[0:00:21] Voice 12: I want to begin the meeting by acknowledging that we are grateful to be able to live, work,

[0:00:28] Voice 12: and gather today in locations across the traditional territory of Coast Salish peoples.

[0:00:33] Voice 12: The nations with interest in this local trust area include Penelope Trotter and the Accent

[0:00:38] Voice 12: First Nation.

[0:00:39] Voice 12: We are grateful to the nations for their continued stewardship and relationship to these lands

[0:00:44] Voice 12: and waters, as well as for engaging with us as we learn how to co-steward and co-manage.

[0:00:52] Voice 12: I want to offer my congratulations, and I'm sure on behalf of the LTC, to Cowichan Nations

[0:00:59] Voice 12: for the victory in the BC Supreme Court in the decision to uphold the nation's rights

[0:01:06] Voice 12: to Teotihuacan's lands, the river, and Cowichan's hereditary fishing rights.

[0:01:14] Voice 12: The recognition of Cowichan Nations, which of course includes Cowichan tribes, Seneas,

[0:01:20] Voice 12: Connecticut, Palo Alto, and L'Aix and Fitch Nations,

[0:01:25] Voice 12: recognizes Cowichan Nation's presence and long-standing connection to the south arm of the Cowichan River,

[0:01:31] Voice 12: which is now known as the Fraser River South Arm,

[0:01:34] Voice 12: where their ancestors lived, fished, and thrived for generations.

[0:01:40] Voice 12: After more than 150 years of struggles since the land was taken from Cowichan during the colonial era,

[0:01:45] Voice 12: It is wonderful to see this ruling affirm their constitutionally protected right and title.

[0:05:27] Trustee Luckham (probable): in fact um here we are today um uh i think probably the one significant that i did as

[0:05:37] Trustee Luckham (probable): an individual not so much as the ltc was attend the um the um the it's all the name of it actually

[0:05:47] Trustee Luckham (probable): on august the uh first the event in in germany it was uh remembering the children a recognition

[0:05:54] Trustee Luckham (probable): recognition of the children, extremely well attended by members of the public and significant

[0:06:02] Trustee Luckham (probable): presentations by a number of people from across the province, including the person whose name

[0:06:11] Trustee Luckham (probable): is Gation at the moment that started the Orange Shirt Day movement, and humbling, and I was

[0:06:23] Voice 7: I was glad to be able to sit and be witness to them,

[0:06:26] Voice 7: those who presented and those who were there.

[0:06:33] Voice 7: Otherwise, it's been relatively fine.

[0:06:37] Voice 5: Yes, and for me, obviously, very quiet on CEDIS

[0:06:40] Voice 5: during the summertime, except very, of course.

[0:06:45] Voice 5: I did read a book by Bruce MacGyver

[0:06:48] Voice 5: called Reconciliation in One Minute,

[0:06:51] Voice 5: and he was citing 200 or 300 different court cases

[0:06:57] Voice 5: has shaped what is now becoming reconciliation and in the back of his book he had a place there

[0:07:05] of course we could email him if we had questions so then the telephonic

[0:07:09] Voice 5: decision came down and so

[0:07:11] Voice 5: i emailed him i said what do you think of that one he forwarded back and said well my colleague

[0:07:19] Voice 5: kate dunn wrote a piece on that and he referred me to it and very very interesting so

[0:07:36] Voice 12: Yeah, I do follow Bruce McIver's work, and he publishes a regular blog with a big summary of case results and decisions.

[0:07:54] Voice 12: Okay, so for my chair's report, I was very pleased to attend the Phoebus Island Water Fair on July 27th.

[0:08:06] Voice 12: I was here just for the one day and presented as part of a panel some of the updates on the Islands Trust water work,

[0:08:16] Voice 12: specifically with a focus on Gabriola and how the freshwater, the groundwater

[0:08:25] Voice 12: analysis is potentially going to result in OCP policies. We have not yet received the

[0:08:32] Voice 12: consultant's report but it is coming imminently and so how that works with our OCP review will

[0:08:38] Voice 12: really be a model, I think, for other local capital areas to follow. So it's very important

[0:08:45] Voice 12: work and I was very grateful to be included and invited.

[0:08:52] Voice 12: June 3rd was our last meeting here on data, so it's been quite a time. I guess significant

[0:09:00] Voice 12: items is that there was a cabinet shuffle. I think folks, Van Heert, Minister Ravi Kalon

[0:09:06] Voice 12: is no longer our Minister of Municipal Affairs and in fact the day that the

[0:09:11] Voice 12: Catalan Shuffle was announced, Executive Committee was to have a meeting with

[0:09:15] Voice 12: Minister Calon and that was of course cancelled. So now Christine Boyle is our

[0:09:21] Voice 12: Minister and we have a meeting scheduled for September 15th and sort of an update on

[0:09:26] Voice 12: where Owens Cuts is at, we've established a relationship and I think she's keenly

[0:09:32] Voice 12: be interested in following along our going-ons. We do have Trust Council coming up on Gabriela

[0:09:41] Voice 12: Island in September. That is in 16, 17, 18. We're just reviewing the agenda for Executive

[0:09:53] Voice 12: Committee tomorrow. And I'll note for folks that are interested in sort of management

[0:09:59] Voice 12: and operational reviews and efficiency, our CAO has a really good, our Chief Administrative

[0:10:09] Voice 12: Officer's report has some highlights about the corporate planning process framework and

[0:10:16] Voice 12: the updates moving forward with that.

[0:10:19] Voice 12: There's been quite a bit of work, which our new CAO jumped in with both feet really and

[0:10:26] Voice 12: and undertook an operational review starting to be in the springtime and at the June meeting

[0:10:32] Voice 12: Islands Trust staff participated in an exercise to share their perspectives and opportunities

[0:10:37] Voice 12: to improve operational process, practices and policies.

[0:10:41] Voice 12: So those two pieces, the operational review as well as the corporate planning process

[0:10:47] Voice 12: framework, really will probably be the areas that will provide the most information on

[0:10:55] Voice 12: on our updating, modernizing some of our processes.

[0:10:59] Voice 12: So for those of you interested in that, please do follow.

[0:11:04] Voice 12: And one other item of note, the Governance Committee recommendations,

[0:11:08] Voice 12: there's going to be a substantial discussion on that at the U.S. Council.

