thank you for
[1:11:54] Trustee Elliott: keeping an eye on the water i have
[1:11:58] Trustee Luckham (probable): one further question not that hasn't been the topic of
[1:12:03] Trustee Luckham (probable): discussion at this point for well enforcement absolutely well manager dingman etc i'm just
[1:12:09] Trustee Luckham (probable): Just wondering whether or not you've heard anything from the Thetis Island area with respect to a barge with a teepee on it that is sort of wandering around and anchoring and possibly tying up to the shoreline.
[1:12:25] Manager of Bylaw Compliance and Enforcement: Through the chair, yes, we have received, it actually may be several complaints about structures being used for residential use off Thetis and as well as some of the accessory islands.
[1:12:39] Manager of Bylaw Compliance and Enforcement: we've got those concerns uh just for the public in general they should be aware that we need
[1:12:48] Manager of Bylaw Compliance and Enforcement: complaints in writing uh that's the policy uh you know we can't take telephone complaints or
[1:12:56] Manager of Bylaw Compliance and Enforcement: complaints over the telephone so if anyone is concerned about these activities they should
[1:13:00] Manager of Bylaw Compliance and Enforcement: submit the complaints in writing but i do believe one of our files already concerns this use
[1:13:06] Manager of Bylaw Compliance and Enforcement: use anyway and we have done some work on it thank
[1:13:10] Trustee Luckham (probable): you very much and thank you for reiterating the
[1:13:14] Trustee Luckham (probable): message that people should write to you um with respect to their concerns and i always have
[1:13:20] Trustee Luckham (probable): suggested include photographs so that it's obvious what the nature of the complaint is so thank you
[1:13:26] Trustee Luckham (probable): for that you're
[1:13:28] Manager of Bylaw Compliance and Enforcement: welcome i
[1:13:30] Trustee Luckham (probable): do understand the rcmp has visited this recently oh
[1:13:34] Trustee Elliott: okay great uh thank
[1:13:38] Trustee Elliott: Thank you, Manager Dingman. I think that's all from us right now.
[1:13:45] Trustee Elliott: Happy Labor Day.
[1:13:48] Trustee Elliott: It's laboring.
[1:13:50] Trustee Elliott: Okay, does anyone need a five-minute break before we go into our main item of business,
[1:13:54] Trustee Elliott: which is consideration of the application for rezoning 2025-0072 Welsh FAEC?
[1:14:04] Trustee Elliott: Five-minute break could be good.
[1:14:07] Trustee Elliott: Okay, so we'll break. We'll recess until 11.
[1:14:10] Trustee Elliott: Oh, sorry, so 10...
[1:14:12] Trustee Elliott: Yes, I don't know.
[1:14:14] Trustee Elliott: 50.
[1:14:16] Trustee Elliott: 1050.
[1:14:17] Voice 14: That
[1:14:17] Trustee Luckham (probable): is at 30 kilometres.
[1:14:18] Voice 14: Thank you.
[1:14:20] Voice 14: I have attended a number of meetings over time,
[1:23:10] Trustee Luckham (probable): but like Dave, I have a life,
[1:23:11] Trustee Luckham (probable): and I simply cannot attend it.
[1:23:14] Voice 11: Okay, I was just
[1:23:16] Voice 11: wondering if any of you
[1:23:17] Voice 11: one out of three could attend
[1:23:19] Voice 11: on a rotating basis.
[1:23:23] Voice 11: Well, I wouldn't expect
[1:23:25] Voice 9: We're not in a formal meeting yet, right?
[1:23:29] Voice 9: We
[1:23:29] Trustee Elliott: do need to get back.
[1:23:33] Voice 9: Peter, you know, can go and attend. Usually a written report is sent as well.
[1:23:37] Voice 9: That's it. Okay.
[1:23:40] Trustee Elliott: Let's get back to our votes. We're in an open meeting now.
[1:23:44] Trustee Elliott: Thank you, those of you who are leaving us.
[1:23:48] Trustee Elliott: Okay, so item 9.1
[1:23:52] Trustee Elliott: And appeal rezoning 2025-0072 Welch F.A.E.C. with the longest report the Phoebus Local Trust Committee has ever seen.
[1:24:04] Trustee Elliott: Maybe? No? Not? Not necessarily. 300 pages? You've had one pretty good.
[1:24:09] Trustee Elliott: That's very
[1:24:10] Trustee Elliott: good. That's it. It's a
[1:24:11] Trustee Elliott: steak and a side of potatoes.
[1:24:13] Trustee Elliott: Okay, I'll hand it over to Planet Tomatoes.
[1:24:17] Trustee Elliott: Oh, thank you.
[1:24:18] Trustee Elliott: Oh, was it?
[1:24:20] Trustee Elliott: Planet Tomatoes, would you like to introduce your report?
[1:24:23] Trustee Elliott: Yes, thank you, Chair Elliott.
[1:24:26] Trustee Elliott: And yes, I contemplated whether or not to attach all of the submitted documents,
[1:24:32] Trustee Elliott: but it's what we do for preliminary staff reports,
[1:24:35] Trustee Elliott: present all the information that was provided to us, so we did our best.
[1:24:40] Trustee Elliott: Yeah, so the purpose of this preliminary report is to provide information regarding the rezoning
[1:24:46] Trustee Elliott: application and to seek direction from the LTC on next steps.
[1:24:52] Trustee Elliott: The application as submitted would amend the Thetis Island land use by-law 2011 by rezoning
[1:24:59] Trustee Elliott: portions of the rural residential or R1 and Waterford zones to site-specific shoreline
[1:25:06] Trustee Elliott: protection zones to facilitate the future installation of a nature-based shoreline
[1:25:11] Trustee Elliott: protection project, or Green Shores for Homes project, to protect the land and the existing
[1:25:17] Trustee Elliott: buildings and structures on the upland property from shoreline erosion, future shoreline erosion.
[1:25:24] Trustee Elliott: The project site is located north of the French Channel called the Comet, connecting
[1:25:29] Trustee Elliott: a clam bay to the west side of the East Island and through printed wrestling vessels.
[1:25:33] Trustee Elliott: vessels. The project location is relatively sheltered from the Salish Sea by Kalyani and
[1:25:39] Trustee Elliott: Valdez Islands and is southwest of Saltmarsh Wetland and Coastal Swift. The subject properties
[1:25:46] Trustee Elliott: at 83 and 84 Blue Marin Road have existing residential buildings which were constructed
[1:25:52] Trustee Elliott: between the 1950s and 1970s. Both properties have had the same owner since 2016 who are
[1:25:59] Trustee Elliott: presently here and we reside at number 83 Blue Heron Road and rent out the second property at 84.
[1:26:08] Trustee Elliott: The owners intend to undertake renovations to the existing dwelling at 83 Blue Heron Road in
[1:26:15] Trustee Elliott: the future. The existing dwelling is approximately five meters from the natural boundary hence their
[1:26:22] Trustee Elliott: desire to protect the remaining bank from erosion. Also an existing 18-meter long concrete seaball
[1:26:29] Trustee Elliott: which was installed in approximately 1954, as well as a set of concrete beach access stairs
[1:26:35] Trustee Elliott: are located along the southern shoreline adjacent to the dwelling. If approved, the application
[1:26:43] Trustee Elliott: would permit the installation of a nature-based shoreland protection project along the shore
[1:26:47] Trustee Elliott: and up to 10 meters seaward from the tidal boundary, including burying that existing
[1:26:53] Trustee Elliott: concrete seawall. The total proposed shoreline protection area is 237 meters squared approximately
[1:27:01] Trustee Elliott: in the upland slope portion and 1,410 meters square along the foreshore area.
[1:27:09] Trustee Elliott: And in that 10 meters seaward installation would involve depositing approximately 40 to 50
[1:27:16] Trustee Elliott: truckloads of materials including beach management, including sand and gravel, some cobble structures,
[1:27:24] Trustee Elliott: some larger boulders, and attaching a large variety strategically.
[1:27:30] Trustee Elliott: The shoreline would then be replanted with a variety of native plants
[1:27:34] Trustee Elliott: and monitored for up to three years to ensure successful ecological rehabilitation.
[1:27:41] Trustee Elliott: As you can see, there were many reports submitted, professional reports submitted
[1:27:45] Trustee Elliott: in support of the application, and they were found in attachments 4 to 10 of the staff report.
[1:27:51] Trustee Elliott: One
[1:27:53] Voice 13: more place to add.
[1:27:58] Voice 13: So
[1:28:04] Trustee Elliott: that recommend the applicant provide a clear list of all construction, installation
[1:28:09] Trustee Elliott: and maintenance recommendations, as well as a list of all environmental protection measures,
[1:28:15] Trustee Elliott: including the specific best management practices and mitigation, adaptation and avoidance measures
[1:28:22] Trustee Elliott: to be used during installation to protect any identified species at risk, sensitive
[1:28:27] Trustee Elliott: ecosystem to send archaeological sites, which there are some archaeological sites not adjacent
[1:28:33] Trustee Elliott: to the proposed area of installation. Staff also recommend requesting from the applicant
[1:28:40] Trustee Elliott: specifically a site plan indicating where equipment will access the shoreline and the
[1:28:46] Trustee Elliott: extent of any work areas during construction including access and lay down areas.
[1:28:53] Trustee Elliott: and this information makes the application overseas the LTC could consider uh including
[1:29:00] Trustee Elliott: details in a section 219 restrictive covenant for the upland property at the very least
[1:29:05] Trustee Elliott: that includes installation and maintenance requirements
[1:29:08] Trustee Elliott: and that also ensures that best management practices are followed during installation
[1:29:26] Trustee Elliott: So staff also recommended the LTC defer further consideration such as proceeding to draft
[1:29:35] Trustee Elliott: bylaws of the application in order to provide more time for early and meaningful opportunities
[1:29:44] Trustee Elliott: opportunities for involvement with a discussion of concerns with First Nations uh you know this
[1:29:52] Trustee Elliott: has to do in part with the LIAX First Nation Island West Coast Protocol Agreement um and
[1:30:00] Trustee Elliott: that protocol agreement, which specifies, you know, the LCC should not be making decisions regarding,
[1:30:08] Trustee Elliott: you know, this First Nations territory without meaningfully discussing concerns of Lax and First
[1:30:14] Trustee Elliott: Nations. Staff have been trying to reach out to Lax and Penelaket and continue to work, and as well
[1:30:23] Trustee Elliott: the applicant for this application has been reaching out to and working with elders from
[1:30:29] Trustee Elliott: Peneliket as well as staff members from Peneliket Nation for almost a year.
[1:30:38] Voice 16: Maybe
[1:30:38] Trustee Elliott: the applicant can speak more to that but there has been ongoing attempts to engage with
[1:30:44] Trustee Elliott: First Nations but staff have identified that that's potentially there needs to be more to
[1:30:52] Trustee Elliott: uphold that protocol agreement with Wai'aqsa First Nation and again these early opportunities
[1:30:58] Trustee Elliott: that for ongoing engagement could include, you know, having a site visit with First Nations
[1:31:04] Trustee Elliott: applicant and owners and staff, continuing to share ongoing project information as it's
[1:31:11] Trustee Elliott: received, and then the LTC has discretion to request any additional engagement with
[1:31:18] Trustee Elliott: First Nations, early engagement with First Nations that they want to be included.
[1:31:24] Trustee Elliott: So, yeah, in summary, the recommendations to request additional information while proceeding with the application are supported because meaningful engagement by First Nations can take place prior to the LTC's consideration to proceed, and information gaps on environmental protection should also be resolved.
[1:31:46] Trustee Elliott: And if the LTC concurs with the recommendations, the staff recommendations in this report,
[1:31:52] Trustee Elliott: staff will proceed to notify the applicants and early referrals will be sent to First
[1:31:59] Trustee Elliott: Nations and staff will continue to engage and send out a site visit invitation to First
[1:32:04] Nations as well.
[1:32:06] And then we'll put in a staff report for future
[1:32:08] Trustee Elliott: consideration, summarizing any kind of feedback.
[1:32:12] Trustee Elliott: back. So if the LTC has any questions, the applicant is
[1:32:17] Trustee Elliott: present, a connected consultant. And then both owners, Rob and
[1:32:23] Trustee Elliott: Marcy Welsh are also here to speak to the application.
[1:32:27] Trustee Elliott: Thank you. So typically, we give the applicant some some time to
[1:32:35] Trustee Elliott: to share from your perspective, either one of you want to add
[1:32:39] Trustee Elliott: anything to our information or we could go straight into
[1:32:42] Trustee Elliott: questions.
