Hornby Island Local Trust Committee NOTICE TO WAIVE PUBLIC HEARING Proposed Bylaw No. 167 Minimum Average Lot Area Amendments Project (MALA) NOTICE is hereby given that the Hornby Island Local Trust Committee is waiving a public hearing for Proposed Bylaw No. 167, cited as “Hornby Island Land Use Bylaw, 2014, Amendment No. 1, 2021”. The Hornby Island Local Trust Committee gave first reading and second reading of the proposed bylaw at the regular business meetings held on March 26, 2021 and July 16, 2021; and will consider further readings to the bylaw at its’ business meeting scheduled at 11:30 am, Friday, October 8, 2021, at Room to Grow, 2100 Sollans Road, Hornby, B.C. What is Proposed Bylaw No. 167 about? Proposed Bylaw No. 167, if adopted, will amend the current Hornby Island Land Use Bylaw (LUB) No. 150, by proposing one single change to the Hornby Island LUB: to delete regulation 8.2(9) of the LUB in its entirety, in order to clarify that the minimum average lot area for subdivision in the Large Lot (R2) zone on Hornby Island is at least 2.0 hectares in size, instead of 4.0 hectares. The public hearing is being waived under the authority granted in Sections 464(2) and 467 of the Local Government Act that states that a local government may waive the holding of a public hearing on a proposed bylaw if an Official Community Plan is in effect for the area that is subject to a proposed zoning bylaw, and the proposed bylaw is consistent with the plan.