[0:11:13] Voice 12: There's quite a number of recommendations coming out of the Governance Committee work.

[0:11:18] Voice 12: A few of the recommendations from the 2022 Governance Report are prioritized,

[0:11:23] Voice 12: and they're asking the council to, well, we're going to debate it and basically get some permission.

[0:11:32] Voice 12: And then following trust council is UBCM.

[0:11:35] Voice 12: So the Union of BC Municipalities annual convention is going to be held in Victoria this year,

[0:11:40] Voice 12: the 22nd to the 26th.

[0:11:43] Voice 12: I'll be attending along with our chair, Laura Patrick, and our vice chair, Peterson,

[0:11:50] Voice 12: along with two staff.

[0:11:51] Voice 12: and you have I know how many times can I go to a meeting without mentioning tiny

[0:11:59] Voice 12: homes I don't know if I ever have but the RDN Regional District of Long Island

[0:12:06] Voice 12: director Vanessa Craig put together a seminar proposal on the findings from

[0:12:12] Voice 12: our tiny homes project which was a joint project between the RDN and Long Island's

[0:12:17] Voice 12: Trust, although I'm just paid for it. And it was accepted six

[0:12:23] Voice 12: out of over 100 submissions, one of six. So we will be presenting

[0:12:28] Voice 12: on the Tuesday morning, a one hour seminar and sort of a ton

[0:12:31] Voice 12: of discussion with those findings. And it's quite an

[0:12:34] Voice 12: exciting time there. Well, I think that's it for me. That's a

[0:12:37] Voice 12: lot of overview. So we have no electoral area directors report

[0:12:46] Voice 12: unless, is Jesse here today?

[0:12:49] Voice 12: We got some participants.

[0:12:55] Voice 12: An Honest Trust Conservancy report.

[0:12:57] Voice 12: There is an update in this agenda.

[0:13:00] Voice 12: And I will just say that we are celebrating our 35th

[0:13:03] Voice 12: anniversary this year.

[0:13:06] Voice 12: Very thankful for the work of the Think Conservancy

[0:13:10] Voice 12: that you do.

[0:13:12] Voice 12: And I just want to say how critical the partnerships

[0:13:14] Voice 12: are with the local Conservancy group.

[0:13:16] Voice 12: So I'm always happy to field or direct materials if anybody wants to contact me about conservancy stuff on that board.

[0:16:34] Voice 12: you have correspondence that you want to appear on the agenda so this agenda came out august 26

[0:16:39] Voice 12: which i think is the date that your correspondence was sent but typically we need to receive it

[0:16:46] Voice 12: before you know as the agenda is getting put together so september 2nd 26th basically if

[0:16:54] Voice 12: we receive it by the Friday before, like the 22nd, then it can be included. Pardon me, yes, and for

[0:17:01] Voice 12: items that you'd like to be in correspondence with on the agenda itself. That's correct.

[0:17:08] Voice 12: Okay, thank you. But we can't retroactively add material to the minutes, but you can speak to it

[0:17:13] Voice 12: as we hope you will do right now. And to clarify, we do, for any correspondence that comes in after

[0:17:32] Voice 11: yeah so my questions are around the abrupt shellfish license and my first question is

[0:17:40] Voice 11: there been any change in the status since the provincial minister approved that license

[0:17:46] Voice 11: And I guess where I'm heading is, how will you know, how will our compliance officers

[0:17:52] Voice 11: know if something starts happening in Creedy Harbour, or will it just be word of mouth,

[0:17:59] Voice 11: or is there some way of monitoring that?

[0:18:03] Voice 12: I don't have an update from our by-law enforcement manager.

[0:18:07] Voice 12: They are watching everything closely.

[0:18:11] Voice 12: But I guess there's two parts to your question.

[0:18:14] Voice 12: the the matter of jurisdiction and any potential dispute between the minister of water and lands

[0:18:26] Voice 12: and islands trust we would work through the protocol agreement and there has been no meetings

[0:18:34] Voice 12: to date on that however we did an ask for a meeting at ubcm and we got one with the ministry

[0:18:41] Voice 12: of water lands and resources and it is to talk about crown lands and the disposition of crown

[0:18:48] Voice 12: lands and um my intention is to speak strongly for the islands trusts um interests that they

[0:18:56] Voice 12: not be overridden by provincial um priorities if it's to come up against the preserve and protect

[0:19:04] Voice 12: mandate we will have to engage with them over any dispute over the interpretation

[0:19:13] Voice 12: of that

[0:19:14] Voice 13: that's

[0:19:16] Voice 12: at UBCM so it's a meeting with the minister and perhaps one of the

[0:19:21] Voice 12: staff and I've asked for an update from our senior staff but they're in a

[0:19:24] Voice 12: management meeting this morning so nothing I don't think there has been any

[0:19:29] Voice 12: um back and forth on the protocol agreement as far as i understand through the chair

[0:19:37] Voice 12: i don't have any updates to share i have heard that there's nothing been happening but

[0:19:44] Voice 12: eyes and ears on the water would be and if you see anything you can circulate it to your local

[0:19:50] Voice 12: trustees and they'll go forward to staff okay

[0:19:54] Voice 11: my third question uh relates to the it policy

[0:19:58] Voice 11: Policy Statement 3.5.19, and it's quoted in my, I'm not going to read it all out, it's quoted there, point number three.

[0:20:07] Voice 11: It did put in bold areas that are recreational significance, which I would think community harbors would probably qualify for that.

[0:20:19] Voice 11: So does this, do you think that this new policy will prevent a license like aquaculture in the future?

[0:20:30] Voice 12: Do you want to take that one?

[0:20:32] Voice 12: I

[0:20:33] Trustee Luckham (probable): have a bunch of questions for you, actually, in the perspective of the Executive Committee regarding this topic.

[0:20:38] Trustee Luckham (probable): And so I'll reserve some of my comments for that. But having provided the opportunity, one, I completely agree with you.