[1:32:44] Voice 6: Just, Rob, you want to have a few, I just want to put this context of the volume and
[1:32:51] Voice 6: interior into perspective, because this is our sort of first kicker of all of this, but this
[1:32:55] Voice 6: actually reflects the new checklist for an expedited permit for the problem, or a nature-based
[1:33:02] Voice 6: shoreline protection process. Nothing more, nothing less, in some ways, not enough in some respects,
[1:33:08] Voice 6: So it's good, but it's a lot for everybody to consider.
[1:33:16] Voice 6: So I'm not really apologizing, but what it does is it puts us in a mindful place to go forward,
[1:33:21] Voice 6: and it includes the First Nations up front and centre on that.
[1:33:27] Voice 6: The only thing is, the Romans has First Nations at number eight on those,
[1:33:33] Voice 6: and we put them at number one and brought them in,
[1:33:36] Voice 6: and though the business unit was not available to attend that,
[1:33:40] Voice 6: I think we did have the elders,
[1:33:41] Voice 6: I think Sylvester and Maria,
[1:33:47] Voice 6: last name, no?
[1:33:48] Voice 6: No, it's me.
[1:33:50] Voice 6: Kimmel and George with us on Kerrville spoke.
[1:33:55] Voice 6: So we've done that.
[1:33:57] Voice 6: We've had the opportunities since then,
[1:34:01] Voice 6: but they have not been able to show up.
[1:34:02] Voice 6: up and the late founder Florence James participated from the tech side of it and she's reviewed
[1:34:10] Voice 6: and helped coaches through the planning plan and saw all of that and the plan was on that
[1:34:17] Voice 6: document or was reflecting her which she was comfortable with and the vision that a short
[1:34:23] Voice 6: amount of time might become a place that they would not only climb on to the road but they
[1:34:30] Voice 6: would come back up along to the shoreline to water and cultural either fruits and plants and that
[1:34:38] Voice 6: medicinal plants that were of value to them so that was sort of more of kicking it off
[1:34:45] Voice 6: and the ability to obviously do it and to that yeah
[1:34:51] Voice 3: i don't really have anything to add at this
[1:34:53] Voice 3: I mean, I'm thankful that MARHU put all of those documents online so that you could all
[1:35:03] Voice 3: review them.
[1:35:04] Voice 3: They are extensive, certainly the assessment report that Fenton compiled before anything
[1:35:12] Voice 3: anything else happened, so the existing situation and all the sensitive areas and this are taken
[1:35:29] Voice 3: consideration before we even got to a construction engineer and coastal engineer to look at what
[1:35:37] Voice 3: could be done in
[1:35:38] Voice 16: that
[1:35:39] Voice 3: way. So you know my only comment really is that as you know we have tried
[1:35:49] Voice 3: to engage with the First Nations and they have been invited to what was our shoreline demonstration
[1:35:58] Voice 3: and you know it's no comment and they don't reply so that in itself is a comment I think.
[1:36:10] Voice 3: i'm sure what it means but i don't really know how you go forward to engage i've read the protocol
[1:36:16] Voice 3: for the time stress has with the reaction
[1:36:20] Voice 15: i
[1:36:21] Voice 3: understand that they need to be informed and
[1:36:26] Voice 3: they need to be consulted
[1:36:27] Voice 16: it's
[1:36:31] Voice 3: not sure how that can progress i mean they could you would think
[1:36:37] Voice 3: write an email and say we don't have time we can't consider this you know
[1:36:45] Voice 3: something but just nothing
[1:36:48] Voice 16: is
[1:36:50] Voice 3: that doesn't make you feel very good about
[1:36:55] Voice 3: this process no comment and it gets we've already invested years into this
[1:37:03] Voice 3: and
[1:37:03] Voice 16: how
[1:37:04] Voice 3: much longer would it be anticipated that the local trust committee, Islands Trust,
[1:37:15] Voice 3: would wait for a response.
[1:37:24] Voice 3: But your
[1:37:26] Trustee Elliott: intention is, and thank you for stating that, to do this in a good way
[1:37:35] Trustee Elliott: and to start that engagement if you wanted to have their input.
[1:37:42] Voice 3: Certainly, I appreciate where we are with indigenous recognition
[1:37:47] Voice 3: and unceded territory, land.
[1:37:53] Voice 3: I mean, they're using it now.
[1:37:54] Voice 3: The 10-meter boundary was something I stressed
[1:37:59] Voice 3: when we had the engineering consultants come,
[1:38:02] Voice 3: that that is the demarcation line for me with Nelliput's clam harvesting marine license to
[1:38:15] Voice 3: harvest clams is 10 meters from the natural boundary so that would be the extent of where
[1:38:20] Voice 3: we could potentially do this nature-based protection yeah so they of course I mean we are
[1:38:32] Voice 3: well aware of how many clams
[1:38:34] Voice 3: and how much activity goes on
[1:38:35] Voice 3: there. It's pretty
[1:38:38] Voice 3: extensive.
[1:38:41] Voice 3: And
[1:38:41] Voice 3: we don't have any issue with that.
[1:38:45] Voice 3: They're all, you know,
[1:38:47] Voice 3: people are very respectful.
[1:38:49] Voice 3: There's not, we know
[1:38:51] Voice 3: one of the, Denman Island
[1:38:53] Voice 3: for instance, has a commercial
[1:38:55] Voice 3: harvesting up there.
[1:38:57] Voice 3: It's not First Nations,
[1:38:59] Voice 3: I don't believe, but it is quite
[1:39:01] Voice 3: an issue with
[1:39:03] Voice 3: people on the waterfront there because of the disrespect
[1:39:06] Voice 3: by the people that are harvesting there
[1:39:09] Voice 16: i
[1:39:11] Voice 3: think they burned down somebody's home because of the
[1:39:14] Voice 3: beach fire too close to it or something so so that is kind of the other extreme or
[1:39:20] Voice 3: something that could take place which it isn't yeah
[1:39:28] Voice 6: ready to start to that um
[1:39:32] Voice 6: to the art perspective so yeah but i think this is a this is a permanent only if you're going to
[1:39:37] Voice 6: do anything with the towel in that regard then it's a permanent only site so the design is a no
[1:39:44] Voice 6: dig and so that was the approach we took this was not a any ancestors resting place and that this
[1:39:53] Voice 6: was just culturally used this was
[1:39:56] Voice 6: actually the salt marsh which was the hub of penelaket island
[1:40:00] Voice 6: from the north end of Phoenix to the south end of Connecticut.
[1:40:04] Voice 15: And
[1:40:04] Voice 6: it was just literally a canoe pass, low tides pushing the flat bottom canoe through.
[1:40:11] Voice 6: And it was basically a trout fish, and they did logs and different sort of additional cultural sources.
[1:40:19] Voice 6: The machine was by all of the families that lived on Connecticut for millennia.
[1:40:23] Voice 6: And so that has all been disrupted since the red ship and the salt marsh is no longer functional.
[1:40:33] Voice 6: But it still is viable for clams and other items in that regard.
[1:40:40] Voice 6: That is all at a very distant, that's out, the tide's out a long ways for actually clam digging.
[1:40:48] Voice 6: There's a long distance between the plants and this project, so there's no need to start
[1:40:55] Voice 6: with the plant quality because of the silt from the New River Bank on East Shoreline,
[1:41:02] Voice 6: which is constant.
[1:41:03] Voice 6: Every time there's a tide or a storm, all of that ground and this wonderful silt from
[1:41:10] Voice 6: about the applicant property. So the two goals of this project is one, if we decide or
[1:41:17] Voice 6: request an engineering design to set them in at the date, it would be there long-term,
[1:41:24] Voice 6: it would last for 25 to 50 years, that would not impact and over time once it actually comes back
[1:41:32] Voice 6: to life and it's plants and other things living in that more shorebound shore area,
[1:41:37] Voice 6: area, and the plan quality should improve, because there won't be any more sediment from
[1:41:43] Voice 6: above. It'll be actually managed by the land itself, and this project will be right off
[1:41:49] Voice 6: that term. So the security for that, as far as a source, and long term for anybody using
[1:41:59] Voice 6: that beached area. Now it's being very accessible by the long term, just because there's a rickety
[1:42:08] Voice 6: to get down to the shorelines to visit John. So this project there will make that whole
[1:42:16] Voice 6: sort of self-approach easy for anybody that's using it. The E4's access won't really change,
[1:42:26] Voice 6: except for when they come out onto the beach and are alive, when they see asparagus and
[1:42:33] Voice 6: salt grass and further out. The area now gets insulted by winter cods and estuaries. That
[1:42:43] Voice 6: area will become just normal. You just hear the bubble that's in the design will protect
[1:42:50] Voice 6: the tool from being eroded and from the winter flows or heavy flows coming up off from the
[1:42:57] Voice 6: And then the actual storms coming in will actually just be pushed off by a few meters.
[1:43:04] Voice 6: So all the energy is now off of the bank, which is trying to fix it.
[1:43:10] Voice 6: So it'll just be further out. The beach will be back to being a beach.
[1:43:14] Voice 6: It's up to you to be a healthy beach.
[1:43:19] Voice 6: Of the existing vegetation, there's quite a bit of shrubbery.
[1:43:24] Voice 6: into the plant life is limited because it's just a broader way. So this new space will allow it to
[1:43:33] Voice 6: actually regrow and our goal would be that it becomes a healthy, regenerative, biodiverse.
[1:43:46] Trustee Elliott: So I'm sure trustees have questions, but thank you for all the work and this amazing project
[1:44:02] Trustee Elliott: really that is an opportunity to file a much better way of protecting private property
[1:44:11] Trustee Elliott: as well as engaging with the hereditary and ancestral rights holders who are interested
[1:44:21] Trustee Elliott: in seeing this continue as a harvesting area. So I really appreciate both of you, your work
[1:44:27] Trustee Elliott: in tension with this. It's very important, and I'm so glad to see it proceeding. So I
[1:44:34] Trustee Elliott: won't make any remarks other than I have comments and questions, but go to the trustees first.
[1:44:39] Trustee Luckham (probable): I'm going to go to Ken first because I always I'm trying to be conscious of me taking up too much
[1:44:44] Trustee Luckham (probable): air time. I'll leave
[1:44:47] Voice 5: it up to Ken. Okay so how long have you actually been attempting to get this
[1:44:55] Voice 3: going? Well we started with the Stewardship Center of BC and registered with them to do
[1:45:04] Voice 3: green shores program so that was about five years ago okay and then a little over two years ago
[1:45:15] Voice 3: so when i did that i proceeded in the wrong direction i guess other than
[1:45:21] Voice 3: than registering for green shores i was contacting contractors on my own and
[1:45:27] Voice 3: And I could see that that was really not going to, you know, go in the right direction.
[1:45:35] Voice 3: So I took a course that Stewardship Centre offered.
[1:45:40] Voice 3: And through that, I met with Kelly Locke from the Stewardship Centre.
[1:45:46] Voice 3: And that is when things started to actually move forward.
[1:45:50] Voice 3: Okay. So, you know, one of the,
[1:45:54] Voice 4: so
[1:45:55] Voice 3: the Stewardship Center, their green choice program is the guiding document, I'll call it. And to fulfill that program, you need to hire, you need to have an environmental professional on board to oversee it. So that is what we hired Doug.
[1:46:13] Voice 3: Okay. Yeah.
[1:46:16] Voice 5: um i'm in favor of this i can tell you that right now i wish you could start tomorrow
[1:46:26] Voice 5: so but if i may say about first nations it is it is somewhat frustrating that they do not seem to
[1:46:36] Voice 5: reply to requests and i've noticed that i wasn't a trustee last term but i was the previous one
[1:46:47] in 2014 and it just seems that
[1:46:51] Voice 5: that is frustrating aspect of it so i don't know if we can put a time
[1:46:56] Voice 5: limit of some sort to get a reply and then you can i guess proceed is there any other
[1:47:06] Voice 5: um i mean you've jumped over a lot of hoops and i apologize that it's so cumbersome and
[1:47:13] Voice 5: and so time consuming.
[1:47:15] Voice 5: But that just seems to be the way of the world
[1:47:17] Voice 5: on Cedar's Island,
[1:47:19] Voice 5: when you're trying to go into the shoreline.
[1:47:22] Voice 5: Yeah.