[0:20:46] Trustee Luckham (probable): however the language that is here that may be slightly different than what the language is

[0:20:54] Trustee Luckham (probable): in our policies existing policy statement and in the existing protocol that we have with our

[0:21:00] Trustee Luckham (probable): ministry that and even provincial regulation that indicates that a land use or in this case

[0:21:08] Trustee Luckham (probable): and agriculture use must be compliant with local zoning

[0:21:14] Voice 15: it is not

[0:21:16] Voice 15: what's

[0:21:18] Trustee Luckham (probable): the problem and so this is

[0:21:20] Trustee Luckham (probable): a very serious conversation with not only our new minister but with also with the minister

[0:21:26] Trustee Luckham (probable): of environment because i think our minister needs to support the land use regulations that are in

[0:21:31] Trustee Luckham (probable): place so i don't you know i don't know that any new policy statement is going to make

[0:21:38] Trustee Luckham (probable): any change to the interpretation or actions of a provincial body which i can say is objectionable

[0:21:50] Trustee Luckham (probable): and i certainly hope that we will be able to take a stance in this the island's trust

[0:21:55] Trustee Luckham (probable): because it's not just the theater's island trust area it affects the entire trust very important

[0:21:59] Trustee Luckham (probable): So

[0:22:00] Voice 12: your comments on the draft policy statement would be most welcome at this point.

[0:22:07] Voice 12: We are now engaging in a six-month period with communities, with the LTC.

[0:22:12] Voice 12: That's one of the items on our agenda is to give comment on this.

[0:22:16] Voice 12: And the LTC would probably want to, on the basis of this one event,

[0:22:22] Voice 12: to give a strongly worded recommendation that those policies should be um um should well be

[0:22:30] Voice 12: supported respect from from what i can see the yeah 3.5.19 so right now this is a draft

[0:22:37] Voice 12: um but we want to hear what people think and so but the other piece is that the policy statement

[0:22:44] Voice 12: informs how your ocp is developed right and so um it just would direct that we must direct

[0:22:55] Voice 12: commercial agriculture tenures to appropriate locations which we did we don't have jurisdiction

[0:23:00] Voice 12: over this disposition of crown land which is where the conflict is coming in right now right so i

[0:23:07] Voice 12: think this policy statement draft is very strong we'd love to hear your comments on it um but again

[0:23:13] Voice 12: Again, it's that interagency dispute.

[0:23:17] Voice 11: Okay, so my next question, I'm going to move on,

[0:23:22] Trustee Luckham (probable): just want to comment, because it hasn't been mentioned,

[0:23:24] Trustee Luckham (probable): and I'll just look for confirmation that at our November 9th meeting, we will be having a formal opportunity for comment on the policy statement

[0:23:35] Trustee Luckham (probable): as part of the scheduled public consultation process.

[0:23:39] Trustee Luckham (probable): So that would be kind of the end of that process in November the 4th, I think it was.

[0:23:45] Trustee Luckham (probable): Yeah, I'm getting nods there. So make sure that you've got that material and comments in for us by then.

[0:27:03] Voice 11: Islands Trust. It just seems to me such a perfect opportunity when you've got the community in the

[0:27:13] Voice 11: room for Islands Trust to have a voice and we hear what's going on. That's where I started this

[0:27:23] Voice 11: this question around aquaculture set the assemblies.

[0:27:28] Voice 11: So I'm just suggesting that.

[0:28:19] Voice 12: the stress regulates land use and so taxpayers are representative they are presented

[0:28:45] Voice 11: start with the Chief Administrative Officer's review. Maybe that'll answer some of my questions,

[0:28:53] Voice 11: but you know perspectives like how does this government relate to other levels of government

[0:29:00] Voice 11: in terms of effectiveness in implementing their policies. Another whole line of thinking is

[0:29:10] Voice 11: contingency planning. Like if there's a disaster, an environmental disaster,

[0:29:16] Voice 11: this Islands Trust has policies in place. Another example that comes to mind is we've got the

[0:29:24] Voice 11: federal government saying they're going to fast track infrastructure projects. They've already

[0:29:31] Voice 11: when you started with ports on the eastern side of Canada,

[0:29:37] Voice 11: it's the contingency of the government

[0:29:40] Voice 11: that decides that they're going to greatly expand

[0:29:42] Voice 11: the port of Vancouver.

[0:29:43] Voice 11: And what's that going to do to the sailing sea?

[0:29:46] Voice 11: So those are all kind of things

[0:29:50] Voice 11: that kind of represent what the taxpayer is wanting.

[0:29:55] Voice 11: But I didn't see any of that in there.

[0:29:57] Voice 12: It wouldn't be captured in the policies.

[0:30:00] Voice 12: statement the policy statement is a very specific bylaw that directs what needs to be included in

[0:30:07] Voice 12: each community's official community plan it is not um a an interagency agreement

[0:30:17] Voice 12: if we were talking emergency services that would be the couch and regional districts

[0:30:25] Voice 12: district's realm because they have services and how the honest trust engages with

[0:30:31] Voice 12: powhatan district would be i'm trying to think of an example from my local area can you

[0:30:45] Trustee Luckham (probable): saying and you portrayed the picture very well actually i think i think to kind of summarize it

And there are other policies that exist within the Islanders Trust that facilitate that, particularly those policies that guide the financial planning committee and that how they make decisions and allocation and recognition of communities, et cetera, is covered in those policies.

[0:31:16] Trustee Luckham (probable): And what you picked up on there as a good example is an emergency continuation of business, emergency measures process.

[0:31:24] Trustee Luckham (probable): In fact, we did that at the beginning of the pandemic.

[0:31:30] Trustee Luckham (probable): Measures that exist within policy to provide for continuity of a business plan was invoked by the CAO.

[0:31:38] Trustee Luckham (probable): And I would say, actually, I congratulate Russ Hotson-Pillar

[0:31:42] Trustee Luckham (probable): on a very successful management of a continuation of business plan

[0:31:46] Trustee Luckham (probable): for the Ops Trust during very, very difficult times.

[0:31:50] Trustee Luckham (probable): You know, I'll just say moving 50 people to work at home, for instance,

[0:31:54] Trustee Luckham (probable): and ensuring telephones and internet and computers were accessible

[0:31:58] Trustee Luckham (probable): to allow people to work in that space.

[0:32:00] Trustee Luckham (probable): And, of course, now we're transitioning back into that space

[0:32:46] Voice 12: end as we do need to update it there will be an implementation plan and so when for instance you

[0:32:53] Voice 12: look at directive policies for managing growth and development community facilities and services

[0:32:58] Voice 12: Like how is that to be implemented is going to be very specific to each local trust committee. Each community has evolved very differently, has a different relationship with the regional district of whatever regional district there and other agencies.

[0:33:13] Voice 12: So it's the implementation of it that will guide how all those different services work together.

[0:33:20] Voice 12: But that is not, it's not a fit in those overall policies.

[0:33:24] Voice 12: Those overall policies are supposed to be very broad and embracing.

[0:33:28] Voice 12: And what are we preserving and protecting, essentially?

[0:35:20] Voice 9: the amount of people that went to the site visits was amazing um and they're all covering different

[0:35:26] Voice 9: Doug had the compostable toilets, we had a water collection from Alex, an amazing system he has.

[0:35:36] Voice 9: Went to Matthias and learned about his water collection systems and got to look at his crazy house again too.

[0:35:47] Voice 9: If you have never seen this crazy house, you should go there.

[0:35:52] Voice 9: And so I just wanted to pull that, put that article that she wrote better than I could and throw that in.

[0:36:03] Voice 9: The next part is kind of like the next steps, right?

[0:36:07] Voice 9: And we had like over a hundred people.

[0:36:12] Voice 9: The island doesn't have a large population, so a hundred.

[0:36:16] Voice 9: and a lot of those people were

[0:36:18] Voice 9: visitors. I'm not necessarily saying that

[0:36:20] Voice 9: it's a thing, but we were definitely

[0:36:25] Voice 9: a large number

[0:36:27] Voice 9: you could say a quarter of the

[0:36:30] Voice 9: population if you wanted to

[0:36:33] Voice 9: of the

[0:36:34] Voice 9: people attended one of the

[0:36:36] Voice 9: seven events.

[0:36:45] Voice 9: It became clear that this was, we had a fellow that came from Calgary, didn't even have a home here, but was thinking of getting a home, flew from Calgary on Friday night, attended the events, and flew back to Calgary Sunday night.

[0:37:06] Voice 9: It's, and so it's something that we did, and then as we get there, we feel like we just really just scratched the surface.

[0:37:14] Voice 9: So, a few of us have gotten together, and Mike Harris is very leading on the science on this,

[0:37:24] Voice 9: because I know this talk with Mike Harris knows that he's water systems and things,

[0:37:33] Voice 9: he can talk until it hurts, and he would be here, except he's in Newfoundland,

[0:37:41] Voice 9: the fact there's a lot of people that would be here, but when I invited them they basically

[0:37:46] Voice 9: reminded me that they also have a life. But following the meeting I reached out to

[0:37:53] Voice 9: people I know with the CBRD Environmental Services and we were able to schedule a meeting with

[0:38:02] Voice 9: I'm not sure of his name, Galen McMann and he works with them and he's working on their water

[0:38:09] Voice 9: water strategy right now. In fact, the water strategy was set in 2020 that they did, and

[0:38:19] Voice 9: so now we're in 2025. And a lot of it had to do with the rivers and streams and such.

[0:38:29] Voice 9: So I kind of felt like I was the person that goes with the tags for your shoes or whatever,

[0:38:38] Voice 9: where they show up and you say,

[0:38:40] Voice 9: oh, I'm ready to choose.

[0:38:41] Voice 9: Oh, yes, we're just thinking of you

[0:38:44] Voice 9: and they'll be ready next week.

[0:38:45] Voice 9: So when seeing Galen,

[0:38:47] Voice 9: yes, we were thinking of you,

[0:38:49] Voice 9: we're coming right up to it,

[0:38:51] Voice 9: is what his view was.

[0:38:54] Voice 9: Though fair enough to him,

[0:38:56] Voice 9: he has been already reaching out

[0:38:57] Voice 9: to the Analysts Trust

[0:39:04] Voice 9: was that this is a multi-government thing.

[0:39:06] Voice 9: uh thing i wanted to thank you for your presentation as well it was a it was a very

[0:39:10] Voice 9: very helpful and and it started us along with reed but it it's multi multi-level

[0:39:17] Voice 9: thing so that's uh the islands trust the regional district the provincial government and also

[0:39:24] Voice 9: some other community agencies are all going to be part of the solution

[0:39:30] Voice 9: What we have identified is that there are an awful lot of people that are willing to participate on that.

[0:39:39] Voice 9: One of the simple things is the test wells. There are no test wells.

[0:39:48] Voice 9: Some people talk about there may be some. The CDRD knows of none.

[0:39:54] Voice 9: There is one.

[0:39:56] Voice 9: The alien doesn't know it.

[0:39:58] Voice 9: Okay.

[0:40:01] Voice 9: But the fact that it's aware of the data, when is it getting tested is the question then.

[0:40:08] Voice 9: If you're a test well that never tested, is it a tree in a forest?

[0:40:11] Voice 9: for it um um and so uh the uh the question is we have people i think uh uh people in this room

[0:40:21] Voice 9: have volunteered to have their wells watered on top of that we have already had a rainwater

[0:40:27] Voice 9: collection uh being monitored um by uh keith rush but keith rush and four or five other people

[0:40:35] Voice 9: are monitoring the rainwater collection um we have so we uh we have a lot of on the ground

[0:40:45] Voice 9: readiness for this for this project um and we just so this coming here is just to make sure

[0:40:53] Voice 9: um that we are staying top of mind right is that because uh and we're we're um mike harris and i

[0:41:03] Voice 9: our meeting with the CDRE again. We're having a face-to-face meeting in the end of September

[0:41:10] Voice 9: with them to talk about their plan. And then I met with Pam Kooling from

[0:41:18] Voice 9: Debra Poporowski's office to talk about provincial government participation as well.

[0:41:23] Voice 9: And so this thing's all starting to roll down the hill. And I just mostly want to

[0:41:34] Voice 9: keep in mind the two things are that the data collection and the data analysis is not well

[0:41:39] Voice 9: there's an awful lot of data collection that's gone all that has never been analyzed which is

[0:41:46] Voice 9: the way it's not really that helpful but the data collection and data analysis is one side of it

[0:41:52] Voice 9: the other side is i've been speaking for the people in this room there's an awful lot of us

[0:42:00] Voice 9: that water understanding is top of mind,

[0:42:05] Voice 9: but it's not top of mind for everybody

[0:42:08] Voice 9: that comes to the island

[1:24:26] Voice 12: And yes, I contemplated whether or not to attach all of the submitted documents,

[1:24:32] Voice 12: but it's what we do for preliminary staff reports,

[1:24:35] Voice 12: present all the information that was provided to us, so we did our best.