[1:47:23] No, I can
[1:47:23] Voice 5: appreciate that.
[1:47:24] Voice 5: So I am in favor of your project.
[1:47:27] So
[1:47:28] Voice 5: I'll see what Dusty Luckum has to say.
[1:47:35] Trustee Luckham (probable): Okay.
[1:47:36] Trustee Luckham (probable): So Doug used the word mindful
[1:47:42] Trustee Luckham (probable): and that's actually a really good word to use
[1:47:45] Trustee Luckham (probable): in all of this because it embraces so much and of course in all of this one has to always keep
[1:47:55] Trustee Luckham (probable): an open mind and so I'm not in a position to make a decision or endorsement of the project
[1:48:06] Trustee Luckham (probable): in an open mind however I am in support of this and I want to thank the chair for also
[1:48:16] Trustee Luckham (probable): of recognizing, taking a new approach to this,
[1:48:20] Trustee Luckham (probable): in order to make the world a better place, really.
[1:48:25] Trustee Luckham (probable): And I would recognize that.
[1:48:30] Trustee Luckham (probable): And I think that, sure, there's lots of resistance
[1:48:35] Trustee Luckham (probable): on shoreline projects,
[1:48:37] Trustee Luckham (probable): so I'm not supposed to worry.
[1:48:39] Trustee Luckham (probable): And there are problems with that,
[1:48:41] Trustee Luckham (probable): because if we don't offer solutions,
[1:48:43] Trustee Luckham (probable): then we're gonna continually be in this place of conflict.
[1:48:47] Trustee Luckham (probable): And we don't need to do that.
[1:48:49] Trustee Luckham (probable): And so I appreciate that you've been working with the Senate stewardship, whatever they call themselves, and also mindful of the Green Shores approach and engaging with your professional here that's bringing new science, new understanding to the table and is cognizant of his and our responsibility to engage with nations.
[1:49:16] Trustee Luckham (probable): These are all very important things.
[1:49:20] Trustee Luckham (probable): Thank you for recognizing again and remembering Florence James in this conversation.
[1:49:26] Trustee Luckham (probable): It's important to remember that name, that person, that wisdom that we carry forward on her behalf to some extent.
[1:49:34] Trustee Luckham (probable): I think I can say that. I would go back 1954.
[1:49:40] Trustee Luckham (probable): 1954. I was born in 1957. It's a confession. So long before my time. The historic impact
[1:49:53] Trustee Luckham (probable): in that body of water since before then, when the seawall was built, has been significant.
[1:50:04] Trustee Luckham (probable): And the fact that a seawall was built there in 1954 with a complete lack of knowledge
[1:50:10] Trustee Luckham (probable): that's available to us today indicates the erosion and the concerns that's happening on the land
[1:50:17] Trustee Luckham (probable): there um all this in since time immemorial for what phrase there's another phrase to learn
[1:50:25] Trustee Luckham (probable): actually use actually respect that but let me pursue my train of thought um certainly there's
[1:50:33] Trustee Luckham (probable): a philosophy of better leave things alone and natural erosion is part of the evolution of the
[1:50:38] Trustee Luckham (probable): planet and investors to leave it alone and no seawalls or whatever. However, it doesn't reflect
[1:50:44] Trustee Luckham (probable): the natural environmental aspects of the land that are vulnerable and in climate change are
[1:50:52] Trustee Luckham (probable): becoming much more precious. And of course, the human habitation aspects of that property
[1:51:01] Trustee Luckham (probable): are also potentially impacted. So I appreciate that we're looking at this through a new lens
[1:51:08] Trustee Luckham (probable): and hopefully creating an opportunity for us to learn
[1:51:12] Trustee Luckham (probable): with a demonstration of a way to do this going forward.
[1:51:18] Voice 13: I'm just checking
[1:51:24] Trustee Luckham (probable): my notes here.
[1:51:28] Trustee Luckham (probable): I just think that with respect to First Nations engagement,
[1:51:36] Trustee Luckham (probable): every one of these decisions,
[1:51:38] Trustee Luckham (probable): every one of these opportunities,
[1:51:39] Trustee Luckham (probable): I would suggest is a test of our moral stance on this.
[1:51:45] Trustee Luckham (probable): And I don't believe that any of us are not prepared to live up to that.
[1:51:55] Trustee Luckham (probable): And so I think if I'm not mistaken, and I'm in agreement with the recommendation that are here,
[1:52:04] Trustee Luckham (probable): and I'm hoping that actually, despite the fact that this is going to take more time and more money and more delays in the project,
[1:52:11] Trustee Luckham (probable): that you are in support of essentially,
[1:52:14] Trustee Luckham (probable): and I do have a question with respect to the recommendations,
[1:52:17] Trustee Luckham (probable): but generally are in support of the recommendations
[1:52:20] Trustee Luckham (probable): to step forward,
[1:52:21] Voice 15: is that fair?
[1:52:24] Trustee Luckham (probable): It's fair, I know exactly.
[1:52:29] Trustee Luckham (probable): It's continuing on.
[1:52:31] Trustee Luckham (probable): You'd rather, as Ken was indicating,
[1:52:33] Trustee Luckham (probable): you'd rather get started with the public.
[1:52:35] Trustee Luckham (probable): And I would love that,
[1:52:36] Trustee Luckham (probable): but we have to dot all the I's and cross all the T's
[1:52:39] Trustee Luckham (probable): and do all the engagement that's necessary.
[1:52:41] Trustee Luckham (probable): so i think with respect to this moment in time where the first recommendation is direct staff
[1:52:48] Trustee Luckham (probable): to share professional reports information and invite first nations to the site visit
[1:52:51] Trustee Luckham (probable): etc i don't think we've done that not a islands trust has not done that on a formal basis so
[1:52:59] Trustee Luckham (probable): let's do this
[1:53:00] Voice 6: and
[1:53:01] Trustee Luckham (probable): let's hope that we get i anticipate we'll get some response because
[1:53:08] Trustee Luckham (probable): Because now it's not just conversations going on between parties, of which the Islands Trust may or may not be in support of.
[1:53:15] Trustee Luckham (probable): We're now saying we're interested in this.
[1:53:17] Trustee Luckham (probable): Here's a formal request.
[1:53:19] Trustee Luckham (probable): And I'm hoping that we can facilitate this conversation going forward.
[1:53:24] Trustee Luckham (probable): And it may look differently than what we spelled out here about site visits.
[1:53:28] Trustee Luckham (probable): It may be just discussions and conversations.
[1:53:31] Trustee Luckham (probable): But we need to have that.
[1:53:33] Trustee Luckham (probable): And so I look forward to this opportunity in time.
[1:53:40] Voice 3: My brother-in-law, Marcia's brother,
[1:53:43] Trustee Luckham (probable): runs
[1:53:44] Voice 3: the little oyster catcher. He lives on Baldy's Island.
[1:53:47] Voice 3: He's transported the Penelope to Beagles quite a lot, and also the Axum.
[1:53:56] Voice 3: So, you know, if they need to come by boat for some reason...
[1:54:04] Trustee Luckham (probable): absolutely we will ensure that there are no impediments if their desire to come and visit
[1:54:10] Trustee Luckham (probable): let's make sure there's no impediments to that happening so thank you for that um i would just
[1:54:17] Trustee Luckham (probable): say what was interesting and i think maybe you mentioned it um that the a lot that the prior
[1:54:24] Trustee Luckham (probable): decision about the 10 meter setback um that we're permitting that shellfish agriculture activity
[1:54:30] Trustee Luckham (probable): harvesting to continue and indeed that did receive support from Penelakut at the time
[1:54:36] Trustee Luckham (probable): and so what you're doing I think I agree does align with the prior decision making so let's
[1:54:44] Trustee Luckham (probable): confirm that and and continue to move forward in a good way that's the language we use
[1:54:55] Trustee Luckham (probable): and sometimes it would be better if I wrote more clearly because I don't understand my own comments
[1:54:59] Trustee Luckham (probable): But anyway, I want to pursue this. I like the recommendations. The only question I have is with respect to the second motion, item A, you're asking for the final construction and environmental management plan prepared by, et cetera, et cetera.
[1:55:16] Trustee Luckham (probable): It strikes me that if I was the applicant, I wouldn't necessarily, I don't know if I'm
[1:55:23] Trustee Luckham (probable): not trying to set any fear here, if I was the applicant, I wouldn't want to spend the
[1:55:26] Trustee Luckham (probable): money on this until I knew that I had a rezoning permit in my hand.
[1:55:31] Voice 3: Sorry, is this the issue with trying to hire someone to do it when we don't know that we
[1:55:38] Voice 3: can do it and we want that plan is based on, okay, what company have you got?
[1:55:44] Voice 3: about what resources they're going to use.
[1:55:48] Voice 3: And we're kind of stuck in the middle of it.
[1:55:52] Trustee Luckham (probable): That's exactly what I'm saying.
[1:55:54] Trustee Luckham (probable): And I don't want you in that place.
[1:55:55] Trustee Luckham (probable): I don't want us in that place.
[1:55:56] Trustee Luckham (probable): And so it does strike me that if we get to the stage
[1:56:00] Trustee Luckham (probable): where we're approving this application,
[1:56:04] Trustee Luckham (probable): that clearly that work would not begin
[1:56:07] Trustee Luckham (probable): until we had seen the construction plan.
[1:56:10] Trustee Luckham (probable): Is that reasonable for us to consider?
[1:56:15] Trustee Luckham (probable): the final construction environmental management plan because if they're not they don't we don't
[1:56:22] Trustee Luckham (probable): give them the permit they're not going to have to do that and i think you've indicated their
[1:56:25] Trustee Luckham (probable): difficulties with doing the other remarks that's through
[1:56:28] Trustee Elliott: the chair and i'll defer to
[1:56:30] Trustee Elliott: as well um just to clarify are you wondering where this um recommendation number two
[1:56:41] Trustee Elliott: could come in into this zoning amendment process like before yeah item b
[1:56:47] Trustee Luckham (probable): and c i see us not having
[1:56:50] Trustee Luckham (probable): any issues but they're seeking
[1:56:52] Trustee Elliott: clarity are you thinking before a public hearing or at another
[1:56:55] Trustee Elliott: permit stage no
[1:56:57] Trustee Luckham (probable): i see that at the final reading or something you know where we decided that
[1:57:02] Trustee Luckham (probable): everything is good and now we want to know how this is going to proceed you know the protective
[1:57:08] Trustee Luckham (probable): active fencing and tile situations and whatever else is involved one
[1:57:13] Trustee Elliott: consideration and I'll
[1:57:14] Trustee Elliott: um another way is to to also comment is if this is new information it might need to be considered
[1:57:24] Trustee Elliott: oh actually before public hearing did you want anything um yeah sorry I just to clarify I think
[1:57:31] Trustee Elliott: the chair um that you're asking whether you can you know the recommendation specifically says
[1:57:37] Trustee Elliott: prior to further consideration of the application if you know family can be delayed and to allow
[1:57:45] Trustee Elliott: more time so it's maybe prior to public hearing that information is provided is that is that kind
[1:57:53] Trustee Elliott: of what you're what you're thinking giving giving more time in the process for that information to
[1:57:59] Trustee Elliott: be confirmed or waiting until even after the rezoning has been processes over because there
[1:58:09] Trustee Elliott: are no other permits required for violence trust it's just the zoning for structures in that
[1:58:15] Trustee Elliott: not set back and for sure area um so this this is the process with violence trust
[1:58:24] Trustee Elliott: that's required there's no other development permit required or there's no building permits
[1:58:29] Trustee Elliott: what's required
[1:58:29] Voice 15: so
[1:58:30] Trustee Elliott: this is the opportunity to confirm any information that you need to make
[1:58:37] Trustee Elliott: an informed decision about whether to allow it or not.
[1:58:42] Trustee Luckham (probable): Okay I guess what I need is a definition of
[1:58:51] Trustee Luckham (probable): what CEMP means because I'm considering that to be a detailed implementation of what is going to
[1:59:01] Trustee Luckham (probable): to happen during construction maintenance of that site which might be difficult for the applicant
[1:59:08] Trustee Luckham (probable): to and significantly probably significantly more expensive to to acquire and may change
[1:59:17] Trustee Luckham (probable): depending upon who the professional organ company is that undertakes the work
[1:59:23] Trustee Luckham (probable): I just see complications associated with that level of detail which I don't know that because
[1:59:29] Trustee Luckham (probable): of items b and c you're asking for all of the other details uh with respect to uh mitigation
[1:59:37] Trustee Luckham (probable): adaption associated with the site and you're asking for in c a site plan showing shoreline
[1:59:46] Trustee Luckham (probable): access points extensive work and site access i think that that would answer any of the questions
[1:59:52] Trustee Luckham (probable): and unless i'm just interpreting that incorrectly the actual construction and maintenance of the
[1:59:59] Trustee Luckham (probable): That's all.