[1:24:40] Voice 12: Yeah, so the purpose of this preliminary report is to provide information regarding the rezoning

[1:24:46] Voice 12: application and to seek direction from the LTC on next steps.

[1:24:52] Voice 12: The application as submitted would amend the Thetis Island land use by-law 2011 by rezoning

[1:24:59] Voice 12: portions of the rural residential or R1 and Waterford zones to site-specific shoreline

[1:25:06] Voice 12: protection zones to facilitate the future installation of a nature-based shoreline

[1:25:11] Voice 12: protection project, or Green Shores for Homes project, to protect the land and the existing

[1:25:17] Voice 12: buildings and structures on the upland property from shoreline erosion, future shoreline erosion.

[1:25:24] Voice 12: The project site is located north of the French Channel called the Comet, connecting

[1:25:29] Voice 12: a clam bay to the west side of the East Island and through printed wrestling vessels.

[1:25:33] Voice 12: vessels. The project location is relatively sheltered from the Salish Sea by Kalyani and

[1:25:39] Voice 12: Valdez Islands and is southwest of Saltmarsh Wetland and Coastal Swift. The subject properties

[1:25:46] Voice 12: at 83 and 84 Blue Marin Road have existing residential buildings which were constructed

[1:25:52] Voice 12: between the 1950s and 1970s. Both properties have had the same owner since 2016 who are

[1:25:59] Voice 12: presently here and we reside at number 83 Blue Heron Road and rent out the second property at 84.

[1:26:08] Voice 12: The owners intend to undertake renovations to the existing dwelling at 83 Blue Heron Road in

[1:26:15] Voice 12: the future. The existing dwelling is approximately five meters from the natural boundary hence their

[1:26:22] Voice 12: desire to protect the remaining bank from erosion. Also an existing 18-meter long concrete seaball

[1:26:29] Voice 12: which was installed in approximately 1954, as well as a set of concrete beach access stairs

[1:26:35] Voice 12: are located along the southern shoreline adjacent to the dwelling. If approved, the application

[1:26:43] Voice 12: would permit the installation of a nature-based shoreland protection project along the shore

[1:26:47] Voice 12: and up to 10 meters seaward from the tidal boundary, including burying that existing

[1:26:53] Voice 12: concrete seawall. The total proposed shoreline protection area is 237 meters squared approximately

[1:27:01] Voice 12: in the upland slope portion and 1,410 meters square along the foreshore area.

[1:27:09] Voice 12: And in that 10 meters seaward installation would involve depositing approximately 40 to 50

[1:27:16] Voice 12: truckloads of materials including beach management, including sand and gravel, some cobble structures,

[1:27:24] Voice 12: some larger boulders, and attaching a large variety strategically.

[1:27:30] Voice 12: The shoreline would then be replanted with a variety of native plants

[1:27:34] Voice 12: and monitored for up to three years to ensure successful ecological rehabilitation.

[1:27:41] Voice 12: As you can see, there were many reports submitted, professional reports submitted

[1:27:45] Voice 12: in support of the application, and they were found in attachments 4 to 10 of the staff report.

[1:27:51] Voice 12: One

[1:27:53] Voice 13: more place to add.

[1:27:58] Voice 13: So

[1:28:04] Voice 12: that recommend the applicant provide a clear list of all construction, installation

[1:28:09] Voice 12: and maintenance recommendations, as well as a list of all environmental protection measures,

[1:28:15] Voice 12: including the specific best management practices and mitigation, adaptation and avoidance measures

[1:28:22] Voice 12: to be used during installation to protect any identified species at risk, sensitive

[1:28:27] Voice 12: ecosystem to send archaeological sites, which there are some archaeological sites not adjacent

[1:28:33] Voice 12: to the proposed area of installation. Staff also recommend requesting from the applicant

[1:28:40] Voice 12: specifically a site plan indicating where equipment will access the shoreline and the

[1:28:46] Voice 12: extent of any work areas during construction including access and lay down areas.

[1:28:53] Voice 12: and this information makes the application overseas the LTC could consider uh including

[1:29:00] Voice 12: details in a section 219 restrictive covenant for the upland property at the very least

[1:29:05] Voice 12: that includes installation and maintenance requirements

[1:29:08] Voice 12: and that also ensures that best management practices are followed during installation

[1:29:26] Voice 12: So staff also recommended the LTC defer further consideration such as proceeding to draft

[1:29:35] Voice 12: bylaws of the application in order to provide more time for early and meaningful opportunities

[1:29:44] Voice 12: opportunities for involvement with a discussion of concerns with First Nations uh you know this

[1:29:52] Voice 12: has to do in part with the LIAX First Nation Island West Coast Protocol Agreement um and

[1:30:00] Voice 12: that protocol agreement, which specifies, you know, the LCC should not be making decisions regarding,

[1:30:08] Voice 12: you know, this First Nations territory without meaningfully discussing concerns of Lax and First

[1:30:14] Voice 12: Nations. Staff have been trying to reach out to Lax and Penelaket and continue to work, and as well

[1:30:23] Voice 12: the applicant for this application has been reaching out to and working with elders from

[1:30:29] Voice 12: Peneliket as well as staff members from Peneliket Nation for almost a year.

[1:30:38] Voice 16: Maybe

[1:30:38] Voice 12: the applicant can speak more to that but there has been ongoing attempts to engage with

[1:30:44] Voice 12: First Nations but staff have identified that that's potentially there needs to be more to

[1:30:52] Voice 12: uphold that protocol agreement with Wai'aqsa First Nation and again these early opportunities

[1:30:58] Voice 12: that for ongoing engagement could include, you know, having a site visit with First Nations

[1:31:04] Voice 12: applicant and owners and staff, continuing to share ongoing project information as it's

[1:31:11] Voice 12: received, and then the LTC has discretion to request any additional engagement with

[1:31:18] Voice 12: First Nations, early engagement with First Nations that they want to be included.

[1:31:24] Voice 12: So, yeah, in summary, the recommendations to request additional information while proceeding with the application are supported because meaningful engagement by First Nations can take place prior to the LTC's consideration to proceed, and information gaps on environmental protection should also be resolved.