[2:00:00] Trustee Luckham (probable): is a different thing that I think would be being prepared
[2:00:04] Trustee Luckham (probable): by the contractor that was involved in undertaking the work.
[2:00:07] Trustee Luckham (probable): And without a rezoning in place,
[2:00:11] Trustee Luckham (probable): that would be a significant additional expense
[2:00:15] Trustee Luckham (probable): to actually hire somebody else, an individual
[2:00:18] Trustee Luckham (probable): that may or may not agree that once it's issued,
[2:00:23] Trustee Luckham (probable): the contract that comes into play
[2:00:25] Trustee Luckham (probable): may not necessarily agree
[2:00:26] Trustee Luckham (probable): with the construction and maintenance plan.
[2:00:28] Trustee Luckham (probable): So that's where I'm at. And so if I have a misunderstanding of what that is, then I need to have that corrected.
[2:00:35] Trustee Luckham (probable): But I just want to make it less onerous and provide that and also not fettering our discretion by having implied that we need all of this stuff in order to approve the permit.
[2:00:48] Trustee Luckham (probable): And then something comes up for whatever reason and we just go, no, we can't approve this.
[2:00:53] Trustee Luckham (probable): and yet we forced the applicant to go to a great deal of expense to facilitate that and yeah there
[2:00:59] Trustee Luckham (probable): isn't really any obligation there but i like to make sure i'm not misleading anybody so am i right
[2:01:07] Trustee Luckham (probable): or wrong or and you can call me wrong no
[2:01:09] Trustee Elliott: no i think you're i think you're right i think that
[2:01:12] Trustee Elliott: so the construction environmental management plan as you can see there's a draft version that has
[2:01:17] Manager of Bylaw Compliance and Enforcement: been attacked
[2:01:17] Trustee Elliott: one of the attachments and in my conversation with the applicant all this time
[2:01:22] Trustee Elliott: there was the intention of a final construction environmental management plan final version it's
[2:01:28] Trustee Elliott: really a living document but there would be a final version submitted uh you know at some point
[2:01:34] Trustee Elliott: and and maybe doug if you'd like to speak to that more what the construction environmental
[2:01:39] Trustee Elliott: management plan is meant to well
[2:01:41] Trustee Luckham (probable): maybe we can just jump to the pitch do you see any significant
[2:01:45] Trustee Luckham (probable): impediment or expense associated with creating this item a of motion number two because it's
[2:01:52] Trustee Luckham (probable): not, then let's proceed with the recommendations as presented.
[2:01:58] Voice 6: Well, I see this as, yes, there's definitely an expense on time, energy, but it's not as,
[2:02:07] Voice 6: this is A, but you know, B and C sort of fall as part of it. But I, at this point,
[2:02:14] Voice 6: suggest that this be kept at a sort of a framework level versus the finite minutiae,
[2:02:19] Voice 6: Because we are working through those, we are not aware of where the province is at.
[2:02:26] Voice 6: And so my previous experience, this is the day you show up, you hear it from DFO and
[2:02:31] Voice 6: other elements of the provincial and federal governments that will get into this minutia
[2:02:37] Voice 6: and work through and tease out the difference of whether you need what kind of habitat officer
[2:02:42] Voice 6: involved or, you know, you have those conversations with them over time.
[2:02:47] Voice 6: one to finalizing, including days before you actually start your work, you know, you've
[2:02:52] Voice 6: got to be notified in the habitat officer. So those are pieces that come out of the woodwork,
[2:02:58] Voice 6: but much later in the game, but you have to sort of, so put, yeah, this sort of puts a
[2:03:04] Voice 6: bit of a barrier with regards to getting there without trying to finish it in detail. And
[2:03:10] Voice 6: two, we don't have a contractor yet. So the equipment, and that's been my experience as
[2:03:15] Voice 6: well as the equipment side of it depending on what they use for equipment etc all plays out
[2:03:20] Voice 6: in the final wash right so that you have to go back in so it's not that the framework needs to
[2:03:25] Voice 6: be changed but the details within it yeah based on the size of your home or how many o's or whether
[2:03:30] Voice 6: you're using a conveyor belt or some trucks or a barge oh yeah so those are kind of things where
[2:03:37] Voice 6: you want to make sure you're covered i totally get that and it's important but at the same time
[2:03:41] Voice 6: I appreciate that notion that we try to keep it the framework sound but I love
[2:03:47] Voice 6: our last at the end for you to proceed sooner than I agree.
[2:03:53] Voice 6: Yeah so
[2:03:54] Trustee Luckham (probable): I guess then this question back to staff becomes can we delay asking for this piece
[2:04:02] Trustee Luckham (probable): somewhere else in the process not necessarily at the end but where it's more clear that we've
[2:04:10] Voice 7: we have agreed on the principles of supporting this application well
[2:04:18] Trustee Elliott: can the islands kind of
[2:04:22] Trustee Elliott: the local trust committee not agree in principle to the approach because it supports the preserve
[2:04:29] Trustee Elliott: and protect mandate it's innovative it's using modern science and technology as well as nature
[2:04:36] Trustee Elliott: nature-based solutions as well as engaging with First Nations like it hits all the
[2:04:40] Trustee Elliott: the big questions that we need to consider there isn't really an issue I don't think in anyone's
[2:04:48] Trustee Elliott: mind that the project would not proceed the question is where does everything come in the
[2:04:55] Trustee Elliott: process and you've
[2:04:56] Trustee Elliott: indicated that you're sort of in this like in between where you can't start
[2:05:01] Trustee Elliott: something because we can't and we're not getting the response yet from last and
[2:05:08] Trustee Elliott: First Nation that is needed because we are in their territorial area and so to
[2:05:14] Trustee Elliott: put your question to the to the test is can where do we stage that final
[2:05:22] Trustee Elliott: management plan I think before asking you to do any more work can the LTC lay
[2:05:30] Trustee Elliott: out a bit more of a process that has those requirements, like where does it fit in the
[2:05:40] Trustee Elliott: timeline?
[2:05:40] Trustee Elliott: And I would say that it's probably after first reading, when we have a set of draft bylaws
[2:05:46] Trustee Elliott: that we are considering, and the LTC would then make a decision at first reading, okay,
[2:05:51] Trustee Elliott: it signals an intent to rezone, yes or no, and then we go through that formal referral
[2:05:58] Trustee Elliott: process.
[2:05:59] Trustee Elliott: And I think within that period between first and second and third reading or before public hearing, right, because that's when we need to have everything really tight so that the public can give their comments on exactly what is going to happen.
[2:06:17] Trustee Elliott: I think that would be the time to ask for the final report or the management plan.
[2:06:23] Trustee Elliott: Does that make sense?
[2:06:24] Trustee Elliott: Yes.
[2:06:26] Trustee Elliott: Planners?
[2:06:28] Trustee Elliott: so
[2:06:28] Trustee Luckham (probable): it strikes me that the first reading is an opportunity for us to say we need the management
[2:06:33] Trustee Luckham (probable): and that's for me would be a better place to be in rather than asking before we because really
[2:06:40] Trustee Luckham (probable): first reading is we're serious about this
[2:06:43] Trustee Elliott: we're drafting bylaws with the intent to proceed
[2:06:46] Trustee Elliott: through a legislative process to and and through that we'll refine it but there shouldn't be any
[2:06:55] Trustee Elliott: giant surprises otherwise we'd have to go back to first reading for reconsideration yeah yeah
[2:07:01] Trustee Elliott: through the chair that that is still a reasonable approach i think um one sort of process point i'd
[2:07:10] Trustee Elliott: flag is that if you'd like to use this info it's about using information to potentially inform a
[2:07:17] Trustee Elliott: section 219 covenant if you're concerned about how all of the construction or installation
[2:07:25] Trustee Elliott: unfold or just ensuring that specific measures mitigation and adaptation measures are
[2:07:32] Trustee Elliott: are used and that can still be done after first reading that's fine I've not that has happened
[2:07:41] Trustee Elliott: This information was flagged now because the process of drafting
[2:07:48] Voice 15: could
[2:07:50] Trustee Elliott: take some time.
[2:07:51] Trustee Elliott: And again, the decision whether to have a Section 219 comment is up to the LTV's discretion.
[2:07:59] Trustee Elliott: So
[2:07:59] Voice 15: yes,
[2:08:00] Trustee Elliott: like tabling the first reading, that indicates the decision to proceed to begin
[2:08:14] Trustee Elliott: My question sort of about the information that we are presenting to First Nations is,
[2:08:22] Trustee Elliott: I think there was a note in the staff report of some of, there's so much information here.
[2:08:29] Trustee Elliott: There's so many reports that it's really hard to get a summary of, okay, what is happening?
[2:08:35] Trustee Elliott: happening. And for, you know, I think 200 members, they've got three
[2:08:41] Trustee Elliott: counselors, one hereditary
[2:08:42] Trustee Elliott: chief and three staff, and they've just had like a major decision from the BC Supreme Court they've
[2:08:48] Trustee Elliott: been fighting for for 10 years. So there's, this may be important to them. It's always the timing
[2:08:54] Trustee Elliott: question and getting the right person to fit this into their schedule. I don't think there's
[2:09:02] Trustee Elliott: any question about our intent so it's how the information is presented and I would say
[2:09:07] Trustee Elliott: looking at this preliminary package it's kind of overwhelming I would wonder if we could do
[2:09:15] Trustee Elliott: a summary of key points the draft plan of you know there's things like no dig like that that's
[2:09:26] Trustee Elliott: That's really important to know, just for a summary for busy people
[2:09:31] Trustee Elliott: and have that be conveyed to LAACs and say,
[2:09:34] Trustee Elliott: do you want to engage with this at an early opportunity
[2:09:40] Trustee Elliott: or are we okay to proceed with Penelakut's oversight?
[2:09:45] Trustee Elliott: Because they are part of the same group of nations.
[2:09:49] Trustee Elliott: it's and they may just they may just be glad to know that penelaket has been involved when elders
[2:09:56] Trustee Elliott: and knowledge holders have been on site um and and that's the information that they might need
[2:10:02] Trustee Elliott: i don't know
[2:10:03] Voice 16: but
[2:10:04] Trustee Elliott: i i would worry about giving them so much information that it's like um oh what
[2:10:11] Trustee Elliott: what is really happening here
[2:10:13] Voice 3: all required by the nature-based expedited permit yeah process
[2:10:18] Voice 3: process, that's the requirements, that's why
[2:10:21] Voice 3: it's there, and one document that's not there
[2:10:26] Voice 3: is a document that Doug Fenton put together as a questionnaire to potential contractors,
[2:10:35] Voice 13: which
[2:10:37] Voice 3: I thought was, I'll call it over the top, of social responsibility, environmental
[2:10:44] Voice 3: environmental responsibility, all the questions that a contractor had to answer if they were
[2:10:51] Voice 3: interested in doing it in
[2:10:52] Voice 15: the
[2:10:53] Voice 3: first place, which
[2:10:55] Voice 15: might
[2:10:57] Voice 3: be a good thing.
[2:11:05] Voice 13: So we're
[2:11:07] Voice 7: not really considering coming in at this point, it's just where we want to
[2:11:13] Voice 7: go.
[2:11:13] Trustee Elliott: Perhaps.
[2:11:14] Trustee Elliott: You may not need a covenant.
[2:11:16] Trustee Elliott: well
[2:11:16] Voice 7: no exactly so
[2:11:17] Trustee Luckham (probable): it's a discussion yeah with this point so can we pro to move this along can
[2:11:23] Trustee Luckham (probable): we proceed with the first motion and proceed with the second motion excluding that item a
[2:11:29] Trustee Luckham (probable): and then ask you to bring that item made back to us between first reading and public hearing
[2:11:43] Trustee Luckham (probable): So, and so we don't spin our wheels. Does that help
[2:11:48] Voice 15: outside
[2:11:51] Trustee Luckham (probable): of the approving it today is, you know, is that a B and C.
[2:11:55] Voice 6: I think
[2:11:59] Trustee Luckham (probable): B and C, you'd
[2:12:00] Voice 6: want to continue, you'd want to provide all of that is not independent of each other.
[2:12:04] Voice 6: it's all interconnected it's all working out that it truly is well a final construction plan
[2:12:11] Trustee Luckham (probable): is i think the other item elements to me well i'll turn to staff um could we forego
[2:12:22] Trustee Luckham (probable): a motion tool together i wasn't necessarily sure about that
[2:12:26] Trustee Elliott: through the chair um my
[2:12:30] Trustee Elliott: My comment to share in terms of where this could appear in the process could be, if this
[2:12:37] Trustee Elliott: information is needed to inform drafting bylaws, it may be important to ask for it again, bring
[2:12:47] Trustee Elliott: it back to the LTC after first reading, in
[2:12:50] Trustee Elliott: which case, Leonard Marble would need to possibly
[2:12:56] Trustee Elliott: read you know revise the draft the drafted bylaws after first reading or second reading
[2:13:03] Trustee Elliott: it's important i think maybe to consider this information coming in before the public hearing
[2:13:10] Trustee Elliott: especially as it could be used to for information to inform agencies and cannot get to
[2:13:18] Trustee Elliott: with accid nations and other nations about what the project is going to involve and they may be
[2:13:24] Trustee Elliott: able to provide with that information um
[2:13:27] Voice 15: so
[2:13:28] Trustee Elliott: moment in that regard as we pursue someone so that could
[2:13:35] Trustee Elliott: be part of what the engagement includes is perhaps site visit at letting them know when this
[2:13:43] Trustee Elliott: information is ready they can also um see that as
[2:13:47] Voice 15: part
[2:13:49] Trustee Elliott: of the providing policy and then we would
[2:13:51] Trustee Elliott: see would have that information hopefully in time so
[2:13:57] Trustee Luckham (probable): maybe just for clarity I sort of perceive
[2:14:03] that items b and c is something that you can engage Doug to do it's within if he hasn't already
[2:14:12] done all that
[2:14:12] Trustee Luckham (probable): work I think most of it yeah yes so therefore that that's an easy piece the first
[2:14:18] Trustee Luckham (probable): to a is something that you're going to have to find a third party that may or may not be able
[2:14:23] Trustee Luckham (probable): to commit to a project with the scope sometime in the distant future and so that's my discomfort
[2:14:30] Trustee Luckham (probable): is that part i think you could do the b and c and then the final construction environmental
[2:14:36] Trustee Luckham (probable): management plan could come later but that's me yeah
[2:14:39] Voice 15: yeah to
[2:14:41] Voice 6: describe suggesting it's
[2:14:44] Voice 6: So it's related, right, because that's the overarching document that oversees the construction.
[2:14:51] Voice 6: And now that it's sort of drawn to the entire evolution, it becomes then the living document
[2:14:58] Voice 6: for the band owner, which then turns it into
[2:15:02] Trustee Luckham (probable): what you're going to sort of do.
[2:15:05] Trustee Luckham (probable): I guess if I was doing the work, I would want to engage with the contractor that was
[2:15:08] Trustee Luckham (probable): actually going to be running the
[2:15:10] Voice 6: equipment and machinery.
[2:15:11] Voice 6: Well, that would be part of our picture, absolutely, but that's where that needs to be refined,
[2:15:16] Voice 6: so it remains draft, right?
[2:15:19] Voice 6: Well, if you want me to leave it in, I will.
[2:15:21] Voice 6: No, no, no.
[2:15:22] Voice 6: The only lulls of saying this is the document itself never really gets until you've actually
[2:15:27] Voice 6: hired a contractor, I guess a machine operator, not the environmental professional, and that
[2:15:35] Voice 6: that the machine operating company contractor will inform the construction and environmental
[2:15:42] Voice 6: management plan right
[2:15:44] Trustee Luckham (probable): okay so we're on we're on yeah agreed except that i think that b and c
[2:15:48] Trustee Luckham (probable): probably have that information already at hand and you can create that document whereas a is
[2:15:54] Trustee Luckham (probable): going to require working with whomever that other party is yeah we
[2:16:00] Voice 13: agree yeah
[2:16:06] Voice 3: That's the expert on that. It seems that most of that is incorporated into the draft.
[2:16:16] Voice 3: We
[2:16:16] Voice 6: would like to not have to go into the contractor. Higher the contractor pay is, keep it at a low.
[2:16:23] Voice 6: Something that's functional and usable and then mindful of the fact that on the day,
[2:16:30] Voice 6: of construction it won't be informed by the contractor hired and their equipment etc will
[2:16:37] Voice 6: inform that plan so that it's meets well so then but
[2:16:43] Trustee Luckham (probable): that's a different day down the road okay
[2:16:45] Trustee Luckham (probable): so i understand so therefore then i guess the difficulty i'm having is with the word final
[2:16:52] Trustee Luckham (probable): and so if we were to delete the word final and just ask for a construction environmental
[2:16:58] Trustee Luckham (probable): environmental management plan, I go with that because I think the final plan has to be vetted
[2:17:03] Trustee Luckham (probable): by whomever you're going to hire to do it.
[2:17:05] Trustee Elliott: There is a draft plan here, it's in like that's the plan is in there, if you
[2:17:12] Voice 14: want to ask me
[2:17:13] Trustee Elliott: for it.
[2:17:13] Trustee Elliott: No, we're asking for a final one.
[2:17:15] Trustee Elliott: There is a draft plan in there, there's a framework, there's all the intentions for
[2:17:19] Trustee Elliott: how it's
[2:17:20] Trustee Luckham (probable): going to be done.
[2:17:21] Trustee Luckham (probable): Okay, so what's in here is already that work?
[2:17:24] Trustee Elliott: Yes.
[2:17:24] Trustee Elliott: And
[2:17:24] Trustee Luckham (probable): we're refining it because we're trying to figure out what size she needs.
[2:17:28] Trustee Luckham (probable): So we don't need to do that.
[2:17:30] Trustee Elliott: It's just what stage does the final plan have to come at?
[2:17:36] Trustee Elliott: There will need to be a final plan.
[2:17:38] Trustee Elliott: Contractors will need to be hired.
[2:17:40] Trustee Elliott: There has to be a plan.
[2:17:41] Trustee Elliott: We're at that formulating stage.
[2:17:43] Trustee Elliott: And right now, planners are suggesting we ask for that final plan now, whereas I think
[2:17:49] Trustee Elliott: The LTC is going towards let's wait until there's more or further in the process before asking for that final report.
[2:17:58] Voice 7: So we can remove item A.
[2:18:01] Trustee Elliott: I think I agree with you on that.
[2:18:02] Trustee Elliott: I have something else that I would like to request.
[2:18:06] Trustee Elliott: It would be more of a summary document.
[2:18:08] Trustee Elliott: Your report is great.
[2:18:12] Trustee Elliott: The attachments are all necessary, but it's necessary to meet the stewardship.
[2:18:17] Trustee Elliott: what are they called again? Sorry. Stewardship Center.
[2:18:21] Trustee Elliott: Stewardship Center of BCs. And I don't
[2:18:24] Trustee Elliott: know all the scientific requirements. So I'm wondering if, so back to the question of First
[2:18:33] Trustee Elliott: Nations input into this. As we were talking, I was reviewing, Linox and First Nations just
[2:18:40] Trustee Elliott: just put out for 2024 an action plan that is like they've got a lot going on they
[2:18:47] Trustee Elliott: are revamping
[2:18:48] Trustee Elliott: their governance they've got they're capturing oral history they're um developing an economic
[2:18:54] Trustee Elliott: um farm so it's how can we convey or how can we learn their level of interest and if they
[2:19:05] Trustee Elliott: They would be wanting to be involved at that stage,
[2:19:12] Trustee Elliott: but were referred to the work that Penelakut
[2:19:14] Trustee Elliott: and those elders have been doing.
[2:19:18] Trustee Elliott: That's kind of where I'm sitting with this
[2:19:22] Trustee Elliott: as a question to Lance,
[2:19:24] Trustee Elliott: and then maybe you've already asked it.
[2:19:26] Trustee Elliott: Do you want to be involved with this project?
[2:19:29] Trustee Elliott: Here's a one-page summary.
[2:19:31] Trustee Elliott: You're busy people.
[2:19:33] Trustee Elliott: will, um, could we have a response by October 30th? This is our early engagement. This is not
[2:19:42] Trustee Elliott: a formal referral and it actually follows our cooperation agreement with them. I think the
[2:19:48] Trustee Elliott: wording is a referral of land use planning or land use change documents or contents with
[2:19:56] Trustee Elliott: opportunities for discussion of concerns before consideration by the respective party provided
[2:20:00] Trustee Elliott: that this is not considered a formal consultation and so we could say you know in respect of a
[2:20:07] Trustee Elliott: protocol agreement this is the referral with a very simple one pager and this is not formal
[2:20:15] Trustee Elliott: consultation and our deadline is this date yeah have
[2:20:21] Trustee Elliott: we done that we've done that okay in may
[2:20:24] Trustee Elliott: and then we followed up in august but obviously there was a lot going on there's a lot and it's
[2:20:28] Trustee Elliott: a busy season. So we acknowledge that. But that is exactly what we've done.
[2:20:38] Trustee Elliott: And so all the work that Mr. Kenton you've done is with elders, knowledge
[2:20:47] Trustee Elliott: holders who've come to walk the land and
[2:20:50] Voice 6: the business union is aware has copies
[2:20:53] Voice 6: and copies of everything in that center communication slide as well. Okay.
[2:20:58] Voice 6: So, okay.
[2:20:59] Trustee Elliott: Yeah, we're doing everything we can. It's, it's the
[2:21:03] Voice 6: one thing I'm thinking is I can reach out to both of them specifically and reach out to Dr. Margo for a year and that was the research to Shannon Lucy, but she's the director of economics and sort of evolving titles because of all the changes there.
[2:21:21] Voice 6: but she's in
[2:21:23] Voice 16: separate
[2:21:24] Voice 6: it's working for them but I may be able to just have a conversation and say
[2:21:29] Voice 6: watch for a martyr's email
[2:21:35] Voice 6: feedback and I'm leaving we should we need to talk to the new chief so maybe I'll just
[2:21:40] Voice 6: reach out to the chief in a similar fashion try to book a phone call or a face-to-face and go over
[2:21:45] Voice 6: and say hey this is an important part of the project opportunity to try to find new ways to
[2:21:51] Voice 6: go forward it's supposed to be just sort of hearing about it after the fact um not sort
[2:21:57] Voice 6: of in the conversation to throw on but they have well yeah but the new chief is an opportunity to
[2:22:04] Voice 6: reach out and say hey
[2:22:05] Trustee Elliott: no no yeah yeah i would be cautious about directly to the chief but
[2:22:15] Trustee Elliott: I'm wondering, I don't know, you said Shaylee Robinson is the point of contact?
[2:22:21] Voice 6: No, it's my accident. She had one again.
[2:22:26] Trustee Elliott: Okay.
[2:22:26] Voice 13: I don't know the energy.
[2:22:31] Voice 13: Okay.
[2:22:34] Voice 6: Okay.
[2:22:34] Voice 6: They're looking to, you know, through their referral.
[2:22:37] Voice 6: All right.
[2:22:40] Trustee Elliott: through the chair um just going back to recommendation we want to be proposed in
[2:22:46] Trustee Elliott: terms of providing meaningful opportunities for involvement and discussing concerns that
[2:22:51] Trustee Elliott: that stop and the LTC can do a site visit is one way it could be um we've heard feedback that
[2:22:59] Trustee Elliott: emails don't always work they don't
[2:23:01] Trustee Elliott: always land because they're very transactional yeah so there
[2:23:05] Trustee Elliott: could be other ways that the LTC and staff can also reach out to the nations to talk about this
[2:23:11] Trustee Elliott: particular application or maybe there's other aspects as part of your bigger your bigger
[2:23:17] Trustee Elliott: mandate right you hit the nail on the head they are inundated with referrals so back to your
[2:23:23] Trustee Elliott: question of how do we get we can't get an email response often email is just not going to get a
[2:23:30] Trustee Elliott: response so it's like don't take it personal maybe your brother-in-law contact with the
[2:23:35] Trustee Elliott: frequent taxi service can have a conversation and say hey who's the best person to talk to
[2:23:39] Trustee Elliott: about this um proposal can you give me a phone number of a contact it's
[2:23:45] Trustee Elliott: and perhaps the perhaps i know it's more work but it's probably going to be a faster result to be
[2:23:53] Trustee Elliott: honest there might be interest in inviting members to have a site visit to learn more about
[2:23:59] Trustee Elliott: but it's a great idea to land.