[1:31:46] Voice 12: And if the LTC concurs with the recommendations, the staff recommendations in this report,

[1:31:52] Voice 12: staff will proceed to notify the applicants and early referrals will be sent to First

[1:31:59] Voice 12: Nations and staff will continue to engage and send out a site visit invitation to First

[1:32:04] Nations as well.

[1:32:06] And then we'll put in a staff report for future

[1:32:08] Voice 12: consideration, summarizing any kind of feedback.

[1:32:12] Voice 12: back. So if the LTC has any questions, the applicant is

[1:32:17] Voice 12: present, a connected consultant. And then both owners, Rob and

[1:32:23] Voice 12: Marcy Welsh are also here to speak to the application.

[1:32:27] Voice 12: Thank you. So typically, we give the applicant some some time to

[1:32:35] Voice 12: to share from your perspective, either one of you want to add

[1:32:39] Voice 12: anything to our information or we could go straight into

[1:32:42] Voice 12: questions.

[1:32:44] Voice 6: Just, Rob, you want to have a few, I just want to put this context of the volume and

[1:32:51] Voice 6: interior into perspective, because this is our sort of first kicker of all of this, but this

[1:32:55] Voice 6: actually reflects the new checklist for an expedited permit for the problem, or a nature-based

[1:33:02] Voice 6: shoreline protection process. Nothing more, nothing less, in some ways, not enough in some respects,

[1:33:08] Voice 6: So it's good, but it's a lot for everybody to consider.

[1:33:16] Voice 6: So I'm not really apologizing, but what it does is it puts us in a mindful place to go forward,

[1:33:21] Voice 6: and it includes the First Nations up front and centre on that.

[1:33:27] Voice 6: The only thing is, the Romans has First Nations at number eight on those,

[1:33:33] Voice 6: and we put them at number one and brought them in,

[1:33:36] Voice 6: and though the business unit was not available to attend that,

[1:33:40] Voice 6: I think we did have the elders,

[1:33:41] Voice 6: I think Sylvester and Maria,

[1:33:47] Voice 6: last name, no?

[1:33:48] Voice 6: No, it's me.

[1:33:50] Voice 6: Kimmel and George with us on Kerrville spoke.

[1:33:55] Voice 6: So we've done that.

[1:33:57] Voice 6: We've had the opportunities since then,

[1:34:01] Voice 6: but they have not been able to show up.

[1:34:02] Voice 6: up and the late founder Florence James participated from the tech side of it and she's reviewed

[1:34:10] Voice 6: and helped coaches through the planning plan and saw all of that and the plan was on that

[1:34:17] Voice 6: document or was reflecting her which she was comfortable with and the vision that a short

[1:34:23] Voice 6: amount of time might become a place that they would not only climb on to the road but they

[1:34:30] Voice 6: would come back up along to the shoreline to water and cultural either fruits and plants and that

[1:34:38] Voice 6: medicinal plants that were of value to them so that was sort of more of kicking it off

[1:34:45] Voice 6: and the ability to obviously do it and to that yeah

[1:34:51] Voice 3: i don't really have anything to add at this

[1:34:53] Voice 3: I mean, I'm thankful that MARHU put all of those documents online so that you could all

[1:35:03] Voice 3: review them.

[1:35:04] Voice 3: They are extensive, certainly the assessment report that Fenton compiled before anything

[1:35:12] Voice 3: anything else happened, so the existing situation and all the sensitive areas and this are taken

[1:35:29] Voice 3: consideration before we even got to a construction engineer and coastal engineer to look at what

[1:35:37] Voice 3: could be done in

[1:35:38] Voice 16: that

[1:35:39] Voice 3: way. So you know my only comment really is that as you know we have tried

[1:35:49] Voice 3: to engage with the First Nations and they have been invited to what was our shoreline demonstration

[1:35:58] Voice 3: and you know it's no comment and they don't reply so that in itself is a comment I think.

[1:36:10] Voice 3: i'm sure what it means but i don't really know how you go forward to engage i've read the protocol

[1:36:16] Voice 3: for the time stress has with the reaction

[1:37:47] Voice 3: and unceded territory, land.

[1:37:53] Voice 3: I mean, they're using it now.

[1:37:54] Voice 3: The 10-meter boundary was something I stressed

[1:37:59] Voice 3: when we had the engineering consultants come,

[1:38:02] Voice 3: that that is the demarcation line for me with Nelliput's clam harvesting marine license to

[1:38:15] Voice 3: harvest clams is 10 meters from the natural boundary so that would be the extent of where

[1:38:20] Voice 3: we could potentially do this nature-based protection yeah so they of course I mean we are

[1:38:32] Voice 3: well aware of how many clams

[1:38:34] Voice 3: and how much activity goes on

[1:38:35] Voice 3: there. It's pretty

[1:38:38] Voice 3: extensive.

[1:38:41] Voice 3: And

[1:38:41] Voice 3: we don't have any issue with that.

[1:38:45] Voice 3: They're all, you know,

[1:38:47] Voice 3: people are very respectful.

[1:38:49] Voice 3: There's not, we know

[1:38:51] Voice 3: one of the, Denman Island

[1:38:53] Voice 3: for instance, has a commercial

[1:38:55] Voice 3: harvesting up there.

[1:38:57] Voice 3: It's not First Nations,

[1:38:59] Voice 3: I don't believe, but it is quite

[1:39:01] Voice 3: an issue with

[1:39:03] Voice 3: people on the waterfront there because of the disrespect

[1:39:06] Voice 3: by the people that are harvesting there

[1:39:09] Voice 16: i

[1:39:11] Voice 3: think they burned down somebody's home because of the

[1:39:14] Voice 3: beach fire too close to it or something so so that is kind of the other extreme or

[1:39:20] Voice 3: something that could take place which it isn't yeah

[1:39:28] Voice 6: ready to start to that um

[1:39:32] Voice 6: to the art perspective so yeah but i think this is a this is a permanent only if you're going to

[1:39:37] Voice 6: do anything with the towel in that regard then it's a permanent only site so the design is a no

[1:39:44] Voice 6: dig and so that was the approach we took this was not a any ancestors resting place and that this

[1:39:53] Voice 6: was just culturally used this was

[1:39:56] Voice 6: actually the salt marsh which was the hub of penelaket island

[1:40:00] Voice 6: from the north end of Phoenix to the south end of Connecticut.