[2:24:00] Trustee Elliott: So I think what
[2:24:02] Trustee Elliott: Planar Comitas and the
[2:24:04] Trustee Elliott: owners have already kind of spoken about
[2:24:06] Trustee Elliott: what some of these ideas
[2:24:07] Trustee Elliott: might be worth following up on.
[2:24:10] Trustee Elliott: Yes, absolutely. As it relates
[2:24:12] Trustee Elliott: to recommendation two,
[2:24:15] Trustee Elliott: I'm still
[2:24:16] Trustee Elliott: of consideration
[2:24:19] Trustee Elliott: sometime before public
[2:24:20] Trustee Elliott: hearing, after first reading
[2:24:22] Trustee Elliott: makes sense.
[2:24:24] Voice 13: The
[2:24:25] Trustee Elliott: LTC can ask
[2:24:27] Trustee Elliott: for that information, whether it's final
[2:24:28] Trustee Elliott: final or keep it in draft but it would have to be enough to inform make sure you're informed
[2:24:34] Trustee Elliott: if you want to ask for a covenant if it's enough information for for us to use for referrals
[2:24:47] Voice 16: yeah
[2:24:49] Voice 13: or all of our communication too so
[2:24:56] Voice 7: are you suggesting we don't need to do motion number two
[2:24:58] Voice 7: at all at this time i
[2:25:00] Trustee Elliott: think based on through the chair based on the ltc's feedback and discussion
[2:25:07] Trustee Elliott: um suggesting it come back to the ltc after first reading okay well that makes it easier okay
[2:25:17] Voice 5: so that's what i was leaning toward
[2:25:20] Trustee Luckham (probable): myself so the only thing that concerns me around how we're
[2:25:25] Trustee Luckham (probable): talking about this is wanting to put deadlines on it. I
[2:25:31] Trustee Luckham (probable): have difficulty. I also have difficulty
[2:25:35] Trustee Luckham (probable): with conveying how this is such an important project and now is the time for you to
[2:25:42] Trustee Luckham (probable): provide input. It's important to us,
[2:25:45] Voice 15: it's
[2:25:46] Trustee Luckham (probable): not important to them. So we have to just keep that in
[2:25:51] Trustee Luckham (probable): mind as we're moving forward to provide to communicate our interest in pursuing this
[2:26:00] Trustee Luckham (probable): with them and it's it's implied that we're not writing to you because we don't want a response
[2:26:10] Trustee Luckham (probable): but i think applying over pressure for when absolutely as toby has said there is so much
[2:26:19] Trustee Luckham (probable): every local government every land alteration application in british columbia goes to a nation
[2:26:26] Trustee Luckham (probable): and it's and that's good news but it's inundating the world's capacity of connections
[2:26:35] Voice 13: okay so do you want both
[2:26:38] Trustee Elliott: well the first one yeah i think so the question
[2:26:48] Trustee Elliott: in my mind is still to defer but what is the goal not so much a deadline but what are we wanting to
[2:27:01] Trustee Elliott: achieve to understand whether layaks and first nations interests are impacted want to comment
[2:27:08] Trustee Elliott: or not is that the only question we're holding off on or no well oh and penelope haven't formally
[2:27:22] Trustee Elliott: We
[2:27:23] Voice 7: need the political authority within those nations to endorse or deny.
[2:27:32] Trustee Elliott: Through the Chair, I would say this is, at this stage, one of the early conversations.
[2:27:38] Trustee Elliott: We know that there's no formal response necessary at this stage.
[2:27:46] Trustee Elliott: It's, you know, this recommendation is really based on the fact that there hasn't been a
[2:27:52] Trustee Elliott: discussion, any kind of early informal discussion, staff-to-staff, with Penelaket or LIAACS, and
[2:28:00] Trustee Elliott: that's being flagged as, you know, not upholding the agreement, and I know that there is no
[2:28:07] Trustee Elliott: So formal protocol isn't relevant necessarily, but there's a local nation there.
[2:28:14] Voice 15: But
[2:28:14] Trustee Luckham (probable): that said, this is the first time this LTC has seen this, right?
[2:28:20] Trustee Luckham (probable): You've had it, that's true, but this is the first time you've heard it to us.
[2:28:24] Trustee Luckham (probable): So this is now the time for this LTC to say, now we need to go to the nations and think
[2:28:29] Trustee Luckham (probable): of what they're interested in and convey it.
[2:28:31] Trustee Luckham (probable): And this is a learning opportunity for them to inform the decision later when we do get
[2:28:37] Trustee Luckham (probable): to a first reading
[2:28:37] Voice 7: to say what do you think is that right
[2:28:42] Trustee Elliott: that's yeah that's the idea i think
[2:28:46] Trustee Elliott: that also aligns with the protocol agreement we have no opportunities for early informal
[2:28:54] Trustee Elliott: discussions yeah concerns and opportunities for formal comments on that he's playing about right
[2:28:59] Voice 13: Right.
[2:28:59] Trustee Elliott: Perfect. So as to my view, as a chair who a year ago listened to how terribly the
[2:29:11] Trustee Elliott: trust was not upholding or terribly we're upholding our reconciliation declaration and
[2:29:18] Trustee Elliott: everything else, I would just want to make sure that there is a record that demonstrates
[2:29:25] Trustee Elliott: we we have upheld our end of the protocol agreement which is to refer all these any
[2:29:33] Trustee Elliott: considerable land use change in an early way before the formal process so i i'm in agreement
[2:29:40] Trustee Elliott: that we need to try just one more time whether that's it for an in-person um through leadership
[2:29:48] Trustee Elliott: council through the business arm and then through planning just very politely saying
[2:29:53] Trustee Elliott: our intent is to do this we want to make sure that we capture your interests and concerns um and
[2:30:00] Trustee Elliott: Then when we do get a challenge, we may get a challenge, we'd say, well, we have done our part.
[2:30:07] Trustee Elliott: We are trying to, we've always tried to reach out.
[2:30:10] Trustee Elliott: So I just wanted to make sure that that language was in there.
[2:30:14] Trustee Elliott: The spirit of cooperation, that's the principle we're trying to uphold.
[2:30:17] Trustee Elliott: We are just trying to cooperate together.
[2:30:19] Trustee Elliott: And for whatever reason, we can't get a response.
[2:30:21] Trustee Elliott: That's okay.
[2:30:22] Trustee Elliott: It's, we did our best.
[2:30:25] Trustee Elliott: And we don't want to hold this process up anymore.
[2:30:27] Trustee Elliott: I don't like the word deferral.
[2:30:29] Trustee Elliott: I really would rather it was something like just direct staff to you know engage with First Nations
[2:30:36] Trustee Elliott: before further consideration because there's no intention in what I'm hearing to defer this any
[2:30:43] Trustee Elliott: further it's just can we make sure that that piece is followed through before we proceed so
[2:30:50] Trustee Elliott: So I guess that isn't the problem.
[2:30:56] Trustee Luckham (probable): Let me just talk about that for a second.
[2:30:58] Trustee Luckham (probable): That's an interesting view, and I appreciate it.
[2:31:03] Trustee Luckham (probable): And I sort of, I said, oh, yeah, we should just take that out.
[2:31:06] Trustee Luckham (probable): We should change that.
[2:31:09] Trustee Luckham (probable): However, that is a decision we're making.
[2:31:12] Trustee Luckham (probable): We're not going forward with this until we've done the consultation.
[2:31:15] Trustee Luckham (probable): And that's meaningful in itself.
[2:31:19] Trustee Luckham (probable): We're consciously deferring it because we haven't done something.
[2:31:22] Trustee Luckham (probable): something we need to do and I think that it isn't so much it was interesting I picked up on I want
[2:31:28] Trustee Luckham (probable): this on the record as you
[2:31:29] Trustee Luckham (probable): said no criticism I want to be able to know in my heart I've done the right
[2:31:33] Trustee Luckham (probable): thing
[2:31:34] Voice 15: and
[2:31:34] Trustee Luckham (probable): I want the penelope and the vaccine to know that we've done the right thing
[2:31:38] Voice 15: I believe
[2:31:39] Trustee Luckham (probable): it doesn't have to be on a record we just need to do it
[2:31:41] Voice 15: so
[2:31:44] Trustee Luckham (probable): everything's paperwork and you need it
[2:31:47] Trustee Luckham (probable): on the record everything for sure get that just comes as a matter of course
[2:31:58] Trustee Luckham (probable): all
[2:31:58] Trustee Elliott: right okay i've been convinced by my
[2:32:04] Trustee Elliott: i i'm ready to hear a motion if somebody wants to read one
[2:32:12] Trustee Luckham (probable): I move then that the Thetis Island Local Trust Committee defer for the consideration of applicants
[2:32:20] Trustee Luckham (probable): PLRZ 2025-072 Welch and direct staff to share professional reports and information and invite
[2:32:28] Trustee Luckham (probable): First Nations to a site visit in order to provide meaningful opportunities for involvement,
[2:32:33] Trustee Luckham (probable): involvement discussion of concerns in cooperation prior to the LTC proceeding with the application.
[2:32:41] Trustee Luckham (probable): Second.
[2:32:42] Trustee Elliott: I've moved and seconded.
[2:32:45] Trustee Elliott: Discussion on the motion.
[2:32:46] Trustee Elliott: I'm good with this.
[2:32:48] Trustee Elliott: We've had a great conversation.
[2:32:49] Trustee Elliott: Great conversation.
[2:32:50] Voice 5: Just have one question.
[2:32:51] Voice 5: Site visit, is that with the LTC present or is that just concerned for stations?
[2:33:00] Voice 5: The way it's written, I don't understand.
[2:33:04] Trustee Elliott: Through the Chair, I think that could actually be up to the LTC if you'd like to attend as well.
[2:33:12] Trustee Elliott: I think the intention was to have First Nations, Island's Trust staff, the owners, and the applicant.
[2:33:20] Trustee Elliott: But I also think you make a good point that that can happen, you know, as you have to use your welcome to attend that site visit as well.
[2:33:30] Trustee Elliott: to the chair would just be for information so you wouldn't be making decisions you just
[2:33:35] Voice 7: maybe discussing business
[2:33:37] Trustee Elliott: okay so
[2:33:41] Voice 7: i would suggest that when we receive
[2:33:47] Trustee Luckham (probable): um an expression of interest in attending a site visit that if that's a staff visit
[2:33:53] Trustee Luckham (probable): that we maintain that staff to staff if it's staff and leadership that i would be more comfortable
[2:34:01] Trustee Luckham (probable): and attending as a leadership to leadership because that both of those relationships need
[2:34:07] Trustee Luckham (probable): to be developed but if it at this stage if it's determined by because leadership will determine
[2:34:13] Trustee Luckham (probable): how they want to respond to this and if they say staff you guys got to talk to them then that's
[2:34:17] Trustee Luckham (probable): fine but it could be expressed in the invitation that the elected would be present if it was
[2:34:25] Trustee Luckham (probable): design
[2:34:25] Voice 7: yeah circumstances and i
[2:34:31] Voice 13: would make every effort to attend it that was great
[2:34:38] Trustee Elliott: so question on the motion would you include all of these reports like
[2:34:46] Trustee Elliott: and uh we'd likely post them to the website and then get links but but yeah i know the interest
[2:34:54] Trustee Elliott: just a clear communication for anyone
[2:34:57] Trustee Elliott: that's receiving a referral on this,
[2:34:59] Trustee Elliott: we summarized and then just knowing that
[2:35:04] Trustee Elliott: potentially new information would be that
[2:35:07] Trustee Elliott: strategy and key when it's potentially changing
[2:35:11] Trustee Elliott: and having the most recent version of all documents
[2:35:15] Trustee Elliott: posted to the website on the
[2:35:17] Trustee Elliott: current applications page
[2:35:18] Trustee Elliott: and then linking.
[2:35:19] Trustee Elliott: Yeah, so yeah, but definitely in summary as well.
[2:35:23] Trustee Elliott: Okay. Thank you. All right. No further questions. Ready to vote? All those in favor?
[2:35:31] Trustee Elliott: And that is carried. Thank
[2:35:33] Trustee Elliott: you. The hurdle is not an ideal scenario, but
[2:35:39] Trustee Elliott: I really appreciate the work that you've done. It's amazing. And this is a
[2:35:45] Trustee Luckham (probable): good day. It's all
[2:35:48] Trustee Luckham (probable): all right yes we
[2:35:51] Trustee Elliott: got the funnel to the stage
[2:35:52] Trustee Elliott: now there's a process is
[2:35:55] Voice 3: uh is it legitimate
[2:35:58] Voice 3: for for myself to ask my brother-in-law or um maria de young that has the
[2:36:08] Voice 3: baldies island conservancy they have a relationship with the accent because
[2:36:14] Voice 3: because we have a lot of units going on in your nose and say, yeah, yeah, so use any
[2:36:22] Trustee Elliott: means that
[2:36:24] Trustee Elliott: feel natural, and that are, that build relationship, right, so the goal is to establish a cooperative
[2:36:31] Trustee Elliott: relationship, so if it's, you know, a taxi ride, and, and a guardian that someone's transporting,
[2:36:37] Trustee Elliott: asking the question who's the best person to talk to about a nature-based approach to
[2:36:44] Trustee Elliott: my property and the accidents and trees and that like yeah I think making inquiries it's very
[2:36:52] Trustee Elliott: respectful um I think that was a bit tricky but staff is going to do that right yeah I was going
[2:36:59] Trustee Elliott: to confirm that but um you know staff would coordinate because I talked to you about that
[2:37:06] Trustee Elliott: in a whole right other
[2:37:07] Trustee Elliott: ways that you can help make that happen but we would be
[2:37:12] Trustee Elliott: taking on that administrative stuff as well
[2:37:17] Voice 16: as
[2:37:17] Trustee Elliott: we do okay so we're not going to consider motion number two uh and we'll
[2:37:25] Trustee Elliott: defer that for a later time
[2:37:28] Trustee Luckham (probable): well for sure you'll bring this back to us as a matter of due court we
[2:37:33] Trustee Luckham (probable): don't need to specifically tell you to bring that back to it it
[2:37:36] Trustee Elliott: says it'll report to ltc
[2:37:38] Trustee Elliott: the next steps in november and we might give direction to draft by laws and proceed with
[2:37:44] Trustee Elliott: the application that's sort of the plan okay yeah oh great so
[2:37:52] Voice 6: the next state you're talking
[2:37:54] Voice 6: about is that about every meeting or is there another you know question in november well if
[2:38:01] Trustee Elliott: the site because it
[2:38:02] Voice 6: were to happen
[2:38:02] Trustee Elliott: between now and then that would be
[2:38:05] Voice 6: yeah well it's an ideal
[2:38:06] Trustee Luckham (probable): situation a long time between now and november would be good yeah
[2:38:10] Voice 6: what's all my gumbo one was
[2:38:15] Voice 6: out there was february
[2:38:20] Voice 6: chile visit
[2:38:35] Trustee Elliott: There's a bit of business to carry on with, but are we trying to get a 1.30?
[2:38:42] Trustee Elliott: I think that would be really good.
[2:38:46] Trustee Elliott: There are a couple other stuff, sorry, we're under application still.
[2:38:53] Trustee Elliott: So page two is both self-strain referral response and falsify referral.
[2:39:00] Trustee Elliott: So the LTC may wish to get up now or break the nine points.
[2:39:05] Voice 13: Yeah, I think we could do a break.
[2:39:11] Voice 13: Well, let's do 15. Is everybody okay with 15?
[2:39:16] Trustee Elliott: It's not really a lunch break.
[2:39:18] Trustee Elliott: But I think we could get through everything else after that.
[2:39:24] Trustee Elliott: just give everybody a chance to reset okay 15 minutes thanks
[2:39:30] Voice 14: everybody
[2:39:32] Voice 14: thank you uh we're gonna start
[2:58:18] Trustee Elliott: again although we don't have trustee lockham because he went
[2:58:22] Trustee Elliott: i don't know why do you have in this space there i do
[2:58:27] Voice 13: we're going
[2:58:28] Trustee Elliott: to proceed very slowly
[2:58:29] Trustee Elliott: HAB-Masyn Moyer- Like.
[2:58:30] Trustee Elliott: HAB-Masyn Moyer-
[2:58:34] Voice 13: Live
[2:58:40] Trustee Elliott: streaming we're just waiting for one more trustee.
[2:58:46] Voice 13: HAB-Masyn Moyer- Okay
[2:58:49] Trustee Elliott: we're good let's reconvene and look we're going to reconvene and consider what we can, noting trustee is absent, but when we will slow down as a request for decision actually maybe.
[2:59:11] Trustee Elliott: So we'll just hold off on 9.4. Let's go with 9.2. Salt Spring LTC bylaw number 546, referral for responses to 3.2.
[2:59:28] Voice 14: Okay,
[2:59:36] Trustee Elliott: so we've got a proposed bylaw 546.
[2:59:40] Trustee Elliott: sticks um a bit of an interesting this is right
[2:59:48] Voice 13: right
[2:59:52] Trustee Elliott: so this is for rezoning to allow for a housing
[3:00:01] Trustee Elliott: Oh, okay. This is why it's okay. So this is a new format. I just realized. I think it was executive committee who asked for draft resolutions for the first time rather than just the check through the chair.
[3:00:19] Trustee Elliott: So the memo is on page 283 in this referral for proposed bylaw number 520B from Salisbury Island.
[3:00:29] Voice 15: If
[3:00:29] Trustee Elliott: you go to page 284, it explains the proposal and the purpose of the bylaw is a land use bylaw amendment to bring existing use into compliance at the expiration of an existing land use contract.
[3:00:46] Trustee Elliott: Right. So that's what the referral is related to in the land use bylaw that will be bringing this property into court.
[3:00:59] Trustee Elliott: Okay.
[3:00:59] Voice 5: So we have to do one of the four recommendations there. Page
[3:01:05] Voice 13: 283.
[3:01:08] Voice 13: Yep.
[3:01:10] Voice 13: So,
[3:01:12] Voice 13: The
[3:01:13] Trustee Elliott: two of us can
[3:01:14] Trustee Elliott: Can we call it a quorum?
[3:01:16] Trustee Elliott: no the two of us can proceed and we'll just um yeah trust committee of two i would venture to
[3:01:25] Trustee Elliott: suggest that our interests are unaffected by the bylaw okay does that uh
[3:01:30] Voice 4: sound good to me
[3:01:32] Voice 4: do you want to make the motion maybe i move that this is a local trust committee respond to the
[3:01:36] Voice 4: salt spring on the local trust committee that interests are unaffected by bylaw number 546
[3:01:42] Voice 4: sure good
[3:01:43] Trustee Elliott: moved i will second the motion any discussion all those in favor all right and that
[3:01:50] Trustee Elliott: is carried thank you now the next so this is the rezoning sorry uh so residential 12 variant a to
[3:02:02] Trustee Elliott: residential 13 to permit the development of 50 units affordable housing general offices child
[3:02:07] Trustee Elliott: care days and there's a reduction of a lot size for a potential subdivision.
[3:02:20] Voice 16: I
[3:02:30] Trustee Elliott: would support the bylaw if there is an opportunity to do that. I do recommend
[3:02:35] Trustee Elliott: proceeding with the bylaw for the reason that affordable or zoning for affordable housing
[3:02:46] Trustee Elliott: and a child daycare center is definitely supported by the Salt Spring Island OCP and
[3:02:54] Trustee Elliott: we've heard a lot of calls for more housing we could recommend to proceed or that our interests
[3:03:03] Trustee Elliott: are not affected only in the future or not proceeding um
[3:03:08] Voice 5: if you want to make a motion that
[3:03:12] Voice 5: you want to proceed for some reasons that you just mentioned i'm fine with that too
[3:03:24] Trustee Elliott: I'm just going to change it up for fun here I remove that the Thetis Island Local Trust
[3:03:30] Trustee Elliott: Committee recommends the Salt Spring Island Local Trust Committee that proposed bylaw number
[3:03:34] Trustee Elliott: 549 proceed for the following reasons that affordable housing and child daycare centers
[3:03:45] Trustee Elliott: Center's center will support the objectives of a community that is has been uh has long had some
[3:04:01] Trustee Elliott: need for affordable housing let's just put it that way
[3:04:08] Trustee Elliott: so at least I probably made that more complicated than you wanted
[3:04:13] Trustee Elliott: um that we support Salt Spring Island's community's desire for
[3:04:21] Voice 13: more affordable housing
[3:04:22] Voice 13: How
[3:04:22] Trustee Elliott: about that? Does that make sense?
[3:04:29] Voice 5: I have
[3:04:33] Voice 10: that, Chair Elliott.
[3:04:34] Voice 10: Okay.
[3:04:35] Trustee Elliott: So moved. Do I have a seconder? Second. Seconded by Trustee Hunter.
[3:04:39] Trustee Elliott: Any discussion? All those in favor?
[3:04:43] Trustee Elliott: That is carried. Okay.
[3:04:47] Trustee Elliott: Now we're going to
[3:04:48] Trustee Elliott: slow
[3:04:49] Voice 13: down a little bit. Moving to
[3:04:57] Voice 13: bylaw referral.
[3:04:59] Voice 15: And
[3:05:02] Trustee Elliott: so 9.4.
[3:05:05] Trustee Elliott: no 9.3 yep i believe you know it's 9.4 you're right sorry you're
[3:05:11] Voice 5: 97 okay
[3:05:13] Trustee Elliott: so the briefing that
[3:05:14] Trustee Elliott: uh comes before the memo is just to correct the date um
[3:05:20] Voice 13: so
[3:05:23] Trustee Elliott: they will need a response no later
[3:05:25] Trustee Elliott: than february 6th not october 10th and so is this coming to our next november meeting
[3:05:33] Trustee Elliott: through the chair i'll just maybe for the benefit of our members attending in person
[3:05:45] Trustee Elliott: and online the purpose of this report of this briefing is to update the ltc and the
[3:05:53] Trustee Elliott: island's trust conservancy that the trust council expects to receive referral referral responses
[3:05:59] Trustee Elliott: responses from LTCs and the Conservancy no later than February 6, 2026, not the October
[3:06:07] Trustee Elliott: 10, 2025 date as stated in the original referral package that was sent out in August.
[3:06:16] Trustee Elliott: So as follow-up, Trust Area Services staff will follow with individual LTCs and the Conservancy
[3:06:25] Trustee Elliott: see as needed right so this is just for for information okay so there isn't a response
[3:06:32] Trustee Elliott: needed right now you know okay trustee hunter did you have your do you want to be in here
[3:06:42] Voice 13: so
[3:06:50] Trustee Elliott: about november 4th okay so we have two meetings before the deadline february 6th
[3:07:00] Trustee Elliott: and trustee luck will join us we have to get going i'm glad you did
[3:07:15] Trustee Elliott: Okay, we moved through the two bar log referrals from Salt Spring, but notice that there's
[3:07:23] Trustee Elliott: a new response.
[3:07:26] Trustee Elliott: So an executive committee, it might have been David Mott, said that he would like to see
[3:07:33] Trustee Elliott: options laid out.
[3:07:34] Trustee Elliott: So for the first time, I want to say interest on the fact that I said we supported the Salt
[3:07:40] Trustee Elliott: Supreme Island rezoning for the reasons that Salt Supreme has been calling for affordable
[3:07:45] Trustee Elliott: housing for a long time.
[3:07:46] Trustee Elliott: That's fine.
[3:07:47] Trustee Elliott: Well, now we're on 9.4, the policy statement.
[3:07:54] Trustee Elliott: So noting that we don't have to give a response right now, there are two meetings of the Federal
[3:08:01] Trustee Elliott: local trust committee that will happen before february 6th so
[3:08:08] Voice 13: it's just a memo
[3:08:15] Trustee Elliott: yeah if you want through the through the chair um the briefing also does mention that
[3:08:23] Trustee Elliott: um it would be great if the lcc can submit referral responses as soon as practical um
[3:08:29] Trustee Elliott: following the local engagement events that are happening on the policies following the local
[3:08:34] Trustee Elliott: engagement events. I don't know if BIDA selected any local engagement events.
[3:08:42] Trustee Elliott: We can check in with the senior policy advisor. Yeah, I did. There's a message from
[3:08:52] Trustee Elliott: Jason Reimans about a November 4th meeting, a discussion happening. I think we selected to
[3:08:59] Trustee Elliott: have it during town hall or to have public participation at the LTC meeting, right?