[1:40:04] Voice 15: And

[1:40:04] Voice 6: it was just literally a canoe pass, low tides pushing the flat bottom canoe through.

[1:40:11] Voice 6: And it was basically a trout fish, and they did logs and different sort of additional cultural sources.

[1:40:19] Voice 6: The machine was by all of the families that lived on Connecticut for millennia.

[1:40:23] Voice 6: And so that has all been disrupted since the red ship and the salt marsh is no longer functional.

[1:40:33] Voice 6: But it still is viable for clams and other items in that regard.

[1:40:40] Voice 6: That is all at a very distant, that's out, the tide's out a long ways for actually clam digging.

[1:40:48] Voice 6: There's a long distance between the plants and this project, so there's no need to start

[1:40:55] Voice 6: with the plant quality because of the silt from the New River Bank on East Shoreline,

[1:41:02] Voice 6: which is constant.

[1:41:03] Voice 6: Every time there's a tide or a storm, all of that ground and this wonderful silt from

[1:41:10] Voice 6: about the applicant property. So the two goals of this project is one, if we decide or

[1:41:17] Voice 6: request an engineering design to set them in at the date, it would be there long-term,

[1:41:24] Voice 6: it would last for 25 to 50 years, that would not impact and over time once it actually comes back

[1:41:32] Voice 6: to life and it's plants and other things living in that more shorebound shore area,

[1:41:37] Voice 6: area, and the plan quality should improve, because there won't be any more sediment from

[1:41:43] Voice 6: above. It'll be actually managed by the land itself, and this project will be right off

[1:41:49] Voice 6: that term. So the security for that, as far as a source, and long term for anybody using

[1:41:59] Voice 6: that beached area. Now it's being very accessible by the long term, just because there's a rickety

[1:42:08] Voice 6: to get down to the shorelines to visit John. So this project there will make that whole

[1:42:16] Voice 6: sort of self-approach easy for anybody that's using it. The E4's access won't really change,

[1:42:26] Voice 6: except for when they come out onto the beach and are alive, when they see asparagus and

[1:42:33] Voice 6: salt grass and further out. The area now gets insulted by winter cods and estuaries. That

[1:42:43] Voice 6: area will become just normal. You just hear the bubble that's in the design will protect

[1:42:50] Voice 6: the tool from being eroded and from the winter flows or heavy flows coming up off from the

[1:42:57] Voice 6: And then the actual storms coming in will actually just be pushed off by a few meters.

[1:43:04] Voice 6: So all the energy is now off of the bank, which is trying to fix it.

[1:43:10] Voice 6: So it'll just be further out. The beach will be back to being a beach.

[1:43:14] Voice 6: It's up to you to be a healthy beach.

[1:43:19] Voice 6: Of the existing vegetation, there's quite a bit of shrubbery.

[1:43:24] Voice 6: into the plant life is limited because it's just a broader way. So this new space will allow it to

[1:43:33] Voice 6: actually regrow and our goal would be that it becomes a healthy, regenerative, biodiverse.

[1:43:46] Voice 12: So I'm sure trustees have questions, but thank you for all the work and this amazing project

[1:44:02] Voice 12: really that is an opportunity to file a much better way of protecting private property

[1:44:11] Voice 12: as well as engaging with the hereditary and ancestral rights holders who are interested

[1:44:21] Voice 12: in seeing this continue as a harvesting area. So I really appreciate both of you, your work

[1:44:27] Voice 12: in tension with this. It's very important, and I'm so glad to see it proceeding. So I

[1:45:21] Voice 3: than registering for green shores i was contacting contractors on my own and

[1:45:27] Voice 3: And I could see that that was really not going to, you know, go in the right direction.

[1:45:35] Voice 3: So I took a course that Stewardship Centre offered.

[1:45:40] Voice 3: And through that, I met with Kelly Locke from the Stewardship Centre.

[1:45:46] Voice 3: And that is when things started to actually move forward.

[1:45:50] Voice 3: Okay. So, you know, one of the,

[1:45:54] Voice 4: so

[1:45:55] Voice 3: the Stewardship Center, their green choice program is the guiding document, I'll call it. And to fulfill that program, you need to hire, you need to have an environmental professional on board to oversee it. So that is what we hired Doug.

[1:46:26] Voice 5: so but if i may say about first nations it is it is somewhat frustrating that they do not seem to

[1:46:47] in 2014 and it just seems that

[1:46:51] Voice 5: that is frustrating aspect of it so i don't know if we can put a time

[1:46:56] Voice 5: limit of some sort to get a reply and then you can i guess proceed is there any other

[1:47:06] Voice 5: um i mean you've jumped over a lot of hoops and i apologize that it's so cumbersome and

[1:50:10] Trustee Luckham (probable): that's available to us today indicates the erosion and the concerns that's happening on the land

[1:50:17] Trustee Luckham (probable): there um all this in since time immemorial for what phrase there's another phrase to learn

[1:50:25] Trustee Luckham (probable): actually use actually respect that but let me pursue my train of thought um certainly there's

[1:50:33] Trustee Luckham (probable): a philosophy of better leave things alone and natural erosion is part of the evolution of the

[1:50:38] Trustee Luckham (probable): planet and investors to leave it alone and no seawalls or whatever. However, it doesn't reflect

[1:50:44] Trustee Luckham (probable): the natural environmental aspects of the land that are vulnerable and in climate change are

[1:50:52] Trustee Luckham (probable): becoming much more precious. And of course, the human habitation aspects of that property

[1:51:01] Trustee Luckham (probable): are also potentially impacted. So I appreciate that we're looking at this through a new lens

[1:51:08] Trustee Luckham (probable): and hopefully creating an opportunity for us to learn

[1:51:12] Trustee Luckham (probable): with a demonstration of a way to do this going forward.

• The next Trust Council meeting will be held on Gabriola Island in September;  
• Findings from the joint Regional District of Nanaimo/Islands Trust tiny homes on 
wheels project will be presented at the upcoming Union of BC Municipalities 
convention.

5. PUBLIC COMMENTS 
A member of the public spoke to late correspondence submitted to the Local Trust 
Committee and asked the following questions: 
• How can one get questions or correspondence included in the minutes; 
• Has there been any change in status on the Abrupt Shellfish crown lease; 
• How will bylaw enforcement know if there is any activity at the aquaculture site; 
• Will the new Trust Policy Statement prevent an aquaculture license from being issued in 
the future without the agreement of Islands Trust; 
• Will a representative of the Local Trust Committee attend future Thetis Community 
Assembly meetings;  
• Why is the taxpayer’s perspective not included as part of the draft Trust Policy 
Statement; and 
• Are there any risk management policies in the Trust Policy Statement, for example does 
Islands Trust have a contingency plan if the federal government includes the Port of 
Vancouver in fast tracking infrastructure development? 
The following comments and clarifications were provided by staff and members 
of the Local Trust Committee: 
o Questions and comments can be sent directly to the Local Trust Committee, 
a member of the public can ask questions during the public comment 
session during a meeting or request to present as a delegation, and 
correspondence can be included in an agenda package if it is received prior 
to agenda deadlines in advance of a meeting; 
o The Abrupt Shellfish license of occupation is a jurisdictional matter, any 
potential dispute between a provincial ministry and Islands Trust is 
addressed through the protocol agreement, and members of Executive 
Committee are meeting with the Minister of Lands, Forests, and Natural 
Resources at the Union of BC Municipalities conference to discuss the 
disposition of Crown lands; 
o Bylaw Compliance and Enforcement staff are monitoring the Abrupt 
Shellfish operation; 
o The language in the draft Trust Policy Statement and provincial regulations 
indicate aquaculture must be compliant with local zoning and the protocol

agreement with the province is the mechanism to dispute the decision to 
grant a license; 
o Islands Trust regulates land use and taxpayers are represented as residents;

A member of the public spoke to the Nature of Water event and the following comments 
were noted: 
• The event attracted over 100 attendees; 
• A meeting has been scheduled with Cowichan Valley Regional District Environmental 
Services to discuss updates on the 2020 water strategy developed by the district; 
• Islands Trust, regional districts, the Province, and community agencies will need to work 
together to develop solutions to water-related issues; 
• There are no test wells on Thetis Island, many local residents are willing to participate in 
data collection, and some residents are already monitoring rain water collection; 
• Data collection and analysis are critical and there needs to be an educational process 
regarding water issues;  
• They will be seeking resources from Islands Trust as they develop a working group. 
A Trustee stated the Cowichan Valley Regional District had previously indicated 
a test well existed at the time they presented the financial request to Thetis 
Island with respect to the water strategy work, the Local Trust Committee is 
looking at potential requirements for rainwater catchment for new construction 
builds, and the Islands Trust Freshwater Specialist might be able to provide 
resource information.

7.1 Follow-up Action List dated August 26, 2025 
Discussion ensued on the follow-up action items and the following comments were 
noted: 
• There may be opportunity to invite Penelakut Tribes Council members to attend 
a Local Trust Committee meeting as progress is made on Land Use Bylaw 
amendments; 
• The Local Trust Committee would like Bylaws No. 113 and 114 to be forwarded 
to the Ministry of Environment in reference to the rezoning application that was 
rejected, along with a cover letter supporting the importance of Local Trust 
Committee bylaws, prior to the upcoming Union of BC Municipalities meeting.

Staff clarified the meeting scheduled during Union of BC Municipalities conference 
was being held with the Minister of Lands, Forests, and Natural Resources.  
 
Discussion was undertaken regarding the focus of the meeting and the following 
comments and clarifications were noted: 
• The topic of the meeting is the crown lease referral process that led to a license 
of occupation being granted despite the Local Trust Committee highlighting the 
operation is contrary to local bylaws; 
• The Executive Committee has requested staff to review the letter of agreement 
with the ministry and subsequent discussion will focus on willingness to update 
the agreement and address issues related to respecting local government 
bylaws and regulations; 
• The concerns identified include upholding Local Trust Committee land use 
bylaws and potential lack of meaningful engagement with First Nations 
regarding issuance of an aquaculture license; 
• The Bylaw Compliance and Enforcement Manager noted a letter was sent to the 
license holder who has stated they are not willing to recognize local government 
jurisdiction over the matter. 
 
The meeting was recessed for a break at 10:44 a.m. and reconvened at 10:54 a.m.

9. APPLICATIONS AND REFERRALS 
9.1 PL-RZ-2025-0072 (Welsh FAEC) - Preliminary Staff Report 
The planner summarized the staff report and highlighted the following: 
• The rezoning application seeks to amend the Land Use Bylaw by rezoning 
portions of the Rural Residential (R-1) and Water 4 (W4) zones to site-specific 
shoreline protection zones to facilitate installation of nature-based shoreline 
protection to decrease shoreline erosion; 
• The existing dwelling at 83 Blue Herron Road is approximately 5 metres from the 
natural boundary and an existing 18-metre-long concrete seawall and set of 
concrete beach access stairs are located along the southern shoreline adjacent 
to the dwelling; 
• The design incorporates a “Green Shores” approach to shoreline protection and 
would involve depositing approximately 40-50 truckloads of natural materials 
and the shoreline would then be replanted with native plants and monitored for 
up to three years; 
• The applicant has submitted a number of professional reports in support of their 
application. 
 
The applicant was in attendance and spoke to the application. 
 
Discussion ensued and the following comments and were noted: 
• Trustees are generally in support of the project; 
• The initial seawall was built in 1954 which indicates ongoing erosion and the 
Green Shores approach offers a way in which natural land habitat can be 
protected;

• There are potential challenges in asking the applicant to provide a final 
Construction Environmental Plan prior to approval of the application; 
• The Local Trust Committee could request the Construction Environmental Plan, 
list of mitigation, adaptation, and avoidance measures, and a site plan be 
provided prior to public hearing, or another time, instead of prior to First 
Reading; 
• There is a draft Construction Environmental Plan and the final plan does not 
necessarily need to be provided until later in the process; 
• In order to learn about the Lyackson First Nation and Penelakut Tribe’s level of 
interest and potential involvement, a summary report with a response deadline 
could be provided as part of early engagement; 
• The Planner confirmed Lyackson First Nation and Penelakut Tribe staff have 
received early engagement information from staff in May and August;  
• The Local Trust Committee wishes to uphold the protocol agreement and 
ensure First Nations have every opportunity to provide an early engagement 
response. 
TH-2025-018

application PLRZ-2025-0072 (Welsh) and direct staff to share professional 
reports and information, and invite First Nations to a site visit in order to

application.