[3:09:06] Trustee Elliott: Oh, Steph Millard, how's her hand raised? Hello, Lita.
[3:09:11] Voice 10: Chair Elliott, the LTC did choose to have an engagement session within their November 4th meeting.
[3:09:20] Trustee Elliott: Perfect. So we will formulate and convey our response following that meeting after the public participation.
[3:09:31] Trustee Elliott: Okay.
[3:09:32] Trustee Elliott: i think it well you want to hear from the public and then give the ltc's response unless i maybe
[3:09:40] we don't we have to make a politically correct decision all
[3:09:44] Trustee Luckham (probable): the way we didn't just say that
[3:09:48] Trustee Elliott: okay so we'll reconsider this at our november 4th meeting okay okay sounds good
[3:10:02] Trustee Elliott: Now we move on to reports. We do have one piece of business, consideration of Trust
[3:10:12] Trustee Elliott: Council by-law, well actually, sorry, do you want to introduce this? I mean I could do
[3:10:16] Trustee Elliott: it because I've seen it a couple of times
[3:10:18] Voice 13: before. You might be
[3:10:19] Trustee Elliott: welcome to. Okay. So
[3:10:23] Trustee Elliott: June, Trust Council approved a new local trust committee meeting procedures
[3:10:29] Trustee Elliott: procedures by-law, which supersedes all the local LTC meeting procedure by-laws.
[3:10:37] Trustee Elliott: There are no significant changes from Thetis' LTC by-law.
[3:10:42] Trustee Elliott: I think it's one of the more recent ones.
[3:10:46] Trustee Elliott: And so it just formalizes that across all the LTCs.
[3:10:53] Trustee Elliott: But we do have to do a bit of business with a repeal by-law.
[3:10:57] Trustee Elliott: so for consideration and decision today is a repeal by law number 116.
[3:11:04] Trustee Luckham (probable): So you're okay with this, Ken?
[3:11:05] Trustee Luckham (probable): Yes, I am.
[3:11:06] Trustee Luckham (probable): So I'm going to move that the Thetis Island Local Trust Committee
[3:11:08] Trustee Luckham (probable): give by law 116 side of the Thetis Island Local Trust Committee
[3:11:11] Trustee Luckham (probable): meeting procedures repeal by law number 116-2025 first reading.
[3:11:17] Trustee Elliott: Moved.
[3:11:18] Trustee Elliott: I have a seconder.
[3:11:18] Trustee Elliott: Seconded by Trustee Hunter.
[3:11:20] Trustee Elliott: All those in favor?
[3:11:21] Trustee Elliott: Aye.
[3:11:22] Trustee Elliott: That is carried.
[3:11:23] Trustee Luckham (probable): I move that the Thetis Island Local Trust Committee
[3:11:25] Trustee Luckham (probable): Committee by-law 116, cited as Thedas Island Local Trust Committee, meeting procedures
[3:11:29] Trustee Luckham (probable): repeal by-law number 116, 2025. Second reading. Moved. Seconded by Trustee Hunter. All those
[3:11:36] Trustee Luckham (probable): in favor? Aye. That is carried. I move that Thedas Island Local Trust Committee by-law
[3:11:40] Trustee Luckham (probable): 116, cited as Thedas Island Local Trust Committee by-law, meeting procedures by-law number 116,
[3:11:46] Trustee Luckham (probable): 2025. You need to repeat the repeal. You skipped the repeal. I thought we did repeal by-law
[3:11:52] Trustee Luckham (probable): bylaw 116-2025, third reading.
[3:11:55] Trustee Luckham (probable): Thanks.
[3:11:55] Trustee Luckham (probable): Okay.
[3:11:56] Trustee Elliott: Second.
[3:11:57] Trustee Elliott: Seconded.
[3:11:57] Trustee Elliott: All those in favor?
[3:11:59] Trustee Elliott: All right.
[3:11:59] Trustee Elliott: That is in favor.
[3:12:00] Trustee Elliott: Thank you.
[3:12:01] Voice 5: I'll let you do the last one.
[3:12:03] Voice 5: I move that the Asylum and Local Trust Committee
[3:12:05] Voice 5: forward bylaw 116,
[3:12:07] Voice 5: cited as the Asylum and Local Trust Committee
[3:12:10] Voice 5: repeal bylaw number 116-2025
[3:12:13] Voice 5: to the Island's Trust Executive Committee
[3:12:16] Voice 5: for consideration of approval.
[3:12:18] Trustee Elliott: Second.
[3:12:19] Trustee Elliott: Seconded.
[3:12:20] Trustee Elliott: All those in favor?
[3:12:21] Trustee Elliott: All right.
[3:12:22] Trustee Elliott: And that is carried.
[3:12:23] Trustee Elliott: Perfect.
[3:12:24] Trustee Elliott: Excellent.
[3:12:26] Trustee Elliott: Thank you.
[3:12:27] Trustee Elliott: So there is a Trust Conservancy Board report dated May 27th.
[3:12:35] Trustee Elliott: Does B&S Almond have a fall fair or some kind of event in the fall?
[3:12:42] Voice 9: We've had fall fairs.
[3:12:44] Voice 9: We haven't had it in a couple of years.
[3:12:47] Voice 9: A fall event.
[3:12:48] Voice 9: I'm trying to think of a fall event that didn't, and I don't, doesn't cross my mind.
[3:12:55] Trustee Elliott: Okay. Well, the Conservancy's always looking for an opportunity to share the news that it's our 35th anniversary celebration.
[3:13:03] Trustee Elliott: So I'll just point everybody to the website.
[3:13:06] Trustee Elliott: They could apply
[3:13:06] Trustee Luckham (probable): to the Tejas Island Forum for an opportunity as a delegation.
[3:13:09] Trustee Luckham (probable): Oh, the Forum.
[3:13:11] Voice 9: That's what we do.
[3:13:11] Voice 9: John Gerstle, And we have kind of a speaker series that we put on in conjunction with soups on.
[3:13:19] Voice 14: John Gerstle,
[3:13:20] Voice 9: So we
[3:13:21] Trustee Luckham (probable): have advertised themselves as a connector guy would suggest that we connected.
[3:13:27] Trustee Luckham (probable): John
[3:13:27] Voice 9: Gerstle, If you if you want an event you me yeah.
[3:13:30] Trustee Elliott: Okay. Great. Applications report. So seeing the rezoning on there. Let's see. Subdivision one is...
[3:13:48] Voice 13: Okay. So I don't have any questions about either of those.
[3:13:51] Trustee Elliott: Okay.
[3:13:53] Voice 13: Work in progress.
[3:13:54] Trustee Elliott: our islands trust expenses very affordable well done and our committee policies and

[3:14:45] Trustee Elliott: Yeah, no, we have a project. Okay. Any further business? No,

5. PUBLIC COMMENTS
A member of the public spoke to late correspondence submitted to the Local Trust
Committee and asked the following questions:
• How can one get questions or correspondence included in the minutes;
• Has there been any change in status on the Abrupt Shellfish crown lease;
• How will bylaw enforcement know if there is any activity at the aquaculture site;
• Will the new Trust Policy Statement prevent an aquaculture license from being issued in
the future without the agreement of Islands Trust;
• Will a representative of the Local Trust Committee attend future Thetis Community
Assembly meetings;
• Why is the taxpayer’s perspective not included as part of the draft Trust Policy
Statement; and
• Are there any risk management policies in the Trust Policy Statement, for example does
Islands Trust have a contingency plan if the federal government includes the Port of
Vancouver in fast tracking infrastructure development?
The following comments and clarifications were provided by staff and members
of the Local Trust Committee:
o Questions and comments can be sent directly to the Local Trust Committee,
a member of the public can ask questions during the public comment
session during a meeting or request to present as a delegation, and
correspondence can be included in an agenda package if it is received prior
to agenda deadlines in advance of a meeting;
o The Abrupt Shellfish license of occupation is a jurisdictional matter, any
potential dispute between a provincial ministry and Islands Trust is
addressed through the protocol agreement, and members of Executive
Committee are meeting with the Minister of Lands, Forests, and Natural
Resources at the Union of BC Municipalities conference to discuss the
disposition of Crown lands;
o Bylaw Compliance and Enforcement staff are monitoring the Abrupt
Shellfish operation;
o The language in the draft Trust Policy Statement and provincial regulations
indicate aquaculture must be compliant with local zoning and the protocol

agreement with the province is the mechanism to dispute the decision to
grant a license;
o Islands Trust regulates land use and taxpayers are represented as residents;
o The Trust Policy Statement is not an interagency agreement but a guiding
principles document.
A member of the public spoke to the Nature of Water event and the following comments
were noted:
• The event attracted over 100 attendees;
• A meeting has been scheduled with Cowichan Valley Regional District Environmental
Services to discuss updates on the 2020 water strategy developed by the district;
• Islands Trust, regional districts, the Province, and community agencies will need to work
together to develop solutions to water-related issues;
• There are no test wells on Thetis Island, many local residents are willing to participate in
data collection, and some residents are already monitoring rain water collection;
• Data collection and analysis are critical and there needs to be an educational process
regarding water issues;
• They will be seeking resources from Islands Trust as they develop a working group.
A Trustee stated the Cowichan Valley Regional District had previously indicated
a test well existed at the time they presented the financial request to Thetis
Island with respect to the water strategy work, the Local Trust Committee is
looking at potential requirements for rainwater catchment for new construction
builds, and the Islands Trust Freshwater Specialist might be able to provide
resource information.

Local Trust Committee Minutes

Staff clarified the meeting scheduled during Union of BC Municipalities conference
was being held with the Minister of Lands, Forests, and Natural Resources.
Discussion was undertaken regarding the focus of the meeting and the following
comments and clarifications were noted:
• The topic of the meeting is the crown lease referral process that led to a license
of occupation being granted despite the Local Trust Committee highlighting the
operation is contrary to local bylaws;
• The Executive Committee has requested staff to review the letter of agreement
with the ministry and subsequent discussion will focus on willingness to update
the agreement and address issues related to respecting local government
bylaws and regulations;
• The concerns identified include upholding Local Trust Committee land use
bylaws and potential lack of meaningful engagement with First Nations
regarding issuance of an aquaculture license;
• The Bylaw Compliance and Enforcement Manager noted a letter was sent to the
license holder who has stated they are not willing to recognize local government
jurisdiction over the matter.
The meeting was recessed for a break at 10:44 a.m. and reconvened at 10:54 a.m.

9. APPLICATIONS AND REFERRALS
9.1 PL-RZ-2025-0072 (Welsh FAEC) - Preliminary Staff Report
The planner summarized the staff report and highlighted the following:
• The rezoning application seeks to amend the Land Use Bylaw by rezoning
portions of the Rural Residential (R-1) and Water 4 (W4) zones to site-specific
shoreline protection zones to facilitate installation of nature-based shoreline
protection to decrease shoreline erosion;
• The existing dwelling at 83 Blue Herron Road is approximately 5 metres from the
natural boundary and an existing 18-metre-long concrete seawall and set of
concrete beach access stairs are located along the southern shoreline adjacent
to the dwelling;
• The design incorporates a “Green Shores” approach to shoreline protection and
would involve depositing approximately 40-50 truckloads of natural materials
and the shoreline would then be replanted with native plants and monitored for
up to three years;
• The applicant has submitted a number of professional reports in support of their
application.
The applicant was in attendance and spoke to the application.
Discussion ensued and the following comments and were noted:
• Trustees are generally in support of the project;
• The initial seawall was built in 1954 which indicates ongoing erosion and the
Green Shores approach offers a way in which natural land habitat can be
protected;

• There are potential challenges in asking the applicant to provide a final
Construction Environmental Plan prior to approval of the application;
• The Local Trust Committee could request the Construction Environmental Plan,
list of mitigation, adaptation, and avoidance measures, and a site plan be
provided prior to public hearing, or another time, instead of prior to First
Reading;
• There is a draft Construction Environmental Plan and the final plan does not
necessarily need to be provided until later in the process;
• In order to learn about the Lyackson First Nation and Penelakut Tribe’s level of
interest and potential involvement, a summary report with a response deadline
could be provided as part of early engagement;
• The Planner confirmed Lyackson First Nation and Penelakut Tribe staff have
received early engagement information from staff in May and August;
• The Local Trust Committee wishes to uphold the protocol agreement and
ensure First Nations have every opportunity to provide an early engagement
response.
